Abstract

Gratuity is a new thing in the criminal act of corruption. Changes made to the previous regulation aim at overcoming the many modes and series of actions of civil servants and state administrators that have an impact on state financial losses and public welfare. The research method used is a normative method and this research is analytical descriptive. Regulations on acts of gratuity in corruption and criminal liability given by judges based on decision number: 35 / Pid.Sus.TPK / 2016 / PN.Mdn. Laws and regulations governing gratification have been set out in Article 12 B of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning Eradication of Corruption, Factors for Acceptance of Gratuity due to greed, organization, and conflict of interests of civil servants or state administrators, and criminal liability given by the judges based on their considerations have considered mitigating and burdensome matters as well as paying attention to the absence of justification and forgiveness for imposing penalties in the form of imprisonment for 5 years and a fine of Rp. . 200,000,000 towards the perpetrators.

Abstract

Handling of Narcotics Child Victims in Child Special Coaching Institutions Class I Tanjung Gusta, Medan based on Law No. 23 of 2002 concerning Child Protection which is to provide supervision, direct for worship, equip in the field of formal education and skills training, and provide adequate facilities to children who commit narcotics crime. That is a way to make a criminal child free from narcotics goods, so that when a child who commits a narcotics crime out of a development institution has the skills and soul to re-socialize with the community. The problems discussed in this study are how the legal rules governing the handling of child victims of narcotic crime in prison in dealing with narcotics crime committed by children of Tanjung Gusta Medan and How are the factors causing the occurrence of narcotics abuse committed by children of Tanjung Gusta Medan, as well as how the efforts to tackle the crime of drug abuse committed by children of Tanjung Gusta Medan. The method used in this writing is empirical juridical namely reviewing the applicable legal provisions and what happens in the reality of society. The data collection techniques are carried out through library research (liberary research) and also field research (field research), namely by conducting direct interviews of studies at the Penitentiary Special Class I Tanjung Gusta Medan.

Abstract

This research focuses on analyzing the empowerment of social institutions as village government partners in the participatory development process. The location is in Percut Village, Percutseituan District, Deliserdang Regency. The background that is used as a reference for this research begins with the understanding that the urgency of villages in development in Indonesia is so urgent. The village is given authoritative to grow and develop in line with the development of its own community. Furthermore, the village holds millions of pieces of knowledge of the virtues of life and harmony of local wisdom that should be maintained, can be recognized from the mantra of three orders, namely; ordinances, manners, and manners (Zamroni, 2017). This kind of thinking construction is important to restate in order to examine the current relationship between the village government and the community (social institutions). Social institutions as partners of the Village Government have a very strategic role; start to formulate participatory development plans, implement, control, utilize, maintain and develop participatory development, mobilize and develop participation, mutual cooperation and community self-help, and foster dynamic development of the community in the context of community empowerment. Seeing the huge role that village community institutions have, it is important and interesting that this research is carried out to see the existence of community institutions as village government partners in the participatory development process. With this research, it will provide reference data for stakeholders related to community institution empowerment. In addition, it is an academic study in public policy and provides input to the village government regarding the reference to the model of community institution empowerment as a partner of the village government in order to work together to manage development in a participatory village. As for answering the problem of this study using qualitative methods and types of research with a descriptive approach. The targeted research output is a journal article and as a follow up will create a model in the institutionalization of village community organizations.

Abstract

The main issues in this paper are as follows judge's role in court to eradicate corruption according to law number 20 in 2001 (Study of Decision 16/PID.SUS.K/2011/PN.MDN). This type of research is normative or normative juridical or library legal research which can be interpreted as legal research by examining library materials and secondary materials.The nature of this study is descriptive analytical.This research will be carried out by the researcher is Medan Disrict Court, having his address at Court Road No. 8 Medan Medan City, North Sumatera Province This research will be carried out by researchers starting in December 2018 until completion Data collection techniques are used in writing this essay are through library research techniques and also through the help of electronic media, namely the internet, and the method of data analysis conducted by the author is to use a normative legal approach that examines secondary data. The result shows that the role of the judge in an effort to eradicate corruption cases in the Medan District Court contained in the Decision Study 16/PID.SUS.K/2011/PN.MDN, namely to prosecute the process of corruption cases and impose corruption penalties with imprisonment during 2 (two) years 6 (six) months and a fine of Rp. 50,000,000 (fifty million rupiahs), provided that the fine is not paid, it must be replaced with imprisonment for 2 (two) months.

