Abstract

Permasalahan dalam penelitian ini adalah urgensi penerapan keadilan restoratif di Lembaga Kepolisian, penerapan pendekatan keadilan restoratif dengan korban anak dan efektivitas penerapannya di Kepolisian Resor Sibolga. Metode penelitian dalam penulisan ini adalah metode normatif dengan dukungan data empiris dan bersifat deskriptif analisis. Berdasarkan hasil penelitian ini diantaranya, urgensitas Lembaga Kepolisian RI menerapkan keadilan restoratif yaitu untuk menguatkan kedudukan Lembaga Kepolisian Republik Indonesia, mengatasi dinamika penegakan hukum pidana di Indonesia yang terkesan membebani negara, memenuhi suatu kebutuhan hukum masyarakat Indonesia yang sesuai dengan nilai-nilai yang hidup dalam masyarakat Indonesia. Pelaksanaan pendekatan keadilan restoratif  pada Lembaga Kepolisian Republik Indonesia didasarkan pada Perpol Nomor 8 Tahun 2021 serta Pasal 12 Perkap Polri Nomor 6 Tahun 2019. Dalam penanganan perkara tindak pidana dengan korban anak melalui pendekatan di Kepolisian Resor Sibolga telah dilakukan sebanyak 2 (dua) kali pada tahap penyidikan dengan mengeluarkan surat perintah penghentian penyidikan (SP3). Penerapan pendekatan keadilan restoratif dengan korban anak di wilayah hukum Kepolisian Resor Sibolga dapat dikatakan belum efektif dikarenakan faktor hukum, penegak hukum, sarana dan prasarana, masyarakat, serta kebudayaan.

Abstract

This research focuses on the form of punishment for children who commit narcotic crimes based on Indonesian laws and regulations. obstacles to law enforcement against children as perpetrators of narcotics crimes in the Medan City Region. penal and non penal policy strategies carried out by the Indonesian National Police in tackling Narcotics Crimes by children. The research method used is normative juridical. The data was collected by means of a literature study which was sourced from secondary data consisting of primary, secondary and tertiary legal materials, then analyzed qualitatively. The results of the first research are that the form of punishment for children who commit narcotic crimes under the law can be subject to criminal sanctions in the form of imprisonment and sanctions in the form of medical and social rehabilitation. The imposition of criminal sanctions for children is used as an ultimum remedium. Obstacles to Law Enforcement Against Children as Perpetrators of Narcotics Crime in the Medan City Region can be categorized into internal constraints and external constraints. Internal obstacles consist of the presence of the police who back up/protect drug dealers so that raid information is always leaked, minimal operational funds, limited human resources in the Medan Polrestabes narcotics unit, and the lack of arresting tools in eradicating narcotics. While the external constraints consist of, the environment is not good, the rise of nightclubs, the changing modus operandi, the presence of new types of drugs. The non-penal policies carried out by law enforcement officials consist of counseling, outreach, collaboration, anti-drug campaigns, with the distribution of pamphlets and social media, as well as the establishment of the Anti-drug Tangguh Village Command Post to prevent the abuse and illicit trafficking of narcotics in Medan City. The Penal Policy is carried out by applying criminal, medical and social rehabilitation for children who are involved in narcotics crimes.

Abstract

The purpose of this study is to analyze the urgency of criminal prosecution of perpetrators who carry out mining business activities without a business license, law enforcement in decision Number: 517/Pid.B/2021/PN.Lbp regarding criminal acts of mining without a business license, and the factors that cause the occurrence of criminal acts. mining crime without a business license in Deli Serdang Regency. The type of research used is normative legal research supported by field data through interviews with investigators at the Medan Metropolitan Police. Data analysis in this study was carried out by selecting secondary data from library research and field research data analyzed qualitatively. The results of this study are, the urgency of criminalizing business actors who carry out mining businesses without a permit in Indonesia, namely to avenge criminals' mistakes is also intended to protect the public, by creating order in carrying out mining business activities. Law enforcement against business actors who carry out mining business without a mining business permit in decision Number: 517/Pid.B/2021/PN.Lbp is not optimal and does not reflect a sense of justice. Factors causing the occurrence of cases of mining without a mining business permit in Deli Serdang Regency are divided into 2 (two), namely, internal factors and external factors. Internal factors consist of educational factors and economic factors. On external factors due to the lack of socialization related to mining business licenses and the complicated management of mining business permits.

