Abstract

Digital transformation fosters the massive utilization of Artificial Intelligence (AI) in creating literary, artistic, and musical works worldwide, including in Indonesia. The autonomous functioning of AI challenges the essential presumption that technology is merely a device in the hands of humans in the creation process of Works. This paper examines several legal issues and problems concerning the copyright-ability, authorship, and ownership of AI-generated works using a juridical normative approach. The result of the analysis shows that although the framework of Indonesia's copyright law is based on the principle of human authorship, the rapid development of AI must be balanced with an accommodating legal framework. In conclusion, the Indonesian government can open up the possibility of accepting AI's role in the creation of the work and formulate the limited artificial legal personhood of AI by granting exclusive rights, copyright protection, moral rights, and economic rights to individuals or groups of individuals who produce AI or whose contribution is required for AI function. This formulation is expected to encourage the utilization of AI also provide legal certainty and solve the problem concerning the lack of legal accountability for AI-generated works. In addition, the advancement of technical and legal support is needed in implementing this provisioning model.

Abstract

Van Gogh's immersive exhibition is held in more than 90 cities around the world including Berlin, Beijing, Paris, London, Madrid, Rome, Sydney, and Jakarta. Until mid-2023, the exhibition has been attended by more than 8.5 million visitors and is an example of intellectual property development. Corresponding to business, IP Development is the capitalization of ideas, creativity, and innovation in producing products or services that contain creative content through systems of human activity related to the creation, production, distribution, and consumption of goods and services that have cultural, artistic, aesthetic, intellectual and emotional values for consumers. This paper employs a descriptive-analytical approach to describe the relevant legal rules and legal theories of copyright and their application in the IP development of artworks for businesses and the opportunities for Indonesia. The finding of the study indicates that immersive technology as a platform for the development of artworks based on Traditional Cultural Expressions (TCEs) potentially creates opportunities for intellectual property legal protection and business development of Indonesia’s TCEs in the frame of Cultural Industries. The commercialization of TCEs using immersive technologies potentially helps in fulfilling two key objectives: capturing new audiences and contributing to economic profit. However, the involvement of legal and non-legal elements as the basis for the implementation conducted in a collaborative framework between state holders and relevant stakeholders is required

Abstract

The regulation of copyright ownership of works created in Public Service Relations, as stated in Article 35 of the Copyright Law, indicates an injustice in the protection of copyright ownership for creators. This research aims to examine the implementation of the principle of justice in copyright ownership of works created in Public Service Relations and to compare this with the regulations in Germany and France. This study employs a comparative normative juridical approach with a descriptive-analytical research specification. Data collection is conducted through literature studies. The method of analysis used is descriptive-analytical. The results show that the regulation in Article 35 of the Copyright Law lacks elements of justice for creators in Public Service Relations. This is due to the difference in recognition given to creators of works made in Public Service Relations compared to works made in employment relationships. Compared to the regulations in Germany and France, the regulation of copyright ownership for "works made for hire" in Indonesia does not yet provide adequate protection for creators.

Abstract

This research examines the urgency of incorporating authentic deeds in patent licensing agreements and formulating such documents to establish legal safeguards that enhance the effectiveness of patent licensing ventures. This study employed a normative juridical approach with analytical descriptive methods. The results showed that the integration of authentic deeds in patent licensing agreements ensures legal certainty for the involved parties, as these deeds serve as conclusive evidence to validate legal actions taken by the parties. Furthermore, authentic deeds act as a deterrent against bad faith actions by preventing parties from disavowing the agreement's contents. Additionally, there are no specific government-mandated formulations for patent licensing agreements. To achieve optimal legal protection, the formulation of an authentic deed in a patent license agreement should encompass aspects such as license exclusivity, limitations on patent usage, annual patent fees, information disclosure clauses, the equilibrium of patent use, sanctions, and dispute resolution.

Abstract

Pemanfaatan internet atau media elektronik telah menjadi bagian terpenting dalam hal meningkatkan suatu kinerja baik di bidang instansi pemerintahan maupun berbagai profesi lainnya. Salah satu profesi yang dikenal di masyarakat adalah profesi Notaris, Notaris sebagai pejabat umum bertugas untuk memberikan pelayanan kepada anggota masyarakat yang memerlukan jasanya dalam pembuatan alat bukti tertulis, khususnya berupa akta Autentik dalam bidang hukum perdata seperti pembuatan akta Jual beli, akta Pendirian Perseroan Terbatas, akta jaminan Fidusia, akta Keterangan Hak Waris, akta Wasiat, akta perjanjian Kerjasama dan lain-lain, Keberadaan notaris merupakan pelaksanaan dari hukum pembuktian. Penelitian ini mengkaji pelayanan Notaris secara elektronik dilihat dari implementasi, pengaturan dan kepastian hukumnya sebagai perwujudan dari konsep Cyber Notary dan E-Notary. Melalui pendekatan Yuridis normatif dengan metode deskriptif analitis ditemukan bahwa dari segi substansi, struktur dan kultur Indonesia masih memerlukan berbagai macam penyesuaian, pembaharuan maupun strategi kolaboratif untuk membentuk suatu harmonisasi dari aspek regulasi, dukungan dari insrastruktur teknologi dan sumber daya manusia serta kepercayaan terhadap jabatan notaris sendiri. Hal tersebut perlu adanya suatu pembenahan- pembenahan terkait dengan Harmonisasi subtansi dalam peraturan terkait jabatan Notaris serta sarana dan prasarana pendukung. Abstract