Abstract

This study is to find an alternative model of North Sumatra provincial government policy in resolving the ex-hgu land conflicts of PTPN II plantations in Deli Serdang Regency. This study is based on the fact that regional autonomy as regulated in Law Number 23 of 2014 gives the authority to the regional government in autonomy to resolve disputes over arable land in their territories. One of them relates to ex-HGU PTPN II land disputes starting in 2002 with the Central BPN Decree number 42, 43 and 44 / HGU / BPN / 2002 and Decree Number 10/2004 regarding the granting of an extension of the term of the Right to Cultivate (HGU) covering an area of 5,873 , 068 Ha from PTPN II HGU. However, the problem arises because of legal uncertainty over the distribution of land that had expired during the PTPNII HGU, so that horizontal or vertical conflicts (community cultivators, PTPN II, government and developers) occurred. From the results of the study, it was concluded that first, the ineffective model of handling policies that are appropriate, fast, and comprehensive is carried out by the government. This relates to the problem of land conversion where there is a lack of orderly administration and past land data. So that each party has its own claim on land ownership and ownership. Both the boundary and location of land parcels. Second, legal uncertainty, that there are legislation that overlaps both horizontally and vertically as well as regulated substance

Abstract

This study aims to analyze how the factors causing the occurrence of criminal act of rape-murder, what is the role of investigators in uncovering criminal act of rape-murder police of Batubara District, What are the obstacles faced by investigators in uncovering rape-murder in Police Labuhan Ruku Talawi. The research method uses in this study is Analytical Descriptive. In this case the researchers directly conducted research into Police Labuhan Ruku Talawi, Batubara Sub-District, North Sumatera. The results shows obtained are criminal acts of murder can occur due to factors that support the occurrence of these killings which can be caused through many things including through, conditions, circumstances and so forth that give room for the occurrence of these things. The role of the police investigator is to uncover the occurrence of a criminal act of murder through a series of acts of search and examination of matters relating to the murder case. Obstacles faced by investigators in uncovering murder cases include the lack of equipment and facilities and also the absence of witnesses that complicate the examination process.

Abstract

The aim of this article to analysis to regulate, responsibility and how to overcome efforts to prevent children from committing murder crimes. This type of research is directed to normative juridical law research. The nature of the research is descriptive analysis, which from these results can describe (describe) thoroughly and systematically regarding the responsibility for children as perpetrators of the crime of murder.The legal arrangements for the crime of murder committed by children are: Article 338 of the Criminal Code in conjunction with Article 351 Paragraph (3) of the Criminal Code, Law of the Republic of Indonesia Number 8 of 1981 concerning Criminal Procedure Code. Law of the Republic of Indonesia Number 11 of 2012 concerning the Juvenile Criminal Justice System and Law of the Republic of Indonesia Number 35 of 2014 concerning Child Protection. The responsibility of children as perpetrators of the crime of murder is regulated in the Criminal Code and Law no. 11 of 2012 concerning the Juvenile Criminal Justice System. In the decision Number 4/Pid.Sus-Anak/2019/PN.Kbj, the child was sentenced to imprisonment for 4 (four) years. Efforts to overcome the crime of murder are carried out with penal efforts, namely by imposing criminal penalties for perpetrators and also with non-penal efforts, namely preventively, namely prevention efforts are carried out by: conducting legal counseling to the assisted villages and to schools. Conduct mobile patrols around legal areas that are prone to homicide. Placement of police officers in places suspected of being prone to crime.

