Abstract

Penelitian ini membahas tentang perlindungan hukum bagi mahasiswa sebagai penyewa dalam kasus wanprestasi pemilik kos terkait fasilitas yang tidak sesuai perjanjian. Permasalahan ini muncul karena seringkali terjadi ketidaksesuaian antara fasilitas yang dijanjikan dalam perjanjian sewa-menyewa kos dengan fasilitas yang sebenarnya diberikan. Hal ini merugikan mahasiswa sebagai penyewa yang telah membayar sesuai kesepakatan. Tujuan penelitian ini adalah untuk mengetahui perlindungan hukum bagi mahasiswa dalam kasus wanprestasi perjanjian sewa kamar kos mengenai fasilitas yang tidak sesuai. Lokasi penelitian ini berada di daerah Pancing, Kota Medan. Penelitian ini menggunakan metode normatif-empiris. Metode yang digunakan melalui observasi, wawancara, dan dokumentasi. Wanprestasi pemilik kos dapat berupa tidak memenuhi, tidak sesuai, atau memberikan fasilitas terlambat. Perlindungan hukum bagi mahasiswa sebagai penyewa dapat dilakukan melalui upaya non-litigasi seperti negosiasi atau mediasi, maupun litigasi dengan menggugat wanprestasi ke pengadilan. Abstract

Fast-track legislation refers to a legislative process that proceeds rapidly, oftenwithout adequatepublic participation and is considered lacking in transparency.This study employs a descriptive qualitative method with data collection techniquesincluding observation, interviews, and documentation. The number of respondentsto be studied is approximately ten. The research focuses on one or more laws thatare considered controversial by the public, such as the Military Law (TNI Law), theJob Creation Law (Omnibus Law), and the Mineral and Coal Mining Law (MinerbaLaw). The aim of this study is to analyze the perceptions of Unimed students towardthe formation of fast-track legislation, particularly those that frequently sparkpublic controversy. This study aims to analyze the perceptions of Unimed studentsregarding the formation of fast-tracked legislation, particularly those that oftentrigger public controversy. The research is expected to provide an overview of theextent to which students understand, respond to, and critique the practice ofexpedited lawmaking, as well as highlight its impact on public trust in the legal drafting process in Indonesia. The findings indicate that the majority of UNIMEDstudents have a negative perception of fast-tracked legislation, as the process isconsidered rushed, lacks public participation, and does not follow a transparentdeliberative mechanism. The conclusion of this study is that the absence of publicinvolvement in the legislative process strengthens students' distrust in legislativeinstitutions, fosters a skeptical attitude, and even encourages their involvement incritical movements as a form of social control.

Abstract

This study aims to examine the legal protection of property brought into marriage that is mixed with joint property as a result of joint management in a marriage. In many cases, this mixing causes unclear legal status of the assets, especially during divorce or inheritance division. This study uses empirical normative legal methods with a qualitative descriptive approach. The data obtained were analyzed using data reduction, data presentation, and conclusion drawing techniques. This study shows that legal regulations in Indonesia related to the protection of property brought into marriage that is mixed with joint property due to joint management in marriage, and highlights the inconsistency of court decisions in such disputes and their impact on household economic stability. Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law have distinguished between property brought into marriage and joint property, practice in the field shows that mixing of property due to joint management often causes conflict during divorce. Inconsistency in court decisions arises due to the unclear norms in Article 37 of the Marriage Law which provide room for different interpretations by judges. This has an impact on legal uncertainty and potential injustice, especially for parties who are socially or economically weaker. Mixed property disputes also affect household economic stability, exacerbate social inequality, and cause psychological burdens for family members, including children. This study recommends the need for more detailed regulatory updates, the issuance of technical guidelines by the Supreme Court to unify decision standards, and increased legal education for the community to prevent conflicts through marriage agreements.

Abstract

The concept of ‘abandoned land’ in the Basic Agrarian Law (UUPA) No. 5 of 1960 faces interpretation challenges that impact the effectiveness of the management of unproductive Cultivation Rights (HGU). This research aims to analyse the reconstruction of the concept of abandoned land in UUPA and its implications for the management of unproductive HGU to support the optimisation of agricultural land use. This research is conducted through normative juridical with qualitative descriptive analysis of laws and regulations, court decisions, and related literature. The research findings show that the concept of abandoned land in the UUPA is still multi-interpretive, especially regarding the criteria of ‘not being cultivated according to the circumstances or nature and purpose of the right’. This has led to inconsistencies in the application of sanctions against HGU holders who leave their land unproductive. Concept reconstruction is needed by clarifying the objective parameters of productivity, the period of neglect, and law enforcement mechanisms. The implications of this research indicate the need for regulatory revisions to strengthen legal certainty in HGU management, as well as the development of more effective policy instruments to prevent abandonment of agricultural land to support national food security and social justice in agrarian reform.

