Abstract

The emergence of Islamic banks in Indonesia today is increasingly mushrooming. This is inseparable from the role of the number of Muslim populations in Indonesia who want an Islamic economic and banking system that is far from usury. The Islamic banking system has been exemplified by the Prophet Muhammad and his companions in the past and this has become the basis or foundation for the establishment of Islamic banks. But in reality in Indonesia, the relevance of the Islamic banking system is less attractive. This research is a descriptive qualitative research, using library research method. The purpose of this study is to examine the practice of Islamic banking as exemplified at the time of the Prophet Muhammad SAW and to see the relevance and development of Islamic banking practices in Indonesia. The conclusion of this study is that the model of banking services, products and activities exemplified by the Prophet is still used in the Islamic banking system in Indonesia, but in fact there are many Islamic bank practices that deviate and are not in accordance with Sharia rules.

Abstract

Amil zakat fundraising institutions have a challenge because the law in Indonesia adheres to a voluntary system that cannot force prospective muzakki to pay zakat. On the other hand, society continues to question the high gap between the potential of zakat and the realization of its collection. It means zakat amil has to be more creative in developing marketing strategies. As an institution that operates both b-to-b and retail at once, amil zakat institutions should be able to take advantage of advertisements in online media such as Facebook. Funneling is very effective in conventional business. Unfortunately, it has not been used in many amil zakat institutions promptly. Based on data obtained, boosted posts with sponsored ads are hard selling or education about ziswaf services without collecting a database of prospective muzakki. This study is a qualitative study aimed at describing how the funneling strategy is applied to the products and services of the amil zakat. Although the ad sample was taken from Facebook, the ad flow design offered applied to other advertising media. The advertising flow was not trial as in the RND research. This design was used to strengthen the explanation regarding the application of funneling in zakat institutions. The results showed that the zakat amil must prepare a lead magnet to attract the attention of prospective muzakki to join the database management available. After prospective muzakki are in the database, zakat amil can follow up with them with various offers and education about zakat products and services and other ziswaf products.

Abstract

The demand for domestication and localization of children’s literature compels translators to not only translate the texts but also transadapt them. Significant problems arise when the texts have to fit the cultures and religions of the target users. This qualitative study attempts to address this issue. Gathering teachers of Taman Pendidikan Al Qur’an (TPQ) or Qur’an study club for Muslim children in the Greater Boyolali area of Indonesia, children’s literature translators, and TPQ students in a Focus Group Discussion, we investigated the strategies of transadapting fables in English into Bahasa Indonesia with Islamic values as the core teaching along with the impacts ensued. Through the FGD constructed based on the purification strategy by Klingberg (1986), translation as adaptation and selection by Gengshen (2003), children picturebook translation by Oittinen (2000), narrative connectedness by Christman (2004), proairetic decoding by Nikolajeva (2010), and skopos by Reiss and Vermeer (2014), paratextualization, insertion, and bleaching strategies are constructed. Paratextualization adds clickable religious comments on the digital versions of the fables. Insertion adds religious lessons within the text. Bleaching refines any expressions considered unfit for the target religious values. These strategies trigger an impact called drifting. To reveal the extent of faithfulness, we constructed a drifting-level assessment. This assessment enables translators to reveal whether a transadapted children’s literature is still on track, slipped, or out of track. The study finding is expected to fill up the theoretical absence of transadaptation strategies and drifting level assessment. Its practical nature also brings benefits for children’s literature translators and TPQ teachers.

