Abstract

One of the most common issues in marriage is the marriage contract, which might take days to finalize. It happens when a guardian refuses to marry off his daughter because he disapproves of the marriage. Therefore, Malojongkon Boru is frequently practiced to get the approval of the woman's guardian or father. The subject of discussion for this study is the transition of the nasab guardian to the judge guardian in the practice of Malojongkon Boru. The focus of the problem in this study is the perspective of Indonesian Ulema Council (MUI) and Traditional Leaders on the transition of nasab guardian to the judge guardian in Malojongkon Boru marriage practice. This study is a field research with a qualitative approach. The data sources are classified into field data as primary data, including interviews and documentation, and literature data as secondary data. The findings indicate that MUI and Traditional Leaders view the transition of marriage guardians in the practice of Malojongkon Boru marriage as conducted in conformity with Islamic law.

Abstract

This research was motivated by the results of the researchers' initial observations regarding the premarital guidance provided by the Medan Marriage Clinic to the participants. This study aims to determine the main objectives of establishing the Medan Marriage Clinic, the system of providing premarital guidance carried out by the Medan Marriage Clinic, the suitability of premarital guidance at the Medan Marriage Clinic with the provisions of the Directorate General of Islamic Community Guidance in 2018, as well as the effectiveness of the Medan Marriage Clinic in forming a happy family. sakinah. In this study, researchers used descriptive qualitative methods with observation and interview data collection techniques. This type of research is field research (field research). The number of respondents in this study were 5 founders of the Medan Marriage Clinic and 30 alumni of the Marriage Clinic. Based on the results of the research, the guidance system implemented by the Medan marriage clinic is quite good with a lecture system in 12 meetings for a period of 3 months, as for the material, Mindset and Intentions for Marriage, Premarital Health, Stages of Choosing a Match, Ta'aruf, Khitbah and Dowry , KUA Administration, Walimah Fiqh, Jima' Fiqh, Fiqh of Livelihoods, Financial Management, Building Communication, Family Conflict Management, Fiqh of Divorce and Ruju', Consolidation Towards Marriage. Abstract

This study aims to analyze the law enforcement against online gambling players in Aceh Tenggara Regency, particularly in the implementation of Qanun Aceh Number 6 of 2014 concerning Jinayat Law. This research uses a case study approach with an empirical legal research method. Primary data is obtained through interviews and observations with law enforcement officers, offenders, and the public regarding online gambling, while secondary data is collected from document reviews, regulations, and related literature. The research findings indicate that law enforcement against online gambling offenders in Aceh Tenggara has been carried out by law enforcement agencies, but the results are still not optimal as online gambling practices continue to expand. The main challenges faced are the lack of public awareness, limited technological resources, and insufficient training and coordination among agencies, which require a more effective strategy to address these issues.

Abstract

Powder embroidery or Beauty Balm (BB) Face Glow is a beauty trend that is increasingly popular in the cosmetics industry. This procedure is carried out by implanting color pigments into the outermost layer of skin using a microneedling technique, resulting in bright and smooth looking skin without the need for daily makeup application. However, from the perspective of Islamic law, this practice is still controversial. This research aims to analyze the law of powder embroidery based on the views of members of the Medan City MUI Fatwa Commission using descriptive-analytical qualitative methods. The results of the research show that powder embroidery is categorized as haram because it resembles tattoos and is included in the practice of changing Allah's creation (QS. An-Nisa: 119). Even though it does not block the ablution water and does not invalidate the prayer, this practice is still prohibited if it is only for aesthetic purposes. From a business aspect, powder embroidery services are also considered impermissible in Islam because they support practices that are contrary to sharia. The clerics emphasized the importance of seeking halal sustenance and appealed to Muslim women to decorate in permitted ways, such as using halal cosmetics that are not permanent.

Abstract

Penelitian  ini bertujuan untuk mengetahui bagaimana ketentuan hukum dalam ijtima' ulama komisi fatwa se-Indonesia dalam memberikan perlindungan hukum terhadap data pribadi nasabah. Penelitian ini adalah yuridis normatif dengan pendekatan konseptual. Teori yang digunakan adalah teori kepatuhan hukum, karena dengan menempatkan fatwa sebagai objek yang mengatur perilaku dalam beragama. Penelitian ini menggunakan pendekatan bibliografi untuk pengumpulan data, serta mengumpulkan informasi sekunder dari berbagai sumber, seperti putusan pengadilan, undang-undang, peraturan, buku dalam koleksi pribadi dan perpustakaan, artikel surat kabar dan majalah, jurnal online, dan makalah ilmiah. Penelitian ini menghasilkan berdasarkan hasil Ijtima Ulama Komisi Fatwa Se-Indonesia membuat ketentuan hukum mengenai perlindungan data pribadi yang mana aturan tersebut berisi tentang pinjaman online bahwa dilarang memberikan ancaman fisik atau membuka rahasia (aib) seseorang yang tidak mampu membayar hutang.

