Abstract

This study aims to analyze Legal Protection and Gender Justice for Women in the Practice of Siri Polygamy: Analysis of the Principles of Islamic Civil Law. The practice of polygamy in Indonesia often causes injustice for women, who do not receive adequate legal protection. This study analyzes the relationship between the principles of Islamic civil law and the reality faced by women in the practice of siri polygamy. Although Islamic law emphasizes justice and protection of women's rights, many women are trapped in situations of injustice due to a lack of legal understanding and social stigma. This study uses a normative juridical method to explore the truth between legal norms and practices in the field. The results of the study indicate that minimal social support, lack of understanding of legal rights, and social stigma contribute to the injustice experienced by women. To improve legal protection and gender justice, it is recommended that there be recognition and registration of siri polygamous marriages, strengthening of legal regulations, assistance for women, and education and socialization regarding legal rights. With these steps, it is hoped that women's rights in the practice of siri polygamy can be fulfilled fairly within the framework of Islamic law and state law.

Abstract

This study discusses the legal consequences of the absence of a marriage agreement on marital property according to the Indonesian legal system, especially based on the Civil Code and the Marriage Law No. 1 of 1974. By default, the absence of a marriage agreement leads to the enactment of a system of property union, in which all property acquired during the marriage is considered joint property. This condition has various legal implications, such as the vulnerability of personal property to third-party claims, difficulties in proving ownership of inherited property, and potential conflicts in the division of property in the event of divorce or death of one of the spouses. This study also highlights the difference in the regulation in Islamic law that does not recognize the automatic union of property, but still has the potential to cause disputes if there is no written agreement. The research method used is empirical normative with a qualitative approach, examining positive legal provisions and practices that develop in society. The results of the study show that low public understanding and negative stigma towards marriage agreements are the main factors in the low making of these agreements. The Constitutional Court Decision No. 69/PUU-XIII/2015 which allows the making of agreements during the marriage period expands legal protection, but its implementation still faces challenges. This study recommends the need to increase legal education and socialization on the importance of marriage agreements to provide certainty and fair legal protection for the parties in the institution of marriage.

Abstract

This study aims to build a complete picture of the relationship between the indirect regional election system, public perception of political representation, and the level of legitimacy of elected regional heads. Public perception of representation in indirect regional elections is the public's view of political representation in the election of regional heads by the DPRD and its influence on public recognition and trust in the elected regional heads. This legitimacy is the main foundation for regional heads to carry out their duties and authorities effectively. This study uses a qualitative approach with a descriptive method. Data collection techniques are carried out through observation, interviews, and documentation of relevant sources. The number of respondents in this study was 5 respondents. The results of the study show that most people reject indirect regional elections because they are considered to reduce public participation and weaken the legitimacy of regional heads. Direct regional elections are considered more democratic, representative, and reflect the will of the people.

Abstract

Law enforcement against corruption is a vital aspect of maintaining the integrity of the Indonesian nation, considering that corruption has become a widespread and systemic phenomenon across various sectors. In this context, students, as agents of change, play an important role in overseeing legal enforcement issues. Unfortunately, understanding of anti-corruption laws remains uneven among students from different academic disciplines. This study uses a descriptive qualitative method with data collection techniques including observation, interviews, and documentation involving 10 respondents from various departments at Universitas Negeri Medan. The purpose of this research is to analyze the level of understanding, differences in perspective, and the concern of students across disciplines toward the enforcement of anti-corruption laws in Indonesia. The findings reveal variations in understanding based on academic background, yet most students acknowledge the importance of integrating anti-corruption education across all majors as a preventive step to foster legal awareness and integrity from an early stage.

