Abstract

This study examines the effectiveness of Supreme Court Regulation No. 3 of 2022 on electronic mediation in the Religious Courts of Medan and Riau, drawing on legal effectiveness and mediation theory. It responds to the limited comparative research on the implementation of electronic mediation across Indonesian regions, particularly in light of disparities in technological infrastructure, judicial capacity, and legal culture. The study adopts an empirical juridical approach with a qualitative design. Data were collected through interviews with mediator judges, observations of online mediation practices, and analysis of judicial documents and relevant regulations. The findings indicate that electronic mediation is a significant innovation in dispute resolution within religious courts; however, its effectiveness varies across regions. In Medan, implementation is relatively effective, supported by a more developed technological infrastructure and a stronger judicial capacity. In Riau, implementation continues to face challenges, particularly low digital literacy among disputing parties and limited access to technology. In addition, local legal culture plays a crucial role in shaping the success of mediation, especially with regard to trust in virtual communication. This study concludes that the implementation of Supreme Court Regulation No. 3 of 2022 has not yet reached full effectiveness, as alignment among legal substance, institutional structure, and legal culture remains incomplete. These findings contribute to the literature on legal effectiveness in the context of judicial digitalization and offer practical implications for strengthening judicial capacity, enhancing public digital literacy, and advancing technology-driven judicial policies.

Abstract

Tujuan dalam penelitian ini yaitu untuk mengetahui dan menganalisis mengapa Majelis Hakim Pengadilan Agama Padangsidimpuan mengabulkan permohonan izin poligami tanpa izin dari isteri. Dan Untuk mengetahui dasar pertimbangan hukum Majelis Hakim Pengadilan Agama Padangsidimpuan dalam memutuskan izin poligami dengan berdasarkan putusan nomor: 195/pdt.g/2022/pa.psp. Penelitian ini merupakan penelitian yuridis normatif. Hasil penelitian ini menunjukkan bahwa Putusan Pengadilan Agama Padangsidimpuan terhadap penetapan izin poligami perkara Nomor 195/pdt.g/2022/pa.psp.berdasarkan Pasal 4 dan pasal 5 yaitu istri tidak mampu menjalankan kewajiba sebagai istri, istri tidak dapat melahirkan keturunan serta persetujuan istri tidak memenuhi rasa keadilan. Putusan ini hanya melihat alasan pemohon tanpa mempertimbnagkan penolakan pemberian persetujuan poligami dari termohon akibat yang akan dialami pemohon jika poligami ini dalakukan. Dalam memutus Perkara Nomor 195/pdt.g/2022/pa.psp sangat kaku. Hakim membuat dasar putusan hanya melihat Undang-Undang yang tertulis tanpa mepertimbangkan aspek lain. Seperti aspek sosial, Agama,kesehatan dan Pendapat para ulama. harusnya Permohonan itu tidak dapat diterima karena tidak memenuhi syarat materil. Karena kalau dilihat dari permohonan yang diajukan oleh Pemohon maka sebenarnya permohonan tersebut tidak memenuhi syarat materil dimana istri menolak dengan tegas memberikan prsetujuan kepada suai untuk melakukan poligami

Abstract

This study examines the effectiveness of oversight of power in preventing corruption in Indonesia from the perspective of fiqh siyasah hisbah. Studies on corruption have tended to focus on positive law and modern institutional approaches, while the Islamic ethical-political dimension has not been widely used as an analytical framework in evaluating weak institutional oversight. This article addresses this gap by analyzing how the principles of fiqh siyasah, particularly the concepts of amanah, hisbah, and maslahah, can be used to interpret the structural problems in the oversight of power in Indonesia. This study uses library research with a qualitative-analytical approach through a review of primary sources in the form of the Qur'an, hadith, and classical and contemporary literature on fiqh siyasah, combined with an analysis of regulations, anti-corruption policies, and academic studies on oversight institutions in Indonesia. The results show that the weak effectiveness of oversight institutions is not solely caused by regulatory issues, but also by the dominance of political interests, low elite integrity, and the absence of ethical oversight oriented towards moral accountability. In this context, fiqh siyasah hisbah offers a normative and theoretical framework that places supervision of power as a collective responsibility of the state and society.
