Abstract

This study aims to find out the reality of unrecorded marriages in Pematang Jaya District. To find out how the role of the Head of KUA Pematang Jaya in minimizing marriage is not recorded in the community in Pematang Jaya. To find out what obstacles faced by KUA Pematang Jaya District in minimizing marriage are not recorded in the community in Pematang Jaya. The type of research used is descriptive research, while the data analysis used is qualitative descriptive data analysis. The author obtained this data source through direct interviews with the parties, namely the Head of KUA Pemtatang Jaya. In this study, what is included in the secondary data is literature research. The role of the Religious Affairs Office (KUA) of Pematang Jaya District in minimizing marriage under hand, including Coordinating work with all sectors (village heads, hamlet heads) that support the implementation of the effectiveness of marriage registration in various ways including giving reprimands, to amils / clerics who have intentionally or unintentionally married men and women, the Office of Religious Affairs collaborates with ustadz and religious leaders to convey counseling and guidance to the community of all villages in Pematang Jaya District on how important a marriage is recorded from every religious kegatan both recitations and others, Conducting counseling on Marriage Registration and Happy Family conducted by the Marriage Advisory, Guidance and Preservation Agency (BP4) at the Office of Religious Affairs to prospective brides and guardians. There are several things that become obstacles faced by KUA, including the very limited economic income of the community in their daily lives. So they reasoned that they were unable to pay the administrative costs in KUA as well as transportation costs to travel the distance to KUA. There is still a lack of awareness and understanding of the law in the community among people in Pematang Jaya sub-district who do not realize and fully understand how important marriage registration is. The low level of education studied by the community in Pematang Jaya sub-district, where the perpetrators of marriage are under their hands.

Abstract

This article aims to find out what the judge considers in determining the status of the defendant/respondent in absentia. Then, the consideration is analyzed using the maqashid al-usrah theory which is part of the maqashid al-syariah study. The judge's consideration referred to here is the consideration of the judge of the Pandan Religious Court, which is limited to occult divorce cases, to be precise Decision Number 33/Pdt.G/2020/PA.Pdn and Decision Number 24/Pdt.G/2020/PA.Pdn. This decision is interesting to discuss, because the entire determination of the invisibility limit in the Pandan Religious Court does not have a definite time limit, including these two decisions. The methodological flow of this research uses a normative legal research format, with primary legal materials (secondary data), Law Number 1 of 1974 concerning Marriage, the Compilation of Islamic Law, and copies of Decision Number 33/Pdt.G/2020/PA.Pdn and Decision Number 24/Pdt.G/2020/PA.Pdn. The results of the study show that in the two decisions, it must be distinguished between the judge's consideration in determining the status of the defendant/respondent in occultation and the judge's consideration in breaking the marriage bond between the litigants. Regarding the determination of the status of the respondent/applicant as invisible, it turned out that the judge was not guided by Islamic law (fiqh mazhab), but rather the general civil procedural law. As for the reason for dissolving the marriage, the judge saw that the marriage of the litigants no longer fulfilled the elements to achieve the purpose of marriage; if the family is maintained, it will bring mafsadah. It can be concluded that the judge's consideration in each decision is in accordance with maqashid al-usrah.

Abstract

The results of this study are that the differences and varieties of qira'at contained in the Qur'an are not the result of one's ijtihad in determining the type of reading in the Qur'an, but must be based on and based on following the sanad and history that is directly connected to the Prophet Muhammad SAW. because qira'at is a discipline of science that is alone. As for the qira'at asyrah shughra and qira'at asyrah kubra in Surah Al-Fatihah, that there are differences in almost all verses in Surah Al-Fatihah according to qira'at and their respective histories. As for the qira'at asyrah shughra is a qira'at that there are ten imams qurra' and each imam imam qurra' has two narrators, and each of these narrators has one thariq (path) which is commonly called the path of shathibiyyah, so that the total history and path is twenty history and twenty thariq (path). While what is meant by qira'at asyrah kubra is qira'at which is attributed to ten imams qurra' which in each imam qira'at has two narrators, in addition to each History has fifty thariq, so the total is twenty History and a thousand thariq (paths).

Abstract

Trade is a dynamic economic activity, governed by laws that continually evolve over time. In Indonesia, the implementation of Minister of Trade Regulation No. 31 of 2023 on Business Licensing, Advertising, Guidance, and Supervision of Business Actors in Electronic Commerce has significantly impacted the landscape, notably resulting in the closure of TikTok Shop in 2023. This research seeks to explore the legal foundation underlying the prohibition of social commerce platforms from conducting trade transactions, as stipulated in MOT 31/2023, and to examine the concept of legal compliance in trade through the lens of Umar bin Khattab’s legal principles. The study employs a normative-juridical approach, framed by the theory of legal compliance. The findings reveal that the restriction on social commerce platforms from facilitating payment transactions on their own platforms is intended to mitigate conflicts of interest in electronic transactions. Furthermore, adherence to the legal principles of trade, as outlined by Umar bin Khattab, is regarded as fundamentally crucial and must be upheld within the framework of trade ethics