Abstract

AAOIFI states in Mikyar (19) verse (7) regarding qardh that, merging ba'i, ijarah, mu'awadah contracts may not be carried out with qardh contracts, as in the gold rahn product currently applicable in sharia pawnshops. This study aims to analyze the application of the golden rahn contract at the Solo Baru sharia pawnshop. And analyze the hybrid contract that occurs in the product. This is a field research with a descriptive analytical research specification. The data collection method is done by interview and direct observation Sharia gold pawn transactions (rahn gold) at the Solo Baru sharia pawnshop use qardh, rahn and ijarah contracts. The existence of qardh as an initial contract for the occurrence of debts which is the basis of the occurrence of pawning (rahn) where the customer's initial intention is to come to the sharia pawnshop to get financing in the form of debt and an ijarah contract for the wages of storing gold as collateral in the pawned rahn contract. That the practice of pawning gold in sharia pawnshops, especially in Solo Baru, is allowed because the combination of ijarah and qardh contracts in this product cannot be equated with bai' and qardh contracts which are prohibited in the hadith and AAOIFI fatwas. The ijarah contract on this product is a necessity because the collateral which is used as collateral is maintained and stored properly by the pawnshop for the money that has been given by the bank to the customer and in the Bai' contract or sale and purchase there is a transfer of property rights from the seller to the buyer while in the ijarah contract there is no transfer of ownership as occurs in the sale and purchase. AAOIFI menyatakan dalam Mikyar (19) ayat (7) tentang qardh bahwa, penggabungan akad ba’i, ijarah, mu’awadah tidak boleh dilakukan dengan akad qardh, seperti dalam produk rahn emas yang saat ini berlaku di pegadaian syariah. Penelitian ini bertujuan untuk menganalisis penerapan akad rahn emas pada pegadaian syariah Solo Baru. Serta menganalisis hybrid contract yang terjadi pada produk tersebut. Penelitian ini berjenis penelitian lapangan dengan spesifikasi penelitian secara deskriptif analitis. Metode pengumpulan datanya dilakukan dengan cara wawancara dan observasi langsung. Transaksi gadai emas syariah (rahn emas) di pegadaian syariah Solo Baru menggunakan akad qardh, rahn dan ijarah. Adanya qardh sebagai akad awal terjadinya utang-piutang yang menjadi pangkal dari terjadinya gadai (rahn) dimana niat awal nasabah datang ke pegadaian syariah untuk mendapatkan pembiayaan berupa utang dan akad ijarah atas upah penyimpanan emas sebagai jaminan dalam akad rahn yang digadaikan. Bahwa praktik gadai emas di pegadaian syariah khususnya di Solo Baru itu boleh karena penggabungan akad ijarah dan qardh pada produk ini tidak bisa disamakan dengan akad bai’ dan qardh yang dalam hadis dan fatwa AAOIFI dilarang. Akad ijarah pada produk ini merupakan suatu keniscayaan karena barang jaminan yang dijadikan jaminan dipelihara dan disimpan dengan baik oleh pegadaian atas uang yang telah diberikan oleh bank kepada nasabah dan pada akad Bai’ atau jual beli terdapat pemindahan hak milik dari penjual kepada pembeli sedangkan pada akad ijarah tidak terdapat perpindahan hak milik sebagaimana yang terjadi pada jual beli.

Abstract

This study aims to explain (1) an analysis of the practice of the LinkAja Sharia Service application viewed from the perspective of DSN-MUI Fatwa No. 116/DSN-MUI/IX/2017 concerning Sharia electronic money, (2) analysis of electronic money (e-money) in the LinkAja Sharia Service application in terms of Maslahah Mursalah. The research will be conducted in 2022. This research is a field research. using a qualitative research approach with data collection techniques using interviews and documentation. Checking the validity of the data using triangulation. Data analysis data was carried out through three stages, namely data reduction, data presentation and drawing conclusions. The results of this study are (1). LinkAja's sharia service is the first digital wallet in Indonesia that uses sharia principles, which has received an official certificate from DPS MUI and permission from Bank Indonesia. LinkAja's sharia services are in accordance with the Fatwa of the MUI National Sharia Council No. 116/DSN-MUI/IX/2017 concerning Sharia Electronic Money both general provisions and specific provisions as well as the legal provisions used. (2) Electronic money (e money) in the LinkAja application in terms of maslahah mursalah there are several menus available in LinkAja sharia services. there are 3 (three) categories of levels of needs. For LinkAja sharia services, there are only 2 categories of needs, namely: hajjiyat (secondary needs) and maslahah tahsiniyah (tertiary needs) owned by LinkAja sharia services.

Abstract

This paper examines the jurisprudence moderate in a global context. Focus of this study is not only theoretical but also practical studies examined by the two principal sub study, the concept of jurisprudence moderate epistemological argument as a scientific vision of the Faculty of Sharia IAIN Surakarta in the global era and moderate form of implementation of the concept of jurisprudence as a scientific vision of the Faculty of Sharia IAIN Surakarta in the global era. By using descriptive-qualitative research and content analysis method (content analysis), the study concluded that moderate jurisprudence is the integration effort between a literal understanding of the text and maqasid ash-Shari'ah, which is to understand the balance between as-sawabit and almutaghayyir, between the literal understanding with liberal notions become a necessity today. Faculty of Shariah IAIN Surakarta have not a vision of science and fiqh clear patterns of thought so that there are no policies related to vision science and also patterns of thought jurisprudence at the Faculty of Sharia IAIN Surakarta. Jurisprudence existing patterns of thought is highly dependent on the mode of thinking that administer the course lecturers.

