Abstract

The acts of thuggery that usually occur in Denpasar are carried out in groups and organized. The presence of thugs in the area of trade centers, terminals and highways which are often public places is one of the obstacles for the community in carrying out their activities. The formulation of the problems in this study are Factors causing the occurrence of mass organization thuggery acts in Denpasar and Criminal sanctions for perpetrators of thuggery committed by mass organizations against civil service police officers in Denpar, this study uses an empirical legal. Based on the research results, the causes of thuggery include economic and environmental problems. Criminal sanctions for thuggery perpetrators committed by mass organizations at the Satpol PP Denpasar are determined on suspicion of fighting government officials who are carrying out state duties and or persecution and or crimes against people's independence. This is as stipulated in Article 211 of the Criminal Code, Article 212 of the Criminal Code, Article 214 of the Criminal Code and/or Article 351 of the Criminal Code and/or Article 335 of the Criminal Code

Abstract

Pregnancy due to rape has a negative impact on the victim, namely physically, mentally, socially so that the victim performs abortion provocatus, but the Criminal Code does not provide exceptions regarding the act of abortion Unlike the Law of the Republic of Indonesia No. 36 of 2009 concerning Health, abortion is allowed if the requirements of the Law are met. This is certainly contrary to the reproductive rights of organs. Therefore, legal protection for rape victims is needed to protect everyone's right to legal treatment and protection. The formulation of the problem is What is the criminal law regulation regarding abortion provocatus carried out by rape victims? and What is the legal protection for rape victims from abortion provocatus? Research methods used normative legal research. The results of the discussion on criminal law regulations for rape victims from abortion provocatus are contained in Articles 299, 346, 349 of the Criminal Code and Law of the Republic of Indonesia No. 36 of 2009 concerning Health Articles 75, 76, 77, 194. It is necessary to cooperate with relevant parties to ensure that the implementation of abortion does not traumatize rape victims and can perform abortions legally, safely as permitted by law.The research method used is normative legal research. The results of the discussion regarding the regulation of criminal law against rape victims of abortion provocatus are contained in the Criminal Code Articles 299, 346, 349 and Law No. 36 of 2009 concerning Health Articles 75, 76, 77, 194. Need for cooperation of related parties to ensure the implementation of abortion does not traumatize victims of rape and can perform abortion legally, safely permitted by law.

Abstract

In its implementation, billboards often use public facilities that should not function as a place or means of promotion. This results in irregularities in the licensing field with the Government such as in Badung Regency. Based on this, how is the implementation of billboard installation in Badung Regency? And how is the control of the implementation of billboard installation in Badung Regency? Research writing uses empirical legal methods. Based on Badung Regent Regulation Number 80 of 2014, the installation of billboards must pay attention to aesthetics, ethics and beauty, where in Badung Regency there is still a lot of overlap in the practice of installation places. In this case, the Badung Regency Government has a Master Plan (location of billboard distribution) to issue permits for the implementation of billboards that are not in accordance with the rules, by making repressive and preventive efforts such as demolition and socialization of the rules for billboards and processing billboard permits.

Abstract

Public transport and transportation is very important to be able to realize transportation that meets the needs. Online transportation is a means of land transportation that is more efficient and effective. However, not everyone can accept the technological advances that occur. There are parties who refuse in terms of transportation; people feel rivaled by online ojek. The formulation of the problem in this study is 1) The impact of online transportation on local taxis 2) Criminal sanctions against local taxis who commit physical and verbal violence against online taxis. The research method uses empirical legal research. The results showed that the impact of online transportation on local taxis in Canggu is tight competition and difficulty getting passengers. In the provision of supporting facilities for transportation tourism, local residents have provided in each tourist area. Criminal sanctions against local taxis who commit physical and verbal violence against online taxis in their arrangements are not united in one special chapter, but are separated in certain chapters. In the Criminal Code, violent crimes can be classified as follows: Crimes against the life of another person Article 338- 350 of the Criminal Code.

Abstract

A restaurant is a business that provides food and drinks for customers. Business opportunities for restaurants have broad market potential because food and drink are the basic needs of every individual. In this study the authors will discuss 1) the legal arrangements for business licences in the restaurant industry? and 2) how the sanctions against violators of business licences in the restaurant industry?. The research method used in this research is normative legal method. Based on the research obtained, in establishing a restaurant, a licence is required in accordance with applicable regulations, the licence will be grouped according to the level of business risk. Although there are regulations governing this sector, cases of licence violations are still very common in the community. As a result, business actors who violate the rules will be subject to administrative sanctions in the form of warnings, temporary suspension of operations through freezing business licences, fines, use of force by police officers, and revocation of company licences. In this case, the government should apply strict legal sanctions against violations of restaurant business licences, and business actors should have awareness in taking care of their business licence ownership.

