Abstract

This study discusses the urgency of premarital health checks for women from the perspective of maqāṣid al-sharīʿah by emphasizing how the values of benefit can address contemporary issues related to women's reproductive health. One of the issues raised is whether premarital checks, which in some regions are beginning to be directed as administrative requirements, have the potential to marginalize women, especially if applied asymmetrically only to prospective brides. Thus, this study formulates two main questions: (1) how does maqāṣid al-sharīʿah view premarital health checks for women? and (2) can premarital checks be categorized as a hajj necessity or even elevated to darūriyyāt under certain conditions? This study uses a qualitative method with a normative nature through a literature study approach. Data were collected from fiqh literature, contemporary fatwas, national regulations, and reproductive health studies. They were then analyzed using the maqāṣid al-sharīʿah framework, which focuses on the five main objectives of Syarī‘ah, specifically the preservation of the soul and the preservation of the nasl. The results of the study indicate that premarital health checks, especially for women, are generally categorized as hajj because they aim to preserve the soul and prevent harm after marriage. However, under certain conditions, such as the potential for transmission of genetic diseases or infectious diseases, these examinations can be elevated to the category of darūriyyāt. The study also emphasizes that the obligation of premarital checks must be applied fairly and symmetrically to men and women to avoid bias or administrative marginalization. These findings contribute to strengthening policies at the Office of Religious Affairs (KUA), the development of gender-responsive national regulations, and the development of welfare-oriented family jurisprudence.

Abstract

This study discusses the understanding of millennial brides of Generation Z towards sighat taklik after ijab kabul in brides and grooms who carry out weddings at the Sambas Religious Affairs Office, West Kalimantan. The understanding of millennial brides about sighat talik in KUA is that every millennial bride and groom after carrying out ijab kabul, especially men (husbands), some recite sighat taklik and some do not pronounce sighat taklik whose manuscript is in the marriage book. From this case, the pros and cons of the bride and groom after ijab kabul arise, so the question arises whether the pronunciation of sighat taklik is an obligation or not?. The focus of this research is how millennial brides of generation Z understand sighat taklik after ijab kabul at KUA Sambas, West Kalimantan?. The method in this study is to use a qualitative field approach while the approach in this study uses phenomenology. The findings in this study from eight respondents interviewed, namely the bride and groom, four of the bride and groom did not know the existence of sighat taklik and did not pronounce sighat taklik and four bride couples knew and pronounced the sighat taklik in the marriage book. The conclusion in this study is the occurrence of pros and cons to the sighat taklik in the marriage book, the lack of emphasis on socialization from the BP4 in the premarital material to the prospective bride and groom, and the lack of knowledge of the bride and groom in the affirmation of knowledge of the Marriage Law No. 1 of 1974, article 29 of the marriage agreement, and the understanding of the Compilation of Islamic Law article 46 concerning taklik talaq.

Abstract

Penelitian ini bertujuan menganalisis serta membandingkan pemikiran tokoh orientalis yang mengkaji Al-Quran serta memberikan pandangan cendekiawan muslim dalam melihat perkembangan pemikiran orientalis. Tujuan penelitian ini untuk melihat sejauh mana perbandingan dan perbedaan pendapat orientalis dalam melakukan pengkajian Alquran. Penelitian ini bersifat penelitian kepustakaan dengan metode kualitatif diskriptif Sumber data penelitian ini berasal dari berbagai literature baik buku, jurnal yang terkait dengan penelitian ini. Hasil penelitian ini menunjukkan perbandingan kedua tokoh orientalis dalam mengkritik Al-Quran. Perbedaan yang terdapat ialah Noldeke lebih cenderung melihat Al-Quran dari sisi sejarah turunya Al-Quran dan proses penulisan Al-Quran, sedangkan Watt ia lebih mempersoalkan ayat-ayat Al-Quran yang dianggap ditambahkan oleh Muhammad sesuai dengan kebutuhan umat saat itu. Serta pandangan cendekiawan muslim yang menganggap pandangan orientalis tersebut terlalu obyektif.