Abstract

The purpose of this study was to examine and analyze the legal arrangements regarding customs for smuggling of baby lobsters according to the provisions of laws and regulations in Indonesia, the roles and constraints carried out by Kualanamu Customs and Excise officers in carrying out law enforcement for the crime of baby lobster smuggling. The nature of this research is descriptive analysis, and the approach used in this research is an empirical approach. The results of the study stated that the legal regulation regarding customs for baby lobster smuggling according to the provisions of laws and regulations in Indonesia is the Regulation of the Minister of Maritime Affairs and Fisheries Number 17/PERMEN-KP/2021 concerning Management of Lobsters (Panurilus spp), Crabs (Scylla spp.), and Blue swimming crab (Portunus spp.) in the territory of the Republic of Indonesia. Kualanamu Customs and Excise officers act as customs law enforcers in collaboration with law enforcement officials. Kualanamu Customs and Excise officers play a role in inspecting goods, both incoming and outgoing goods. Kualanamu Customs and Excise officers play a role in making arrests of criminal offenders. The obstacles faced by Kualanamu Customs and Excise officers in carrying out law enforcement for the crime of baby lobster smuggling are Obstacles from Legal Regulations (Acts), Obstacles from Law Enforcement, Obstacles from Facilities and Infrastructure.

Abstract

Extortion activities played by thugs are very disturbing to the community. The act of thuggery that occurred on the Tuntungan bridge which connects the Durin Jangak Village area, Pancur Batu District, the criminal act of extortion that occurred against residents who crossed the bridge. As a result, actions like this often lead to chaos and violence between the community and these individuals. The purpose of this research is to find out how the laws governing illegal levies committed by thugs in Pancur Batu and how the Pancur Batu police are trying to deal with illegal levies. The research method used in this research is normative juridical, namely a research method that examines document studies, namely by using various data such as legislation, court decisions as well as primary, secondary and tertiary materials. The results of the study show that the role of the Indonesian National Police as Law Enforcement and Protector, Protector, and Public Servant demands a professional handling of thuggery, by taking firm action against the perpetrators of thuggery and taking concrete steps to overcome thuggery and providing suggestions and reviewing public policies. so that it can be more targeted, so that the handling of thuggery does not continue to grow and increase in number, especially with regard to acts of thuggery committed by individuals, groups, groups, and mass organizations, which result in conflicts between ethnic groups and groups and have the potential to divide the nation.

Abstract

Illegal levies (pungli) are levy activities carried out by someone for personal gain by violating the rules. The purpose of this study is to find out the factors that cause extortion in the jurisdiction of patumbak. This study uses empirical juridical research regarding the enactment or implementation of a normative legal provision in the act of the occurrence of a certain law made in society. The nature of this research is descriptive analysis. The data used in this research is secondary data, namely data obtained from library research in the form of legal materials. Data collection techniques, namely literature and field. The results of the study show that the causes of extortion in the patumbak jurisdiction are due to internal factors that abuse position or authority resulting in an intention to violate legal norms (crime) because we know that crime arises as a result of opportunity. The main factors are economic factors, lack of jobs and minimal education that causes crimes to occur in society, causing damage to norms in social life.

Abstract

This research was conducted to discuss the criminal policy on tobacco excise at North Sumatra Regional Office of the DGCE. The phenomenon of increasing excise rates every year does not reduce tobacco consumption in Indonesia but instead increases the circulation of illegal tobacco products. The research method used is normative juridical research supported by empirical data and interviews. The nature of this research is descriptive analysis. The results of the research on the policy of combating tobacco excise criminal offenses at the North Sumatra Regional Office of the DGCE refer to Law No. 11 of 1995 as last amended by Law No. 7 of 2021, Minister of Finance Regulation No. 237/PMK.04/2022, and DGCE Instruction No. INS-05/BC/2022 dated November 1, 2022. The North Sumatra Regional Office of the DGCE has not yet resolved tobacco excise criminal cases with restorative justice from 2021 to 2022. The obstacles faced by the North Sumatra Regional Office of the DGCE include the absence of implementing regulations for the law, the failure to implement the roles of Customs and Excise investigators, inadequate facilities and infrastructure, low legal awareness of the public, smoking culture, and negative perceptions of tobacco excise regulations.

