Abstract

Ittiḥād al-majlis is one of the terms in the discussion of the marriage contract. Hanafiyah and Syafi’iyah differ in the ittiḥād al-majlis. This disference has implications for its application in implementation of online marriage contracts during the covid-19 pandemic. Analysis of the methodology for determining the law is important to study because there has been an online marriage in the city of Medan during the Covid-19 outbreak. This paper aims to explain how the rules of the Hanafiyah and Syafi’iyah schools in understanding ittiḥād al-majlis, and how the law of online marriage during the Covid-19 pandemic according to Hanafiyah and Syafi’iyah. This paper is a normative legal study, which examines the legal rules applied in the Hanafiyah and Syafi’iyah schools. The theory of ushul fiqh, namely how the rules are applied by these two schools to determine the meaning of a word. This study found that: First, Hanafiyah and Syafi’iyah have strong argument in giving the meaning of the majlis. Second, Hanafiyah interprets majlis as a word that indicates time, so that the unity of the place is not a condition for the validity of the marriage contract. As for Syafi’iyah, majlis is a word that indicates time and place, so the marriage contract must be in one place, where if the unity of the place is not fulfilled, then the marriage is invalid

Abstract

Hajj is one of the pillars of Islam that must be performed by Muslims who meet specific conditions, one of which is istiṭā‘ah (capability). Therefore, thorough preparation—mentally, physically, and financially—is essential for prospective pilgrims. This study aims to analyze Hajj financing through loan or advance funding schemes from the perspective of maṣlaḥah mursalah. The research employs a descriptive-qualitative method with field-based data collection. Data sources include both primary and secondary materials, such as interviews, documents, DSN MUI fatwas, books, papers, and online content. The findings reveal that the condition of istiṭā‘ah is not fully met by pilgrims who use Hajj advance funding. While this facility provides convenience for some people, especially in securing a Hajj quota earlier, it raises concerns regarding the validity of the pilgrimage, particularly in terms of financial capability. Nevertheless, in areas like Sigambal Village, this funding scheme is perceived as beneficial in increasing community participation in performing Hajj.

Abstract

Out-of-court divorce is a practice still often found in Indonesia, despite being contrary to positive laws, such as Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law (KHI). This study aims to analyze the legal implications of talaq outside the court from the perspective of the Fatwa of the Indonesian Ulema Council (MUI) of North Sumatra. With a normative juridical approach, this study explores the legal provisions of talaq in Islamic law, the relevance of fatwa to laws and regulations, and its impact on legal certainty and the protection of the rights of wives and children. Data was obtained through document studies of MUI fatwas, regulations, Islamic legal literature, and related academic studies. The results of the study show that the fatwa of the North Sumatra MUI recognizes the validity of talaq outside the court from a religious perspective, provided it meets the requirements of Sharia, but still recommends reporting it to the religious court to ensure legal certainty. This fatwa educates the public not to impose talaq carelessly and ensures the rights of the parties involved, such as alimony, custody, and the distribution of common property. The legal and social implications of this fatwa reveal a fundamental distinction between Islamic law and positive law, which can impact the protection of family rights. By applying the theory of maqashid shari'ah, this study concludes that the MUI fatwa aims to harmonize Islamic shari'ah values with state law in order to achieve the benefits of society.

Abstract

Penelitian ini membahas sengketa Tanah Ulayat antara masyarakat Suku Awyu dengan PT Indo Asiana Lestari terkait putusan PTUN Jayapura Nomor 6/G/LH/2023/PTUN.JPR, yang menggambarkan konflik antara kepentingan ekonomi dan hak masyarakat adat. Penelitian bertujuan untuk menganalisis apakah putusan hakim telah memenuhi prinsip keadilan substantif menurut perspektif fiqh siyasah, khususnya konsep siyasah qadhaiyyah dan teori ihya al-mawat. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan putusan pengadilan (yurisprudensi), pendekatan konseptual, dan pendekatan kasus, menggunakan bahan hukum primer berupa putusan pengadilan, serta bahan hukum sekunder dan tersier terkait. Hasil penelitian menunjukkan bahwa putusan hakim lebih menekankan aspek prosedural formal dibandingkan dengan keadilan substantif, sehingga tidak memenuhi prinsip siyasah qadhaiyyah yang menuntut perlindungan hak masyarakat adat, kelestarian lingkungan, dan kemaslahatan umat. Penelitian ini merekomendasikan adanya peninjauan kembali putusan serta penguatan partisipasi bermakna masyarakat adat dalam proses perizinan dan pengambilan kebijakan sebagai upaya mewujudkan keadilan substantif dalam penyelesaian konflik agraria di Indonesia.

Abstract

The handling of ongoing sexual violence crimes committed by children requires an approach that considers victim protection, offender rehabilitation, and legal certainty. Using Decision Number 59/Pid.Sus-Anak/2024/PT MDN as a framework, this essay examines how Islamic criminal law applies to persistent cases involving juvenile offenders.  Researchers used primary and secondary sources, conducted descriptive and qualitative analyses, and adhered to a normative juridical methodology that included a statute approach, a case approach, and an examination of Islamic law. The results show that the judges' decision to impose a 12-month prison term with a 6-month work-study program was based on legal considerations (Article 81 paragraph (2) of Law No. 17/2016 Jo. Article 64 paragraph (2) of the Criminal Code Jo. Law No. 11/2012), philosophical considerations (the rehabilitation of children), and sociological aspects (the psychological impact on victims). According to Islamic criminal law, a juvenile offender who commits a crime at the age of seventeen is regarded to be in the puberty and accountability stages, but due to the presence of compulsion and the juvenile's position, syubhat (doubt) arises, and hudud is not enforced.  In accordance with the concepts of ishlah (reform) and ta'dib (education), the crime is designated as jarimah zina (fornication) with violent components and is punished with ta'zir, a kind of education that is both corrective and instructional.  Islamic law and positive law work together to prioritize victim protection and offender rehabilitation, as emphasized by this ruling, which represents maqasid syariah, especially hifz al-nafs (protection of life) and hifz al-nasl.

