Abstract

Population has been a complex problem in development these days, especially in Denpasar, rapid population growth with limited support and capacity is the main problem. In conncetion to that, this research is aiming to find out 2 (two) things: first, to know juridical regulation for migrants in Denpasar. Second, to know about the involment of Pakraman Village (Customary Village) in managing migrants. This research uses statute approach. According to research it is concluded that: first, to anticipate rapid population growth or manage migrants in legal area of Denpasar, Government of Denpasar bases its authority in 1945 Constitution of the Repulic of Indonesia, Law Number 23 of 2014, Law Number 23 of 2006 as amended in Law Number 24 of 2013, Local Government of Bali Act Number 10 of 1998, Local Government of Bali Act Number 3 of 2001, Local Government Act Number 5 of 2014 concerning Amendement of Local Government Act of Denpasar Number 6 of 1996 concerning Framework Implementation for Population Registration in Population Management Information System, Mayor Act Number 593 of 2000 concerning Migrants Management. This act is also amended to Mayor Act Number 610 of 2002 concerning Amandement of Mayor Act Number 539 of 2000. Second, the involment of Pakraman village in managing migrants in Denpasar is regulated under the said Local Government Act, Mayor Act and Agreement between Government with Pakraman Village in Denpasar. The regulation is clear, giving the village authority to manage migrants in accordance to local customary law in force (awig-awig). This Research recommends that a clearer regulation in awig-awig and implementation of policies concerning migrants management is needed. Masalah kependudukan telah menjadi persoalan yang sangat kompleks dalam perkembangan dewasa ini, khususnya di Kota Denpasar, pertumbuhan penduduk sangat pesat dengan daya dukung serta daya tampung sangat terbatas menjadi persoalan utama. Berhubungan dengan hal tersebut maka dilakukan penelitian untuk mengetahui 2 (dua) hal yaitu : pertama, untuk mengetahui pengaturan secara yuridis penduduk pendatang di Kota Denpasar. Kedua, untuk mengetahui mengenai keterlibatan desa pakraman dalam pengendalian penduduk pendatang. Pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan (statue approach). Berdasarkan hasil penelitian dapat disimpulkan sebagai berikut : pertama, untuk mengantisipasi ledakan kependudukan ataupun pengendalian penduduk pendatang di wilayah hukum Kota Denpasar, Pemerintah Kota Denpasar mendasarkan kewenangannya dengan UUD Negara Republik Indonesia Tahun 1945, UU 23 Tahun 2014, UU 23 Tahun 2006 sebagaimana telah diubah dengan UU Nomor 24 Tahun 2013, Perda Provinsi Bali 10 Tahun 1998, Perda Provinsi Bali 3 Tahun 2001, Perda 5 Tahun 2014 tentang Perubahan atas Peraturan Daerah Kota Denpasar Nomor 6 Tahun 1996 tentang Penyelenggaraan Pendaftaran Penduduk dalam Kerangka Sistem Informasi manajemen Kependudukan (SIMDUK), Keputusan Walikota Nomor 593 Taun 2000 tentang Penertiban Penduduk Pendatang. Keputusan ini juga terjadi perubahan yaitu Keputusan Walikota Denpasar Nomor 610 Tahun 2002 tentang Perubahan Keputusan Walikota Denpasar Nomor 539 Tahun 2000. Kedua, mengenai pelibatan Desa Pakraman dalam pengendalian penduduk pendatang di Kota Denpasar diatur secara jelas di dalam Perda, Keputusan Walikota dan Kesepakatan Kerja sama antara Pihak Kedinasan dengan Pihak Desa Pakraman di Kota Denpasar. Pengaturan secara jelas keterlibatan Desa Pakraman, memberikan otoritas kepada Desa Pakraman dalam pengendalian Penduduk pendatang sesuai dengan awig-awig desa pakraman setempat. Rekomendasi penelitian adalah perlu adanya pengaturan lebih jelas dalam awig-awig desa pakraman dan penerapan kebijakan-kebijakan hukum yang sungguh-sungguh terkait dengan pengendalian penduduk pendatang.

