Abstract

The development of the online shopping system has given rise to new business opportunities, one of which is known as a buying and selling service. One of the risks for users of ticketing services is the danger of defects in products received by users of online ticketing services. Based on this, what is the legal protection form of consumers of online ticketing services in the event of a defect in the product received? And how are online delivery service business actors responsible for losses received by consumers for defective goods products. This research uses a normative type of legal research. There are two forms of legal protection for consumers of online ticketing services in the event of product defects received through online buying and selling services, namely preventive and repressive legal protection which can be seen in the provisions of the UUPK. The responsibility of online delivery service business actors for losses received by consumers for defective goods products, in addition to rights and obligations, there are also responsibilities that must be carried. This responsibility is part of a binding obligation in the activities of running a business.

Abstract

Law No. 24 of 1992 was enacted to effectively manage natural resources on land, sea and air in a sustainable manner. The aim is to promote sustainable development through dynamic spatial planning and environmental conservation. The problems are: 1) How is environmental law enforcement in sustainable business strategy? And 2) What are the sanctions for companies that violate the environment? This research uses normative research methods. The Job Creation Law aims to address pollution problems and encourage environmentally friendly practices in the business sector. Environmental law enforcement in this sustainable business is set to prevent companies from exceeding acceptable limits in releasing substances or energy into the environment. This law provides penalties for environmental violations, with priority on administrative sanctions, civil liability for compensation and environmental restoration, as well as criminal law specifically for serious violations that have a major social and environmental impact.

Abstract

Traffic problems faced by the Indonesian state are increasing. The problems that are often encountered are worse because of the rampant traffic accidents caused by minors. In this study the author will discuss the implementation of Diversion of children in committing criminal acts of traffic accidents in the Bangli Police District and what factors are an obstacle in the implementation of Diversion of children in committing criminal acts of traffic accidents in the Bangli Police District. The writing of this thesis uses empirical methods as well as statutory, conceptual, and case approaches. The results of this study indicate that the implementation of Diversion against children in the crime of traffic offenses in the jurisdiction of Bangli Police Station during the settlement of cases directed by Diversion has been carried out properly and obstacles in the implementation of Diversion against minors in the crime of traffic offenses in Bangli Police Station, including internal and external factors.

Abstract

The principle of openness refers to the principle that the law-making process must be conducted in an open and transparent manner to the public. This means that the process must be accessible to the general public and interested parties, and provide opportunities for them to participate and provide input. In a democratic society, the government should prioritize the welfare of its citizens and listen to their wishes. However, there may be differences of opinion among citizens when it comes to making laws and regulations. The problem formulations raised are 1) How is the regulation of the process of forming laws and regulations in Indonesia? and 2) How is the form of the principle of openness in the formation of laws and regulations? The research method used in this research is normative legal research. The results show that the process of forming laws and regulations in Indonesia goes through several stages, such as initiation, preparation, discussion, ratification, enactment, and implementation. The principle of openness is very important in making laws and regulations because this principle encourages public involvement in the process because it includes providing access to information and seeking input from individuals and groups affected or interested in the issue.

Abstract

Bisphenol-a is a chemical ingredient in polycarbonate plastics, which has shown negative effects on brain tissue. BPOM found the following compound in excess of 0.9 ppm per liter in polycarbonate gallon drinking water. Although the safe threshold is set at 0.6 parts per million (ppm) during 2021-2022 in 6 regions in Indonesia. The problems are: (1) How is the regulation of the use of drinking bottles made from polycarbonate? (2) How is legal protection for consumers for the use of polycarbonate bottles contaminated with bisphenol-a? This research uses normative legal research. According to the findings of this research, BPOM Regulation number 20 of 2019 concerning Food Packaging Supervision regulates the use of Bisphenol-a in drinking water containers. that the distribution threshold of bisphenol-a in food containers is no more than 0.6 bpj (600 microgram/kg) from polycarbonate packaging. The form of legal protection for consumers is the existence of food laws as a way to ensure panga safety.  As well as by setting food packaging standardization. In relation to bisphenol-a, the government is obliged to protect the legal rights of consumers by regulating, fostering, and supervising polycarbonate drinking bottles.