Abstract

DSN sebagai lembaga yang berwenang mengeluarkan fatwa juga telah mengeuarkan beberapa fatwa transakasi muamalah dengan menggunakan hybrid contract, salah satunya yaitu Fatwa DSN MUI Nomor 31/DSN-MUI/VI/2002 tentang pembiayaan take over atau pengalihan utang. Metode pendekatan yang dipergunakan dalam penelitian ini adalah yuridis normatif dengan menitik beratkan pada data kepustakaaan atau data sekunder yaitu suatu penelitian yang secara deduktif dimulai analisa terhadap fatwa-fatwa. Tidak semua alternatif pada fatwa DSN-MUI tentang pengalihan utang digunakan dalam transaksi pengalihan utang yang dilakukan nasabah dan lembaga keuangan syariah. Kurang mendalamnya fatwa yang dikeluarkan DSN-MUI mengakibatkan simpang siur pemikiran dan pendapat oleh para praktisi, sehingga munculnya akad baru yang mana tidak sesuai dengan syariah terjadi di lapangan.

Abstract

Saat ini, perilaku masyarakat sering berlawanan dari ajaran agama, seperti merosotnya nilai etika dalam perniagaan. Bagi kalangan tersebut, perniagaan merupakan kegiatan yang semata-mata hanya untuk mencari laba sehingga meninggalkan nilai etika. Oleh sebab itu, maka dibutuhkan solusi terbaik untuk menanggulangi permasalahan tersebut. Solusi terbaik bagi umat Islam atas apa yang terjadi, maka kembalilah pada ajaran pokok yakni Al-Qur’an dan Al-Hadits. Allah menurunkan Al-qur’an adalah sebagai solusi utama bagi manusia untuk menjadikan sebagai petunjuk dan pedoman dalam kehidupannya. Tujuan penelitian ini adalah untuk menganalisis tafsir ayat Al-Qur’an yang membahas tentang bentuk perniagaan dalam hal ini yaitu tijarah. Metode penlitian yang digunakan yaitu library research (penelitian pustaka), yang bersumber dari Al-Qur’an, tafsir ayat Al-Qur’an, buku, maupun jurnal ilmiah terkait tijarah. Hasil penelitian menunjukkan bahwa tijarah dalam Al-Qur’an memiliki dua makna, yaitu sebagai interaksi antara hamba dengan Allah Yang Maha Esa, dimana tijarah ini adalah hasil timbal balik dari ketakwaan kepada Allah, serta makna kedua yaitu sesungguhnya dari tijarah itu sendiri, dalam arti kegiatan manusia dalam tukar menukar harta dengan harapan mendapatkan keuntungan.

Abstract

Artikel ini membahas tentang “Istilah-istilah Yang bermakna perempuan dalam al-Qur’an” (Suatu Tinjauan study pustaka) dalam penelitian ini yaitu kata apa saja yang terkait dengan kata “perempuan” dalam al-Qur’an dan bagaimanakah makna kata، الأخت، زوج المسلمات، مؤمنة نساء ، امرأة ، الأم، لأنثى dalam al-Qur’an. Adapun tujuan penelitian ini yaitu untuk mengklasifikasi kata-kata perempuan dalam al-Qur’an dan untuk menganalisis makna ، الأخت، زوج، المسلمات، مؤمنة نساء ، امرأة ، الأم، لأنثى dalam al-Qur’an, dan membumikan pesan-pesan al-Qur’an terutama mengenai masalah perempuan dalam kisah-kisah al-Qur’an sekaligus sebagai kontribusi bagi keilmuan islam, terutama dalam bidang bahasa Aran dan al-Qur’an. Penelitian ini merupakan penelitian kualitatif, yaitu suatu penelitian yang digunakan untuk memaparkan dan mendeskripsikan suatu fenomena pengumpulan data secara detail. Serta menggunakan jenis penelitian telaah pustaka Hasil penelitian ini menunjukkan bahwa term perempuan dalam al-qur’an menarik untuk dikaji, terutama dalam memperoleh makna-makna yang utuh sesuai dengan kebutuhan kaum perempuan sepajang masa. Dalam kisah al-Qur’an term yang bermakna perempuan dalam al-Qur’an berjumlah 9 term yang meliputi kata ، الأخت، زوج المسلمات، مؤمنة نساء ، امرأة ، الأم، لأنثى This article discusses "terms that mean women in the Qur'an" (a review of literature studies) in this study, namely what words are related to the word "women" in the Qur'an and what is the meaning of the word الأخت المسلمات، اء امرأة الأم، لأنثى in the Qur'an. The purpose of this study is to classify women's words in the Qur'an and to analyze the meaning of الأخت، المسلمات، اء امرأة ، الأم، لأنثى in the Qur'an, and to ground the messages of al-Qur'an. The Qur'an is mainly about women's issues in the stories of the Qur'an as well as a contribution to Islamic scholarship, especially in the fields of Aran language and the Qur'an. This research is a qualitative research, which is a research that is used to describe and describe a phenomenon of data collection in detail. As well as using the type of literature review research. The results of this study indicate that the term women in the Qur'an is interesting to study, especially in obtaining complete meanings according to the needs of women throughout the ages. Abstract