Abstract

The research objective is to analyze the rule of law in the application of diversion to children; the factors causing the criminal act of theft of motorized vehicles by children and the diversion policy against child suspects in the crime of theft of motorized vehicles at the Sibolga Resort Police. The research method used is descriptive method, while the data analysis technique uses descriptive qualitative. The results of the study indicate that the rule of law in the application of diversion to children who commit criminal acts is regulated in Law No. 11 of 2012 concerning the Juvenile Criminal Justice System, namely in articles 6 – 15 and Law no. 35 of 2014 concerning Child Protection, namely article 1 number (2). Factors causing the theft are internal factors, namely economic factors where children come from families of weak economic groups, lack of parental supervision because they are busy at work, lack of legal awareness by children because they are still not mature in thinking, narcotics needs because they are wrong in the association of friends, external factors are the opportunity to commit theft, the influence of the environment where children are connected to criminal groups or motorcycle gangs, the influence of adults who try to take advantage of children to commit theft of motorized vehicles, and the number of collectors of stolen motorized vehicles. The diversion policy against child suspects in the crime of motor vehicle theft at the Sibolga Resort Police is carried out by means of formal and non-formal policies.

Abstract

Narcotics crimes are included in extraordinary crimes (extraordinary crime). Cases of narcotics abuse during this pandemic are increasing, from 2019 to 2020. The increase in narcotics circulation during the COVID-19 pandemic can be seen from the increasing number of evidence of narcotics being caught which is getting higher. This study aims to determine the modus operandi of narcotics trafficking and abuse during the Covid-19 pandemic. The research method used is normative juridical. The data used is secondary data consisting of primary, secondary and tertiary legal materials. Qualitative data analysis is used in analyzing the problem. The results of the study found that first, the modus operandi of narcotics trafficking and abuse during the Covid-19 pandemic had developed, namely by sending three bottles of narcotics in the form of liquid from China containing 10 ml which read Hemp Oil, Drug abuse is carried out in homes, apartments, and hotels. session, the modus operandi is to use postal and expedition services to several areas, and via online with a website, besides that, the mode of circulation is by means of agricultural logistics transportation, as if sending goods for the needs of the community.

Abstract

AbstrakPeraturan Presiden Nomor 20 tahun 2018 tentang Penggunaan Tenaga Kerja Asing  menjadi pro dan kontra ditengah masyarakat terutama dikalangan pekerja/tenaga kerja Indonesia. Dibentuknya Peraturan Presiden Nomor 20 tahun 2018 telah menimbulkan ketidakharmonisan sebuah peraturan dengan peraturan yang berada diatasnya dan peraturan horizontal dengan sektor yang sama. Ketidakharmonisan tersebut dimanfaatkan pemerintah untuk melegalkan atau meligitimasi masuknya orang asing dalam wujud tenaga kerja yang seyogyanya bertentangan dengan asas keadilan dan kemanfaatan hukum serta kepastian hukum. Penelitian ini bertujuan untuk mengkaji tentang kedudukan Peraturan Presiden Nomor 20 tahun 2018 dan mengkaji tentang kerugian negara akibat masuknya Tenaga Kerja Asing ke Indonesia. Hasil penelitian didapat pertama, bahwa kedudukan Peraturan Presiden Nomor 20 tahun 2018 secara substansi/materi bertentangan dengan Pasal 27 ayat (2) UUD 1945 dan Pasal 42 sampai dengan Pasal 49 Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan karena adanya diskriminasi hak antara tenaga kerja Asing (TKA) dengan Tenaga Kerja Indonesia. Kedua, Penyalahgunaan wewenang oleh Pemerintah dengan memberikan izin masuk orang asing melalui jalur Tenaga Kerja Asing (TKA) dengan mempermudah suatu korporasi atau orang tertentu/kelompok tertentu berpotensi merugikan keuangan negara dari sektor penerimaan pajak dari Tenaga Kerja Asing.Kata Kunci: Tenaga Kerja Asing, Kerugian Negara, Korupsi.
