Abstract

Perkembangan pesat kendaraan bermotor listrik berbasis baterai di Indonesia telah mendorong pemerintah untuk memberikan insentif fiskal berupa pembebasan bea masuk mobil listrik. Kebijakan ini diatur melalui berbagai peraturan, termasuk Peraturan Menteri Keuangan Republik Indonesia Nomor 62/PMK.010/2025, yang dalam praktiknya menimbulkan masalah terkait kepastian hukum dan validitas peraturannya. Permasalahannya adalah bagaimana kebijakan fiskal mengenai bea masuk mobil listrik di Indonesia dan validitas PMK Nomor 62/PMK.010/2025 mendasari peraturan tersebut. Studi ini bertujuan untuk menganalisis ketentuan hukum kebijakan fiskal tentang bea masuk mobil listrik dan menilai validitas peraturan Menteri Keuangan tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan statutori dan konseptual. Hasil penelitian menunjukkan bahwa kebijakan fiskal tentang bea masuk mobil listrik merupakan kebijakan fiskal ekspansif yang bertujuan untuk mendorong investasi dan transfer teknologi. PMK Nomor 62/PMK.010/2025 secara formal berlaku, tetapi dalam praktiknya, berpotensi menimbulkan ambiguitas regulasi karena ketergantungan pada keputusan administratif lintas lembaga

Abstract

Trash is a problem faced almost everywhere in the world. Considering the numerous waste issues that occur, it is expected that all elements of society work together to tackle the waste problem from upstream to downstream. Bali, which is famous as a tourist destination, also has serious waste issues, prompting the Governor of Bali to issue Governor Regulation No. 47 of 2019 regarding Source-Based Waste Management. The purpose of this research is also to discuss the legal framework that enables the Apuan village government to implement a source-based waste management program and to understand the mechanism of source-based waste management. The research method involves conducting interviews with the Apuan Village Government, Susut Sub-district, Bangli Regency. Source-based waste management has not been fully implemented in Apuan Village due to the lack of legal framework for source-based waste management. The proposed solution to the partner is to draft a new village regulation that provides detailed provisions for implementing source-based waste management, as well as conducting Focus Group Discussions (FGD) and raising awareness about the importance of proper waste management. The method to be used involves providing assistance during the drafting of the village regulation and conducting public awareness campaigns on the significance of source-based waste management.

Abstract

It is undeniable that the development of the tourism industry can have both positive and negative impacts on the economic, socio-cultural and environmental sectors. In the context of Bali, development of tourism industry will certainly have impacts towards the development of tourism supporting facilities in the form of hotels, restaurants, entertainment and recreation and so on. The aims of this research are to examine the impacts of the development of the tourism industry in relation to violations of the utilisation of cliff borders by tourism entrepreneurs and the one that involves reconstruction of legal norms in accordance with the concept of sustainable tourism development. The research takes the type of empirical legal research. The results show that the existence of tourism supporting facilities on the cliff borders in turn brings about negative impacts on the environment. As a consequence, legal reconstruction is urgently needed by adding more detailed justifications related to the regulations regarding the cliff border areas. The legal reconstruction in question can be done by adding the provisions of Articles in Provincial and Regencial or Municipal Regulations, or can be executed through preparation or reconstruction of additional provisions of Articles in the Regencial or Municipal Spatial Detail Plan or through zoning regulations based on sustainable tourism development.

Abstract

Election is a series of activities in democratic voting. In this regard, the election is regulated in Law Number 7 of 2017, here it explains how the participation of the people of Ubung Village in the context of participating in the 2019 election process. This study aims to determine the election management system according to Law No. 7 of 2017 and knowing about the implementation of the election in Ubung Village. This type of research is empirical research. This research was carried out by going directly to the research location which was located in the Ubung Village. The results showed that the stages in the people's participation in the kelurahan ubung are: in the election process it can be classified into 3 (three) stages, namely: the preparation stage, the implementation stage, and the evaluation stage. So in this regard here it is said that the phase of people's involvement in the election of the Kelurahan ubung is very enthusiastic because almost 49.41% of the registered voters of the Kelurahan ubung and the Permanent Election list come to the polling stations to exercise their voting rights.

Abstract

The environmental condition in Klungkung Regency has shown some signs of increasing environmental damage and pollution. In the context of environmental protection, the Klungkung Regency Government issued Regional Regulation Number 2 of 2010 concerning Control of Environmental Damage and Pollution. Based on the description, the problems faced are how effective Perda No. 2 of 2010 is and what are the obstacles in enforcing Perda No. 2 of 2010. The type of research used is empirical legal research with data collection techniques and field interviews. The effectiveness of the Regional Regulation in an effort to stop the level of pollution on the Watu Klotok beach with preventive and repressive efforts through: administrative sanctions in the form of verbal warnings, written warnings, fines or civil sanctions for environmental damage or pollution. The obstacles encountered include: factors from the implementation of the law itself, factors from law enforcement officials, community culture, economy and public awareness. The conclusion of the research shows that the effectiveness of the regulation has not been implemented effectively by law enforcers in terms of imposing sanctions. Therefore, the Klungkung Regency Government must be more firm and wise in implementing the existing legal regulations.