Abstract

This article was written based by result of normative legal research about the regulation of padagelahang marriage on customary law that created by customary law society of desa pakraman inBali. That research was aimed to identify legal norms in awig-awig desa pakraman that regulateabout pada gelahang marriage.From that research’s result, it was known that aspect of matrimonial law has been regulated inawig-awig, whic is on certain chapter that regulate family law. That chapter titled Sukerta TataPawongan, that regulate the legal aspects about marriage, divorce, lineage, and inheritance.Although, the research result aslo shown that on nine awig-awig desa pakraman researched, onlyone that regulate about pada gelahang marriage, which is Awig-Wig Desa Pakraman Gadungan(Tabanan). The regulation is rather ambigious, only regulate about recognition of pada gelahangmarriage existance, without any further regulation about requirements, procedure or it’s legalconsequences.

Abstract

Kondisi perekonomian di Bali yang bergantung pada kegiatan pariwisata menjadi terpuruk sebagai dampak dari Covid-19. Hal ini menjadi pelajaran kepada setiap lapisan termasuk Desa Adat di Bali untuk bersama-sama menangani Covid-19. Penelitian ini bertujuan untuk menganalisis dan mengkaji implementasi otonomi Desa Adat serta mengelaborasi model sinergi yang tepat dalam rangka percepatan penanganan Covid-19. Hasil penelitian menunjukkan bahwa otonomi Desa Adat dalam penanganan Covid-19 ditempatkan pada peran strategis Desa Adat dalam pembentukan aturan hukum adat yaitu Pararem yang bertujuan untuk mengatur kehidupan masyarakat hukum adat Bali sesuai dengan hukum nasional yang berlaku di Indonesia. Hal ini menunjukkan model sinergi berlakunya hukum adat dan hukum nasional sesuai dengan konsep pluralisme hukum dan regulatory compliance.

Abstract

Children’s problems lately are very complex. Many cases occur in the community that ignore the fulfillment of children’s rights. One is the lack of fulfillment of children’s rights on birth certificates. In connection with this matter, it is important to do research to find out 2 (two) things, namely; first, to find out about children’s rights in obtaining birth certificates to Balinese indigenous people. Second, to find out whether a child can get a birth certificate if the birth registration goes beyond the deadline. In accordance with the research objectives, the research method used isa normative research method with a statue approach. The results of this study are legal protection of children’s rights in obtaining birth certificates in the community has been regulated starting from the 1945 Constitution of the Republic of Indonesia, Law of the Republic of Indonesia Number 23 of 2002 concerning Child Protection, Law of the Republic of Indonesia Number 23 The year 2006 was amended by the Republic of Indonesia Law Number 24 of 2013 concerning the Implementation of Population, Badung Regency Regional Regulation Number 10 of 2010 which was amended by Badung District Regulation Number 9 of 2016 concerning Amendment to Badung Regency Regional Regulation Number 10 of 2010 concerning Implementation Population Administration, Regional Regulation of Denpasar City Number 5 of 2014. Birth Registration that exceeds the fixed time limit can be done by requesting approval from the Head of the Population and Civil Registration Office. The advice can be given 1) socialization is needed regarding the procedures for registering births including procedures for registering online and needing to improve services by the Regional Government. For the community, the need for public awareness of the importance of having a birth certificate as a manifestation of children’s rights in obtaining a birth certificate. Abstract

Desa adat sebagai kesatuan masyarakat hukum adat yang memiliki otonomi berdasarkan hak konstitusionalnya. Namun penjabaran dalam Peraturan perundang-undangan tidak ada mengatur mengenai status desa adat sebagai subyek hukum. Ketidakjelasan status desa adat menyebabkan desa adat kurang berani melakukan tindakan terhadap tanah adat termasuk pengelolaan tanah adat. Dalam membahas persoalan ini metode penelitian normatif tepat digunakan untuk menjawab isu ketidakjelasan status desa adat. Tujuan penelitian ini untuk mengungkap kejelasan status desa adat sebagai subjek hak kepemilikan atas tanah yang berimplikasi pada kewenangan desa adat dalam pengelolaan tanah adat di Bali. Hasil penelitian ini menunjukan bahwa dasar kepemilikan atas tanah adat oleh desa adat telah diatur secara jelas dalam Keputusan Menteri Agraria dan Tata Ruang/ Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 276/KEP-19.2/X/2017 tentang Penunjukan Desa Pakraman di Provinsi Bali sebagai Subjek Hak Kepemilikan Bersama (Komunal) Atas Tanah dan kewenangan desa adat dalam pengelolaan tanah adat diatur dalam Perda 4 Tahun 2019 tentang Desa adat Di Bali.

