Abstract

Proyek Strategis Nasional (PSN) bertujuan untuk meningkatkan kwalitas serta sarana prasana infrastruktur Indonesia dengan cepat untuk dapat meningkatkan effisiensi dan produktifitas perekonomian nasional. Salah satu PSN terbaru pada tahun 2024 adalah Proyek Pengembangan PIK-2 Tropical Concept. Sejak awal dimasukkan proyek ini sebagai PSN menimbulkan polemik sosial dan perdebatan ilmiah meskipun proyek ini didanai swasta dan telah memenuhi kriteria yang ditetapkan pemerintah. Permasalahan yang timbul meliputi bagaimana realisasi dari hak menguasai negara dalam pembebasan tanah untuk pembangunan, sejauh mana dampak Proyek PIK-2 bagi warga setempat yang terdampak proyek ini serta apakah aturan yang ada sudah diterapkan, tujuannya untuk mengkaji penerapan aturan pengadaan tanah untuk PSN. Menggunakan metode penelitian yuridis normatif bersifat kualitatif dengan menggali sumber dari hasil studi kepustakaan, dan menekankan pada penggunaan data primer, data sekunder, termasuk bahan hukum tersier. Kesimpulan yang diperoleh menunjukan bahwa prosedur pengadaan dan pembebasan lahan Proyek P-2 tidak sesuai dengan ketentuan peraturan yang ada dan cenderung hanya menguntungkan pihak pengembang proyek, sementara banyak masyarakat setempat yang kehilangan mata pencaharian karena digusurnya lahan persawahan mereka.

Abstract

In principle, our constitution has regulated the State’s Right to Control as reflected in the constitutional authority given to the state to regulate, manage, oversee, and control all natural resources or branches of production which are crucial for the state and affect the livelihoods of the people. Land acquisition by the Government for the implementation of the national strategic projects often encounters resistance from local communities. This resistance is not baseless, as there are losses suffered by local communities in the execution of these projects. The research applied normative legal research as the method, focusing solely on document studies, with sources of law including legislation, court decisions, contracts/agreements, legal theories, and opinions of legal scholars. The suggested solution is that land use by the Government must apply the principle of caution to prevent land degradation that could lead to natural disasters due to the construction of the Surabaya waterfront. Essentially, the state’s right to control should not be interpreted as the state’s absolute right to individually control all natural resources. Instead, its meaning is limited to actions taken by the Government in managing natural resources that must aim for the greatest welfare of the people.

Abstract

This research aims to analyze the role of the National Strategic Program in the development of toll roads in Section Harbour Road II, North Jakarta, focusing on the perspective of state sovereignty over land. The development of toll roads is crucial for enhancing urban connectivity and mobility. However, it raises concerns regarding national sovereignty over land and resources. Through comprehensive analysis, this research examines the implications of the National Strategic Program on state land sovereignty in the context of toll road development. The study also explores the legal framework, socio-economic impacts, and environmental considerations related to toll road projects. Furthermore, it explores strategies to mediate infrastructure development with the protection of national sovereignty and the rights of affected communities. The findings of this research provide insights for policymakers, stakeholders, and the public to navigate the complexities of toll road development within the framework of national strategic planning and state sovereignty.

Abstract

Although there are clear regulations regarding state control rights, implementation in practice often faces complex challenges. The main challenges include conflicts with local communities who have traditional rights related to land and natural resources around industrial areas. This study aims to conduct a legal analysis of the implementation of state control rights in the context of industrial development in the Kolaka Industrial Area, Southeast Sulawesi. The normative research method is a review of legal regulations governing natural resource management, industrial licensing, and environmental protection. With a literature study approach to collect data from various legal sources and related literature. The results of the study show that the implementation of state control rights in practice faces complex challenges, including conflicts with local communities who have traditional rights related to land and natural resources. Community participation in the decision-making process is key to avoiding social conflict and ensuring the sustainability of industrial projects. The conclusion of this study underlines the importance of wise and transparent management by the government in implementing state control rights, so that it can integrate national, social, and environmental interests in a balanced manner in industrial development in Southeast Sulawesi.

Abstract

The development of the Stargate Astra Industrial Estate (KISA) in Southeast Sulawesi has garnered significant attention as part of Indonesia's government initiative to strengthen regional economy through a national strategic project. This study aims to critically analyze the implementation of KISA while considering state sovereignty in the context of natural resource management policies and regional development. The research employs a mixed-methods approach combining qualitative and quantitative analyses to explore the economic, social, and environmental impacts, as well as the implications for community rights in KISA development. Literature review emphasizes the need for balance between economic development and environmental conservation, as well as the importance of social sustainability in industrial area development processes. The analysis findings indicate that KISA development holds substantial potential to enhance local economic growth through job creation and infrastructure improvements. However, the project implementation also presents challenges related to sustainable environmental management and inclusive social integration. Therefore, recommendations include rigorous law enforcement, active community participation in decision-making, and effective risk mitigation strategies. This study aims to provide deep insights to policymakers, developers, and communities on the importance of considering state sovereignty in every step of implementing national strategic projects like KISA. Thus, ensuring sustainable economic growth without compromising environmental sustainability and local community welfare in Southeast Sulawesi.

