Abstract

Industri musik Indonesia berkembang pesat, menciptakan peluang ekonomi sekaligus tantangan dalam melindungi hak cipta di era digital. UU No. 28 Tahun 2014 tentang Hak Cipta hadir untuk memperkuat perlindungan ini, termasuk hak ekonomi pemegang hak cipta atas lagu. Penelitian yuridis normatif ini mengkaji syarat dan prosedur izin penggunaan lagu, kewenangan Lembaga Manajemen Kolektif (LMK), serta mekanisme penyelesaian sengketa. Hasilnya menunjukkan bahwa pengelolaan hak cipta lagu di Indonesia melibatkan proses kompleks, di mana pengguna harus mengidentifikasi pemegang hak cipta, mengajukan permohonan rinci, dan menyepakati syarat penggunaan. LMK berperan sebagai perantara dengan kewenangan non-eksklusif dalam pemberian lisensi blanket dan pengelolaan royalti. UU No. 28 Tahun 2014 menyediakan berbagai opsi penyelesaian sengketa, dari alternatif penyelesaian sengketa hingga proses di Pengadilan Niaga, bertujuan memberikan perlindungan hukum efektif bagi pemegang hak cipta sambil mendorong penyelesaian damai. Sistem ini dirancang untuk menyeimbangkan kepentingan pencipta, pengguna, dan industri musik secara keseluruhan.

Abstract

Penelitian ini mengkaji penyelesaian sengketa merek yang berkaitan dengan pewarisan, dengan studi kasus Putusan Pengadilan Niaga pada Pengadilan Negeri Medan No. 5/Pdt.Sus-HKI/Merek/2019/PN.Niaga.Mdn. Permasalahan dalam penelitian ini mencakup pengaturan peralihan hak atas merek dikarenakan pewarisan, pelaksanaan peralihan hak atas merek obat gosok/minyak urut “Nurhayati”, dan analisis penyelesaian sengketa berdasarkan putusan Pengadilan Niaga terkait merek tersebut. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan deskriptif-analisis. Sumber data utama adalah Undang-Undang No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis, Peraturan Menteri Hukum dan Hak Asasi Manusia RI No. 67 Tahun 2016 tentang Pendaftaran Merek, serta putusan Pengadilan Niaga terkait. Data dianalisis secara kualitatif dengan pendekatan deduktif-induktif. Hasil penelitian menunjukkan bahwa pengaturan peralihan hak atas merek memberikan kepastian hukum dan pelindungan hukum yang memadai bagi ahli waris, asalkan prosedur administratif yang ditetapkan diikuti dengan benar. Studi kasus menunjukkan pentingnya pencatatan pengalihan hak untuk mendapatkan pelindungan hukum.

Abstract

This research aims to understand the implementation of Law Number 28 of 2014 in addressing pirated book sales on Shopee. This study uses an empirical legal research method, adopting a virtual ethnographic approach to understand the legal behavior of internet users. The results show that the implementation of Law Number 28 of 2014 in addressing the sale of pirated books on Shopee is still not optimal, especially regarding monitoring and law enforcement. Effective law enforcement is necessary to strengthen copyright protection and restore losses that have occurred, including removing illegal content, civil lawsuits, and applying criminal fines as consequences for negligence. Therefore, it is recommended that various parties selling books on Shopee enhance their copyright protection efforts. First, Shopee should proactively improve its monitoring system to identify and remove infringing content before transactions occur. Second, Shopee sellers should ensure that their products comply with copyright requirements. Third, consumers should raise their awareness of the importance of purchasing legitimate products and support copyright protection efforts by reporting pirated books they find on the marketplace. Lastly, copyright holders are advised to actively monitor the distribution of their work and collaborate with marketplaces like Shopee to prevent copyright infringements and utilize available legal mechanisms to take action against violations. Through coordinated cooperation among all these parties, a fairer and more just environment in the digital market can be expected.