The development of information and communication technology has caused world relations to become borderless. This can be seen on the creation of a song that can easily be transformed into a new song and uploaded on a digital platform without the permission of the Copyright Holder of the changed song, as well as the legal acts committed by foreign nationals outside the territory of Indonesia, such as one of the cases that the author researched, involving the national song Halo-Halo Bandung, which allegedly was transformed into a song titled Hello Kuala Lumpur without permission and uploaded on a Malaysian YouTube account named Lagu Kanak TV. The purpose of this research is to determine and analyze the legal provisions that can be imposed on the Hello Kuala Lumpur song maker or the owner of the Lagu Kanak TV YouTube account and also to find out the legal actions that can be taken by the Heirs of the Creator and the Copyright Holder of the song Halo-Halo Bandung and the Indonesian Government. The research method used in this research is normative juridical, which is legal research that bases its study on legal regulations. There is an examination of legal documents related to this research topic. The data collection technique used is a literature study by reviewing the relevant literature and legal regulations. Based on the results of the research, it is known that the act of changing the song Halo-Halo Bandung into Hello Kuala Lumpur by Lagu Kanak TV and its broadcast through YouTube without permission is a form of Copyright infringement on moral rights and economic rights. Dispute resolution through negotiation is recommended for both parties because negotiation is an effective way of resolving disputes and has several advantages.

Abstract

Merek merupakan tanda dan ciri-ciri yang melekat kepada barang dan jasa. Sebagai suatu bagian dari kekayaan intelektual, pemilik dari merek dagang mendapatkan hak eksklusif untuk melindungi merek dagangnya. Pelindungan yang diberikan terhadap merek dagang perlu dan layak untuk diimbangi dengan penggunaan asas itikad yang baik didalamnya. Pemerintah telah melindungi merek sebagai bagian dari kekayaan intelektual berdasarkan Undang-Undang Nomor 20 Tahun 2016, meskipun tantangan tetap ada seperti adanya tindak perundungan merek dagang. Perundungan merek dagang sudah cukup umum terjadi di Indonesia, namun belum ada pengaturan yang jelas untuk memberikan pelindungan kepada pegiat usaha dalam menghindari terjadinya tindak perundungan merek dagang. Metode penelitian yang digunakan adalah menggunakan pendekatan secara yuridis normatif dengan penggunaan studi dokumen atau bahan pustaka yang menggunakan data sekunder yang berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa berlakunya Undang-Undang Merek di Indonesia belum cukup melindungi pemilik merek dagang dari adanya praktik perundungan merek dagang, baik untuk pengusaha besar maupun terutama UMKM. Selain itu, hukum positif yang berlaku di Indonesia masih perlu mengatur secara lebih jelas terkait tindak perundungan merek dagang, dimulai dari kriteria dan indikator yang rasional serta implementasi asas itikad baik dalam pelindungan merek dagang.

Abstract

This research highlights the problem of copyright infringement through illegal websites, especially in the context of free movie streaming. The purpose of this research is to explain the formulation of creating a blacklist of blocked domain names as a preventive measure in protecting copyright in digital media based on Indonesian positive law, as well as identifying the liability of electronic system organizers related to copyright infringement in ICT media. The method used is normative and comparative juridical with data from various sources. The Safe Harbor concept protects PSEs from liability for copyright infringement on their platforms, but proactive measures are still required. Recommendations include improving monitoring of user content, cooperation with copyright owners, updating internal policies, and disseminating copyright education to users.

Abstract

The actualization of Intellectual Property Development in the Copyright regime, a derivative work through electronic media, must be balanced with extra protection outside the legal protection of Copyright regulated in the national Copyright Law. Improving the quality of digital Copyright protection is necessary, considering that digital Copyright objects have increasingly transformed into various new forms, followed by the possibility of digital Copyright Infringements. The resolution of problems related to the legal issues of digital copyright infringement needs to be carried out through a legal and technological approach, which will be discussed through this research in several forms of legal protection efforts and non-legal protection as complementary protection.

Abstract

Trade secret is one of the Intellectual Property Rights (IPR) protected by the Law No. 30 Year 2000 on Trade Secrets. However, the Trade Secret Law has not regulated in detail the act of prohibiting the sale of products resulting from trade secret infringement. Therefore, the purpose of this research is to analyse the reasons for the urgency of regulating the act of prohibiting the sale of products resulting from violations of Trade Secrets based on the Trade Secrets Act, and to explore the regulation of temporary determination of the sale of products resulting from violations of Trade Secrets based on the Trade Secrets Act and Directive (EU) 2016/943. This research uses normative law and comparative law methods with descriptive analytical research specifications. The research was conducted by comparing the laws. The data collection technique used is literature review. Based on the results of the research, it is concluded that the provisions of the Trade Secrets Law regarding injunction in Article 11 are still not detailed enough to provide legal certainty. This is different from the case of Directive (EU) 2016/943, which has regulated the provisions of interim injunction quite comprehensively. In this case, Indonesia can use Directive (EU) 2016/943 as one of the references to complete the provisions of the Indonesian Trade Secrets Law.
