Abstract

ABSTRAK Tidak adanya pedoman pemberian pidana yang umum (norma kosong) menyebabkan hakim mempunyai kebebasan untuk menentukan jenis pidana, cara pelaksanaan pidana dan tinggi atau rendahnya pidana. Bisa terjadi dalam suatu delik yang sama atau sifat berbahayanya sama tetapi pidananya tidak sama. Namun kebebasan ini tidak berarti bahwa hakim boleh menjatuhkan pidana dengan kehendaknya sendiri tanpa ukuran tertentu. Tujuan dalam penelitian ini untuk menganalisis (1) Penyebab terjadi disparitas putusan hakim pada Pengadilan Negeri Jakarta Barat terhadap penyalahguna narkotika; dan (2) Pengaturan disparitas penjatuhan pidana oleh hakim dalam perkara tindak pidana narkotika. Penelitian ini menggunakan jenis dan pendekatan penelitian kualitatif. Teknik analisis data yang digunakan teknik analisis data kualitatif dengan interaktif model dari Miles dan Huberman. Hasil penelitian menunjukkan (1) Penyebab terjadi disparitas putusan hakim pada Pengadilan Negeri Jakarta Barat terhadap penyalahguna narkotika meliputi tidak bekerjanya elemen-elemen Sistem Peradilan Pidana sebagaimana mestinya menurut aturan perundang-undangan yang berlaku; dan (2) Pengaturan disparitas penjatuhan pidana oleh hakim dalam perkara tindak pidana narkotika berdasarkan prinsip kemerdekaan hakim, kemerdekaan hakim atau independensi hakim merupakan cara berpikiran hakim terhadap subjek maupun objek di dalam suatu kasus/perkara di luar dirinya sehingga dapat memeriksa, mengadili dan memutuskan perkara berdasarkan fakta, hukum, dan keyakinan dalam diri hakim. Kata Kunci: Disparitas, Putusan Hakim, Pengadilan Negeri, Narkotika.

Abstract

Currently, there are around 12,295 refugees registered at the UNHCR office in Indonesia. However, many of them have an unclear fate, and many of them have even held demonstrations in various places in Indonesia. The empirical legal research with a comparative approach that was conducted resulted in the following conclusions: a) The chaotic handling of foreign refugees in Indonesia is caused by the negative stigma of the community and government towards the existence of foreign refugees, institutional problems, and socio-economic conditions that do not support facilitating employment opportunities for foreign refugees; b) Indonesia and Malaysia are not obliged to accept refugees because they are not signatories to the 1951 Refugee Convention and the 1967 Refugee Protocol. However, the two countries continue to accept them temporarily for humanitarian reasons. The system for handling foreign refugees in Malaysia is more controlled because the legal system adopted also influences Malaysia's firm stance towards foreign refugees. The government must immediately improve the mechanism for handling asylum seekers and foreign refugees in Indonesia so that institutional problems can be overcome and create a more focused handling system that is able to form a firm stance regarding the existence of foreign refugees in Indonesia.

Abstract

Abstract Immigration is a vital instrument in safeguarding a nation's sovereignty and security, especially amid increasing global mobility driven by advances in transportation technology and the openness of international relations. As a popular destination for tourism and foreign labor, Indonesia faces significant challenges in monitoring the movement and activities of foreign nationals within its territory. Law Number 6 of 2011 on Immigration regulates various types of residence permits for Foreign Nationals (FNs), including Visit Stay Permits (ITK), Limited Stay Permits (ITAS), Permanent Stay Permits (ITAP), and Special Immigration Stay Permits. To support its supervisory function, the Directorate General of Immigration developed the Foreign Nationals Traffic Module System (MOLINA), a digital information system that records and analyzes real-time data on the movement of FNs. Although MOLINA has proven effective in supporting immigration supervision, administrative services, and enforcement, it lacks explicit legal grounding within the Immigration Law, leading to a legal vacuum and raising concerns regarding administrative legitimacy and personal data protection. Therefore, this research is crucial as a normative legal study of the legality and legal status of MOLINA from the perspective of Indonesia’s positive law. It also responds to the rising number of stay permit violations by foreign nationals in strategic areas such as Bali and aims to encourage regulatory reform in immigration to become more adaptive to technological developments and the demands of fair law enforcement. Abstract

Abstract The existence of laws and regulations in Indonesia reflects the principle of popular sovereignty, realized through a democratic legislative process, stipulated in Law No. 12 of 2011 and organized through the systematic National Legislation Program (Prolegnas) based on scientific studies through Academic Papers. This process involves synergy between the House of Representatives (DPR), the Government, and the Regional Representatives Council (DPD) in deliberative debates aimed at producing quality laws. However, globalization brings challenges in the form of harmonizing national law with international standards, the involvement of non-state actors, and human rights and environmental issues. Therefore, the legal system must adapt to remain responsive and oriented towards the values of Pancasila and local wisdom as the nation's identity in facing global dynamics. This research aims to provide an in-depth analysis. Using a descriptive-analytical approach, this study is expected to provide a comprehensive overview of the legal and regulatory challenges faced. Abstract

