Abstract

Introduction: The right to health care is a human right guaranteed in Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia.Purposes of the Research: This study aims to analyze the implementation of legal protection of the right to health care security for patients at the Malahayati Medan Islamic Hospital (RSIM) based on Law Number 17 of 2023 concerning Health.Methods of the Research: The research method used is normative-empirical, by analyzing relevant laws and regulations as well as health service practices at RSIM through observation and interviews.Results Main Findings of the Research: The results showed that RSIM has implemented legal protection of patient rights through various mechanisms, such as providing clear medical information, implementing informed consent, access to medical records, and transparent complaint services. In addition, Islamic values are applied in every aspect of service, creating an atmosphere that supports patient comfort and satisfaction. However, implementation challenges are still faced, including patients' lack of understanding of rights and obligations, limited resources, and ineffective communication between medical personnel and patients. This study concludes that while RSIM has complied with the national regulatory framework in protecting patient rights, strategic steps are needed to improve patient education, strengthen resource capacity, develop information technology, and improve the effectiveness of medical communication. By addressing these challenges, RSIM is expected to become a model hospital that excels in the legal protection of patients' rights in Indonesia.

Abstract

In resolving consumer disputes, there are various alternative dispute resolutions. In general, dispute resolution can be divided into two types, namely through litigation and non-litigation models, each of which has different characters and consequences in its resolution. Law Number 8 of 1999 concerning Consumer Protection states that resolving consumer disputes outside of court is carried out to reach an agreement regarding the form and amount of compensation or regarding certain actions to ensure that losses will not occur or reoccur to consumers. In this article, we will discuss the process of resolving consumer disputes in Decision Number 148/Pts.ARB/BPSK-BB/XII/2017? and How Effective is the Implementation of Consumer Dispute Decision Number 148/Pts.ARB/BPSK-BB/XII/2017? The data collection technique used in this research is through normative research. Dispute resolution can be achieved through litigation and non-litigation, non-litigation settlement is carried out in institutions established by law and settlement can be achieved through arbitration. The Consumer Dispute Resolution Agency (BPSK) is one of the institutions that can handle and resolve consumer disputes.

Abstract

Penelitian ini membahas fungsi penalaran hukum dan penemuan hukum dalam mewujudkan kepastian hukum di Indonesia. Penelitian dilatarbelakangi oleh perkembangan masyarakat yang semakin kompleks sehingga sering menimbulkan persoalan hukum yang belum diatur secara jelas dalam peraturan perundang-undangan. Dalam kondisi tersebut, hakim dituntut untuk tidak hanya menerapkan hukum secara tekstual, tetapi juga melakukan penalaran hukum dan penemuan hukum guna mencapai keadilan dan kepastian hukum. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan deskriptif kualitatif melalui kajian terhadap peraturan perundang-undangan, doktrin hukum, dan teori-teori hukum yang relevan. Hasil penelitian menunjukkan bahwa penalaran hukum berfungsi sebagai dasar bagi hakim dalam menghubungkan fakta hukum dengan norma hukum melalui proses interpretasi dan argumentasi hukum secara logis dan sistematis. Sementara itu, penemuan hukum berfungsi untuk mengatasi kekosongan dan ketidakjelasan hukum melalui interpretasi dan konstruksi hukum sehingga tercipta kepastian hukum bagi masyarakat. Dengan demikian, penalaran hukum dan penemuan hukum memiliki peranan penting dalam mewujudkan keadilan, kemanfaatan, dan kepastian hukum dalam sistem peradilan di Indonesia.

Abstract

Penelitian ini mengkaji tindak pidana penipuan dalam transaksi jual beli tanah yang belum bersertifikat dari perspektif yuridis dan sosiologis. Secara yuridis, perbuatan penipuan dalam jual beli tanah termasuk tindak pidana yang diatur dalam Kitab Undang-Undang Hukum Pidana (KUHP) karena mengandung unsur perbuatan melawan hukum dengan maksud untuk menguntungkan diri sendiri maupun orang lain. Ketiadaan sertifikat sebagai alat bukti hak atas tanah sering dimanfaatkan pihak-pihak tertentu untuk melakukan penipuan, sehingga menimbulkan kerugian bagi korban. Dari sisi sosiologis, kasus ini merupakan lemahnya kesadaran hukum masyarakat serta terbatasnya pemahaman terhadap pentingnya legalitas hak atas tanah. Kondisi tersebut akan menimbulkan potensi konflik sosial dan menurunkan rasa kepercayaan dalam hubungan hukum perdata di masyarakat. Penelitian ini bertujuan untuk menganalisis bentuk pertanggungjawaban hukum pelaku penipuan dan dampak sosial yang ditimbulkan terhadap korban dan lingkungan masyarakat. Dengan menggunakan pendekatan hukum normatif, penelitian ini diharapkan dapat memberikan kontribusi dalam mendorong kesadaran hukum masyarakat serta memperkuat upaya pencegahan tindak pidana penipuan dalam jual beli tanah yang belum bersertifikat.

Abstract

A traffic accident that results in the death of the victim is a legal event that causes criminal consequences for the perpetrator, especially if the incident occurred due to negligence. In law enforcement practice, the settlement of traffic accident cases is not always pursued through a repressive criminal approach, but can also be resolved through a restorative justice approach that emphasizes restoration and peace between the perpetrator and the victim's family. This study aims to analyze the form of criminal responsibility of the perpetrators of traffic accidents that resulted in the death of the victim and examine the application of restorative justice in the settlement of the case at the Pematangsiantar District Court. The results of the study show that the perpetrators of traffic accidents that resulted in the death of the victim can still be held criminally responsible based on the provisions of Article 310 paragraph (4) of Law Number 22 of 2009 concerning Road Traffic and Transportation and Article 359 of the Criminal Code.

