Abstract

Inheritance law is a law that regulates what happens to the property of the deceased, namely the transfer of the estate of the deceased person and the impact on his heirs. Indonesia has three inheritance laws: Customary Inheritance Law, Islamic Heritage Law, and Civil Inheritance Law. Each region has different laws depending on the kinship system it has. Al-Takharruj is a study or discourse that can prove that the modernization of Islamic inheritance law is a reality. The modernization of Islamic inheritance law with al-Takharruj's model could also counter accusations that Islamic inheritance is gender-biased, favoring male inheritance over female inheritance. The practice of al-takharruj in Islamic inheritance law is based on the contract of muawwadah whose conditions satisfy each other. When ownership of a particular property passes from one heir to another, then title to the estate is lost and passes to another heir with whom the estate is settled. This transfer can be done according to the personal will of the heir and does not require the heir to know in advance how many shares he is entitled to. After that, each heir decides to whom the right should be given or should be transferred in the form of a grant.

Abstract

This research is motivated by the phenomenon of childcare by fathers after divorce in Padang Lawas County. This phenomenon raises the interest of researchers to further examine child custody by fathers after divorce. The research method used is field research with a qualitative approach. Researchers collected primary data through interviews with traditional leaders and fathers caring for their children after divorce. The data obtained was then analyzed using descriptive analysis techniques, which involved collecting data through interviews and documentation and systematic data processing to describe and interpret existing phenomena. The results show that although customs in Padang Lawas County give custody to the father, it is essential to consider the provisions of the compilation of Islamic law and the broader principles of Islamic law. Child custody should focus on the best interests of the child, ensuring their physical, emotional, and mental development. Both parents have equal rights unless there are compelling reasons to the contrary, and they must work together to maintain the child's stability. Children have the right to adequate education and healthcare, as well as to maintain a good relationship with both parents, even if only one has primary custody.

Abstract

This study aims to evaluate the urgent need to restore the Law of the Republic of Indonesia Number 18 of 2003 concerning Advocates (UUA) to position Sharia advocates as the exclusive legal representatives in religious courts. The research uses a normative juridical method, focusing on the examination of legal norms, rules, and relevant literature. Data were collected through a comprehensive review of legal documents, statutes, and academic sources, and analyzed qualitatively to interpret and critique the legal provisions and their implications. The findings reveal that the current lack of specificity in the advocate profession, particularly in religious courts, has led to the involvement of advocates who may lack the necessary background in Sharia law, potentially harming the legal interests of Muslim clients. The conclusion emphasizes that restoring the Law of the Republic of Indonesia Number 18 of 2003 concerning Advocates to recognize only Sharia advocates in religious courts aligns with the nature of these courts and does not violate human rights. This restoration is vital for protecting the legal interests of Muslims and enhancing the professionalism of Sharia advocates in religious courts, including preparing students of the Faculty of Sharia for specialized legal roles. By promoting legal reforms, the study improves the efficiency of religious courts and ensures better access to justice for Muslim communities.

Abstract

This study explores the concept of marbagi dos in relation to the changing inheritance practices of the Mandailing community, viewed through the lens of legal culture. Marbagi dos, which literally means equal in the Mandailing indigenous people, has traditionally had a very important social dimension and equality. The type of research methodology used in this study is qualitative with a descriptive approach. The research data was obtained through interview techniques and participatory observation. In-depth interviews will be carried out with traditional leaders, scholars, and community members who play a direct role in the inheritance process. Using a legal culture approach, this study analyzes how the changes in values in Mandailing society are influenced by Islam which has implications for changes in inheritance practices in Mandailing, as well as how the community balances customary traditions with modern equality demands. The results of the study show that this inheritance transformation is a reflection of the adaptation of the Mandailing people to social changes, while maintaining cultural values within the framework of customary law. The implications of this study suggest that customary law is dynamic and capable of adapting to Islamic law and state law, highlighting the need for synergy between these three legal systems in crafting more inclusive policies.

Abstract

The article discusses the scope of wills, the legal basis for wills, types of wills, the pillars of a will, the requirements for the validity of a will, wills to heirs, limitations on wills, the number of wills, the cancellation and invalidation of a will, the revocation of a will, and the procedures involved. It then addresses the Islamic legal perspective on the execution of a will. This research uses a qualitative approach with literature study as the main data collection method. The conclusion is that the legal status of a will differs from one person to another depending on the circumstances, namely it is obligatory for someone if it is feared that the property left behind will be squandered. It is considered sunnah if the will is for charitable purposes, such as a will to relatives, the construction of mosques, schools, or other public interests. It is haram if the will can harm the heirs. This study provides both theoretical and practical contributions to the field of Islamic law, particularly in the area of fiqh al-wasiyyah (Islamic jurisprudence on wills). Using a qualitative approach and literature study as the primary data collection method, the article offers a comprehensive analysis of various aspects of testamentary wills, including their legal basis, types, pillars and validity requirements, limitations, revocation procedures, and execution mechanisms. Keywords: Islamic Law, Legal Status, Wills

