Abstract

Forests are one of the natural resources that are used by communities around the forest to support their lives, including the Indigenous Peoples. However, in forest utilization various tenure conflicts are often encountered, such as claims over forest areas. Forest management by communities living around the forest is often in conflict with government policies. After the issuance of the Constitutional Court Decision No.35/PUU-X/2012 it was a form of acknowledgment of Indigenous Peoples in managing forests and designating customary forests as forests within the territory of Indigenous Peoples. In line with the Constitutional Court's decision, the government then launched a Social Forestry program in order to improve people's welfare through forest management. One of the Social Forestry schemes that is the focus of this research is the management of Village Forests (Nagari Forest), which in this case is given to the Indigenous Peoples. There is still a delay in the management permit process because it has to be submitted to the Ministry. Besides that, there are still various tenurial conflicts in forest areas. Based on what was stated, the researcher is interested in examining how the management of Nagari Forest is based on the Social Forestry scheme by Indigenous Peoples, how is the licensing and management of Nagari Forest based on the Social Forestry scheme by Indigenous Peoples, and formulating a pattern of managing Nagari Forest based on the Social Forestry scheme by Indigenous Peoples.

Abstract

The people of Padang Pariaman, who are so diverse in culture, certainly have the potential to be influenced by foreign cultures in the era of globalization and modern developments at this time, Padang Pariaman culture broadly consists of religion or belief, a system of community organizations, a system of knowledge (education), language, arts, livelihood systems. This is what contains a lot of local wisdom in it. In the current condition, culture is starting to be abandoned, even some Indonesian people are ashamed of their culture as a nation's identity. The differences that occur in Indonesian culture are due to different growth processes and influences from other cultures that mix in it. The sharing of laws also mentions culture and indigenous peoples, including in Article 1 paragraph (3) of Law No. 5 of 2017 concerning the Advancement of Culture, the promotion of culture is an effort to increase cultural resilience and Indonesia's cultural contribution to the midst of world civilization.

Abstract

Sale and purchase binding agreement, of course, a notary can provide legal counseling, namely by explaining to the parties, that the binding sale and purchase agreement made should be based on a land certificate, because the ownership of a certificated land right has been registered at the Land Office which has legal certainty, protection law and can prove himself as the holder of the land rights. However, in practice, the binding sale and purchase agreement in Kampar Regency is made using a letter of compensation (SKGR) so it is very straightforwardproblems to occur which can cause losses. The method used is empirical juridical which emphasizes the reality in the field associated with legal aspects or applicable laws and regulations regarding the object of research. The binding sale and purchase agreement should be made using a land certificate instead of using a letter of compensation and based on its authority the notary should be able to provide legal counseling to the parties before the binding sale and purchase agreement is made so that the urgent sale and purchase agreement can be carried out properly.

Abstract

The purpose of this study was to determine and analyze the agricultural land production sharing agreement system that applies in Rangsang Barat District. What are the influencing factors in determining the choice of the implementation system for the Production Sharing agreement? As well as the legal consequences arising from the implementation of the agreement for the results of agricultural land in Rangsang Barat District, Islands Regency. The research method used is an empirical juridical approach. Then the data collected were analyzed qualitatively. From the results of the research, it was found that the implementation of the rice farming yield sharing agreement carried out in Rangsang Barat District, Islands Regency was not by Law Number 2 of 1960 concerning Production Sharing Agreements so the implementation of the rice farming production sharing agreement had not gone well. good and not effective.

Abstract

Masih banyaknya ketidaksesuaian atau penyimpangan dalam pengelolaan keuangan daerah yang ditemukan pada Pemerintah Kabupaten Kuantan Singingi berdasarkan hasil pemeriksaan BPK. Seharusnya dengan adanya Inspektorat Daerah Kabupaten yang melaksanakan fungsi pengawasan, penyimpangan atau ketidaksesuaian pengelolaan keuangan daerah tersebut dapat dicegah atau diminimalisir. Penelitian ini bertujuan untuk mengetahui dan menjawab permasalahan pelaksanaan fungsi pengawasan Inspektorat Daerah Kabupaten Kuantan Singingi terhadap akuntabilitas pengelolaan keuangan daerah dan bagaimana tindak lanjut dari hasil pemeriksaan inspektorat daerah terhadap pengelolaan keuangan daerah melalui rekomendasi oleh Badan Pemeriksa Keuangan. Metode yang digunakan dalam penelitian ini adalah metode yuridis empiris yang dilakukan langsung di lapangan yang bertitik tolak pada data primer yang diperoleh langsung melalui wawancara dan kuesinoer kepada pihak yang kompeten dan relevan. Tujuannya adalah guna memperoleh pemahaman dan kejelasan dari permasalahan dari permasalahan yang diteliti berdasarkan praktik yang selama ini berlansung. Hasil penelitian menunjukkan Untuk mengetahui dan menganalisis pelaksanaan fungsi pengawasan Inspektorat Daerah Kabupaten Kuantan Singingi terhadap akuntabilitas pengelolaan keuangan daerah serta tindak lanjur hasil pemeriksaan pasca rekomendasi dari Badan Pemeriksa Keuangan. Hal tersebut antara lain disebabkan dalam pelaksanaan fungsi pengawasan, Inspektorat Daerah Kabupaten Kuantan Singingi masih menghadapi kendala-kendala seperti kuantitas dan kualitas sumber daya manusia yang belum memadai,rendahnya komitmen dalam penyelesaian tindak lanjut, penggunaan sistem informasi hasil pemeriksaan yang belum optimal dan belum adanya sanksi terkait tindak lanjut.