Abstract

E-commerce trade has become a reality in today's technology-driven society. This type of trade has undoubtedly brought changes to the system of buying and selling goods, especially in terms of contracts or agreements. E-commerce agreements tend to implement what is known as Standard Clauses. Standard Clauses in agreements are generally not allowed to include certain conditions that could harm the public, which is why they are regulated under Law Number 8 of 1999 concerning Consumer Protection as the legal basis for ensuring the rights and obligations of the parties involved. Therefore, it is necessary to investigate this issue. This thesis is titled “Legal Protection for Consumers Regarding Standard Clauses in Electronic Contracts Between Consumers and E-commerce Parties (Case Study on E-commerce Shopee)”. The problem statements in this thesis are: 1) How is the implementation of Standard Clauses in electronic contracts in Indonesia? 2) How is the law applied in e-commerce transactions involving electronic contracts that include standard clauses and what are the legal consequences for consumers and business actors? 3) What are the responsibilities and dispute resolution mechanisms for business actors towards consumers if there is a discrepancy in the electronic contract in e-commerce transactions? The method used in writing this thesis is normative juridical research, which is legal research that examines library materials or secondary data as the basic material to be studied, while its nature is descriptive analytical. The research approach used is the statute approach. The data analysis method used is a qualitative method obtained from research on the study object, which is in the form of contracts or agreements linked to the prevailing laws and regulations. The research findings indicate that the application of Standard Clauses in contracts/agreements in e-commerce still has issues, particularly in cases of default. These issues occur in the form, timing, and quality of the goods being traded, causing consumers to sometimes be dissatisfied with the purchased goods. For these issues, there are mechanisms for business actors to be responsible for compensation as regulated in the Consumer Protection Act (UUPK), and there are three (3) consumer dispute resolution efforts, namely efforts outside the court such as mediation and negotiation, through BPSK, and efforts through the court such as filing lawsuits and others.

Abstract

Abstrack: The current development of information and communication technology has led humans to use the assistance of Generative AI (artificial intelligence) technology to produce various new works, including cinematographic works circulating on social media. However, the emergence of Generative AI has raised new legal issues, because in its use many works have the potential to violate copyright, especially when this technology is used to modify cinematographic works owned by other parties on social media platforms. This study aims to analyze legal certainty, the form of legal liability for the use of Generative AI, and review the form of legal protection for cinematographic works modified using Generative AI on social media without permission. This research is a normative juridical legal research with a descriptive analytical nature. The data used are secondary data consisting of primary, secondary, and tertiary legal materials. Data collection techniques and data were carried out through literature studies. Data analysis used normative analysis methods. The results of the study indicate that legal certainty in the use of Generative AI is currently still not achieved because the Copyright Law is still oriented towards humans as creators. The forms of legal liability that can be applied include civil, criminal, and administrative aspects, while legal protection is provided preventively through takedown mechanisms and repressively through compensation lawsuits and criminal sanctions. The conclusion of this study is that the protection of copyright in cinematographic works for the use of Generative AI on social media platforms creates legal uncertainty that needs to be addressed immediately through regulatory updates and strengthening copyright enforcement policies in the digital era. The formation of specific regulations regarding liability for works involving Generative AI technology is an important step towards realizing legal certainty, justice, and benefits for all parties involved.Keyword: Copyright, Cinematographic Works, Generative AI, Social Media, Legal Protection.Abstrak: Perkembangan teknologi informasi dan komunikasi saat ini membuat manusia menggunakan bantuan teknologi AI Generatif (kecerdasan buatan) dalam menghasilkan berbagai karya baru, termasuk karya sinematografi yang beredar di media sosial. Namun, kemunculan AI Generatif telah menimbulkan persoalan hukum baru, karena dalam penggunaannya banyak karya yang berpotensi melanggar hak cipta terutama ketika teknologi ini digunakan untuk memodifikasi karya sinematografi milik pihak lain di platform media sosial. Penelitian ini bertujuan untuk menganalisis kepastian hukum, bentuk tanjung jawab hukum atas penggunaan AI Generatif serta meninjau bentuk perlindungan hukum terhadap karya sinematografi yang dimodifikasi menggunakan AI Generatif di media sosial tanpa izin. Penelitian ini adalah penelitian hukum yuridis normatif dengan sifat penelitian dekskriptif analitis. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Teknik dan pengumpulan data dilakukan dengan studi kepustakaan. Analisis data menggunakan metode analisis normatif. Hasil penelitian menunjukkan bahwa kepastian hukum dalam penggunaan AI Generatif saat ini masih belum tercapai karena dalam UUHC masih berorientasi pada manusia sebagai pencipta. Bentuk tanggung jawab hukum yang dapat diterapkan meliputi aspek perdata, pidana serta administratif, sementara perlindungan hukum diberikan secara preventif melalui mekanisme takedown dan represif melalui gugatan ganti rugi maupun sanksi pidana. Kesimpulan dari penelitian ini adalah pelindungan hak cipta karya sinematografi atas penggunaan AI Generatif di platform media sosial menimpulkan ketidakpastian hukum yang perlu segera diatasi melalu pembaruan regulasi dan penguatan kebijakan penegakan hak cipta di era digital. Pembentukan aturan khusus mengenai tanggung jawab atas karya yang melibatkan teknologi AI Generatif menjadi langkah penting untuk mewujudkan kepastian, keadilan dan kemanfaatan hukum bagi seluruh pihak terkait.Kata kunci: Hak Cipta, Karya Sinematografi, AI Generatif, Media Sosial, Pelindungan Hukum.

