Abstract

Abstrak: Tujuan penelitian ini untuk menganalisis keterlibatan Pemerintah Desa Kartiasa dalam melaksanakan salah satu program Sanitasi Total Berbasis Masyarakat (STBM), yaitu Open Defecation Free (ODF) pada era otonomi daerah saat ini. Penelitian ini berfokus pada bagaimana bentuk keterlibatan Pemerintah Desa ODF pada wilayah Kabupaten Sambas, yaitu Desa Kartiasa, serta faktor penghambat pelaksanaan program ODF. Tulisan penelitian ini bersifat empiris, dan untuk memperoleh data melakukan obesevasi dan wawancara. Hasil penelitian ditemukan bahwa Pemerintah Desa Kartiasa dalam melaksanakan program ODF berdasarkan pada Surat Edaran Bupati Sambas Nomor 440/16/Dinkes tentang Pelaksanaan Program Sanitasi Total Berbasis Masyarakat. Faktor penghambat pelaksanaan ODF oleh Pemerintah Desa Kartiasa yaitu rendahnya kesadaran masyarakat untuk hidup bersih, rendahnya pengetahuan masyarakat akan nilai kesehatan, tidak ada peraturan desa, terbatasnya sarana dan prasarana, dan tidak ada pengawasanKata Kunci: Pemerintah Desa, Open Defecation Free, Otonomi Daerah Abstract: The purpose of this study was to analyze the involvement of the village government in implementing one of the Community-Based Total Sanitation (STBM) programs, namely Open Defecation Free (ODF) in the current era of regional autonomy. This research focuses on how the form of ODF Village Government involvement in the Sambas Regency area, namely Kartiasa Village, as well as the inhibiting factors for the implementation of the ODF program. The writing of this research is empirical, and to obtain data, we conduct observations and interviews. The results showed that the Kartiasa Village Government in implementing the ODF program was based on the Sambas Regent Circular Number 440/16/Dinkes concerning the Implementation of the Community-Based Total Sanitation Program. The inhibiting factors for the implementation of ODF by the Kartiasa Village Government are low community awareness to live clean, low community knowledge of the value of health, no village regulations, limited facilities and infrastructure, and no supervisionKeywords: Village Government, Open Defecation Free, Regional Autonomy.

Abstract

After Islam was spread by the Muslims throughout the universe, the contact of the Muslims with the a'jam nations had entered a new phase in international relations. Territorial boundaries that are displayed in plain sight do not make Muslims limit themselves in interactions between nations. The relationship that occurs between Muslims and other nations is inspired by the teachings of Islam itself which requires Muslims to always maintain peace between Muslims and internal and external Muslims. Islam has laid the foundation for peace in international relations with a basic stipulation that Muslims are not justified even if they interfere with the internal affairs of other nations

Abstract

Abstract Land is considered an asset that promises high value, so it is not surprising that land disputes occur in order to maintain ownership rights to land. The land dispute resolution process can be carried out by litigation or non-litigation. In the context of the implementation of land dispute resolution conducted at the Sambas BPN office, it is carried out through a mediation process (non-litigation). Based on the facts in the field in 2018 and 2019, there were many land disputes that were not resolved through mediation. This research focuses on what factors are causing the failure of mediation conducted at the Sambas BPN Office and how the legal consequences of resolving land disputes are resolved through mediation. The research uses empirical methods, and is analytical descriptive. To obtain primary data observation and unstructured interviews were conducted with respondents and sampling using purposive sampling. The results showed that: first, the factors causing the failure of mediation were the factors of the parties, the completion time factor, and supporting data factors. Second, the legal consequences of resolving land disputes resolved through mediation bind the parties to the dispute.