يهدف هذا البحث إلى وصف منهج تعليم مهارة الكلام في معهد خلوة تحفيظ القرآن واللغة العربية كارانج أنجار. ويستخدم الباحث المدخل النوعي بالمنهج الوصفي ويتم تحليل البيانات بجمعها وتصنيفها وعرضها والاستنتاج. وتوصل إلى نتائج معهد خلوة تحفيظ القرآن واللغة العربية مؤسسة تعليمية تهتم بتحفيظ القرآن وتعليم اللغة العربية. تهدف معهد خلوة تحفيظ القرآن واللغة العربية إلى أن تصبح مؤسسة تعليمية قائمة على تحفيظ القرآن واللغة العربية النشيطة مع الآداب الإسلامية. والأنشطة هي تحفيظ القرآن، وتعليم اللغة العربية النشيطة، وتعليم علوم الآداب الشرعية، وتدريب إلقاء الكلمات. واستخدم كتاب العربية بين يديك لتعليم اللغة العربية داخل الفصل، واستخدم كتاب تعليم المتعلم لتعليم الآداب. واستخدمت الطريقة المباشرة في تدريس اللغة العربية داخل الفصل. ويكون التقويم بشكل الاختبار، والاختبار نوعان: تحريري وشفهي. وتصحيح الأخطاء لدى الطلبة يكون في كل وقت لوجود المشرفين الذين يرشدونهم في تطبيق اللغة العربية. حقق معهد خلوة مجمع اللغة إنشاء سكن الطلاب الخاص، وتدريب الطلاب على إلقاء الكلمات، واستخدام اللغة العربية، ولم يحقق تعيين الأماكن المحظورة فيها التحدث والكلام بغير اللغة العربية This research aims to describe the method of teaching speaking skill in the Quran and Arabic Language Center, Arabic Language Academy, KarangAnyar. The researcher uses the qualitative approach using the descriptive approach, and the data is analyzed by collecting, categorizing, presenting and drawing conclusions. And he reached conclusions: The Language Complex Center is an educational institution concerned with memorizing the Qur’an and teaching the Arabic language. The Language Complex Center aims to become an educational institution based on the memorization of the Qur'an and the active Arabic language with Islamic literature. The activities are memorizing the Qur’an, teaching the active Arabic language, teaching Sharia sciences, and training speaking. And use the Arabic book in your hands to teach the Arabic language in the classroom, and use the learner’s book to teach literature. The direct method was used in teaching Arabic in the classroom. The assessment is in the form of a test, and the test is of two types: written and oral. Correcting students’ mistakes is made at all times because there are supervisors who guide them in applying the Arabic language. The Language Complex Center achieved the establishment of private student housing, and training of students in speaking and using the Arabic language. Penelitian ini bertujuan untuk mendeskripsikan metode pembelajaran keterampilan berbicara di Quran and Arabic Language Center, Akademi Bahasa Arab, KarangAnyar. Peneliti menggunakan pendekatan kualitatif dengan menggunakan pendekatan deskriptif, dan data dianalisis dengan mengumpulkan, mengkategorikan, menyajikan dan menarik kesimpulan. Dan dia mencapai kesimpulan: Pusat Kompleks Bahasa adalah lembaga pendidikan yang peduli dengan penghafalan Al-Qur'an dan pengajaran bahasa Arab. Pusat Kompleks Bahasa bertujuan untuk menjadi lembaga pendidikan berbasis hafalan Al-Qur'an dan bahasa Arab aktif dengan literatur Islam. Kegiatannya adalah menghafal Al-Qur’an, mengajarkan bahasa Arab aktif, mengajarkan ilmu-ilmu syariah, dan melatih berbicara. Dan gunakan buku bahasa Arab di tangan Anda untuk mengajar bahasa Arab di kelas, dan gunakan buku pembelajar untuk mengajar sastra. Metode langsung digunakan dalam pengajaran bahasa Arab di kelas. Penilaiannya berupa tes, dan tesnya ada dua jenis: tertulis dan lisan. Koreksi kesalahan siswa dilakukan setiap saat karena ada pembimbing yang membimbing mereka dalam menerapkan bahasa Arab. Pusat Kompleks Bahasa mencapai pendirian perumahan siswa swasta, dan pelatihan siswa dalam berbicara dan menggunakan bahasa Arab.