Abstract

Weapons that resemble sharp objects including knives, sickles, axes, machetes, etc. are referred to as sharp weapons. Considerable losses to society will arise due to the increase in crime due to the possession of sharp weapons without a license. The author examines the legal consequences for the owner of sharp weapons in the event of a criminal offense, along with the laws and regulations governing the possession of sharp weapons without a license. Normative legal research is the type of research used. The conclusion of the study shows that unlawful possession of sharp weapons can cause insignificant losses, endanger public safety and order, and disrupt community life. Sharp weapons are not always prohibited from use or possession; examples are domestic sharp weapons, agricultural weapons, heirloom weapons, and antiques. Those caught in possession of bladed weapons without a license are liable to ten months' imprisonment. To hold criminals accountable for their activities, there are penalties for those who violate criminal provisions. In this case, police officers must conduct raids with strict supervision if carrying sharp weapons without a license.

Abstract

Kuta Beach is a very special beach in Bali, a beach visited by foreign and local tourists, in terms of security and legal protection, tourism managers often do not care about this, in practice it is found that tourists complain about security and legal protection at Kuta Beach based on Law Number 10 of 2009 concerning Tourism related to security and legal protection based on this, the problem is formulated, namely 1) How is tourism management in terms of tourist safety at tourism destinations on Kuta Beach Badung? And 2). How is legal protection for tourists to increase a sense of comfort when visiting Kuta Beach Badung? The research method used is the type of empirical legal research with the type of legislative approach. The results of this study indicate that the Kuta Beach manager, namely the customary bendesa, has made efforts to provide legal protection and security by establishing a beach task force and cooperating with the Police in the Kuta Village Area and applying preventive and repressive laws in the Kuta Beach area, in solving problems in the Kuta Beach area using non-litigation channels.

Abstract

Indonesia is abundant with rich natural resources. The natural resources available in Indonesia provide many uses for humans. Due to their irreplaceable nature and vital role for human life, conservation of natural resources is an absolute responsibility for every generation. Currently, conservation efforts are the most discussed topic of conversation. This research is a normative type of legal research, meaning that this research begins with a deductive analysis of the provisions in the governing legislation. The results show that environmental protection for natural resource conservation is regulated in Law No. 5 of 1990. In addition, the law also regulates criminal sanctions for violators who pollute natural resources. Law No. 5 of 1990 contains legal provisions relating to rights, obligations, and authorities in an effort to protect and manage natural resources. Criminal sanctions are a form of punishment that aims to ensure that legal rules regarding natural resource conservation management are respected and adhered to in accordance with the law.

Abstract

Village tourism is important in the world of tourism. But it actually causes exploitation, as for the formulation of the problems taken in this study, namely: (1) How is the implementation of the principle of local wisdom in environmental protection and management in Ubud Tourism Village? (2) How are the supporting and inhibiting factors for the implementation of the principle of local wisdom in the protection and management of the environment in Ubud Tourism Village? The research method used is the type of empirical law research with the type of fact, legislation, and conceptual approach. The results of the study are the implementation of the principle of local wisdom in environmental protection and management in Ubud Tourism Village is carried out traditionally by the Tourism Village Manager, and the surrounding community manages environmental protection with a local wisdom approach. Supporting factors for the implementation of local wisdom principles in environmental protection and management in Ubud Tourism Village are the strong implementation of awig-awig. The inhibiting factor of the implementation of the principle of local wisdom in Ubud Tourism Village is the absence of clear Regional Regulation and lack of socialization.

Abstract

The regulation of spatial planning regarding the conversion of agricultural land into tourist attractions in Bali is analyzed through a scientific approach, examining its impacts on the environment, economy, and local community's social aspects. The research focuses on policies, regulations, and spatial planning implementations influencing land transformation. In this context, the problem formulation revolves around (1) how spatial planning regulates the conversion from agricultural land to tourist areas in Bali?, and (2) how its legal implications on spatial planning due to such transformation. This study adopts a normative law approach, indicating that the regulation of spatial planning concerning the conversion of agricultural land into tourist areas in Bali is outlined in the Provincial Regulation of Bali Number 2 of 2023 regarding the Spatial Planning Plan of Bali Province for the Year 2023-2024. The legal impacts of the transformation of agricultural land into tourist areas in Bali will depend on the regulations in force in Bali.