Abstract

Reforms have been carried out by the government through many land reform programs that regulate land ownership and legal relations between owners and land objects, so that a prosperous and productive society is created to advance the national economy and food security. One of them is the prohibition of agricultural land ownership regulated in article 10 paragraph (1) of the Basic Agrarian Law. It is expected that the owners of agricultural land will work on their own land so that productivity will be maximized, the community will be taught to work and be productive regularly and routinely. But in reality in the field in Jabalsari village Sumbergempol subdistrict Tulungagung regency there are still many people who control agricultural land absentee and interpreted the rules of ownership of agricultural land absentee not yet effective, so this research aims to find out the causes of absentee ownership of agricultural land and how a large role Tulungagung Regency National Land Agency in terms of absentee ownership of agricultural land. This research is carried out using the Empirical Juridical method namely how the law is implemented in social life. The results of research conducted in Jabalsari village Sumbergempol Sub-district Tulungagung District showed that absentee land ownership in Tulungagung District occurred due to many factors namely: community awareness factors, cultural factors, legal factors, law enforcement factors in the area, facility and infrastructure factors as well as quite a lot It was found that economic factors, and the responsibility of the National Land Agency of Tulungagung Regency still reached the supervision of certified land and improved administration of agricultural land data, this was done so that in the future it would run and orderly administration of the problem of absentee ownership of agricultural land.

Abstract

The purpose of this paper is to find out the legality of the position of property rights certificates and the strength of proof of property rights certificates as legal evidence of ownership in Indonesia. This paper uses the normative legal method. This study uses a legal and conceptual approach. The results of the study indicate that the certificate of ownership has a legal status because it is explicitly and explicitly regulated in the laws and regulations. The certificate of ownership has strong evidentiary power but is not absolute. The title certificate will become absolute if it has fulfilled the criteria stipulated in Article 32 paragraph (2) of the PP on Land Registration, namely legally issued, in good faith and in real control for more than 5 years.

Abstract

Abstract The purpose of scientific article is to examine how the arrangements for mortgages are stored at the PPAT Office which have become collateral in terms of offering interested parties to the mortgages and guarantees of guarantees for guarantees and the truth of the HT registration from the point of view of the duties and authorities of the PPAT. The method used in this article is normative juridical which is descriptive in nature with the approach to legislation, conceptual approach and comparative approach. The results of this study indicate that the application for Electronic HT Warkah can be made through the Regional Office of the BPN by interested parties and the PPAT in its implementation must check the data documents from the parties so that the Statement of Validity and Document Truth truly guarantees the validity of a legal act. The correctness of the material when uploaded in the electronic HT service is the responsibility of the sender of the document. There are 2 (two) people who send documents in the Electronic HT System, namely PPAT and Creditors. Abstrak Tujuan dari artikel ini yaitu pengkajian tentang pengaturan dokumen Hak Tanggungan yang disimpan di Kantor PPAT yang telah menjadi warkah dalam hal terdapat permohonan oleh pihak yang berkepentingan terhadap warkah Hak Tanggungan tersebut dan implikasi hukum surat pernyataan pertanggungjawaban keabsahan dan kebenaran dokumen pada pendaftaran HT Elektronik dipandang dari sudut tugas dan kewenangan PPAT. Metode yang dipergunakan dalam artikel ini yaitu Yuridis Normatif yang bersifat Diskriptif Analisis dengan pendekatan perundang-undangan (Statute Approuch) dan Pendekatan Perbandingan (Comperative Approach). Hasil dari penelitian ini menunjukkan bahwa permohonan warkah HT Elektronik dapat dilakukan melalui Kantor Wilayah BPN oleh pihak yang berkepentingan dan PPAT dalam menjalankan tugasnya harus melakukan pengecekan data dokumen dari para pihak agar Surat Pernyataan Keabsahan dan Kebenaran Dokumen yang dibuat merupakan surat yang benar-benar menjamin keabsahan dari suatu perbuatan hukum. Kebenaran materiil saat diupload dalam layanan HT elektronik jadi tanggung jawab pengirim dokumen. Yang menyampaikan dokumen didalam Sistem HT Elektronik ada 2 (dua) itu adalah PPAT dan Kreditor.