Abstract

Keadaan lingkungan di Kabupaten Klungkung telah menunjukkan beberapa tanda peningkatan kerusakan dan pencemaran lingkungan. Dalam rangka perlindungan lingkungan hidup Pemerintah Kabupaten Klungkung mengeluarkan Perda Nomor 2 Tahun 2010 tentang Pengendalian Kerusakan Dan Pencemaran Lingkungan Hidup. Berdasarkan uraian tersebut tujuan penelitian ini adalah untuk membahas efektifitas Perda Nomor 2 Tahun 2010 dan mengkaji kendala-kendala dalam penegakan Perda Nomor 2 Tahun 2010. Tipe Penelitian yang digunakan adalah penelitian hukum empiris, dimana data yang digunakan dalam penelitian ini adalah data primer dan data sekunder. Teknik pengumpulan data wawancara lapangan, dan observasi di lapangan. Hasil penelitian ini menemukan bahwa efektifitas Perda dalam upaya menghentikan tingkat pencemaran di pantai Watu Klotok dengan upaya preventif dan upaya represif melalui: sanksi administratif berupa teguran lisan, teguran tertulis, sanksi pidana denda atau perdata atas kerusakan atau pencemaran lingkungan. Adapun kendala yang ditemui diantaranya: faktor dari implementasi aturan hukumnya sendiri, faktor dari aparat penegak hukum, kebudayaan masyarakat, ekonomi serta kesadaran masyarakat. Kesimpulan dari hasil penelitian menunjukkan bahwa, efektifitas Perda tersebut belum diterapkan secara efektif oleh para penegak hukumnya dalam hal pemberian sanksi. Oleh karena itu Pemerintah Kabupaten Klungkung harus lebih tegas dan bijaksana dalam menerapkan Peraturan Hukum yang ada.

Abstract

Pelaksanaan proses peradilan pidana didasarkan pada Sistem Peradilan Pidana Terpadu (KUHAP). Tindak pidana gangguan jiwa berkaitan dengan Pasal 44 KUHP. Ilmu forensik dibutuhkan untuk pembuktian secara ilmiah terhadap pelaku tindak pidana yang mengalami gangguan jiwa. Dalam hal ini penulis mengambil rumusan masalah sebagai berikut 1) Bagaimana Pengaturan Hukum tindak pidana yang dilaksanakan oleh pelaku dengan gangguan kejiwaan? 2) Bagaimana sanksi pidana terhadap pelaku tindak pidana dengan gangguan kejiwaan? Metode penelitian ini yakni hukum normatif. Hasil penelitian pengaturan hukum terhadap orang dengan gangguan jiwa diatur pada pasal 44 ayat 1 dan 2 beserta pasal 49 ayat 1. Hukuman pidana tidak berlaku bagi pelaku kejahatan yang dilaksanakan oleh individu dengan gangguan jiwa. Hakim bisa menjatuhkan putusan sesuai hukum yang terungkap dan penjatuhan sanksi pidana terhadap pelaku tindak pidana yang mengalami kejahatan gangguan kejiwaan yang diatur dalam peraturan Perundang-Undangan dan tetap memperhatikan juga hak asasi manusia yang dimiliki oleh manusia sejak lahir sesuai ketentuan peraturan Perundang-Undangan mengenai hak asasi manusia.

Abstract

Vehicle tax is included in regional income that can support development through regional revenue and expenditure budgets. Progressive is a tax where the levy is by increasing taxes that must be paid in accordance with the provisions of the tax object. The purpose of this study is to determine the application of progressive tax on motor vehicle taxpayers in Bali Province and to determine legal protection for taxpayers against the imposition of progressive tax on motor vehicles in Bali Province. The method used is empirical legal research. The method used is empirical legal research. Sources of primary legal materials are obtained through research results and it can be concluded that the imposition of progressive vehicle tax can increase regional income towards motor vehicle tax (PKB) which is part of the Bali Province Regional Revenue and Expenditure Budget (APBD) which aims to improve the structure and infrastructure that support the welfare of the local communit. Reducing the number of private vehicle ownership for the community so that it can solve regional problems, namely congestion. Legal protection for progressive taxpayers is often a problem for vehicle owners, because people often do not report that the vehicle has changed hands.

Abstract

This study aims to analyze and describe the determination of the location of slum housing by the Regional Government of Badung Regency with Regional Regulations. Settlement is a space for humans which is also said to be a place to live for every human being. The growth that occurs in society often has positive and negative consequences. One of the problems that arise is the emergence of slum settlements. Based on the Regional Regulation, the categories of slum housing are listed based on the aspects contained in the housing, if there are aspects that are not appropriate, the Badung Regency local government will make efforts to evaluate and improve these aspects so that the housing can be declared livable housing. This regulation also aims to suppress the growth of slum housing so that it can become livable housing. Through this research, it is hoped that a good relationship between the local government and the community will be established in order to create livable housing that will have a good impact on the government and society.

Abstract

Marriages that occur between foreign nationals and Indonesian citizens are mixed marriages. The development of the times makes it easier for someone to interact, so that mixed marriages occur which involve differences in nationality between partners. Based on this, this study aims to analyze and describe the regulation of the citizenship status of children from mixed marriages and registration of citizenship of children from mixed marriages. The method used in this study is normative law that uses a statutory approach and analysis of legal concepts derived from the literature. The results of this study indicate that the regulation of the citizenship status of children resulting from mixed marriages is regulated in Law Number 12 of 2006 concerning Citizenship of the Republic of Indonesia. Children resulting from mixed marriages have the right to declare and choose their citizenship no later than 3 (three) years after turning 18 (eighteen) years old or already married. The procedure for registering children resulting from mixed marriages must be registered in writing in the Indonesian language by a legal guardian or parent. Registration is done online through the pewarganegaraan.ahu.go.id website or by submitting complete requirements to the President of the Republic of Indonesia inside or outside the territory of Indonesia, the Minister of Law and Human Rights.