Abstract

This research aims to discuss in depth the role and effectiveness of justice collaborators in law enforcement of corruption crimes, as well as comprehensively discuss the obstacles and legal policies for the implementation of justice collaborators in corruption crimes. The type of research used is normative juridical with a descriptive-analytical approach, discussing existing legal symptoms and problems and testing them based on applicable laws and regulations and legal norms. The results of this study show that the role of justice collaborators is to reveal and provide information and supporting evidence to law enforcement officials, as well as to give testimony at the trial about the mode, how, and where and who received the money from corruption. The existence of justice collaborators in law enforcement for corruption crimes has not been fully effective because there are still inconsistencies in information or confessions by justice collaborators in trials. Obstacles to the implementation of justice collaborators in corruption crimes include: the absence of legal arrangements, suboptimal protection, the disparity of the judiciary, and the status as the main perpetrators of the crime.

Abstract

Dispute problems often occur in the community and become legal problems and problems that need to be discussed from a juridical aspect, in order to find out the basis for a problem that arises due to indications that arise from misunderstanding, tolerance in the problem, resulting in confusion and the emergence of a problem. which was ultimately resolved through litigation and non-litigation efforts. Specifically regarding the discussion of dispute resolution efforts through non-litigation, in this case using the arbitration settlement method requires a resolution of consumer disputes through arbitration. The law provides an alternative way by providing non-litigation or out-of-court dispute resolution in the form of conciliation, mediation and arbitration. As part of alternative dispute resolution, consumer dispute resolution is resolved through the Consumer ispute Resolution Agency (BPSK) as in dispute Number 038/Arbitrase/2022/BPSK.Mdn. BPSK is an alternative solution in resolving consumer disputes regarding problems in society, although it does not escape peace efforts or legal resolution in judicial procedures.

Abstract

This study analyzes the application of restorative justice to aggravated theft crimes at the East Medan Police Sector between January 2022 and June 2025. The approach used is a normative-empirical study with a juridical-sociological framework. The normative aspect examines Article 363 of the Criminal Code, Law Number 2 of 2002, Police Regulation Number 8 of 2021, Attorney General Regulation Number 15 of 2020, and Supreme Court Regulation Number 1 of 2024. The empirical aspect captures practices at the East Medan Police Sector through case data, interviews with investigators, victims, and perpetrators, as well as administrative documentation. The caseload under Article 363 has been relatively stable at 28 to 46 reports per quarter, with motorcycle theft accounting for 57 to 64 percent. Restorative justice facilitation is selectively implemented in 4 to 8 cases per quarter, with a success rate of 60 to 75 percent, and a resolution time of 18 to 21 days, faster than the typical 40-day transfer of files. Key criteria include voluntary consent from the parties, non-recidivists, restitution of losses, and a lack of public unrest. Cases involving violence, serious threats, or those that disrupt public security are not transferred to restorative justice and remain in litigation. Findings indicate that this restorative justice mechanism is effective for certain cases, consistent with the principle of ultimum remedium, reduces the burden of the judicial process, and increases party satisfaction. However, obstacles arise from differing perceptions among law enforcement officials, concerns about the deterrent effect, and inconsistent post-mediation monitoring. The study recommends strengthening SOPs based on eligibility indicators, mediation training for investigators, formal coordination with prosecutors and courts, involvement of community leaders, and post-settlement monitoring by Bhabinkamtibmas to prevent recurrence and maintain accountability.

Abstract

The principle of proportionality is an important principle in criminal law that serves to ensure a balance between the severity of the crime and the punishment imposed. In crimes of assault in Indonesia, the application of the principle of proportionality is crucial because variations in the form of assault often lead to differences in the level of culpability of the perpetrator and the impact on the victim. This study aims to analyze the application of the principle of proportionality in criminal justice practice, particularly in relation to judges' decisions in assault cases. The method used is a normative juridical approach by examining the provisions of the Criminal Code (KUHP), legal doctrine, and relevant court decisions. The results of the analysis indicate that the application of the principle of proportionality still faces several obstacles, such as disparities in decisions, judges' subjectivity in assessing mitigating and aggravating circumstances, and limited binding sentencing guidelines. Nevertheless, the principle of proportionality remains an important foundation in realizing substantive justice, by considering aspects of victim rights protection, crime prevention, and social reintegration for perpetrators. In conclusion, the application of the principle of proportionality in criminal acts of assault in Indonesia requires consistent application by judges, clearer sentencing guidelines, and strengthening the role of progressive law to achieve a balance between individual and societal interests.

Abstract

The existence of customary law in the reform of national criminal law is a critical issue within the context of Indonesia’s pluralistic legal system. As the indigenous law of the Indonesian people, customary criminal law is, in essence, an integral part of the Indonesian legal system. The reform of Indonesian cri minal law to replace colonial criminal law has accommodated customary criminal law as the basis for its legalization or recognition within the New Criminal Code (KUHP). This study examines the existence of customary criminal law within the national criminal legal system following the enactment of the new Criminal Code (Law No. 1 of 2023). This topic was chosen because it highlights the urgency of recognizing local legal values (living law) within the national system. The research employs a literature review method with a normative legal approach. These findings are crucial for strengthening the synergy between national law and local wisdom to foster an inclusive legal system.