Abstract

The issue of Islamic education has always been an intriguing topic of scholarly inquiry. The use of hermeneutics as the foundational basis of Islamic education is grounded in the Qur’an and prophetic teachings. The objective of this study is to analyze the extent to which the hermeneutic method can serve as a foundation for Islamic education. This research employs a qualitative method with a library research approach. The data sources consist of both primary and secondary materials. Primary data were obtained from key reference books, while secondary data were drawn from relevant journals, books, magazines, and other documents related to this research. The data were analyzed using content analysis. The findings indicate that Islamic education requires the integration of cognitive, affective, and spiritual dimensions, all of which aim to bring human beings closer to God and to actualize their human potential. Thus, Qur’anic and prophetic hermeneutics offer a dynamic conceptual framework for understanding Islamic education as a process of meaning-making rather than merely a transfer of knowledge.

Abstract

The phenomenon of inter-country marriage is one of the social trends that is growing rapidly in various border areas, including in Sambas Regency, West Kalimantan, which borders Malaysia directly. This interstate marriage is not only about administrative and civic aspects, but also has implications for domestic life, especially in terms of harmony, religious values, and culture. This study aims to examine the trend of interstate marriage in the Sambas region and analyze its relevance to domestic harmony in the perspective of Islamic Family Law. This study uses a qualitative approach with field study methods, in-depth interviews, and documentation of transnational married couples, and local religious leaders. The results of the study show that the main motives for interstate marriage in Sambas include economic factors, the openness of border areas, and social and cultural relations that have been established for a long time. However, in practice, intercountry marriages often face serious challenges such as cultural differences, worship practices, maintenance obligations, and marriage legal status that is not always clear nationally or internationally. From the perspective of Islamic Family Law, domestic harmony is highly dependent on the principles of mawaddah, rahmah, and shared responsibility between husband and wife, which must be built on an understanding of religious values and a strong commitment. Therefore, legal regulation and the development of cross-border premarriage are urgently needed so that interstate marriage does not become a source of conflict, but rather strengthens family ties and Islamic values in the midst of globalization dynamics. [Fenomena perkawinan antar negara menjadi salah satu tren sosial yang berkembang pesat di berbagai wilayah perbatasan, termasuk di Kabupaten Sambas, Kalimantan Barat, yang berbatasan langsung dengan Malaysia. Perkawinan antar negara ini tidak hanya menyangkut aspek administratif dan kewarganegaraan, tetapi juga membawa implikasi terhadap kehidupan rumah tangga, khususnya dalam hal keharmonisan, nilai-nilai agama, dan budaya. Penelitian ini bertujuan untuk mengkaji tren perkawinan antar negara di wilayah Sambas serta menganalisis relevansinya terhadap keharmonisan rumah tangga dalam perspektif Hukum Keluarga Islam. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi lapangan, wawancara mendalam, dan dokumentasi terhadap pasangan suami istri lintas negara, dan tokoh agama setempat. Hasil penelitian menunjukkan bahwa motif utama terjadinya perkawinan antar negara di Sambas meliputi faktor ekonomi, keterbukaan wilayah perbatasan, serta hubungan sosial dan budaya yang telah terjalin sejak lama. Namun, dalam praktiknya, perkawinan antar negara seringkali menghadapi tantangan serius seperti perbedaan budaya, praktik ibadah, kewajiban nafkah, serta status hukum perkawinan yang tidak selalu jelas secara nasional maupun internasional. Dalam perspektif Hukum Keluarga Islam, keharmonisan rumah tangga sangat bergantung pada prinsip mawaddah, rahmah, dan tanggung jawab bersama antara suami dan istri, yang harus dibangun di atas kesepahaman nilai agama dan komitmen yang kuat. Oleh karena itu, regulasi hukum dan pembinaan pranikah lintas negara sangat dibutuhkan agar perkawinan antar negara tidak menjadi sumber konflik, tetapi justru memperkuat ikatan keluarga dan nilai-nilai keislaman di tengah dinamika globalisasi.]
