Abstract

Tulisan ini bertujuan untuk mengkaji pemenuhan hak anak dalam perkawinan Sah Sintua-tua di Desa Palding Jaya Sumbul, dengan menelaah realitas perkawinan yang tidak dicatatkan, dampaknya terhadap anak, serta pandangan hukum adat, hukum positif, dan hukum Islam terhadap status anak dari perkawinan tersebut. Penelitian ini merupakan penelitian yuridis empiris dengan pendekatan sosiologi hukum dan deskriptif kualitatif. Data diperoleh melalui wawancara dengan masyarakat Karo, praktisi perkawinan, dan ulama Kabupaten Dairi, kemudian dianalisis menggunakan metode Miles dan Huberman. Hasil penelitian menunjukkan bahwa sebagian masyarakat Muslim Karo masih melaksanakan nikah sintua-tua, yakni perkawinan yang dianggap sah menurut adat tetapi tidak memperoleh pengesahan dari negara maupun agama. Anak-anak dari perkawinan ini tidak diakui sebagai anak sah secara hukum, sehingga menghadapi hambatan dalam memperoleh hak-haknya. Dengan demikian, meskipun sah secara adat, nikah sintua-tua bertentangan dengan hukum Islam dan hukum negara serta berimplikasi pada terabaikannya hak anak. Oleh karena itu, diperlukan peningkatan pemahaman agama dan hukum di masyarakat serta harmonisasi antara hukum adat, hukum agama, dan hukum negara agar perlindungan hak anak dapat terjamin secara menyeluruh dan berkeadilan.

Abstract

Divorce is a social phenomenon that continues to increase, including in the Medan Religious Court, with multidimensional causes. One influential factor that is often overlooked is the quality of biological relationships (emotional support) within the household. This study aims to analyse the influence of biological relationships on divorce, identify the forms of biological problems in divorce cases, and explore the perceptions of judicial officials on divorce cases at the Medan Religious Court during the period 2021-2023. The method used is a legal-empirical study with a descriptive-analytical approach through document analysis of 130 divorce cases and interviews with judges and court clerks. The results of the study show that 22.3% of divorce cases are related to biological problems, either explicitly or implicitly, mainly in the form of lack of intimacy, refusal of sexual relations, and sexual dysfunction. These problems trigger domestic conflicts and contribute significantly to divorce. These findings emphasise the importance of biological relations in maintaining the integrity of the household in accordance with Islamic law and legislation. Therefore, it is necessary to strengthen premarital education, family counselling, and judicial mediation that take into account biological needs as a means of preventing divorce.

Abstract

This article aims to analyze the adequacy of cyberstalking regulation within Indonesian criminal law and to examine it from the perspective of Islamic criminal law. The study focuses on the absence of a specific cyberstalking offense in Indonesian criminal legislation and on how Islamic law positions such conduct within the framework of jarimah ta‘zīr. The research employs a normative juridical method using statutory, conceptual, and comparative approaches. The findings indicate that Indonesian criminal law still relies on the provisions of the Criminal Code (KUHP), the Electronic Information and Transactions Law (UU ITE), and the Sexual Violence Crime Law (UU TPKS), all of which do not fully capture the digital, repetitive, and multidimensional nature of cyberstalking. From the perspective of Islamic criminal law, cyberstalking is classified as a jarimah ta‘zīr because it violates the principles of ḥifẓ al-nafs and ḥifẓ al-ʿird, thereby leaving the determination of sanctions to judicial ijtihād based on public interest. This study underscores the urgency of regulatory reform to formulate a clearer and more integrative cyberstalking offense that aligns with victim protection principles in accordance with maqāṣid al-sharīʿah.

Abstract

Powder embroidery or Beauty Balm (BB) Face Glow is a beauty trend that is increasingly popular in the cosmetics industry. This procedure is carried out by implanting color pigments into the outermost layer of skin using a microneedling technique, resulting in bright and smooth looking skin without the need for daily makeup application. However, from the perspective of Islamic law, this practice is still controversial. This research aims to analyze the law of powder embroidery based on the views of members of the Medan City MUI Fatwa Commission using descriptive-analytical qualitative methods. The results of the research show that powder embroidery is categorized as haram because it resembles tattoos and is included in the practice of changing Allah's creation (QS. An-Nisa: 119). Even though it does not block the ablution water and does not invalidate the prayer, this practice is still prohibited if it is only for aesthetic purposes. From a business aspect, powder embroidery services are also considered impermissible in Islam because they support practices that are contrary to sharia. The clerics emphasized the importance of seeking halal sustenance and appealed to Muslim women to decorate in permitted ways, such as using halal cosmetics that are not permanent.