Abstract

Law No. 32 of 2009 explains that Natural contamination causes harm to biotic and abiotic communities. Natural contamination issues happening are natural issues due to the digging of slopes and waterways around the Unda Waterway which can be utilized as materials for development objects. In case not dealt with genuinely, this huge sum of digging will influence the condition of the encompassing environment. The details of the issue are: How are criminal sanctions controlled for culprits of Unda Stream contamination due to slope digging amid the development of the Bali Social Center? and How is the Tukad Unda stream overseen and secured? About employment standardizing legitimate investigation strategies. Setting criminal sanctions against culprits of waterway digging contamination is critical to energize lawful compliance and natural security. sanctions can be within the shape of fines, jail sentences, or combination of both, duty of the culprit and give obstruction impact against waterway contamination homes. Stream stream administration and assurance requires an all encompassing approach including related parties, compelling directions and community support. Usage of preservation measures, coordination between related teaching, outreach to open almost all threats postured by exercises carried out in waterway watersheds, as well giving strict sanctions for infringement of the utilization of watersheds as ensured zones.

Abstract

Village Regulations are the result of a legal process at the village level that is authorized by the Village Head together with the Village Consultative Body. The Village Consultative Body acts as a liaison between the Village Head and the Village community. This research aims to explore the implementation of the functions of the Village Consultative Body in the formation of Village Regulations in Peguyangan Kangin Village and identify obstacles or barriers faced by the Village Consultative Body in the process. The research method used is an empirical legal method. The results showed that although the Village Consultative Body has a function to take and propose ideas from the community, its implementation has not been optimal because there are still obstacles, such as community disapproval of the Village Regulations made. Efforts made include socializing the formation of Village Regulations to the community. Therefore, the Village Consultative Body should become more proactive in carrying out their roles and functions.

Abstract

Abstrak Desa Plaga kuhusnya desa adat Kiadan secara legal telah didesign untuk menjadi Desa Wisata. Hal ini tidak terlepas dari proses politik dan hukum untuk menjadikan desa Plaga sebagai desa Wisata. Dikeluarkannya Surat keputusan Bupati Badung, nomor 47 tahun 2010 tentang penetapan kawasan desa wisata di kabupaten Badung. Tujuan penetapan desa wisata untuk mencegah kesenjangan ekonomi wilayah Badung Selatan dengan Badung Utara. Dengan adanya Surat Keputusan Bupati tentang Desa Wisata untuk Badung Utara khususnya Desa adat Kiadan diharapkan Desa Adat mampu mengelola fotensi Desa Wisatanya berdasarkan kearifan local yang hidup di masyarakat adat Bali sesuai dengan asas desa mawa cara, negara mawa tata. Hampir 8 (delapan) tahun terbitnya Surat Keputusan Bupati tidak jelas model pengelolaaan Wisata Desa di Kiadan, karena masyarakat belum mengetahui tentang konsep desa Wisata, bagaimana mengelola desa wisata, dan bagaima memanfaatkan potensi sebagai sumber daya budaya untuk mengangkat citra desa wisata untuk kesejahtraan masyarakat adat. Untuk itu, perlu pendampingan aktor pariwisata lokal, penyuratan pengelolaan desa wisata melalui awig-awig desa adat.