Abstract

The Village Head Election in Sambas Regency was formed based on considerations of effectiveness, efficiency, and rationale in accordance with regional needs and capabilities as well as coordination, integration, synchronization and simplification as well as institutional communication between regional centers so that an election of a village head was carried out that truly reflected the will of the community village in determining the best leader. Based on the results of the research, the implementation of the Kartiasa Village Head Election refers to the legal basis for the Sambas Regency Regional Regulation Number 6 of 2015 concerning Village Head Election, and the Sambas Regent Regulation Number 27 of 2015 concerning Village Head Elections. The stages are: preparation, voter registration and nomination, voting, and determination / endorsement. Abstract

The purpose of this study was to determine the role of the Sepuk Tanjung Village Government in waste management, and to determine the inhibiting factors for implementing the government's role. When the amount of waste increases, it will cause problems that can endanger humans, both health and the environment. Therefore, it is important to involve the village government as the government that is closest to the people. This research method uses empirical research methods with a statutory approach, to obtain data, researchers conducted observations and interviews with the village government and the community using purposive sampling. The results of the study reveal that the role of the village government is in accordance with Article 11 of Regional Regulation Number 2 of 2015 concerning Waste Management. As for the inhibiting factors, namely, the community factor, the infrastructure factor and the village government factor.

Abstract

The purpose of this study is to analyze the religious tolerance among different communities in the city of Singkawang. It focuses on the forms of the tolerance as well as the supporting and challenging factors toward tolerance among religious people in the city. This is an empirical research in which it employs descriptive qualitative methods that were used to obtain data through observation and interviews. Among the results of the field research is a finding that in Singkawang City, inter-religious relationships have been facilitated by collaborated forums namely FKUB (Forum Komunikasi Umat Beragama) and FKPELA (Forum Komunikasi Pemuda Lintas Agama). Special for FKPELA, this forum has been claimed as the only interfaith youth communication forums found in Indonesia. Among the supporting factors for the interfaith cooperations are the emotional ties and environmental condition. In this context, the community grows and develops in an environment surrounded by people of different religions. Regarding the challenging factors, it was found that the socio-political situation and traumatic memory of conflict in the city’s history could constitute as inhibiting factors.Tujuan penelitian ini adalah untuk menganalisa toleransi beragama di antara komunitas yang berbeda di kota Singkawang. Penelitian ini berfokus pada bentuk-bentuk toleransi, serta faktor pendukung dan penghambat toleransi antar umat beragama di kota ini. Penelitian ini bersifat empiris dengan menggunakan metode kualitatif deskriptif, yang digunakan untuk memperoleh data melalui observasi dan wawancara. Di antar hasil dari penelitian lapangan tersebut adalah temuan bahwa hubungan keagaman di kota Singkawang diafasilitasi dalam sebuah wadah kolaboratif yakni FKUB (Forum Komunikasi Umat Beragama) dan FKPELA (Forum Komunikasi Pemuda Lintas Agama). Khusus FKPELA, lembaga ini diklaim sebagai satu-satunya forum komunikasi pemuda lintas agama yang ada di Indonesia. Di antara faktor pendukung toleransi dimaksud adalah ikatan emosional dan kondisi lingkungan. Dalam hal ini, masyarakatnya tumbuh dan berkembang di lingkungan yang dikelilingi oleh orang-orang yang berbeda agama. Di sisi lain, faktor sosial politik dan beban ingatan traumatis terkait konflik dalam sejarah masyarakat di kota ini menjadi faktor penghambat.

Abstract

It is still found that investigating officers do not have an S1 degree or equivalent in thejurisdiction of the Sambas Resort Police as mandated in PP No. 58 of 2010 concerningAmendments to Government Regulation Number 27 of 1983 concerning theImplementation of KUHAP article 2A paragraph (1) letter a. If the requirements ofinvestigators are not fulfilled, there will automatically be limits of authority, includingthe inability to issue investigation orders, detention warrants and other administrativeletters. This study used a qualitative method with juridical empirical research. Toobtain accurate data, purposive sampling technique was used, and primary datacollection by conducting in-depth interviews. The research results found, among others:first, discretion regarding the administration of investigations in the jurisdiction of theSambas Resort Police for the Sambas District Police who do not have investigatingofficers who meet the requirements, is then taken over by the Head of the CriminalInvestigation Unit as the supervisor of the integrated criminal investigation function.Second, the impact of an integrated investigation administration causes the time tocarry out investigations to be slow due to the long distance between the Sector Policeand the Resort Police.