Abstract

This article examines the formulation and implementation of the obligation to provide maintenance for orphans in Islamic law and the factors contributing to its variation and neglect in social practice. The main research problem addresses how Islamic law normatively constructs the obligation of orphan maintenance and why this norm is not fully internalized in community life. This study employs an empirical legal research method with a socio-legal approach, integrating normative analysis of the Qur’an, hadith, and classical Islamic jurisprudence with field research conducted in Medan Tembung District through interviews, observation, and documentation. The findings reveal that Islamic law provides a strong and multilayered normative framework for ensuring orphan maintenance through the responsibilities of guardians, extended family, and social mechanisms; however, in practice, maintenance is predominantly perceived as a moral or charitable act rather than a legally binding obligation. Variations and neglect are influenced by economic constraints, low legal awareness, family cultural structures, and weak institutional integration. The study concludes that the gap between normative provisions and social practice undermines effective protection of orphans’ welfare, highlighting the need to strengthen legal awareness and develop a more structured and sustainable system of maintenance responsibility.

Abstract

This study aims to analyze the practice of musical entertainment in the implementation of walīmatul ‘urs and its implications for the understanding of Islamic law among Muslim families in Ujung Padang District, Simalungun Regency. The research uses a qualitative approach with field research through observation, interviews, and documentation techniques involving various informants, including wedding organizers, religious leaders, customary leaders, community members, and local youth. The results of the study show that forms of musical entertainment in walīmatul ‘urs consist of traditional music (rebana and hadrah), modern music (single organ and keyboard), as well as vocal entertainment such as religious and popular songs. These practices reflect the integration of social and religious values through a negotiation process between entertainment needs and adherence to Islamic norms. In addition, there is a spectrum of understanding of Islamic law among Muslim families, which is divided into two main tendencies, namely the view that allows with conditions and the view that is more restrictive. These differences are influenced by factors such as age, level of religious education, and social pressure. Furthermore, the practice of musical entertainment in walīmatul ‘urs has implications for the formation of an understanding of Islamic law that is contextual, adaptive, and dynamic. Tensions between custom (‘urf) and Islamic law (sharia) are also found, but are generally resolved through mechanisms of compromise and adjustment. This study asserts that the understanding of Islamic law at the family level is not static, but is formed through interactions between normative texts and socio-cultural practices. These findings contribute to the development of studies in Islamic law and the sociology of religion, particularly in understanding the dynamics of religiosity among Muslim communities in the local context.

Abstract

This study aims to analyze the form and mode of the crime of falsifying halal labels on food products in Indonesia and to examine the effectiveness of Muslim consumer protection from the perspective of positive law and Islamic criminal law (jinayah). In addition, this study aims to find out how halal label falsification is seen in Islamic sharia norms and its position in the national legal system, especially related to the protection of Muslim consumers' rights to halal product information. The research method used is normative legal research (normative juridical) with a legislative approach, a case approach, and a legal sociology approach. The research data was obtained through library research which includes primary, secondary, and tertiary legal materials, such as laws and regulations, legal literature, ulama fatwas, the Qur'an, and Hadith. The data was analyzed using a descriptive qualitative analysis method by interpreting and comparing positive legal norms and Islamic criminal law related to halal label falsification.  The results of the study show that the falsification of halal labels on food products is generally carried out through the inclusion of halal logos without an official certificate. In Islamic criminal law, this act is included in jarimah ta'zir because it contains elements of fraud and forgery. In positive law, the action violates the provisions of laws and regulations regarding halal product assurance and consumer protection.

