Abstract

This research states that in Islamic law adopting a child is a good act, which helps adopted children get a proper education. Basically, implementing the above rights of children is an obligation and joint responsibility of the government and society. The phenomenon that occurs in Indonesia is that the educational rights of adopted children have shifted to utilization, due to several factors, one of which is economic. The aim of this research is to strengthen previous research, and examine further the shift in the educational rights of adopted children and look at the factors that result in non-fulfillment of adopted children’s rights in Indonesia. This research uses a normative sociological approach with the nature of the analytical descriptive research. The results of this research found several factors that resulted in shifting, even not being given the rights of adopted children.

Abstract

Truth is a fundamental concept in philosophy and theology that has deep relevance in the Islamic tradition. This article examines the relevance of correspondence and coherence theories to the understanding of truth in Islam. Correspondence theory defines truth as the correspondence between propositions and external reality. In Islam, this approach is seen in revelation that is in harmony with natural reality as affirmed in many verses of the Qur'an. On the other hand, coherence theory emphasizes logical consistency in belief systems. Islam integrates revelation, reason, and sharia law to build a harmonious and rational belief. Truth in Islam is not only ontological, referring to the absolute reality of God, but also epistemological, encompassing the way humans understand and apply truth. The correspondence approach affirms the relationship of revelation to nature, while coherence ensures logical harmony within the belief system. The combination of the two creates a comprehensive framework, integrating spirituality, intellect and morality. The article concludes that the dialog between philosophical concepts and Islam enriches the understanding of the nature of truth, making it theologically and practically relevant in everyday life.

Abstract

This paper abstracts a problem one of the problems faced in society today is the problem of waste. Waste not only has an impact on the physical environment, but also has an impact on the non-physical environment, namely the social life of the community such as; cases of landfills (TPAS), degradation of soil and water quality, social conflict. However, waste can be valuable if it is sorted from the time it is generated and becomes raw materials that are awaited by recycling companies, such as paper, plastic, metal, glass companies need glass. Almost all inorganic waste can be sold to companies through collectors so that it can be valued. The research in this article uses field research at PT Planetary Recyled Plastic Indonesia in Banyumas, using the Fikih Ecology approach. The results of data collection were carried out by means of observation, interviews, and documentation. The results of the research in this article show that good and correct waste management not only has an impact on the preservation of the ecosystem of living things, but can also be used as a source of goodness by making it a tool for charity (shodaqoh Sampah)

Abstract

The crisis of values within the family has become one of the primary challenges in fulfilling children's educational rights, particularly in shaping the character of early childhood in the midst of modernization, globalization, and technological advancement. This article aims to analyze the impact of the family values crisis on children's right to education and to examine the solutions offered by Islamic legal principles in addressing this phenomenon. This study employs a library research method, drawing on various sources such as books and relevant journal articles. The findings reveal that the family values crisis significantly affects the fulfillment of children's educational rights, especially in terms of moral and spiritual development. Islamic legal principles (fiqh al-munakahat) provide comprehensive guidance for building a strong family structure through the concepts of parental responsibility, moral education, and value-based upbringing grounded in Qur’anic teachings. This article recommends strengthening the role of the family as the primary center of education, underpinned by robust Islamic legal principles, as a solution to the challenges posed by the modern era.

Abstract

The meaning of the word 'sakinah' has various meanings and points of view. The shift in life values ​​will affect the meaning of the word 'sakinah' itself. This article aims to provide a new perspective on the meaning of 'sakinah' in the context of the modern family. This research is of a qualitative type using the Library Research method which is analyzed descriptively and analytically. From this research it can be concluded that in terms of modern families, family happiness is greatly influenced by several factors, such as financial factors, education, emotional maturity and good communication between husband and wife.

Abstract

Indonesian people commit a lot of fornication and not a few people get pregnant out of legal marriage. Not only that case, but we also find many people in Indonesia who practice unregistered marriages. These cases from both practices have causes and effects on the status of children, which is in the context of inheritance, both Islamically and legally in Indonesia. Therefore, regarding the child's status, it is necessary to ask what the status of his inheritance is. The author uses library research methods or literature studies to answer these questions. In this case, the results of this research will be found from various literature and perspectives to resolve the status of children out of marriage with a broader explanation. From the author's search, it was found that children who birth from fornication (out of Islamic marriage) did not get a share of the inheritance. Meanwhile, the status of a child from an unregistered marriage also does not get an inheritance as long as it cannot be adequately proven.

Abstract

Waqf shares have great potential in supporting social justice, economic empowerment, and sustainable development. However, existing regulations have not been able to fully address the complexity of this instrument. This research analysed and reconstructed the policy of waqf shares in Indonesia through the maqashid sharia approach based on Jasser Auda's system theory. Using qualitative methods through document study and policy analysis, this study examined the compatibility of waqf share policies with the main objectives of sharia, the protection of religion, soul, mind, offspring, and property. The results showed the need for policy reconstruction to establish a waqf share ecosystem that is inclusive and adaptive to modern economic dynamics. Recommendations include strengthening regulations, innovating Islamic financial instruments, and synergising between the government, financial institutions, and religious authorities. The findings contribute to the formulation of a sharia-compatible waqf share policy that is responsive to national socio-economic needs.

Abstract

Usury in Islam is a prohibited system in the Qur'an and hadith. The system is not recognized in the modern banking system, leading to different opinions among Muslims in determining the legality of bank interest. Therefore, this research aimed to explore the contemporary law of bank interest, focusing on the different opinions among the mufasir on the definition of Ad'afan Muda'afah as a basis for determining the legality of usury. A normative method was adopted, and a literature review of several scholars was conducted on usury law and the interpretation of Ad'afan Muda'afah. The data was analyzed considering the modern banking system within the framework of Islamic law, particularly Maqashid Shari'ah. The results showed that the difference in the illat used for bank interest law varied in legal conclusions. Despite efforts to forbid bank interest, Muslims did not attain a definite solution to avoid this issue. Consequently, bank interest was temporarily sanctioned under certain conditions such as not being compounded, having low interest, and not comprising any form of persecution. To address this problem, Muslims should support the existence of Islamic bank producing muamalah products according to Islamic Sharia.

Abstract

Purpose – This research aims to identify the manifestation of gender injustice in the Compilation of Islamic Law, especially in the chapter on the rights and obligations of husband and wife. Methods – The research method used is library research with qualitative analysis. Findings – The analysis shows that Article 79 Paragraph 1 creates stereotypical gender roles by reinforcing the traditional roles of husband and wife. On the other hand, Article 79 Clause 2, and Clause 3 reflect the principles of gender equality and justice in legal rights. The husband's duties, as set out in Article 80, involve a guiding role and financial responsibility, with the issue of discrimination in women's education in Article 80 Clause 3. The wife's duties, as outlined in Article 83, create the potential for gender injustice through psychological pressure, with Article 83 Paragraph 2 indicating a double burden in managing household affairs. Finally, Article 84 Paragraph 1 highlights the potential for gender injustice in judging the wife as nusyuz (defiant), creating inequality in response to acts of defiance from both parties. Research implications – In the Compilation of Islamic Law, marriage aims to achieve a household life that is sakinah, mawaddah, and rahmah (peaceful, loving, and affectionate). To achieve this goal, married couples must commit to fulfilling their rights and obligations according to their respective abilities. Originality/value – This research is important to identify and explain the differences in status between husbands and wives, opening up space for reflection and a better understanding of aspects of gender equality in the context of Islamic marriage.