Abstract

This research endeavors to assess the impact of additional practicum sessions and experimental demonstrations through video presentations on students' comprehension in an Islamic boarding school. The study focuses on enhancing students' understanding of the biochar concept, particularly its role as an adsorbent, aligning with contemporary issues related to the Sustainable Development Goals (SDGs) and environmental problem-solving. To substantiate the research rationale, a concise literature review and bibliometric analysis were incorporated. The experiment involved comparing two classes – the experimental class, which received additional practicum and experimental demonstrations using videos, and the conventional class as the control group. The study included 45 students in Class XI of an Islamic boarding school. Learning outcomes were assessed through pre-test and post-test scores, as well as N-Gain calculations. The hypothesis was tested using the Paired Sample T-test. The practical aspect of the experiment involved carbonizing the skin of jengkol fruit to produce carbon, which was then utilized for adsorbing curcumin. The adsorption phenomena were observed and analyzed.The research findings demonstrated that the experimental demonstration method, particularly when complemented with video presentations, was more effective than conventional methods. This was evident from the N-Gain value of the experimental class and the results of statistical tests. The experimental demonstration method using videos is anticipated to enhance knowledge, provide a more authentic understanding and experience, and yield superior learning outcomes. These findings contribute valuable insights for future research on experimental demonstrations, emphasizing their potential to enhance the overall quality of student learning.

Abstract

Air pollution is a critical issue in Indonesia in 2023, prompting the need to enhance green skills within Vocational High Schools to support a sustainable green economy. The purpose of this study is to investigate the influence of Islamic values on the development of green skills among students. Utilizing quantitative methods, data were collected through online questionnaires distributed to 562 twelfth-grade students at the Islamic Foundation Vocational School in Bogor Regency. The results revealed that Islamic values, particularly beliefs and attitudes towards the environment, significantly impacted the acquisition of green skills. Further analysis identified that Islamic values as a source of inspiration and serenity, along with teachings on tree planting and zero-waste practices, had a partially significant effect. The study concludes that incorporating Islamic religious education into the vocational school curriculum is crucial. These findings offer valuable insights for educators, policymakers, and practitioners, providing a basis for integrating Islamic values into vocational education to enhance green skill development among students.

Abstract

This study examines the behavioral dynamics and social interactions of Muslim school communities by situating them within the ethical framework of the Qur’an and the teachings of the Prophet Muhammad. Although numerous studies have highlighted the importance of school climate and social relations in shaping educational outcomes, limited attention has been given to how Islamic values concretely inform these processes within Muslim educational contexts. To address this gap, a qualitative case study approach was employed, focusing on patterns of behavior and interaction in Muslim school communities. Data were collected through observation, interviews, and document analysis, and subsequently analyzed using a thematic analysis approach. The findings reveal that the Qur’an and Hadith serve not only as spiritual references but also as practical guidelines for cultivating a safe and supportive learning environment, strengthening teacher–student and peer relationships, and reinforcing the influence of family in students’ character formation. These interactions collectively foster a school climate characterized by harmony, inclusivity, and mutual respect. By linking Islamic normative principles with contemporary educational practices, this study underscores the role of religion as a transformative resource in promoting holistic education. The results offer valuable insights for educators, policymakers, and researchers seeking to improve the quality of Islamic education while contributing to broader discussions on values-based education in global contexts.

Abstract

This study examines property law reforms under President Prabowo's administration, particularly through the lens of his vision, Asta Cita, which emphasizes economic transformation, regulatory efficiency, and inclusive governance. Indonesia faces significant challenges in land governance, such as overlapping regulations, conflicts between customary (adat) and national laws, and weak enforcement mechanisms. The administration aims to harmonize traditional and modern legal systems, streamline land registration, and foster investor confidence. The research analyses key legislative reforms, including the Omnibus Law on Job Creation and the Basic Agrarian Law, as well as case studies on property disputes. It finds progress in digitalizing land administration and simplifying land registration, but highlights persistent issues like fragmented policy implementation, inconsistent recognition of adat rights, and inadequate dispute resolution mechanisms. The study proposes solutions such as creating a unified land registry, improving national-regional coordination, and incentivizing faster dispute resolution to enhance property law effectiveness. However, it acknowledges the speculative nature of policy predictions and the lack of empirical data on land disputes, suggesting the need for further research. By offering both theoretical and practical insights, this study contributes to the discourse on Indonesia’s property law reforms and provides actionable recommendations for policymakers, legal professionals, and investors.
