Abstract

This research was conducted in order to identify the factors that become obstacles in the enforcement of criminal law marks in the jurisdiction of the Regional Police of North Sumatra (Poldasu). The method used in this research is normative-empirical law research (applied law research). A literature study was conducted on the legal literature, a field study was conducted on respondents with in-depth interviews with 2 officers from the Criminal Investigation Unit at Poldasu. The results of the research and discussion show that law enforcement is influenced by several factors, which then become obstacles in the implementation of the process, such as: 1) Legal factors, where the term that refers to criminal marks in Law no. 21 of 2016 concerning Marks and Geographical Indications (UU MIG) uses the word “violation” and there are provisions for complaint offenses; (Constitution); 2) Law enforcement factors, namely the parties that form and apply the law; 3) Factors of facilities and facilities that support law enforcement; 4) Community factors, namely the environment in which the law applies and is applied. 5) Cultural factors, namely as a result of work, creativity and taste based on human initiative in social life

Abstract

Restorative justice is an approach to settling a case by means of deliberation and consensus to restore the parties, especially the victims. The author reviews the decision number 478 / Pid.Sus / 2017 / Pn.Mdn. In the verdict it has an elemental value from a restorative justice, namely the existence of an apology from the victim, restitution or ransom of compensation, and relief of criminal penalties. According to Law Number 22 Year 2009 concerning Road Traffic and Transportation, the regulation of legislation and the consequences of compensation laws or peace efforts to victims of traffic accidents. The status of the related party in the case of a traffic accident after giving compensation to the victim or his heirs is not miscarried as stipulated in article 235 of Law Number 22 Year 2009 concerning Road Traffic and Transportation. The role of law enforcers in providing compensation to victims of traffic accidents is not really needed unless there is a special request from one of the parties.

Abstract

The purpose of this study was to find out the legal arrangements, law enforcement obstacles and how to overcome them in collecting Motor Vehicle Tax (PKB) at the Pandan Regional Revenue Management Technical Implementation Unit Office (UPTPPD) based on the legal regulations in force in Pandan Region. The research method used in this research is Normative Juridical by searching and collecting data through library research from reading sources in the form of related legal books, opinions of legal experts, related laws and regulations, related websites and interview results. The results of the study show that the implementation of PKB collection at the Provsu BPPRD starts from registration, determination, payment by the taxpayer and validation to the deposit to the regional treasury by carrying out based on the Permen, Permendagri, Pergubsu that apply at UPT PPD Pandan as a form of implementation of Law no. 28 of 2009 concerning Regional Taxes and Levies. Furthermore, regarding obstacles in the implementation of motorized vehicle tax collection at the Regional Tax and Retribution Management Agency of North Sumatra Province, are the inclusion of the owner's identity (KTP and SIM) according to the tax note/STNK, technical gaps in service to taxpayers, PKB payments with the online system, payments via Banks, the large number of motor vehicle tax arrears objects both caused by the negligence of taxpayers in fulfilling their obligations to pay taxes.

Abstract

The purpose of this study is to analyze legal arrangements, legal policies and countermeasures to prevent the occurrence of money laundering crimes according to Indonesian law, against money laundering criminals (Study Decision No. 630/Pid.Sus/2019/PN. Mdn). The nature of this research is analytical descriptive, by thoroughly and systematically describing legal policies against money laundering criminals using normative legal research. Law Number 8 of 2010, is a legal arrangement for the crime of money laundering, in Articles 3 and 4 it is an active money laundering crime, while in Article 5 it is passive. Legal policy against perpetrators of money laundering crimes where perpetrators must be held accountable for their actions. The panel of judges sentenced the Defendant to imprisonment for 5 (five) years and a fine of Rp. 1,000,000,000.00 (one billion rupiah) provided that if the fine was not paid, it was replaced with imprisonment for 3 (three) months. In order to prevent and eradicate money laundering, including various criminal acts that produce illegal assets, a Financial Transaction Reports and Analysis Center (PPATK) has been established whose main task is to assist law enforcement in preventing and eradicating money laundering and serious crimes. others by providing intelligent information.