Abstract

Penelitian ini menganalisis tentang penggunaan kontrasepsi mantap (kontap) pada pasangan suami dan isteri d Kabupeten Langkat ditinjau dari hukum Islam dan pengaruhnya terhadap ketahanan keluarga. Fokus yang menjadi rumusan masalah dalam penelitian adalah bagaimanakah pengaruh kontrasepsi mantap terhadap ketahan keluarga di Kabupaten Langkat. Metode penelitian yang dilakukan dengan menggunakan jenis penelitian kualitatif, dengan menggunakan pendekatan penelitian yaitu pendekatan kasus (case approach), pendekatan perundang-undangan (statute approach), dan pendekatan konseptual (conceptual approach). Penelitian ini berkesimpulan bahwa kontrasepsi mantap menurut MUI mengubah fatwa hukum vasektomi dari haram menjadi halal. Pasangan suami isteri di Kabupaten Langkat memiliki anggapan yang negatif terhadap kontrasepsi mantap, diantaranya: Pertama, bertentangan dengan adat istiadat yang melarang untuk melakukan kontrasepsi mantap dan rendahnya pengetahuan yang berpendapat bahwa metode kontrasepsi dilarang oleh agama. Kedua, Kerumitan yang cukup tinggi dalam melakukan kontrasepsi mantap dan membutuhkan banyak waktu dan tenaga dan Ketiga, asumsi dan kekhawatiran bahwa kontrasepsi mantap dapat mengganggu kejantanan dan impotensi, serta alasan ekonomi karena beranggapan bahwa vasektomi memerlukan biaya yang sangat tinggi. Metode kontrasepsi mantap juga berdampak bagi pasangan suami isteri di Kabupaten Langkat, kebanyakan dari laki-laki sebagai suami yang menolak untuk dilakukannya kontrasepsi mantap sebagai program keluarga berencana dan bagi pasangan suami isteri yang telah melakukan metode kontrasepsi mantap dalam pernikahannya di Kabupten Langkat berdampak pada keharmonisan rumah tangga dan menjadi ancaman dalam keutuhan rumah tangga.

Abstract

This study delves into the analysis of the rights of apostate wives divorced by their husbands, with a specific focus on the decision rendered by the Klaten Religious Court with case number 0082/Pdt.G/2022/PA. Klt. The research aims to address existing gaps in Marriage Law No. 1 of 1974, as amended by Law No. 16 of 2019, and the compilation of Islamic law, particularly regarding the need for detailed regulations on the legal consequences following post-divorce due to apostasy (riddah). Employing a normative juridical methodology through literature research, the study adopts a comparative approach to analyze the data. The findings reveal that the Klaten Religious Court's decision, registered as 0082/Pdt.G/2022/PA, recognizes apostasy as a valid ground for the dissolution of marriage, in accordance with Article 114, letter (h) of the compilation of Islamic Law listing reasons for marriage dissolution. The court, acknowledging apostasy as grounds for termination, granted the apostate wife the rights to iddah and Mut'ah. Consequently, the ex-wife is entitled to assert her rights. In conclusion, the decision of the Klaten Religious Court addresses the rights of apostate wives post-divorce, yet underscores the necessity for a more detailed and comprehensive legal framework to guide similar cases and safeguard the rights of the involved parties.

Abstract

In 2023, the Simalungun Religious Court adjudicated two cases involving marriage dispensations for pregnant women: Decision Number 26/Pdt.P/2023/PA.Sim and Decision Number 62/Pdt.P/2023/PA.Sim. The outcomes of these cases highlighted a significant divergence, with one ruling in favor of the dispensation request while the other denied it. This study aims to analyze both the Islamic and formal legal perspectives regarding marriage for pregnant women, evaluate scholarly views on marriage dispensations, and conduct a comparative analysis of the judicial considerations influencing these decisions. Employing a normative legal research approach, the findings indicate three key points: First, there exists a significant difference among Islamic scholars concerning the validity of marriages involving women pregnant from adultery; while Imam al-Shafi’i and Imam Abu Hanifah accept such marriages under specific conditions, Imam Malik and Imam Ahmad ibn Hanbal reject them, regardless of the identity of the husband. Second, marriage dispensations for pregnant women are compatible with Islamic law, as endorsed by several scholars. Legally, the framework for marriage dispensations is provided by the Marriage Law and Supreme Court Regulation (PERMA) No. 5 of 2019. Third, Decision Number 26/Pdt.P/2023/PA.Sim, which approved the dispensation, reinforces legal certainty, whereas Decision Number 62/Pdt.P/2023/PA.Sim, which denied it, raises potential issues regarding the predictability of legal outcomes.