Abstract

This study is entitled "The Role of Parboru and Hula-Hula in the Settlement of Divorce Disputes in Batak Toba Customs". The main focus of this study is to analyze the role and position of Parboru (the woman's family) and Hula-Hula (the wife's family) in the divorce settlement process according to Batak Toba customs. This study also presents the dynamics of the interaction of the two elements in customary mediation, as well as how customary values ​​and norms are implemented to maintain the harmony and dignity of the extended family. The method used in this study is a qualitative method with a descriptive approach. Data obtained through interviews and library studies of relevant literature on Batak Toba customary law, Dalihan Na Tolu, and the role of Parboru and Hula-Hula in traditional ceremonies and the resolution of marital conflicts in Batak Toba customs. The results of the study indicate that Hula-Hula has a central position as a decision maker and mediator, while Parboru plays a role as a technical implementer, mediator, and balancer in the customary deliberation forum. The active involvement of both parties is very important to ensure that the divorce process runs according to customary norms and maintains the social harmony of the Batak Toba community. This study is expected to enrich the literature on Batak customary law and become a reference for students, the community, and customary leaders in understanding the importance of the role of kinship in resolving divorce.

Abstract

The role of the local government of North Sumatra province in the development of Tortor Toba dance and gordang sambilan dance as performing arts that are expressions of traditional culture. EBT (traditional cultural expression) is a form of traditional intellectual property. Tortor is a dance, but the meaning more than the movements states that Tortor is a medium of communication, where through the movements displayed there will be interaction between participation in ceremonies, weddings, and also welcome. On the other hand, the lack of attention of the Indonesian government makes the Tortor dance has no copyright protection, therefore the author is interested in conducting further research on legal protection of the Tortor dance, the important role of the local government of North Sumatra province and the solution that can be provided by the government to the problem of claiming tortor and gordang sambilan dances by neighboring countries. This research uses qualitative descriptive research methods, with normative-empirical legal research types. Data collection techniques are interviews, documentation and data sources from the North Sumatra Provincial Culture and Tourism Office and the owner of the Sihoda dance studio. The finding in this study is that legal protection for Tortor's dance has not provided legal certainty specifically for Tortor's own dance, but the law recognizes the existence of regional arts.

Abstract

Pemenuhan hak akses bagi individu dengan disabilitas adalah elemen penting untuk menciptakan masyarakat yang adil dan inklusif. Penelitian ini bertujuan untuk mengevaluasi pengalaman individu dengan disabilitas dalam mengakses layanan publik, seperti transportasi, gedung pemerintah, pusat kesehatan, lembaga pendidikan, hingga area publik lainnya. Metode yang diterapkan dalam penelitian ini adalah analisis studi literatur dengan mengkaji 10 artikel ilmiah dari dalam dan luar negeri yang diterbitkan dalam lima tahun terakhir. Data diolah secara sistematis untuk menemukan hambatan, kondisi saat ini, dan kemungkinan perbaikan. Temuan dari penelitian ini menunjukkan bahwa hambatan utama yang dihadapi oleh individu dengan disabilitas adalah hambatan fisik yang terkait dengan infrastruktur (seperti ramp, lift, guiding block, dan toilet khusus), serta hambatan non-fisik yaitu stigma sosial, minimnya informasi yang dapat diakses, dan tantangan kebijakan akibat lemahnya penerapan aturan. Sintesis dari literatur juga menunjukkan adanya kesenjangan signifikan antara regulasi yang mendukung hak disabilitas dengan praktik layanan publik yang ada di lapangan. Kesimpulan dari studi ini menekankan pentingnya partisipasi aktif dari individu dengan disabilitas dalam proses perencanaan kebijakan, penerapan prinsip desain universal, dan peningkatan pengawasan terhadap standar aksesibilitas. Temuan ini diharapkan dapat menjadi dasar yang kuat bagi pemerintah, perencana kota, dan penyedia layanan untuk menciptakan fasilitas publik yang ramah dan setara bagi semua orang.

Abstract

Geographical Indication (GI) for cimpa food in the context of measuring the value of cultural and economic identity of a particular region. Cimpa food, as a culinary product with deep cultural roots, has a central role in a region's cultural identity, reflecting local history, traditions and culinary richness. However, challenges such as social, economic, and environmental changes have threatened the sustainability of cimpa food production and the integrity of its cultural identity. This research involved field research methods, surveys, historical analysis, and interviews with producers, local stakeholders. We focused our attention on one specific geographical area where cimpa food is produced. In addition, we measured the economic impact of cimpa food production and marketing, assessed the effectiveness of GI protection, and identified challenges and opportunities faced by producers. Our findings reveal that GI protection is an important measure to protect cimpa food from counterfeiting and unfair competition, while appropriate marketing strategies can expand the market for these products. This research not only provides practical benefits for local producers in developing their businesses, but also makes a theoretical contribution to the understanding of the relationship between food, culture, economics, and legal protection in the context of food products with specific geographical origins.

Abstract

Bullying is an act that often occurs in the school environment, which gives rise to conflict between students, thereby reducing students' sense of tolerance. This research aims to find out how citizenship education is implemented towards an attitude of tolerance through learning citizenship education at SMP Negeri 1 Percut Sei Tuan in Class VIII- A. The method used in this research is descriptive qualitative. The sample in this research was 30 students in class VIII- A at SMP Negeri 1 Percut Sei Tuan. The data collection techniques used were interviews, giving questionnaires and documentation. The results of this research show that class VIII- A students at SMP Negeri 1 Percut Sei Tuan still often carry out body shaming bullying by saying their friends are fat which results in fights and saying bad words.
