Abstract

The standard of assessment for elementary schools in Donggala Regency is only at level 2 reaching 2.59% (low category). This happens, because the application of higher-order thinking skills in elementary schools in Donggala District, especially Banawa District, is not optimal. So the research was conducted to reveal data on the ability of teachers in carrying out HOTS-oriented learning assessments. This study uses a quantitative and qualitative approach. This research was carried out by the Elementary School in Banawa District, Donggala Regency by determining the sample using purposive sampling. Data was collected by means of questionnaires and interviews. Data analysis techniques are data collection, data reduction, data presentation, and verification. The results showed that of the 30 elementary schools in Banawa District, only 13 schools or 45% had known and obtained information about HOTS-oriented learning assessment. It was concluded that (1) the assessment of HOTS-oriented learning in elementary schools throughout Banawa sub-district was not yet understood (2) the government and stake holders as well as the school had not utilized the existing information channels to convey and exchange information about HOTS, (3) sufficient time was needed to distribute information about HOTS. HOTS in order to form a diffusion of innovation (4) in this case the social system or teacher group work (KKG) has not become a forum for distributing information about HOTS assessment in elementary schools throughout Banawa District, Donggala Regency.

Abstract

The rapid growth of financial technology, fintech in Indonesia has brought significant benefits in expanding financial inclusion, particularly for communities underserved by traditional banking. However, this progress also presents serious challenges, especially regarding user age verification. The ease of registering with only an uploaded ID card and selfie has enabled minors to misuse their parents' identities to access online loans or pay later services, resulting in financial, psychological, and legal risks for families and fintech providers. Through the legal utilitarianism perspective, strict age verification is seen as a policy that produces the greatest benefit for society by reducing identity misuse, minimizing default risk, and strengthening public trust in the digital ecosystem. Challenges such as cybersecurity, data leakage, weak internal supervision, and illegal fintech proliferation indicate the need for integrated biometric systems, validation with the national population database, Dukcapil, and digital literacy within families. Therefore, strengthening the legal framework for age verification becomes an essential foundation toward a safe, inclusive, and socially beneficial fintech industry.

Abstract

This study aims to analyze the integration of local wisdom and the principle of substantive justice in the financing practice of Musyarakah Mutanaqisah (MMQ) in Bankaltimtara Syariah, East Kalimantan. The central problem is the empirical-normative gap between formal sharia compliance (Sharia Compliance) and the effectiveness of integrating local wisdom (deliberation, cooperation) as an instrument of social law. Using a socio-legal approach (sociological jurisprudence with a descriptive qualitative method), this study is supported by the triangulation of data from in-depth interviews, observations, and document studies. The theoretical significance confirms that Islamic banking practices operate within a legal pluralist framework, demonstrating that the integration of local wisdom serves as a social mechanism of compliance, thereby strengthening the legitimacy of Islamic law. Results show that the integration of local values has been proven to strengthen customer compliance and realize distributive justice through proportional risk sharing and contract transparency. Substantive justice is achieved through dialogue-based dispute resolution and flexible payment options. Effective MMQ governance requires an adaptive and contextual model that prioritizes the principles of raḥmah and adl, ensuring the well-being of customers (hifz al-nafs and hifz al-māl) and the sustainability of partnerships, going beyond formal compliance.