Abstract

Undang-Undang Nomor 16 Tahun 2019 menetapkan usia minimal menikah bagi pria dan wanita adalah 19 tahun, sebuah langkah penting dalam perlindungan keturunan (Hifdzul al-Nasl) sesuai dengan Maqashid al-Syariah. Penelitian ini mengeksplorasi tantangan dan peluang dalam implementasi kebijakan ini dari perspektif Hifdzul al-Nasl. Berdasarkan analisis kebijakan dan tinjauan literatur, tantangan utama meliputi resistensi budaya, keterbatasan akses pendidikan, dan masalah ekonomi. Namun, kebijakan ini juga menawarkan peluang signifikan untuk meningkatkan kesehatan reproduksi, kesejahteraan anak, dan stabilitas keluarga, serta mengurangi angka pernikahan anak. Implementasi yang efektif memerlukan pendekatan holistik yang mencakup sosialisasi nilai-nilai islami, penguatan regulasi, dan peningkatan akses layanan kesehatan serta pendidikan. Dengan demikian, penyamaan usia perkawinan diharapkan dapat mendukung terciptanya generasi yang sehat dan keluarga yang sejahtera, sejalan dengan tujuan syariah untuk melindungi keturunan.

Abstract

Perlindungan terhadap anak pada suatu masyarakat bangsa merupakan tolak ukur peradaban bangsa tersebut, karenanya wajib diusahakan sesuai dengan kemampuan nusa dan bangsa. Karena perlindungan anak merupakan suatu tindakan hukum yang berakibat hukum. Sebagai pendidik orang tua bertanggung jawab untuk memciptakan lingkungan pengasuhan yang dapat memberikan rasa aman dan nyaman kepada anak. Berdasarkan tanggung jawab tersebut maka orang tua harusnya menjadi suri tauladan yang baik untuk anaknya sendiri, namun tanggung jawab itu tidak akan bisa dipenuhi kalau orang tuanya menjadi pencuri, pejudi, pemabuk, dan melakukan tindakan-tindakan yang tercela salah satunya yaitu terlibat dengan narkoba misalnya menjadi pecandu narkoba. Jenis penelitian ini adalah Normatf Empiris dengan pendekan Statute Approach dan Comparative Approach. Pendekatan data dilakukan melalui studi pustaka dan wawancara. Hasil penelitian ini menunjukkan bahwa Penerapan Undang-undang perlindungan anak di Indonesia sudah berjalan sebagaimana mestinya, walaupun masih ada yang tidak sejala atau sesuai dengan peraturan perundang-undangan. Tidak ada peraturan perundang-undangan yang mengatur tentang anak dari orang tua pecandu narkoba. Orang tua yang pecandu narkoba memiliki dampak kepada anak, baik dari segi ekonomi keluarga, pendidikan anak, bahkan kesehatan anak baik fisik maupun psikis anak. Dalam maqashid syariah perlindungan anak dari orang tua pecandu narkoba ini masuk kedalam al-Daruriyyat al-Khams yang meliputi Agama (hifz ad-din), Jiwa (Hifz ad-nafs), Keluarga dan keterunan (an-nasabu wa al-aradu), Akal (hifz ‘aql), Harta (hifz al-mal). Kategori ad-Daruriyyah al Kham ini ialah sesuatu yang tidak boleh tidak ada (harus ada) demi tegaknya kebaikan dan kesejahteraan, baik yang menyangkut urusan ukhrawi maupun duniawi. Jika aspek ini  tidak ada, maka tidak dapat terwujud kehidupan duniawi yang tertib dan sejahtera, bahkan yang terwujud ialah kehidupan duniawi yang berantakan (chaos) dan kehidupan ukhrawi yang menderita dan celaka.  Upaya perlindungan hukum yang dapat diberikan kepada anak dari orang tua pecandu narkoba adalah dengan berupa pendampingan dan menentukan hak asuh anak agar tidak jatuh kepada orang tua yang tidak bertanggung jawab. Jadi perlindungan yang dapat diberikan yaitu pengasuhan anak yang baik dan nafkah anak agar anak yang orang tuanya pecandu narkoba itu tidak terurus dan terlantar..

Abstract

Penelitian  ini bertujuan untuk mengetahui bagaimana ketentuan hukum dalam ijtima' ulama komisi fatwa se-Indonesia dalam memberikan perlindungan hukum terhadap data pribadi nasabah. Penelitian ini adalah yuridis normatif dengan pendekatan konseptual. Teori yang digunakan adalah teori kepatuhan hukum, karena dengan menempatkan fatwa sebagai objek yang mengatur perilaku dalam beragama. Penelitian ini menggunakan pendekatan bibliografi untuk pengumpulan data, serta mengumpulkan informasi sekunder dari berbagai sumber, seperti putusan pengadilan, undang-undang, peraturan, buku dalam koleksi pribadi dan perpustakaan, artikel surat kabar dan majalah, jurnal online, dan makalah ilmiah. Penelitian ini menghasilkan berdasarkan hasil Ijtima Ulama Komisi Fatwa Se-Indonesia membuat ketentuan hukum mengenai perlindungan data pribadi yang mana aturan tersebut berisi tentang pinjaman online bahwa dilarang memberikan ancaman fisik atau membuka rahasia (aib) seseorang yang tidak mampu membayar hutang.