Abstract

Abstract: The problem in this study stems from the existence of unfair business competition arising from trademark registration applications in bad faith. The element of good faith has an important role in the trademark legal system in Indonesia to prevent disputes in the future. This study specifically analyzes the trademark dispute in the Medan District Court Decision Number 4 / Pdt.Sus-HKI / Merek / 2019 / PN Niaga Medan, which involves the registration of the KANDUI and KANDUI VILLAS trademarks by the defendant, even though the trademark has been previously used by the plaintiff, even the defendant himself is a manager at the plaintiff's lodging business. This study uses a normative juridical method with a statutory approach and a case approach. The issues studied include: (1) legal protection of trademarks according to the principle of good faith to prevent unfair business competition; (2) indications of unfair business competition practices in the KANDUI trademark dispute; and (3) the suitability of the judge's considerations in the decision with Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The results of the study indicate that the judge in the decision only emphasized the first to file principle as regulated in Article 3 of Law Number 20 of 2016, but was inconsistent with his considerations which had acknowledged the relevance of the first to use principle. In addition, the judge did not thoroughly examine the defendant's bad faith as stated in the plaintiff's petitum. Thus, although the judge's decision was formally in accordance with regulations, there were still weaknesses in upholding the principle of good faith which is an important instrument to prevent unfair business competition in the trademark legal regime.Keyword: Business competition, Brand, Bad faith Abstrak: Permasalahan dalam penelitian ini berangkat dari adanya persaingan usaha tidak sehat yang timbul akibat permohonan pendaftaran merek dengan iktikad tidak baik. Unsur iktikad baik memiliki peran penting dalam sistem hukum merek di Indonesia agar tidak menimbulkan sengketa di kemudian hari. Penelitian ini secara khusus menganalisis sengketa merek pada Putusan Pengadilan Negeri Medan Nomor 4/Pdt.Sus-HKI/Merek/2019/PN Niaga Medan, yang melibatkan pendaftaran merekKANDUIdanKANDUI VILLASoleh tergugat, padahal merek tersebut telah lebih dahulu digunakan oleh penggugat, bahkan tergugat sendiri merupakan pengurus pada usaha penginapan milik penggugat. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Permasalahan yang dikaji meliputi: (1) perlindungan hukum terhadap merek menurut prinsip iktikad baik untuk mencegah persaingan usaha tidak sehat; (2) indikasi praktik persaingan usaha tidak sehat dalam sengketa merekKANDUI; serta (3) kesesuaian pertimbangan hakim dalam putusan tersebut dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Hasil penelitian menunjukkan bahwa hakim dalam putusan tersebut hanya menekankan asasfirst to filesebagaimana diatur dalam Pasal 3 Undang-Undang Nomor 20 Tahun 2016, namun tidak konsisten dengan pertimbangannya yang sempat mengakui relevansi asasfirst to use. Selain itu, hakim tidak secara mendalam mengkaji iktikad tidak baik tergugat sebagaimana petitum penggugat. Dengan demikian, meskipun putusan hakim secara formil sesuai dengan regulasi, namun masih terdapat kelemahan dalam menegakkan prinsip iktikad baik yang menjadi instrumen penting untuk mencegah persaingan usaha tidak sehat dalam rezim hukum merekKata Kunci : Persaingan usaha, Merek, Iktikad tidak baik

Abstract

Micro, Small, and Medium Enterprises (MSMEs) as small-scale industries tend to ignore the importance of intellectual property protection, particularly evident in the minimal registration of MSME trademarks with the Directorate General of Intellectual Property. Although the World Intellectual Property Rights (WIPO) recognizes the potential of MSMEs to drive product innovation and creativity, MSME awareness of the use of Intellectual Property Rights remains low. This study uses a normative legal research method, focusing on the study of legal provisions related to MSME trademark registration and protection. A descriptive analytical approach is used to identify and resolve existing legal issues, with reference to relevant laws and regulations. Trademark registration is considered the basis for rejecting similar trademarks filed by other parties for similar goods or services. The "first to file" principle applies in Indonesia, which grants exclusive rights to the first registrant for 10 years. Efforts to increase MSME legal awareness of the importance of trademarks, particularly through registration, are crucial. Legal counseling can be an effective means to increase public understanding, by emphasizing the legal protection and legal certainty provided by trademark registration. The importance of legal counseling as a strategy to increase legal awareness among MSMEs in registering their trademarks needs to be considered. This awareness can ensure that MSMEs understand the importance of brands to their businesses and can manage them legally to maintain their protection. This study recommends the need for further provision and understanding through legal counseling to ensure better legal awareness among MSMEs.
