Abstract

The commitment of local governments to protect children in areas such as education, violence, and discrimination is illustrated by Banyumas Regency's Local Regulation Number 1 of 2021, which addresses child protection. However, several challenges persist in its implementation. This study investigates the role of decentralization through local regulations related to child protection, employing normative legal research methods that include a regulatory approach, conceptual analysis, and case studies. The findings indicate that Banyumas Local Regulation No. 1 of 2021 establishes a strong legal framework that significantly protects children from discrimination, violence, and educational inequities. Nevertheless, implementation faces numerous obstacles, including inadequate inter-agency coordination, insufficient infrastructure, limited funding, and a lack of public awareness regarding the importance of protecting children's rights. This research proposes increasing funding allocations through the Regional Budget and recommends creating a collaborative forum that includes local governments, relevant agencies, schools, community organizations, and law enforcement to enhance policy coordination and action. Furthermore, the government is urged to improve community outreach regarding decentralized regulations that protect children. Ultimately, it is crucial to evaluate and refine existing policies to ensure the protection of minors' rights and to provide legal security and certainty.

Abstract

This paper discusses the prophetic treatises carried out by the people in relation to changes in family law reform in Egypt. The culture that has been passed down from generation to generation since the time of the ancestors will take root in the heart, so that the embedded doctrine is difficult to remove, so it takes a harder effort to accept the changing times. This research includes a literature study (Library Research), which is descriptive-analytical, using a historical-sociological approach. The rejection that occurs in the prophetic treatise is the same as the legal changes made by the Egyptian government, the similarities between the two are that they do not want to accept changes that occur in society, still hold on to the old culture adopted by their ancestors and still hold onto the animation culture. The basic reason for not accepting the change is because of the lack of understanding of what it will bring and the absence of an open mind (open thinking) by accepting input which is then discussed. Abstract

Adopted children cannot return the assets of their adoptive parents and only have rights through a mandatory will, the amount of which cannot be more than 1/3 of the assets left by their adoptive parents as stated in Article 209 paragraph (2) KHI. The fact that happened in the Bobosan sub-district there were 3 (three) cases of inheritance distribution for adopted children who received the entire adoptive parent's inheritance. This paper attempts to explain the distribution of the inheritance of adopted children that occurred in the Bobosan sub-district, Banyumas Regency from the perspective of Maqāşid Syarī'ah. This type of research is field research using an empirical juridical approach. The data source used is from primary data sources in the field by conducting in-depth interviews with the informants studied. The method used in qualitative analysis, namely describing, interpreting and hiding research data. Based on the results of the study, it can be interpreted that the division of inheritance that occurs is the need for Ḍaruriyat adopted children who live dependently living in their parents' house and continue the business of their adoptive parents. So that the family and the surrounding community consider the adopted child to be the full successor of the assets and efforts of the adoptive parents in order to prioritize the benefit of the adopted child. Abstract

Islamic Islamic law aims to organize human life better so that every law that is prescribed must have a purpose. Therefore, the existence of marriage law must have a purpose. From several meanings of marriage, marriage has a very noble purpose, namely to form a sakinah mawaddah warahmah family. However, this noble purpose of marriage is widely misunderstood for those who want to practice polygamy. Polygamy is interpreted only as a biological distribution of sex, meaning that it only fulfills sexual needs. Whereas the purpose of polygamy is to maintain and elevate the status of a woman by looking at the large number of women who are not comparable to men. From some people who abuse polygamy, whether they understand the concept of polygamy or not, we are still trying to give them an understanding of the good concept of polygamy so that women are not used as a layer for their desires to channel their biology. We are here to focus on how the concept of polygamy according to classical and contemporary ulama', where the results of their thoughts are implied in the form of a law known as the marriage law in Indonesia. And to increase the data, we use quantitative data here by comparing the thoughts between classical scholars and contemporary scholars about the concept of polygamy. in the concept of polygamy which delivers to families who are sakinah mawaddah warhamah. Abstract

This study examines the epistemological basis behind the choice of four traditional Islamic boarding schools affiliated with Nahdlatul Ulama (NU) in East Java to prioritize ḥisāb (astronomical calculations) over ru'ya (crescent sighting) in determining the beginning of the Hijri month, even though NU institutionally prioritizes ru'ya. Through qualitative, empirical-legal research based on interviews, document analysis, and field observations, this study shows that the practice of ḥisāb is not merely a technical choice, but rather an expression of an epistemic orientation rooted in classical astronomical literature, the continuity of scientific chains of narration, and burhānī reasoning that emphasizes rational certainty. The use of ḥisāb is legitimized by classical al-Shāfi'iyya fiqh and the pesantren ethos, which emphasizes that knowledge must be put into practice (taṭbīq al-‘ilm). Thus, ḥisāb functions as a marker of scholarly authority, legal certainty, and the pesantren's institutional identity. Despite technical variations, all four pesantren demonstrate a common epistemological commitment: the integration of the bayānī textual approach with the burhānī scientific rationality. This study highlights how traditional institutions negotiate textual authority and scientific rationality in contemporary religious practice.

Abstract

This study examines Ahmad Hasyim Muzadi’s concept of fikih kebangsaan (national fiqh) through the lens of Jamal al-Din ‘Atiyyah’s maqāṣid al-sharī‘ah theory. While previous studies have discussed national fiqh primarily in normative and socio-political terms, limited attention has been given to its maqāṣid-based methodological foundation. This article addresses that gap by analyzing how Muzadi’s thought reflects a structured maqāṣidī mode of ijtihad. This research employs a qualitative conceptual approach based on library research, examining primary texts of Ahmad Hasyim Muzadi alongside Jamal al-Din ‘Atiyyah’s maqāṣid framework. The analysis focuses on identifying the epistemological structure and levels of maqāṣid embedded in Muzadi’s formulation of national fiqh. The findings demonstrate that Muzadi’s fikih kebangsaan embodies a maqāṣid-based ijtihad operating across three interconnected dimensions: individual, communal, and humanitarian. His conception positions Indonesian Islam as a harmonizing force within plural society, affirms Pancasila as a constitutional meeting point between religion and state, and frames religious moderation as a strategic instrument for national cohesion. This construction reflects a substantive alignment with Jamal al-Din ‘Atiyyah’s expanded maqāṣid theory, particularly in integrating social welfare, civic solidarity, and national integrity into legal reasoning. The study concludes that Muzadi’s national fiqh represents a contextual maqāṣidī reconstruction of Islamic legal reasoning relevant to contemporary plural societies. It recommends further development of maqāṣid-based national fiqh as a methodological framework for strengthening religious moderation and constitutional harmony in Indonesia.