Abstract

This article examines the practice of joint custody after divorce from an Islamic legal perspective through a legal analysis of two Sharia Court decisions, namely the Idi Sharia Court and the Aceh Sharia Court. The purpose of this study is to assess the legal basis for joint custody and to compare the legal considerations used in the two decisions. This research employs a normative legal approach using case study and conceptual analysis methods. The results of the study show differences in legal reasoning: the Idi Sharia Court took a progressive approach by applying a joint custody model through the division of roles between both parents, while the Aceh Sharia Court took a conservative approach by prioritizing the psychological stability of the child and granting sole custody to the mother. This comparison confirms that although both are based on the principles of the best interests of the child and maqāṣid al-syarī‘ah, their implementation results in different rulings.

Abstract

Royalty payments for the use of musical works often raise legal issues, par-ticularly regarding the parties responsible in commercial concerts. This study aims to analyze the licensing mechanism for the use of copyrighted works under Law No. 28 of 2014, identify the parties responsible for paying royalties in concerts, and examine these obligations from an Islamic legal perspective as interpreted by the Indonesian Ulema Council (MUI). The re-search method used is normative legal research with a legislative and con-ceptual approach. The results of the study show inconsistencies between Ar-ticle 9 paragraphs (2)-(3) and Article 23 paragraph (5) of the Copyright Law, which create legal uncertainty regarding the licensing mechanism for the use of copyrighted works. In commercial concerts, the EO is designated as the party most responsible for royalty payments because it manages all as-pects of the event and derives economic benefits. From an Islamic legal per-spective, copyright falls under ḥuqūq māliyyah, which must be protected, and violations of it are categorized as ẓulm. Therefore, royalty payments are a religious obligation to uphold the principles of justice and protection of property rights in transactions.

Abstract

Kuliah Kerja Nyata (KKN) merupakan salah satu wujud nyata implementasi Tri Dharma Perguruan Tinggi melalui pengabdian kepada masyarakat. KKN Universitas Islam Negeri Sumatera Utara di Desa Bah Aren, Kecamatan Pamatang Sidamanik, Kabupaten Simalungun, difokuskan pada pemberdayaan Usaha Mikro, Kecil, dan Menengah (UMKM). Program utama mencakup pendampingan digitalisasi usaha dengan memperkenalkan QRIS, Google Maps, dan promosi media sosial, serta pelatihan keterampilan eco print berbasis bahan alami. Metode penelitian yang digunakan adalah deskriptif kualitatif dengan pendekatan partisipatif. Hasil menunjukkan bahwa pelaku UMKM memiliki antusiasme tinggi, mulai memahami pentingnya pemasaran digital, serta melihat peluang usaha baru melalui eco print. Meski masih terdapat kendala berupa keterbatasan sarana dan waktu, kegiatan ini memberi dampak positif bagi penguatan daya saing UMKM desa.

Abstract

General Background: Aceh Province holds a special status in Indonesia, allowing the formal implementation of Islamic sharia through Qanun, including sanctions for khalwat (seclusion between non-mahram individuals). Specific Background: Qanun Jinayat No. 6/2014 explicitly categorizes khalwat as a jarimah punishable by flogging, but its enforcement in Aceh Tenggara remains inconsistent and contested. Knowledge Gap: Previous studies largely examined normative or localized aspects, leaving insufficient exploration of the multidimensional obstacles—structural, cultural, juridical, and procedural—that undermine the law’s effectiveness. Aims: This study seeks to identify, analyze, and evaluate the obstacles and challenges faced in enforcing flogging sanctions against khalwat perpetrators in Aceh Tenggara, and to formulate strategic solutions. Results: Findings reveal that weak institutional capacity, limited training, overlapping legal norms, community resistance, and social pressures on law enforcement significantly hinder consistent and fair implementation. Novelty: Unlike earlier works, this study provides a comprehensive analysis that integrates legal theory with empirical insights, offering a holistic view of enforcement challenges. Implications: Strengthening inter-agency coordination, enhancing officer capacity, and promoting community legal awareness are essential to ensure that sharia enforcement in Aceh is more effective, just, and contextually responsive to societal dynamics. Highlights: Structural, cultural, and juridical barriers weaken effective implementation. Social resistance and weak institutional capacity hinder law enforcement. Abstract

This study aims to analyze the fulfillment of the human rights of the elderly in nursing homes in Medan City as part of social protection for the elderly group. The background of the research is based on the increasing number of elderly people which has implications for the high need for adequate social services and protection. The research method uses a qualitative approach with data collection techniques through observation, interviews, and documentation. The results of the study indicate that nursing homes play an important role in fulfilling the basic rights of the elderly, especially related to physical, psychological, and social needs. However, there are still various obstacles such as limited professional staff, infrastructure, and adequate budget support. This study concludes that the fulfillment of the rights of the elderly in nursing homes in Medan City has been carried out but is not optimal, so that policy strengthening, improving service quality, and cross-sector collaboration are needed to realize the welfare of the elderly more comprehensively. This research is expected to provide a realistic picture of the implementation of the human rights of the elderly in nursing homes, while also assessing the role of the state and society in ensuring a decent, dignified, and humane life for the elderly. Furthermore, it will provide input for policymakers and nursing home managers to ensure that services for the elderly are increasingly oriented toward respecting their human rights.
