Abstract

Micro, small and medium enterprises (MSMEs) are one of the drivers of the Indonesian economy. Along with the times and technology, it causes business actors to develop more in all respects, especially finance. One of the most important parts of a business is good financial records. Business actors who do not have neat and correct finances will experience a little difficulty in applying for capital or credit to banks. The lack of education and understanding they have can also be one of the causes. With this problem in mind, the government collaborated with Bank Indonesia to create a financial recording application to assist business actors in reporting their finances, namely the Si Apik application. The purpose of this writing is to find out how Si Apik's role is in optimizing the MSME financial administration so that they can have neat financial reports. The method used is to use a literature review from various sources that examines the understanding of the Si Apik application utilization. The results of the research show that preparedness has an important role in the development of MSME financial accounting literacy. However, the lack of public understanding of this application causes few users. With this, there must be socialization and training that must be carried out by the government and parties who already know how to use the Si Apik application

Abstract

Baitul Maal wa Tamwil (BMT) is a form of simple Islamic financial institution. BMT in its operational system carries out business and social activities. BMT NU Kapongan Situbondo branch is one of the BMT institutions, the application of its activities to the business sector (tamwil) can be in the form of savings or deposits and also financing activities are always based on sharia compliance, especially in funding or deposit activities at BMT NU Kapongan Situbondo branch. As for the profit sharing that will be obtained by the customer in the form of automatic money, the customer does not know for sure the amount of profit obtained from the contract. This study aims to analyze the implementation and determination of profit sharing in the mudharabah muthlaqah contract in the fathonah education savings product of BMT NU Kapongan Situbondo branch. The research method used in this study is a qualitative descriptive method. The results of the study explain that the implementation of fathonah education savings is in accordance with sharia principles in terms of fulfillment rather than contracts, this can be proven by the owner of capital giving freedom to mudharib (BMT). However, the distribution of the profit sharing ratio is not fixed because there are several things, including the small number of customers who collect their funds in fathonah education savings products and the small profit income from managed capital, causing the context of determining the profit sharing ratio not in accordance with the specified contract.

Abstract

To fulfill the halal needs of consumers or the community of Pesantren, the implementation of a Halal Supply Chain in every product is very important. Moreover, in boarding schools that offer various business units, a halal supply chain can be applied to create a halal ecosystem to foster better social change. This study is a qualitative study with a comparative approach on the objects of Darussalam Drinking Water (AMIDAS) and Khizanah Bakery (Manufacturing) and Gambia Market (Retail/Distributor), which are business units of Pondok Modern Darussalam Gontor.. The results of this study indicate that the supply chain in the PMDG business unit has been well implemented. Meanwhile, halal supply chain activities are divided into three; first, halal supply chain resources include organization, information management, physical separation, and Islamic human resources. Second, halal supply chain business processes are halal manufacturing and halal logistics. Third, the halal supply chain network for Amidas and Khizanah Gontor Bakery as producers sources materials from manufacturers, produces goods, stores them in warehouses, and distributes them to retailers, sub-retailers, and so on. Gambia as a distributor receives products from producers according to halal standards and then provides them to customers. All halal supply chain activities have been carried out in accordance with Islamic principles.

Abstract

Corruption in the taxation sector, as reflected in Decision Number 75/Pid.Sus-TPK/2023/PN Jkt.Pst, constitutes an economic crime with systemic impacts that threatens the stability of state finances, in line with the increasing number of corruption cases as indicated by Indonesia’s corruption perception index score and its global ranking. This study aimed to analyze the criminal act of tax corruption in the aforementioned decision and to examine it from the perspective of Islamic criminal law, with a focus on the concept of jarimah taʿzīr. The research employed a qualitative method with a normative juridical approach, based on primary legal materials in the form of an analysis of the court decision and secondary legal materials in the form of books, journals, scholarly articles, and other relevant literature on Islamic law and corruption. The findings show that the defendant, Rafael Alun Trisambodo, was proven legally and convincingly to have committed corruption in the form of gratuities and Money Laundering Crimes (TPPU), for which the judge imposed a prison sentence of 14 years and a fine of IDR 1,000,000,000.00 (one billion rupiah), or six months’ imprisonment in lieu thereof. From the perspective of Islamic criminal law, corruption can be classified as jarimah taʿzīr, the sanctions for which are elastic and may be determined by judicial authorities insofar as certain elements are fulfilled. Analysis of the taʿzīr sanction concept in this decision highlights the importance of considering offender rehabilitation, proportionality, and sentencing flexibility in order to protect property (Hifz al-Mal) and uphold justice. These findings are expected to encourage the imposition of more optimal sanctions to ensure deterrence and maximize the recovery of state financial losses in future tax corruption cases.