The increase in international mobility requires innovations in immigration services that are fast, efficient, and secure. One of the innovations implemented by the Directorate General of Immigration Indonesia is the use of the autogate system, which allows immigration checks to be performed independently by travelers through passport scanning and biometric data. This system aims to expedite the inspection process, reduce queues, and enhance the accuracy and transparency of immigration surveillance. This study aims to analyze the implementation of the autogate system within the context of Indonesian immigration law, referring to Law Number 6 of 2011 on Immigration. The approach used covers the philosophical, legal, and sociological aspects of applying autogate as an instrument for modernizing immigration services. The results show that the use of this technology supports the principles of efficiency, transparency, and national security protection. However, technical challenges, regulations, and inter-agency data integration remain obstacles to its optimal implementation. Therefore, this study is expected to contribute to public policy and the refinement of a technology-based immigration system that is grounded in legal certainty and national interests. Abstract

Abstract This study examines the implementation of the Standard Operating Procedure (SOP) for immigration inspection by the Class I Special Immigration Office at TPI Ngurah Rai as a preventive measure against immigration violations committed by foreign nationals. The background of this research stems from the increasing influx of foreigners into Indonesia, particularly through I Gusti Ngurah Rai International Airport in Bali, which has been accompanied by a rise in administrative violations such as overstaying and visa misuse. The study employs a juridical-empirical approach by analyzing the relevant legal frameworks and their practical application in the field. The findings indicate that the implementation of the SOP, including the use of autogate technology and the immigration information system, has improved the efficiency and accuracy of inspection procedures. However, the autogate system also creates potential gaps in oversight that may be exploited by foreign nationals seeking to bypass regulations. Therefore, strengthening the SOP is necessary through regular evaluation, capacity building of personnel, and balanced integration of manual and digital systems. This study recommends a review of the autogate SOP to ensure its alignment with the principles of legal certainty, national security, and orderly immigration administration. Abstract

Abstract Globalization has brought significant changes in international relations, particularly through increased interaction in the fields of economics, politics, society, and law. One of the most evident impacts of globalization is the growing influence of international law on national legal systems. Indonesia, as part of the global community, has begun adopting various international legal principles, especially in the areas of trade and communication, making its national law more open and transnational in nature. This development also demands that law be more responsive to social dynamics and public policy. Law is no longer static, but must be able to interact with societal interests and the international community. However, globalization also presents challenges, particularly concerning differences in legal systems between countries, such as common law and civil law. To address this, legal harmonization is necessary, aligning principles and procedures through bilateral negotiations, international conventions, or the adoption of model laws from institutions such as UNCITRAL. Fields such as trade, arbitration, and human rights demonstrate the importance of legal harmonization, provided it still respects the legal sovereignty of each country. Abstract

Abstract Globalization has significantly influenced national legal systems, including the legislative process in Indonesia. This study aims to analyze the impact of globalization on the substance, methods, and standards of national law-making, as well as to identify the challenges and opportunities in maintaining Indonesia’s legal sovereignty amid the globalization of law and the integration of international norms. This research employs a normative juridical method using a conceptual and statutory approach. The findings reveal that globalization encourages the adoption of universal values such as human rights, free trade, and environmental protection into Indonesian legislation. However, challenges arise from the potential erosion of national legal authenticity and the dominance of global actors. On the other hand, opportunities emerge for Indonesia to strengthen its position in international legal forums. Therefore, it is essential for Indonesia to strike a balance between global adaptation and national interest to ensure a sovereign yet globally relevant legal system. Abstract

Valuable possessions or inheritances are objects that can be inherited, inheritance in this case is not only about tangible objects such as land, houses, jewelry, and so on, but works of art are also the inheritance rights of the creator that can be inherited. to his family. This article applies normative juridical research methods to analyze the copyright transfer process and identify its implications for Article 1320 of the Civil Code. Research highlights that while copyright is transferable, such actions can violate positive legal provisions. As a result, this study offers a new perspective on the conflict between copyright transfer and existing legal norms, providing a basis for a rethink of relevant regulations. The implications of these findings could impact on further understanding of the relationship between copyright, inheritance, and legal protection of minors.

Abstract

Tourism plays a vital role in supporting the economy while preserving cultural values. Several things need attention in tourism development, one of which is the emergence and arrangement of tourism destinations, which the development of a sustainable tourism sector must support. Based on this background, the problem was formulated: how to regulate the law against discriminatory acts in the tourism sector and how the phenomenon of discriminatory acts against tourism entrepreneurs in Indonesia. The research method used in this research is normative law research. This study concludes that legal arrangements for safe tourism development are regulated based on Article 26 paragraph (d) of Law no. 10 of 2009 concerning Tourism is obliged to provide comfort, friendliness, protection of security and safety of tourists. In addition, according to Article 23 paragraph (1) letter a of Law no. 10 of 2009, the government and regional governments are obliged to provide tourism information, legal protection, as well as security and safety to tourists