Abstract

Prinsip demokrasi yang dianut oleh Indonesia menuntut adanya transparansi dan keterbukaan dalam pembentukan kebijakan daerah. Secara legal formal prinsip demokrasi diatur dalam UU 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan. Dalam konteks ini, perlu dikaji dan dipahami apakah dalam pembentukan kebijakan daerah sudah berasaskan prinsip demokrasi serta perlu dikaji makna demokrasi dalam pembentukan kebijakan daerah. Metode penelitian yang digunakan adalah metode penelitian normatif dengan pendekatan  peraturan perundang-undangan dan pendekatan filsafat.  Hasil pembahasan adalah 1) bahwa makna dari penjabaran prinsip demokrasi dalam pembentukan kebijakan daerah dipahami pelibatan masyarakat dalam pembentukan kebijakan daerah. Pelibatan masyarakat dalam konteks legal formal disebut partisipasi masyarakat yang wajib terlibat dalam setiap tahapan pembentukan kebijakan daerah. 2) Penjabaran prinsip demokrasi  yang dimaknai sebagai partisipasi masyarakat dalam pembentukan kebijakan daerah dilakukan pada setiap proses pembentukan kebijakan daerah. Mulai dari tahap perencanaan, penyusunan, pembahasan, penetapan dan pengundangan kebijakan hukum daerah serta penjabaran prinsip demokrasi juga dituangkan dalam subtansi kebijakan hukum daerah.Kata Kunci : Demokrasi, Pembentukan Kebijakan Daerah The principles of democracy adopted by transparency and openness in the formation of regional policies. Legally formal democratic principles are regulated in Law 12 of 2011 concerning the Establishment of Legislation. In this context, it is necessary to study and understand about the formation of regional policies based on democratic principles and the meaning of democracy. The research method used is a normative research with statue approach and philosophical approach. The results of discussion are 1) the meaning of the elaboration of the democracy principles in the formation of regional policies is understood as involve the community in the formation of regional policies. Community involvement is called community participation which must be involved in every stage of regional policy formation. 2) The descriptions of principle of democracy to described in every process when forming regional policies, starting from the planning, drafting, discussion, determination and promulgation of regional legal policies. Abstract

The specific purpose and target of this research is to determine the role of family welfare empowerment organizations (PKK) in the prevention and early handling of women and children victims of violence. The reason for researching this topic is the increase in the number of victims of violence against women and children every year. Based on data from the Ministry of Women's Empowerment and Child Protection, it is shown that since 2012 it has increased from 18,718 to 54,041 cases in June 2017 and until February 2018 it has shown 374 cases of violence against women and children. In this case, the Government is responsible for providing optimal services needed by victims, both medical, psychological, and legal assistance in an effort to recover their condition. The government in providing services to victims should cooperate and partner with the community, especially in the prevention and early handling of victims of violence. Prevention and early handling of victims of violence at the village level can empower family welfare empowerment organizations (PKK) which are government partners that are considered effective in the prevention and early handling of women and children victims of violence in their areas. Based on these reasons, it is necessary to study in depth the role of the PKK organization in preventing and early handling of women and children victims of violence. To achieve specific goals and targets in this study, the research method used is a normative research method with a statue approach and a conceptual approach.The results of the study provide an overview 1) there is a clear regulation in the laws and regulations related to the participation of the PKK in preventing and early handling of victims of violence, what needs to be further regulated is regulation in the form of Village Regulations and customary law (awig-awig) related to the participation of PKK and indigenous women in the prevention and early handling of victims of violence. 2) the procedures for preventing and early handling of victims of violence need to be stated in the operational standards in the village and the traditional village paparem.