Abstract

The formulation of the problem is (1) What is the legal regulation regarding customs for baby lobster smuggling according to provisions of regulations – invitations in Indonesia? (2) How is law enforcement carried out by Kualanamu Customs and Excise regarding the crime of smuggling lobster seeds? (3) What are the obstacles Kualanamu Customs and Excise officers face in carrying out law enforcement for the crime of baby lobster smuggling? The research method used is normative juridical. The results of the study show that customs law arrangements for baby lobster smuggling are regulated in Law no. 17 of 2006 concerning customs. Law enforcement is carried out by Customs and Excise officers, namely arresting the perpetrators and transferring them to the Attorney General's Office for further legal proceedings. The obstacle faced by Customs and Excise officials is that very often unscrupulous law enforcement officials and unscrupulous airline officers who work at airports are involved in criminal cases of smuggling and assist perpetrators who will try to bring prohibited items to pass from the customs area. This has further reduced public trust in law enforcers and this is an obstacle for law enforcers in general. The conclusion of this study is that Kualanamu Customs and Excise officers as customs law enforcers work together with other law enforcement officers in accordance with statutory regulations. The suggestion from this thesis is for Kualanamu Customs and Excise officers to become officers who really carry out law enforcement in the field of customs, so that in the future there will be no more smuggling cases that occur within the scope of Kualanamu airport carried out by the public or unscrupulous officers working at Kualanamu Airport

Abstract

The more advanced the times, the more negative things are present in society. This service activity was carried out in Patumbak Village 1, Patumbak District, Deli Serdang Regency. This village is located on a causeway so there is quite a lot of community traffic, so it does not rule out the possibility that many drug cases will be encountered in the community. because the large number of cases of delinquency among the younger generation has resulted in the rapid spread of drugs among society. Especially among students and students, drug abuse is of course very worrying. This is because they are the next generation of the nation. Therefore, it is necessary to have the participation of all parties to continue to socialize about the dangerous impacts of drug use both in terms of religion, health and law. The aim of this socialization and counseling is to provide understanding to the community, especially the younger generation, in this case the young generation in Patumbak 1 Village, Patumbak District, Deli Serdang Regency about the dangers of drug abuse by increasing family entrepreneurial activities not only from a legal perspective, but also through efforts instilling moral values in teenagers. The methods used are seminars, lectures, discussions and questions and answers. The activity participants are students and young people

Abstract

The globalization era facilitates the mobilization of workers across borders, resulting in the influx of foreign workers (TKA) into Indonesia. The employment of TKA aligns with the nation's goals of enhancing investments, technology transfers, and expertise to Indonesian Citizen Workers (TKI) while broadening employment prospects. Per the Job Creation Law No.11 of 2020, Article 45 paragraph (1) stresses the necessity of assigning TKI as companions for foreign workers. This mandate emphasizes training to facilitate technology and skill transfer from foreign workers to TKI companions. Employing the standard legal approach, this study aims to evolve legal theories through a rigorous scientific process. It involves scrutinizing legal documents to explore the regulatory framework and theories relevant to contemporary issues. Utilizing a descriptive analytical method, this research interprets and correlates legal statutes and theories with present concerns. Findings, employing a deductive approach, point to the classification of illegal foreign workers and the necessary sanctions for companies involved in illegal labor trafficking. Illegal foreign workers breach migration regulations, while companies partaking in unlawful labor trafficking face stringent penalties like imprisonment, fines, and license revocation. This study underlines the imperative to enforce legal measures to curb illegal labor practices and protect the nation's labor integrity.