Abstract

Pemberian perlindungan terhadap korban perdagangan orang yang pada umumnya perempuan dan anak serta untuk memberikan kepastian hukum dalam upaya pencegahan dan penanganan korban perdagangan orang di Kabupaten Sambas, maka perlu diatur dalam Peraturan Daerah. Tulisan artikel ini mengangkat permasalahan bagaimana kewenangan pembentukan Perda No. 3 Tahun 2015 dalam perspektif siyasah dusturiyyah dan bagaimana mekanisme pembentukan Perda No. 3 Tahun 2015 dalam perspektif siyasah dusturiyyah. bahwa Al-Sultah at-Tasyriiyyah dengan kewenangan pemerintah daerah membentuk Perda No. 3 Tahun 2015 yaitu bersumber pada perolehan kewenangan undang-undang tertinggi, kewenangan Al-Sultah at-Tasyriiyyah diakui atas dasar kesamaan aqidah dan kepatuhan umat terhadap pemimpin yang dianggap perantara aturan Allah, sedangkan dalam konteks pemerintah daerah keberadaannya berdasarkan dipilihnya rakyat dan kewenangannya bersifat memaksa. Berkaitan dengan mekanisme proses terbentuknya Perda No. 3 Tahun 2015 memiliki relevansi dengan terbentuknya hukum dalam konsep ketatanegaraan Islam yaitu mempunyai illat (latarbelakang/sebab harus dibentuknya aturan), berlandaskan nash/undang-undang tertinggi, ijtihad (upaya mencari solusi/penggalian hukum) dan mekanisme syura (musyawarah) dalam proses persidangan dan penetapan Perda.

Abstract

Layang-layang adalah salah satu permainan tradisional yang dimainkan di berbagai penjuru dunia. Permainan ini dimainkan oleh berbagai kalangan usia mulai dari anak-anak hingga dewasa. Pada konteks bermain layangan, di wilayah hukum Kota Singkawang telah mengatur secara eksplisit didalam Pasal 66 Perda No. 1 Tahun 2016 Tentang Ketertiban Umum, Pasal tersebut mengatur setiap orang dilarang bermain layangan dengan menggunakan kawat dan benang gelasan yang dapat membahayakan keselamatan orang lain, dan setiap orang dilarang bermain layangan di jalanan, jalur hijau, taman fasilitas umum dan fasilitas sosial yang dapat membahayakan keselamatan orang lain. Tulisan ini mengangkat rumusan masalah yang akan dikaji yaitu, bagaimana efektivitas pelaksanaan Pasal 66 (larangan bermain layangan) pada Perda No. 1 Tahun 2016 Tentang Ketertiban Umum di Kota Singkawang. Metode penelitian artikel ini menggunakan metode penelitian hukum empiris dengan menjabarkan data analisis deskriptif, untuk memperoleh data dilakukan observasi dan wawancara, selain itu juga melalui dokumen, data tertulis dari Satpol PP Singkawang. Temuan hasil penelitian mengungkapkan bahwa pelaksanaan Pasal 66 Perda No. 1 Tahun 2016 Tentang Ketertiban Umum di Kota Singkawang terlaksana secara efektif, dari sudut pandang faktor hukum itu sendiri, faktor penegakan hukum dan faktor sarana.

Abstract

This study aims to analyze how the implementation of the 2019 simultaneous village head elections in Indonesia, and how the challenges of implementing the 2019 simultaneous village head elections in Indonesia. This research uses literature research method with deriftive approach of analysis. The conclusion of this paper is the implementation of simultaneous village head elections in 2019 in Indonesia there are still differences in administrative requirements, caused by differences in the rule of law at the district level, be it the regulation of the selection of village heads in district regulations and at the technical level of regent regulations on the technical implementation of regional head elections. In addition, the challenges in the implementation of village head elections are on voter data collection, regulation of dispute resolution of village head elections, and money politics.