Abstract

Penelitian ini membahas tentang perlindungan hukum bagi mahasiswa sebagai penyewa dalam kasus wanprestasi pemilik kos terkait fasilitas yang tidak sesuai perjanjian. Permasalahan ini muncul karena seringkali terjadi ketidaksesuaian antara fasilitas yang dijanjikan dalam perjanjian sewa-menyewa kos dengan fasilitas yang sebenarnya diberikan. Hal ini merugikan mahasiswa sebagai penyewa yang telah membayar sesuai kesepakatan. Tujuan penelitian ini adalah untuk mengetahui perlindungan hukum bagi mahasiswa dalam kasus wanprestasi perjanjian sewa kamar kos mengenai fasilitas yang tidak sesuai. Lokasi penelitian ini berada di daerah Pancing, Kota Medan. Penelitian ini menggunakan metode normatif-empiris. Metode yang digunakan melalui observasi, wawancara, dan dokumentasi. Wanprestasi pemilik kos dapat berupa tidak memenuhi, tidak sesuai, atau memberikan fasilitas terlambat. Perlindungan hukum bagi mahasiswa sebagai penyewa dapat dilakukan melalui upaya non-litigasi seperti negosiasi atau mediasi, maupun litigasi dengan menggugat wanprestasi ke pengadilan. Fast-track legislation refers to a legislative process that proceeds rapidly, oftenwithout adequatepublic participation and is considered lacking in transparency.This study employs a descriptive qualitative method with data collection techniquesincluding observation, interviews, and documentation. The number of respondentsto be studied is approximately ten. The research focuses on one or more laws thatare considered controversial by the public, such as the Military Law (TNI Law), theJob Creation Law (Omnibus Law), and the Mineral and Coal Mining Law (MinerbaLaw). The aim of this study is to analyze the perceptions of Unimed students towardthe formation of fast-track legislation, particularly those that frequently sparkpublic controversy. This study aims to analyze the perceptions of Unimed studentsregarding the formation of fast-tracked legislation, particularly those that oftentrigger public controversy. The research is expected to provide an overview of theextent to which students understand, respond to, and critique the practice ofexpedited lawmaking, as well as highlight its impact on public trust in the legal drafting process in Indonesia. The findings indicate that the majority of UNIMEDstudents have a negative perception of fast-tracked legislation, as the process isconsidered rushed, lacks public participation, and does not follow a transparentdeliberative mechanism. The conclusion of this study is that the absence of publicinvolvement in the legislative process strengthens students' distrust in legislativeinstitutions, fosters a skeptical attitude, and even encourages their involvement incritical movements as a form of social control.

Abstract

This study aims to examine the legal protection of property brought into marriage that is mixed with joint property as a result of joint management in a marriage. In many cases, this mixing causes unclear legal status of the assets, especially during divorce or inheritance division. This study uses empirical normative legal methods with a qualitative descriptive approach. The data obtained were analyzed using data reduction, data presentation, and conclusion drawing techniques. This study shows that legal regulations in Indonesia related to the protection of property brought into marriage that is mixed with joint property due to joint management in marriage, and highlights the inconsistency of court decisions in such disputes and their impact on household economic stability. Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law have distinguished between property brought into marriage and joint property, practice in the field shows that mixing of property due to joint management often causes conflict during divorce. Inconsistency in court decisions arises due to the unclear norms in Article 37 of the Marriage Law which provide room for different interpretations by judges. This has an impact on legal uncertainty and potential injustice, especially for parties who are socially or economically weaker. Mixed property disputes also affect household economic stability, exacerbate social inequality, and cause psychological burdens for family members, including children. This study recommends the need for more detailed regulatory updates, the issuance of technical guidelines by the Supreme Court to unify decision standards, and increased legal education for the community to prevent conflicts through marriage agreements.

Abstract

The concept of ‘abandoned land’ in the Basic Agrarian Law (UUPA) No. 5 of 1960 faces interpretation challenges that impact the effectiveness of the management of unproductive Cultivation Rights (HGU). This research aims to analyse the reconstruction of the concept of abandoned land in UUPA and its implications for the management of unproductive HGU to support the optimisation of agricultural land use. This research is conducted through normative juridical with qualitative descriptive analysis of laws and regulations, court decisions, and related literature. The research findings show that the concept of abandoned land in the UUPA is still multi-interpretive, especially regarding the criteria of ‘not being cultivated according to the circumstances or nature and purpose of the right’. This has led to inconsistencies in the application of sanctions against HGU holders who leave their land unproductive. Concept reconstruction is needed by clarifying the objective parameters of productivity, the period of neglect, and law enforcement mechanisms. The implications of this research indicate the need for regulatory revisions to strengthen legal certainty in HGU management, as well as the development of more effective policy instruments to prevent abandonment of agricultural land to support national food security and social justice in agrarian reform.