Abstract

The purpose of this study was to determine the legal setting, inhibiting factors and the role of Bhabinkamtibmas in Combating Crime in the jurisdiction of the Medan Polrestabes. The research method used in this study is normative juridical research with a statutory and conceptual approach, while the data collection instruments use observation, documentation studies and interviews. While the data analysis is descriptive analysis. The results of this study indicate that: The legal arrangements that regulate Bhabinkantibmas include Law No. 2 of 2002 concerning the Indonesian National Police, Regulation of the National Police Chief No. 3 of 2015 concerning Community Policing, and the Decree of the Chief of Police No. Pol : SKEP/737/X/2005 October 15, 2005 Regarding Policies and Strategies for Implementing Community Policing Models. Factors that can hinder crime prevention are influenced by several things, including the organizational structure of Bhabinkamtibmas Polrestabes Medan, human resource factors, budget factors, facilities and infrastructure factors, and community attention and support factors. Its role is to carry out preventive crime prevention actions through the implementation of the Community Police (Polmas) program, the Door to Door System Program and carry out Repressive Crime Prevention Actions through the Problem Solving Program.

Abstract

The problem in this research is how the legal arrangements regarding the granting of permits for foreign ships that will dock at ports in Indonesia, how the process of granting permits for foreign ships that will dock at the Port of Lhoksumawe and what are the constraints and responsibilities of PT. Pelni Lhoksumawe Branch in granting permits for foreign ships that will dock at the port. This type of research is directed to normative juridical law research. The nature of the research used in completing this thesis is descriptive analysis. Data collection techniques are carried out through: Library Research: namely by collecting and studying and analyzing concepts, theories, opinions or findings and statutory provisions related to law. Field research (Field Research), namely by conducting direct field research to obtain data such as interviews. In this case the researchers directly conduct research to PT. Pelni Lhoksumawe Branch which handles the port for foreign ships that will dock. Analysis of the data used in this study is to use qualitative methods.

Abstract

The purpose of this study is to analyze the law enforcement process, obstacles in supervision and law enforcement against criminal acts of violation of residence permits for foreign nationals in Class II TPI Belawan Immigration Offices. The research method used is an empirical legal research method. Empirical legal research is carried out by collecting primary data as the first source by going through empirical results obtained through interviews with the Head of Class II Immigration Office TPI Belawan. This research is a descriptive analysis which is analyzed qualitatively. Based on the results of this study, enforcement of foreign nationals who abuse their residence permits in the Belawan area in 2022 will be subject to Immigration Administration Actions in the form of prevention and deterrence, detention, delegation of detention centers and deportations. In the process of detaining foreign nationals prior to deportation, rights are given according to their basic daily needs. Obstacles in general are unresponsive coordination with embassies, minimal human resources for both immigration officials and PPNS in terms of supervision and law enforcement and relatively long time in completing case files. In particular, there are frequent tidal floods, unstable electrical voltage, and buildings that can be said to be unfit. Supporting factors are the presence of TIMPORA (Foreigner Monitoring Team); There is APOA (Alien Reporting Application).

Abstract

This article aims to analyze the concept of restorative justice in the perspective of criminal law in Indonesia, judges' considerations and the application of restorative justice in traffic accident cases. The case that is the focus of the author is the application of restorative justice in solving traffic accident cases in Samarinda City. in decision number 7/Pid.Sus-Children/2020/PN Pnj. The type of research that the authors use in this study is empirical juridical. Empirical law research is an unwritten positive legal research regarding the behavior of community members in social relations. The results of the study state that the concept of restorative justice. The criminal justice system is a system in society for managing crime. Its main aim is to prevent the Consensus agreement from being actually nothing new to Indonesian society. Considering, that children who are in conflict with the law are not miniature adults who must be fully responsible for their actions, but children who commit crimes must have their rights protected, they must be restored to become children of the nation who have a future as the hope of the nation.

