Abstract

This study aims to analyze the problems faced by the Criminal Investigation Unit of the Bulungan Police Resort in North Kalimantan in handling murder cases involving elderly people in social care facilities. This study also aims to propose solutions and techniques to deal with these investigative problems. This study discusses the challenges faced by the Bulungan City Police Resort criminal investigation unit in handling murder cases involving elderly victims. This emphasizes the importance of quality training for investigators to effectively address the complexity of such cases. Data collection methods included document analysis and interviews. The data analysis method used is qualitative descriptive analysis. This study highlights the challenges faced by the criminal investigation unit in handling murder cases involving elderly victims at the Bulungan City Police Resort. This research identifies difficulties in the management and use of evidence in criminal investigations, including challenges in collecting and examining evidence at crime scenes. This study emphasizes the need for quality training for researchers to effectively address the complexity of such cases. The research analysis concluded that the investigation of violence against the elderly at the Tresna Wherda Social Home faces challenges such as limited evidence, complex cases, and possible mental disorders of the perpetrators. Handling violence against the elderly requires a holistic approach involving the police, health institutions, social workers, and the community as a whole

Abstract

Penelitian ini dilatarbelakangi oleh maraknya pemutusan hubungan kerja pasca berlakunya Undang-Undang Cipta Kerja dan Putusan Mahkamah Konstitusi Nomor 168/PUU-XXI/2023, yang berdampak signifikan terhadap hak-hak pekerja dan stabilitas hubungan industrial. Rumusan masalah dari penelitian ini yaitu pemenuhan keadilan bagi pekerja yang terdampak PHK pasca Putusan Mahkamah Konstitusi Nomor 168/PUU-XXI/2023. Teori yang digunakan dalam penelitian ini adalah teori keadilan dan teori perlindungan hukum. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Adapun hasil penelitiannya menunjukkan bahwa pemenuhan hak pekerja pasca pemutusan hubungan kerja belum sepenuhnya memenuhi prinsip keadilan substantif maupun prosedural. Jaminan Kehilangan Pekerjaan dan Putusan Mahkamah Konstitusi memberikan perlindungan tambahan, namun masih terdapat ketimpangan, terutama bagi pekerja Perjanjian Kerja Waktu Tertentu dan pencari nafkah tunggal. Kesimpulannya adalah pemenuhan hak pekerja pasca PHK dan Putusan MK Nomor 168/PUU-XXI/2023 menunjukkan perlindungan hukum masih belum optimal, terutama bagi pekerja rentan dan PKWT. Sarannya Pemerintah perlu memperkuat implementasi JKP dan mekanisme PHK yang adil, memastikan perlindungan pekerja rentan serta transparansi prosedural. Sementara pengusaha disarankan menerapkan praktik PHK yang manusiawi dan berkeadilan, termasuk pembayaran pesangon sesuai ketentuan, serta mendorong dialog bipartit untuk menjaga stabilitas hubungan industrial dan memperkuat kepercayaan pekerja.

Abstract

This study examines juvenile criminal liability and judicial reasoning in Decision No. 12/Pid.Sus-Anak/2025/PN Sbw through the lens of proportional justice. Employing normative (doctrinal) legal research, the study applies statutory, conceptual, and case approaches by analyzing the applicable legal framework on juvenile justice and sexual violence, relevant criminal law doctrines on liability and causation, and the structure of the court’s reasoning. The findings show that the elements of criminal liability were established covering the actus reus, mens rea, accountability, and the causal nexus between the conduct and the victim’s injury, and yet the sentencing rationale largely centered on the offender’s status as a child under the Juvenile Criminal Justice System Act. As a result, the judgment did not sufficiently articulate the victim’s severe reproductive harm as a decisive aggravating factor for proportional sentencing. This study argues for more robust and transparent judicial reasoning that integrates juvenile justice principles with victim-protection mandates, including a harmonized reading of the juvenile justice regime and the sexual violence legal framework, to secure a substantively fair balance between child protection and victims’ rights.

Abstract

The settlement of sexual harassment cases through peace agreements based on contracts remains a practice commonly found in society. This practice raises complex legal issues as it lies at the intersection of civil law and criminal law. On one hand, civil law recognizes contracts as legally binding instruments provided that the legal requirements of validity are fulfilled. On the other hand, sexual harassment constitutes a criminal offense, meaning that its resolution cannot rely solely on the agreement of the parties involved. This study aims to analyze the settlement of sexual harassment cases through contractual peace agreements from the perspectives of civil law and criminal law. The research employs a normative legal method using statutory and conceptual approaches. The legal materials consist of primary and secondary sources, which are analyzed qualitatively. The findings indicate that peace agreements in sexual harassment cases may be considered legally valid only if they fulfill the legal requirements of a contract, particularly the existence of free consent and a lawful cause. From a criminal law perspective, a peace agreement between the perpetrator and the victim does not eliminate the unlawful nature of sexual harassment, as such acts involve public legal interests protected by the state. Therefore, peace agreements may only operate within the civil law domain and cannot be used as a basis to negate criminal law enforcement processes.