Abstract

Pengelolaan kekayaan negara diatur di dalam Pasal 23 sampai dengan Pasal 23D Undang-Undang 1945. Pengaturan keuangan negara tidak lepas dari tanggung jawab pemeriksaan BPK sebagaimana dijelaskan dalam Undang-Undang Nomor 15 Tahun 2004 tentang Pemeriksaan Pengelolaan dan Tanggung Jawab Keuangan Negara. Pemeriksaan yang dilakukan BPK terhadap laporan keuangan yang disusun oleh pemerintah daerah menghasilkan temuan yang harus ditindaklanjuti berdasarkan rekomendasi BPK. Berdasarkan hasil pemeriksaan BPK pada tahun anggaran 2020-2021 ada beberapa temuan dengan total kerugian sebanyak Rp.1,2 Triliun. Tentu saja ini menimbulkan kewajiban bagi pejabat daerah untuk menindaklanjuti rekomendasi BPK berdasarkan temuan yang ada dengan melengkapi dokumen tindak lanjut. Maka dari itu, penelitian difokuskan pada satu permasalahan yaitu mengapa sebagian pejabat pemerintah daerah tidak menindaklanjuti rekomendasi hasil pemeriksaan BPK Provinsi Sumatera Barat. Hal itu disebabkan kurangnya respon keaktifan dari pejabat pemerintah daerah sehingga masih banyaknya dokumen tindak lanjut yang belum dilengkapi dan kurangnya komitmen untuk kerja sama antara pejabat BPK dengan pejabat pemerintah daerah yang berwenang untuk menyelesaikan rekomendasi BPK.

Abstract

This paper examines the legal certainty of state administrative dispute resolution in taking governmental measures. How is the existence of administrative efforts? What is the judge's legal consideration of not carrying out administrative effort? The results of this study indicate that administrative efforts must be made consisting of administrative objections and appeals unless otherwise stipulated by a law. Based on the judge's legal considerations regarding state administration disputes that do not and/or take administrative measures but are not in accordance with the provisions of Law Number 30 of 2014 concerning Government Administration juncto Supreme Court Regulation Number 6 of 2018 concerning Guidelines for the Settlement of Government Administrative Disputes After Taking Administrative Efforts then the lawsuit is declared not accepted (niet ontvankelijkverklraad).

Abstract

Kabupaten Agam adalah salah satu daerah di Sumatera Barat yang memiliki kawasan hutan yang cukup luas namun juga dengan pertumbuhan penduduk cukup pesat sehingga pada awal mulanya masyarakat menempati suatu kawasan hutan tersebut melalui peruntukkan tanah ulayat nagari dan kemudian diberikan kepada masyarakat dan masyarakat mendaftarkan tanah mereka sebagai hak milik. Seiring berjalannya waktu, pemerintah menetapkan tanah masyarakat tersebut sebagai kawasan hutan lindung padahal masyarakat telah dahulu memperoleh sertipikat hak milik terhadap lahan mereka, sehingga masyarakat yang telah memiliki sertipikat hak milik atas tanah menjadi tidak dapat menggunakan hak mereka sepenuhnya. Akibat permasalahan yang terjadi ini, ketika masyarakat akan melakukan proses peralihan hak nya terkait dengan jual beli, hibah dan lainnya serta dalam melakukan pembebanan hak tanggungan kepada bank dan bank selaku kreditur dan akan menolak pemberian pinjaman jika sertipikat hak milik berada didalam kawasan hutan lindung.

Abstract

Peraturan Mahkamah Agung No 7 Tahun 2022 tentang Perubahan Peraturan Mahkamah Agung No. 1 Tahun 2019 tentang Administrasi Perkara dan Persidangan di Pengadilan secara Elektronik mengatur proses beracara di pengadilan dengan sistem elektronik. Pengadilan Agama Padang sebagai salah satu lembaga peradilan yang berada di bawah Mahkamah Agung harus menjalankan kebijakan Mahkamah Agung disusul dengan Surat Keputusan Ketua Mahkamah Agung Nomor 363/KMA/SK/XII/2022 tentang Petunjuk Teknis Administrasi Dan Persidangan Perkara Perdata, Perdata Agama, dan Tata Usaha Negara di Pengadilan Secara Elektronik. Penelitian ini merupakan penelitian hukum dengan spesifikasi penelitian yang bersifat deskriptif analitis. Pendekatan yang digunakan adalah pendekatan yuridis normatif sebagai pendekatan utama, didukung pendekatan yuridis empiris. Data yang digunakan adalah data primer sebagai data utama dan data sekunder sebagai data pendukung yang dikumpulkan melalui studi lapangan dengan teknik wawancara dan studi kepustakan. Data tersebut kemudian dianalisis secara kualitatif dan disajikan dalam bentuk deskriptif kualitatif.

Abstract

Forests are a natural resource used by communities around the forest to support their lives, including the Customary Law Community or Masyarakat Hukum Adat (MHA). However, various tenurial conflicts are often encountered in forest utilization, such as claims over forest areas. The basis of the problem, which then causes the community around the forest, often conflicts with government policies. However, the issuance of Constitutional Court Decision No.35/PUU-X/2012 provides a form of recognition to MHA in managing forests and determines customary forests as the forest within the territory of MHA. This research will focus on two issues: first, how is the recognition and determination of customary forest by MHA after the presence of the Constitutional Court Decision No.35/PUU-X/2012. Second, how are efforts to recognize and determine customary forests through social forestry schemes in the Province of West Sumatra. To answer the focus of the study, this study used normative juridical research methods with descriptive research specifications and analyzed them through library research.
