Abstract

The increasing divorce rate among members of the Indonesian National Police indicates that compliance with marriage procedures has not fully strengthened family resilience. This study aims to analyze the implementation of premarital hearings within the Mobile Brigade Corps of the Lampung Regional Police, examine their conformity with Islamic law, and evaluate their effectiveness as a preventive model for strengthening family resilience. This research employed an empirical juridical approach using qualitative methods through observation, in-depth interviews, documentation, and normative analysis based on Asy-Shatibi's Maqāṣid al-Sharī’ah perspective. The findings reveal that premarital hearings function as an institutional development instrument integrating spiritual, psychological, organizational, and professional ethical dimensions, thereby serving not only administrative requirements but also enhancing couples' preparedness for the demands of police service. This study proposes the Integrated Organizational Premarital Development Model as its conceptual novelty. Strengthening the curriculum, improving facilitator competence, and providing post-marital assistance are recommended to enhance the sustainability and effectiveness of the program.

Abstract

Pembatalan polis asuransi jiwa secara sepihak oleh perusahaan asuransi setelah terjadinya risiko sering menimbulkan sengketa hukum, khususnya terkait perlindungan hukum terhadap pemegang polis dan ahli waris. Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hakim dalam mengkualifikasikan pembatalan sepihak polis asuransi jiwa oleh Penanggung sebagai perbuatan melawan hukum dalam Putusan Mahkamah Agung Nomor 4943 K/Pdt/2024. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan deskriptif analitis. Data yang digunakan berupa bahan hukum sekunder yang diperoleh melalui studi kepustakaan dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa Mahkamah Agung mengkualifikasikan tindakan PT Asuransi Jiwa Manulife Indonesia yang membatalkan polis dan menolak pembayaran klaim secara sepihak sebagai perbuatan melawan hukum karena telah memenuhi unsur-unsur Pasal 1365 KUHPerdata, yaitu adanya perbuatan, sifat melawan hukum, kesalahan, kerugian, dan hubungan kausal antara perbuatan dan kerugian. Tindakan tersebut dinilai bertentangan dengan asas pacta sunt servanda, asas itikad baik, serta Pasal 1266 KUHPerdata. Putusan ini memberikan perlindungan hukum yang lebih kuat terhadap pemegang polis dan ahli waris serta menegaskan bahwa perusahaan asuransi tidak dapat secara sewenang-wenang membatalkan polis setelah terjadinya risiko.

Abstract

Marriage is a sacred process with several legal requirements that must be obeyed when one of the conditions for the validity of a marriage is not fulfilled. Furthermore, if things contained in the prohibition of marriage, such as committing inbreeding or incest, then the marriage is considered invalid or can even be canceled by law. When a marriage is considered invalid or even annulled by law, it will have legal consequences for the position of children born from the marriage, including the position of children in inheritance. This research uses a normative legal approach method that uses doctrines and principles of law as a reference and uses primary and tertiary legal materials. From this research, it can be concluded that inbreeding or incest is considered invalid in Indonesia, so it results in the position that children born from incest relationships are illegitimate children and are also referred to as adulterous children or discordant children (civil code). In terms of inheritance, children of incest have no inheritance at all. Both Islamic and Civil Law state that children of incest only have relation to their biological mother and mother's family, while to their biological father, there are no relations at all because they have no obligation to inherit each other and only have a right to demand the necessary maintenance from their biological father asset’s

Abstract

This study aims to analyze the legal basis and mechanism for granting abolition to Tom Lembong and amnesty to Hasto from the perspective of Indonesian criminal law. Furthermore, this study also discusses the legal implications of these abolitions and amnesties for law enforcement and legal certainty in Indonesia. The research method used is a normative legal approach, examining laws and regulations, doctrine, and relevant literature. The analysis shows that granting abolition and amnesty is a presidential prerogative, as stipulated in the constitution and laws. However, its implementation must adhere to the principles of justice, legal certainty, and expediency. The granting of abolition to Tom Lembong and amnesty to Hasto has sparked legal debate, particularly regarding the limits of executive authority over the criminal justice process. These legal implications include the potential to reduce the deterrent effect, create a political precedent in law enforcement, and demand stricter regulations to ensure that abolition and amnesty policies do not conflict with the principles of the rule of law.

Abstract

Law enforcement of child abuse cases in Indonesia presents complex challenges, particularly in determining the most effective justice approach for both victims and perpetrators. This article compares Restorative Justice and Retributive Justice in handling child abuse cases, focusing on their impact on victim rehabilitation, deterrent effects on perpetrators, and protection for victims. Restorative Justice, which focuses on restoring relationships between victims and perpetrators, can accelerate the rehabilitation process and reduce long-term trauma for victims. Conversely, Retributive Justice, which prioritizes punishment for perpetrators and aims to provide a deterrent effect, often neglects the aspect of recovery for victims. This article also explores the social and psychological impacts experienced by victims depending on the approach used, as well as the challenges faced by the Indonesian legal system in effectively implementing Restorative Justice in child abuse cases. By understanding these two approaches, it is hoped that more comprehensive solutions can be found in handling child abuse cases in Indonesia.