Abstract

This research examines the legal review of Islamic economic law regarding transactions between Islamic banks and non-Muslims in Pasar Sipirok village in South Tapanuli Regency. The background of this research is based on the observation that the cultural characteristics of Non-Muslims, which often include a lack of cooperation, along with the capitalist spirit commonly associated with Non-Muslims, should make conventional banks, which operate under a capitalist system, a promising investment avenue. However, in reality, a significant number of Non-Muslim customers are also interested in saving their funds in Islamic banking. In the Sipirok market village, the residents are not only Muslims but also non-Muslims. Among those who use Islamic banking services, there are 60 people, 10 of whom are non-Muslims. This research is a field study with a qualitative approach from the perspective of Islamic economic law. The data sources in this study consist of two types: primary data and secondary data sources. The data collection techniques in this research are observation, interviews, and documentation. The data analysis technique used by the researcher in this study is inductive qualitative analysis. The research findings indicate that the views of non-Muslims towards Bank Syariah Indonesia are very positive, as it is a bank that shows tolerance towards non-Muslim customers without discriminating based on religion. It represents an opportunity for growth, as the use of contracts from Bank Syariah Indonesia by non-Muslims can be seen as a chance to develop and understand Islamic financial principles. Non-Muslims experience the services and conveniences provided, so it is not surprising that some non-Muslims choose Islamic banks for their savings and other needs. There are three factors that attract non-Muslims in the village of Pasar Sipirok to use products from Bank Syariah Indonesia: promotion, service, and service reputation.

Abstract

Human Rights This paper discusses the study of Islamic legal politics and the substance of changes in waqf regulation in Indonesia, particularly in Government Regulation (PP) Number 25 of 2018, which amends Government Regulation Number 42 of 2006. This study seeks to analyze how the approach of Islamic legal politics is applied in responding to the evolving needs of waqf management, in line with the times and the demands of national development, while still aligning with the fundamental principles of Islamic law (sharia). The amendment in Government Regulation No. 25 of 2018 specifically clarifies the mechanism of waqf asset exchange (ruislag) by prioritizing the principles of public benefit (maslahah), accountability, and protection of the waqif’s intent. A normative-juridical approach is employed to analyze this regulation within the framework of maqashid al-sharia and the context of national legal policy. The results of this study indicate that the changes in Government Regulation No. 25 of 2018 have a significant impact on the governance of waqf, making it more transparent and accountable. This impact is the result of the presence of Islamic legal politics in integrating sharia principles with the practical needs of waqf governance. It also encourages waqf policymakers in Indonesia to optimize the potential of waqf in building a just society through sharia-based financial institutions that serve the broader Muslim community.

Abstract

Dalam proses penegakan hukum yang dilakukan di Indonesia terlebih dahulu membahas tentang profesi dalam hal ini profesi hukum. Profesi hukum adalah profesi yang melekat pada dan dilaksanakan oleh aparatur hukum dalam suatu pemerintahan suatu negara.Beberapa kritik diarahkan baik berkaitan dengan kualitas hukum, ketidakjelasan berbagai produk hukum yang berkaitan dengan proses legislasi, dan juga lemahnya penerapan berbagai peraturan.Praktik penyelewengan dalam proses penegakan hukum, seperti mafia hukum dan peradilan, peradilan yang diskriminatif atau rekayasa proses peradilan merupakan realitas yang gampang ditemui dalam penegakan hukum di negeri ini. Peradilan yang diskriminatif menjadikan hukum di negeri ini.hal ini yang ditemukan banyak persoalan. Untuk itu dalam peningkatan mutu kualitas profesionalisme masing-masing profesi tersebut, diperlukan sistem sertifikasi nasional dan standarisasi, termasuk berkenaan dengan sistem kesejahteraannya.Disamping itu juga diperlukan program pendidikan dan pelatihan terpadu yang dapat terus menerus membina sikap mental, meningkatkan pengetahuan dan kemampuan profesional aparat hukum tersebut.

Abstract

Artikel ini membahas tentang ruang lingkup pengangkutan termasuk definisi pengangkutan, objek dan pihak pengangkutan, jenis-jenis pengangkutan sifat dan tujuan pengangkutan serta kaitannya dengan penumpang dan barang angkutan, serta membahas tentang sanksi kerugian. Serta pertanggungjawaban pengangkutan ketika terjadi kerusakan serta kehilangan barang penumpang yang disebabkan kelalaian pihak pengangkut, dan batasan batasan yang termasuk dalam tanggungjawab pengangkutan. Dimana terdapat beberapa jenis-jenis pertanggungjawaban yang dilakukan oleh pihak pengangkut yakni pertanggungjawaban pengangkutan dilihat dari kesalahan dan kelalaian, pertanggungjawaban karena praduga dan pertanggungjawaban mutlak. Selanjutnya berbicara tentang hak dan kewajiban para pihak.