Abstract

Islam regulates the various wages of human life, including rent to rent in order to take place with benefits that are in accordance with the goals of sharia. The problem is known to exist virtual couple rental practices that offer dating services for its clients. This paper is to find out how to practice virtual couple rental through social media, and to find out the law based on Wahbah az-Zuhaili perspective. This research is juridical-normative research with a conceptual approach. The theory used as a knife of analysis is the theory of the observance of law. This study found first, the practice of virtual partner rental business through social media can be done by looking at posts about various types of service offerings provided by virtual partner rental business account owners with a set price that is adjusted to the right time desired and clearly defined on the homepage of the account. So, each client is not mistaken about every service provided along with the nominal price to be paid. Second, although at a glance this practice meets the pillars of Ijarah on Wahbah az-Zuhaili and has a clear wage system this practice violates one of the conditions in the form of a work object, which is, where the object of work on this practice is concluded not in accordance Sharia because 85.7% of users choose partners who are against the type so it is likely that the object of this practice is not in accordance with Sharia and banned. Prophet Muhammad SAW said that means ‘It should not be between a man and a woman alone unless accompanied by his muhrim, and a woman should not travel unless accompanied by his mahram. Because it can bring closer to the deeds of adultery.

Abstract

Polygamy is a topic that always invites polemics in society, especially in the context of households. Although polygamy existed long before Islam, Islam accommodates this practice with several limitations and conditions, especially in terms of justice for wives. Problems that often arise in the practice of polygamy include abuse of rights and obligations, physical and psychological violence, and negative impacts on women and children. This study aims to understand more deeply the legal perspective of polygamy, especially according to the views of Buya Hamka and Nasr Hamid Abu Zayd. This study uses a normative juridical method with a literature study approach, utilizing primary legal materials such as the Al-Qur'an interpretation book by Hamka and Abu Zayd, as well as secondary legal materials from Islamic law literature and related laws. The analysis was carried out by describing, recording, and interpreting data to understand the differences in the views of the two figures regarding the law of polygamy. The results of the study show that there are uniqueness and differences in the thoughts of Hamka and Abu Zayd that can influence the implementation of polygamy law in Indonesia. This study provides important insights into the dynamics of polygamy law in the modern context and its contribution to legal policy in Indonesia.

Abstract

This study examines the tindak pidana keterangan palsu in current affairs from the perspectives of positive and Islamic law, with a focus on Putusan Pengadilan Negeri Medan Nomor 737/Pid.B/2024. This is important because, as an otentik act, hibah has a high degree of purity, but rentan is used in conjunction with palsu keterangan that implies the kerugian of law and the public's lack of trust in the government. The study employs a normative legal approach that includes undang-undang, kasus, conceptual, and perbandingan analysis. According to the study's findings, hakim menerapkan Pasal 266 jo. Pasal 55 KUHP by promoting the use of niat (mens rea) and tindakan to fully encase the keterangan palsu (actus reus). From the perspective of jinayah fiqh, this perbuatan is related to syahādah az-zūr (kesaksian palsu), which includes large dosa and can be explained by sanksi ta'zir demi kemaslahatan. Comparative analysis highlights the similarities between Islamic and positive law, despite their differences in sanksi orientation: Islamic law emphasizes morality and substantiation, whereas positive law emphasizes adherence to the law. This study recommends strengthening notary integrity, raising the bar for active verification, and incorporating Islamic legal principles into positive legal practice to prevent corruption and improve legal performance.

Abstract

The implementation of the “hemat” (economy) feature in online ride-hailing services represents a digital promotion strategy aimed at attracting consumers through fare reductions. However, this policy creates systemic pressure on drivers, particularly regarding income and workload. This study aims to analyze the implementation of the feature and assess the form of driver protection from the perspective of al-maṣlaḥah. A qualitative approach with an empirical legal design was employed. Data were collected through semi-structured interviews with 20 Grab and Gojek drivers in Medan City, as well as a review of Islamic legal literature and digital transportation policies. The findings reveal that most drivers feel compelled to activate the feature due to algorithmic pressure, resulting in decreased net income and increased working hours without adequate social protection. The al-maṣlaḥah analysis indicates that the feature does not fulfill the principles of shar‘ī benefit, as it fails to protect the drivers’ lives (ḥifẓ al-nafs) and wealth (ḥifẓ al-māl), and contradicts the principles of riḍā bi al-tarāḍī (mutual consent), the prohibition of gharar (uncertainty), and the legal maxim lā ḍarar wa lā ḍirār (no harm and no reciprocating harm) in Islamic business ethics. The study recommends that online ride-hailing platforms revise or discontinue the “hemat” feature, improve order distribution and fare deduction schemes, enhance transparency and partner participation, and encourage government regulations that ensure fair working conditions for the informal sector, aligning with justice, protection, and the balance of rights in digital business ethics.

Abstract

Regulations regarding mahram and the prohibition of intermarriage in Samosir Batak society are some of the important aspects that influence social life and marriage. The clan in the Samosir Batak tradition has a very central position, so the prohibition on intermarriage within the clan is regulated to maintain the purity of the lineage and social harmony. In Islamic law, the prohibition on intermarriage can be analogous to the prohibition against mahram, namely people who are forbidden to marry because of blood or marriage relations. This research aims to examine the relationship between mahram in Islamic law and the prohibition of intermarriage in Samosir Batak custom, as well as explore the similarities and differences between the two. The method used is descriptive qualitative with a normative approach. The research results show that there are similar goals between the two systems in protecting offspring and family honor. However, there are differences in determining which parties are considered mahram and semarga. This research suggests that there should be a deeper understanding of these two systems to create a balance between religious and customary law in Samosir Batak society. Even though there are differences in determining who is considered a mahram in Islamic law and who is considered a clan in Samosir Batak custom, these two systems have the same goals of maintaining family honor, protecting legitimate descendants, and preventing marriage within a close lineage. Socialization and Education require more intensive outreach efforts regarding the differences and similarities between mahram in Islamic law and the prohibition on intermarriage in Samosir Batak custom. This is important to provide a clear understanding to the community, especially the younger generation so that they can live their religious and traditional lives in harmony.
