Abstract

This Mini Research Report is titled "Legal Protection of Geographical Indications for Typical Foods of Lemang Batok Tebing Tinggi as Local Products." This study examines the understanding of business actors, the forms of legal protection available, and the role of local governments in the Geographical Indication (GI) registration process. The research utilizes a descriptive qualitative approach, employing interviews as the primary data collection technique, and data analysis through methods such as data reduction, data display, and data verification. The findings indicate that business actors, although they do not fully understand the concept of Geographical Indications, continue to preserve the authenticity of their production methods and pass them down through generations. However, the local government's involvement in the GI registration process is still limited, resulting in a lack of legal protection for this local product. The study highlights the need for increased awareness and involvement from both business actors and local authorities to strengthen the legal protection for Lemang Batok Tebing Tinggi as a unique geographical product. It concludes by emphasizing the importance of implementing effective strategies to safeguard such products and ensure their recognition in the legal domain.

Abstract

Traditional knowledge is an important part of the cultural identity of indigenous communities, passed down through generations and serving social, spiritual, and economic functions. One manifestation of this is evident in Toba Batak cuisine, namely Ayam Napinadar, a traditional dish containing symbolic value and deep cultural meaning. For the Toba Batak people, Ayam Napinadar not only plays a role in traditional ceremonies but also serves as a symbol of respect, togetherness, and a source of economic strengthening for the community. However, modernization and commercialization of culinary arts pose challenges such as declining interest from the younger generation, the loss of traditional processing techniques, and risks triggered by outsiders who do not understand its philosophical value. Furthermore, legal protection for traditional knowledge in Indonesia is not optimal because existing regulations do not provide a specific mechanism to protect traditional culinary traditions communally. This study uses a qualitative descriptive method to describe the conservation practices, processing techniques, cultural meaning, and economic potential of Ayam Napinadar. Data were collected through direct observation at the Kepala Kakap Restaurant and in-depth interviews with the owner and employees who understand the production process. Additional documentation in the form of field notes and photographs was also used to strengthen the findings. The analysis was conducted through a process of data reduction, presentation, and verification using source triangulation. The results indicate that the preservation of Ayam Napinadar still relies on oral transmission and is carried out directly without formal documentation. Legal protection is also inadequate, making this dish vulnerable to shifting meanings and exploitation. Nevertheless, Ayam Napinadar has significant economic potential through culinary tourism and the development of MSMEs. Therefore, special regulations, systematic documentation, and community empowerment are needed to prevent cultural poverty while boosting the local economy.

Abstract

This study aims to examine the judge's considerations in rendering decisions in aggravated theft cases at the Medan District Court, with an emphasis on the balance between legal and non-legal aspects in realizing substantive justice. The issue of disparate sentencing that frequently arises is the main background of this study. The methods used are an integrated normative legal approach and an empirical legal approach. The normative approach is used to examine the provisions of Article 363 of the Criminal Code (KUHP) and the legal principles that govern the judge's considerations, while the empirical approach is carried out through direct observation of the trial process and analysis of the judge's decision. The results of the study indicate that the judge in case Number 1110/Pid. B/2025/PN Medan not only complied with legal aspects such as fulfilling the elements of the crime, evidence, and the application of the principle of legality, but also considered non-legal aspects such as the socio-economic conditions, age, and motives of the defendant. These considerations demonstrate the application of the principles of criminal individualization and proportional justice. In addition, the judge also considered moral values ​​and social benefits in his decision, which is in line with Gustav Radbruch's theory of three basic legal values: justice, legal certainty, and utility. This study concludes that the thinking patterns of judges at the Medan District Court reflect a shift toward substantive and restorative justice paradigms. It is recommended that the Supreme Court strengthen integrated sentencing guidelines to avoid disparities in sentencing and encourage the adoption of a rehabilitative approach for offenders with low economic motivations.

Abstract

Kepuasan pasien dipandang sebagai indikator penting dalam menilai mutu pelayanan kesehatan, karena berhubungan erat dengan kepercayaan, kepatuhan terhadap pengobatan, serta keberlanjutan pemanfaatan fasilitas kesehatan. Penelitian ini bertujuan untuk mengetahui perbedaan tingkat kepuasan pasien BPJS Kesehatan dan pasien mandiri terhadap kualitas pelayanan di UPT Puskesmas Mandala Kota Medan. Penelitian menggunakan pendekatan kuantitatif komparatif dengan teknik pengumpulan data melalui observasi, dokumentasi, serta penyebaran kuesioner berbasis skala likert 4 poin kepada pasien BPJS dan pasien mandiri yang pernah atau sedang memperoleh pelayanan kesehatan di Puskesmas Mandala. Analisis data dilakukan dengan uji validitas, reliabilitas, normalitas, serta uji-t independen menggunakan perangkat lunak SPSS. Hasil penelitian diharapkan dapat menunjukkan apakah terdapat perbedaan signifikan antara kedua kelompok pasien berdasarkan dimensi kualitas pelayanan menurut model SERVQUAL, yaitu tangibles, reliability, responsiveness, assurance, dan empathy. Temuan ini diharapkan memberikan masukan bagi pihak puskesmas dan pemerintah daerah dalam meningkatkan kualitas layanan kesehatan, serta menjadi dasar kebijakan untuk mewujudkan pelayanan yang lebih merata, efektif, dan sesuai dengan kebutuhan masyarakat.