Abstract

Tujuan pada penelitian ini adalah untuk mengetahui kebijakan pemerintah dalam menetapkan Kelompok Kriminal Bersenjata (KKB) di Papua menjadi Terorisme, untuk mengetahi implementasi peran Tentara Nasional Indonesia dalam mengatasi tindak pidana terorisme, untuk mengetahui upaya mengatasi kendala pelibatan TNI dalam mengatasi tindak pidana terorisme dimasa yang akan datang (Ius Constituendum). Jenis penelitian adalah penelitian hukum normatif bersifat deskriptif, sedangkan analisis data secara deskriptif dan preskriptif. Hasil penelitian menunjukkan bahwa penyebutan KKB di Papua sebagai teroris berdasarkan Undang-Undang No.5 Tahun 2018. Peningkatan status KKB sebagai organisasi terorisme harus melalui sebuah Penetapan Pengadilan Negeri Jakarta Pusat sebagaimana Prosedur Pencantuman Identitas Orang atau Korporasi dalam Daftar DTTOT yang diatur dalam Pasal 27, Undang-Undang No 9 Tahun 2013. Berdasarkan Pasal 7 Undang-Undang No 34 Tahun 2004 tentang TNI. TNI dalam menangani terorisme dilakukan melalui OMSP. Dalam Undang-Undang no. 5 Tahun 2018 Pasal 43I, pelibatan TNI diatur lebih lanjut dalam Perpres. Rencana Perpres Tugas TNI Mengatasi Aksi Terorisme menjelaskan konsep penanganan terorisme oleh TNI yaitu limitatif” dan “kooperatif” melalui, merumuskan Kebijakan Reformulatif TNI adalah sebagai alat pertahanan negara terhadap Undang-Undang Terorisme yang menegasakan bagaimana sebenarnya peran TNI ketika terjadi tindakan terorisme yang bersifat makar atau separatism, kebijakan operasi militer terhadap KKB berbasis hukum humaniter internasional, optimalisasi Perpres No 7 Tahun 2021 tentang RAN PE Tahun 2020-2024 dalam penanggulangan kelompok teroris papua guna mewujudkan keutuhan NKRI, dan dengan menerbitkan Perpres Pelibatan TNI dalam Pemberantasan Terorisme.

Abstract

Tujuan penelitian ini adalah untuk menganalisis pengaturan Hukum Kekayaan Intelektual Komunal (KIK) dalam melindungi hak masyarakat adat di Indonesia, implementasi perlindungan hukum dan Upaya Pemerintah dalam melindungi hukum KIK sebagai kebutuhan masyarakat adat terhadap KIK Nias. Jenis penelitian yang digunakan adalah penelitian hukum empiris dengan data lapangan melalui wawancara kepada selaku Anggota Lembaga Adat Bawomataluo di Desa Bawomataluo Kecamatan Fanayama Kabupaten Nias Selatan. Analisis data dilakukan dengan cara memilih data sekunder hasil penelitian kepustakaan dan data primer hasil penelitian lapangan dianalisis seecara kualitatif. Penelitian ini berkesimpulan, masih belum melindungi hak masyarakat adat di Indonesia karena tidak mengatur terkait ganti rugi dan ketentuan pidana bagi pelaku yang melanggar keetentuan KIK. Perlindungan hukum tidak dapat diwujudkan seecara efektif dikarenakan instrumen hukumnya masih belum memadai sehingga penegakan hukum pidana terkait pelanggaran KIK tidak dapat dilakukan secara optimal guna melindungi hak masyarakat Nias dalam kepemilikan KIK atas Tari Maena, Fahombo dan Tari Faluaya. Upaya Pemerintah dalam melindungi hukum KIK sebagai kebutuhan masyarakat adat terhadap KIK Nias belum maksimal. Pemerintah Daerah belum menginformasikan atau mensosialisasikan manfaat pendaftaran KIK tersebut kepada masyarakat. Selain itu, Pemerintah Daerah juga kurang memperhatikan resiko para pelompat dalam atraksi lompat batu dan kurang memperhatikan keseejahteraan penari dalam menampilkan budaya tari perang.