Abstract

Each husband and wife has the right to file for divorce in the Religious Court in accordance with Government Regulation Number 9 Article 19 Letter C of 1975 and Compilation of Islamic Law Number 1 Article 116 of 1991 concerning the grounds for divorce. This is stated in the judgment of the Religious Court of Lubuk Pakam Number 2612/Pdt.G/2019/PA-Lpk. The plaintiff is NL residing in Deli Serdang Regency, and the defendant is MSHN residing in Class II B Lubuk Pakam Penitentiary. It is explained in the case summary that the plaintiff and the defendant entered into marriage on February 12, 2017, and were blessed with 2 (two) children. Initially, the plaintiff's and defendant's household was harmonious and peaceful, but on April 27, 2018, the defendant was detained by the police and sentenced to 9 (nine) years in prison for the crime of "Unauthorized mediation of the sale and purchase of Class I Narcotics in non-plant form" based on the verdict of the Lubuk Pakam District Court Number 1809/Pid.Sus/2018/PN-Lbp dated October 1, 2018, and is currently incarcerated in the Class II B Lubuk Pakam Penitentiary. In the Religious Court of Lubuk Pakam, the process of implementing the default judgment was carried out in a single session during the first hearing scheduled by the Religious Court. This one-session implementation of the default judgment was only known to the Religious Court and some of the lawyers, as the community and students considered the court process to involve at least two hearings. Therefore, this research has three main issues. The results of the research and analysis of judgment Number 2612/Pdt.G/2019/PA-Lpk, and direct interviews conducted with the activist judges at the Religious Court of Lubuk Pakam, lead the author to conclude that the process of implementing the default judgment in judgment Number 2612/Pdt.G/2019/PA-Lpk at the Religious Court of Lubuk Pakam

Abstract

This study aims to find out the dowry law in fuqaha studies. Knowing the provisions of Mahar Broh in the marriage of the Acehnese Singkil community. As well as to know the law of dowry broh according to Islamic law. This research uses qualitative type research methods with an ethnographic approach, to try to reveal and study a phenomenon in the Aceh Singkil region. This study used observational data collection techniques, interviews and documentation. This research data analysis technique uses data reduction, data presentation and data verification / conclusions. The results of this study show that (1) Fuqaha has agreed that dowry is a condition of validity for marriage  and no consent should be made to abolish it, Islamic Law has stipulated that the giving of dowry from a husband to his wife is mandatory in marriage. The size of the dowry is not limited. The dowry can be one thousand or a billion, but it can also be one hundred or fifty thousand rupiah, it can even be with a ring made of iron as long as the prospective wife likes and sincerely accepts it. (2) The provision of dowry with a dowry in the form of a dowry in the form of goods (gold) for which payment is suspended, there must be a guarantee in the form of a piece of land equal to the agreed amount of dowry. And the male party must pay off the dowry before the specified time limit, when the dowry is not paid then automatically the broh becomes the full property of the wife. (3) The giving of dowry in the marriage of the Aceh Singkil community can be a legal basis through several things, the dowry must be repaid before the promised time passes, A piece of land that is broh as a guarantee for dowry must be equivalent to the amount of dowry mentioned when contracting, only in the area of Aceh Singkil Regency because the community continues to preserve this culture. and legally Islam is better off going back to the Qur'an and Hadith

Abstract

This research aims to answer the analysis of the Sigli Syariah Court Judge's views on Circular Letter of BIMAS Ministry of Religious Affairs of Indonesia (Surat Edaran BIMAS Islam Kementerian Agama RI) on Marriage During the Wife's Iddah Period. In 2021, the Islamic Community Guidance of the Indonesian Ministry of Religion issued Circular Letter Number: P-005/DJ.III/Hk.00.7/10/2021 concerning Marriage During the Wife's Iddah Period. In the provisions of letter E number 3 of the Circular Letter, it is stipulated that a man's ex-husband can marry another woman after his ex-wife's iddah period has been completed because it is feared that covert polygamy will occur. Interestingly, in the statutory provisions, there are no provisions relating to the prohibition on a man's ex-husband marrying another woman while he is still in his ex-wife's iddah period. This research is empirical legal research with a qualitative approach, and data collection in this research uses observation, interview techniques, and then analysis. This research found that, in Islamic law, there is no provision for an iddah period for men, and a man does not have to wait for the end of his ex-wife's iddah period if he wants to marry another woman. Sigli Syariah Court Judge argued that the Circular Letter No. P-005/DJ.III/Hk.00.7/10/2021 is in line with the al-maslahah al-ammah theory because it contains beneficial values and aims to avoid hidden polygamy. The value of the benefits contained in the circular letter will be properly realized if formal laws are followed.