Abstract

This study aims to analyze the influence of globalization on the internalization of Pancasila values and to examine strategies for revitalizing these values as the foundation of national identity in Kenangan Baru Village, Percut Sei Tuan District, Deli Serdang Regency. Globalization brings various changes to people's social lives, especially in their mindset, lifestyle, and social interactions, which can potentially affect their understanding and practice of national values. This study uses a qualitative approach with a descriptive method. Data was obtained through observation, interviews, and documentation of community leaders, village officials, and local residents. The results of the study show that globalization has influenced changes in communication patterns, lifestyles, and people's views on national values. However, the people of Kenangan Baru Village still strive to maintain Pancasila values through social activities such as mutual cooperation, deliberation, and religious activities. The revitalization of Pancasila values can be achieved through strengthening Pancasila education, enhancing the role of community and religious leaders, and utilizing information technology and social media as educational tools for the younger generation. These efforts are expected to strengthen the understanding and practice of Pancasila values as the basis for maintaining national identity amid the tide of globalization.

Abstract

The position of witnesses in the criminal justice process occupies a key position, as seen in Article 184 of the Criminal Procedure Code (hereinafter abbreviated to KUHAP). The method used is library research, collecting data by searching for sources and constructing them from various sources such as books, journals and existing research. In the criminal justice system, witnesses have not been maximally protected in a number of laws and regulations such as in the Criminal Procedure Code and in the Criminal Code, where witnesses have not received maximum attention because in the law above, almost in the articles of the Criminal Procedure Code there is not a single article that specifically regulates witness protection and almost every article in the Criminal Procedure Code and the Criminal Code, witness rights are always included with the rights of victims. The Criminal Procedure Code, which has so far been the basis for proceedings in Indonesian criminal justice, does not regulate the rights and protection of witnesses fundamentally or specifically even though there are several provisions. in the Criminal Procedure Code which regulates, regarding the rights of a witness as Article 108 paragraph (1) reads: every person who experiences, sees and witnesses and/or becomes a victim of an incident which constitutes a criminal act has the right to submit a report or complaint to the investigator or investigator either verbally or verbally. writing.

Abstract

In this article, we will examine the impact of divorce (Division of Property & Child Custody) where this study was conducted at the Medan District Court. This divorce has a lot of impacts, especially on children. However, this article will focus on the division of assets and child custody as a cause and effect of divorce. This research uses descriptive qualitative and normative legal methods through analytical and observational approaches, with data collection techniques based on literature studies and interviews. Divorce is triggered by various reasons, including disharmonious relations between husband and wife in terms of fulfilling biological needs, issues of different principles of life, differences in income in improving welfare, infidelity. The decision to divorce results in the division of property and child custody, where custody falls to the mother because the child is under 12 years old. Referring to Article 105 KHI, which explains that child custody in divorce with children under 12 years old is given to the mother. Meanwhile, the distribution of assets is in accordance with applicable Islamic law.

Abstract

Toba Regency, North Sumatra Province. This phenomenon is triggered by the pressures of poverty, low public legal awareness, and weak oversight of children's rights. This situation demands preventive legal protection to prevent exploitation before it occurs, as mandated by Law Number 35 of 2014 concerning Child Protection. This study aims to analyze the forms of preventive legal protection for children as an effort to prevent economic exploitation in Toba Regency and to identify factors inhibiting its implementation. This study used a normative-empirical method with a qualitative descriptive approach. Primary data were obtained through observation and in-depth interviews with the Toba Regency Women's Empowerment and Child Protection Office (PMDPPA) and the Toba Police. Secondary data were sourced from laws and regulations, books, journals, and scientific literature. Data collection was conducted through observation, interviews, and documentation, then analyzed using data reduction, data presentation, and conclusion drawing techniques. The results of the study indicate that preventive legal protection for children in Toba Regency has been pursued through outreach, legal education, supervision, and synergy between the local government and law enforcement officials. However, its implementation has not been optimal due to structural, cultural, and social barriers, including family poverty, low legal awareness, and cultural norms that consider children's involvement in economic activities normal.