Abstract

Abstract In the current narcotics case the circulation is wide and the modus operandi is increasingly diverse, the police are required to develop their own law enforcement. With the descriptive theory and description of the practice of disclosing narcotics networks. Polri is expected to further spur members to improve the quality of their human resources, improve supervision of performance in the field, so that the implementation of discretion remains in the legal path. Thus, there will be growing public trust in the police institution, where the community voluntarily becomes a police partner in creating security and order. The police statement on narcotics eradication will theoretically spur police institutions to increase the intellectual capacity of their members to use common sense in acting. Illegal circulation of narcotics and corruption is a new dimension of crime, which requires serious handling. Formulation of the problem in this study: how the steps of the police reveal the drug network and how to eradicate drugs with the concept of discretion. The type of research used is the type of empirical research. The results of the discussion in this study are as follows: Police steps to uncover the drug network begins with: a) Call letter, b). Arrest, Search and Confiscation, c). Examination and d). Detention. Eradicating drugs with the concept of discretion as the executor of the unit of investigation and investigation of drug crimes, the drug work unit working on the basis of the standard was determined by the National Police Chief based on police reports. The guidelines for implementing or implementing the various principles are the steps of the police in uncovering drug networks. The steps to control and control not only control the police's personal supervision to early conduct a selection of his actions, but also his fellow colleagues and the seriousness of the police institution to take action against the police who abuse the discretion, under any pretext. Therefore the standard of operation becomes more important to realize so that there are measures to minimize discretionary deviations. Keywords: Discretion; Narcotics; Police Abstrak Dalam kasus narkotika saat ini peredarannya luas dan modus operandinya semakin beragam, polisi di tuntut mengembangkan penegakkan hukumnya sendiri. Dengan teori deskresi dan gambaran praktek pengungkapan jaringan narkotika. Polri diharapkan makin memacu anggota untuk meningkatkan kualitas sumber daya manusianya, meningkatkan pengawasan kinerja di lapangan, agar pelaksanaan diskresi tetap dijalur legal. Dengan demikian akan tumbuh kepercayaan masyarakat terhadap institusi kepolisian, yang dimana masyarakat secara sukarela menjadi mitra polisi dalam menciptakan keamanan dan ketertiban. Deskresi kepolisian pemberantasan narkotika secara teoritis akan memacu institusi kepolisian meningkatkan intelektualitas anggotanya agar menggunakan akal sehat dalam bertindak. Peredaran gelap narkotika dan korupsi adalah kejahatan berdimensi baru, yang memerlukan penanganan serius. Rumusan masalah dalam penelitian ini: bagaimana langkah-langkah polisi mengungkap jaringan narkoba dan bagaimana memberantas narkoba dengan konsep diskresi.Tipe penelitian yang dipergunakan adalah tipe penelitian empiris. Hasil pembahasan dalam penelitian ini sebagai berikut: Langkah-langkah polisi mengungkap jaringan narkoba diawali dengan: a).Surat panggilan, b). Penangkapan, Penggeledahan dan Penyitaan, c). Pemeriksaan dan d). Penahanan. Memberantas narkoba dengan konsep diskresi sebagai pelaksana dari satuan penyelidikan dan penyidikan terhadap kejahatan narkoba, satuan kerja narkoba bekerja atas dasar pakem ditetapkan oleh Kapolri berdasarkan laporan polisi. Petunjuk pelaksanaan atau Juklak dengan berbagai prinsip itulah yang menjadi langkah-langkah polisi dalam mengungkap jaringan narkoba. Langkah pengendalian dan pengawasan tidak hanya mengendalikan pengawasan dari pribadi polisi untuk secara dini melakukan seleksi atas tindakannya, tetapi juga sesama rekan dan keseriusan institusi kepolisian menindak polisi yang menyalahgunakanan diskresi, dengan dalih apapun. Untuk itu standar operasi menjadi lebih penting diwujudkan agar terdapat ukuran untuk meminimalkan penyimpangan diskresi. Kata Kunci: Diskresi; Narkotika; Kepolisian

Abstract

Land procurement is an activity of obtaining land which is indicated for development for the community in general which involves the land, which is offset by compensation from the government. The holder of land ownership rights must get legal protection, because the rights owned by the community must be protected so that the community gets legal certainty. So that the formulation of the problem used is 1) what is the legal protection of holders of land rights used for the public interest in making roads? 2) What are the Government's efforts towards the release of property rights to land used for the public interest in making roads? Normative legal research methods are used in this study. The results of the study showed that the inclusion of fair and just compensation for compensation was based on deliberation, and the community could file an objection to the form and or amount of compensation handed down by the government to the local District Court for holders of land rights in order to obtain legal protection. The form of government efforts in releasing ownership rights of a community land, namely money that is paid in compensation can be temporarily surrendered to the Court and for people who want to surrender their land without any objection, the community is entitled to tax incentives. Tax incentives are to minimize the cost of a tax so that tax costs become lighter.
