Abstract

Penelitian ini mengkaji bentuk perlindungan hukum terhadap masyarakat dalam penyelesaian sengketa tanah di Badan Pertanahan Nasional (BPN) Kabupaten Gorontalo Menurut Pasal 5 dan 6 Peraturan Menteri Agraria Nomor 21 Tahun 2020. Penelitian ini bertujuan untuk menganalisis langkah-langkah penyelesaian sengketa tanah waris di Badan Pertanahan Nasional apakah sudah sesuai dengan Pasal 5 dan 6 Peraturan Menteri Agraria Nomor 21 Tahun 2020 tentang Penanganan dan Penyelesaian Kasus Pertanahan. Penelitian ini merupakan jenis penelitian empiris yang bersifat deskriptif, teknik pengumpulan data yang dilakukan adalah dengan wawancara, observasi dan dokumentasi yang dilakukan penulis. Untuk proses analisis dalam penelitian ini dilakukan sebelum  memasuki lapangan, selama di lapangan, setelah selesai pengumpulan data dilapangan, penyajian data dan penarikan kesimpulan. Berdasarkan penelitian yang dilakukan, menunjukkan fakta bahwa langkah-langkah yang dilakukan oleh Badan Pertanahan Nasional (BPN) Kabupaten Gorontalo sudah sesuai dengan Peraturan menteri Agraria Nomor 21 Tahun 2020 tentang penanganan dan penyelesaian kasus pertanahan. Dengan melakukan mediasi sebagai mekanisme yang dilakukan dalam penyelesaian sengketa  tanah waris di BPN Kabupaten Gorontalo yang sebelum memasuki mekanisme tersebut, terlebih dahulu ada beberapa  mekanisme lainnya yaitu diadakannya pengkajian kasus, gelar awal yang merupakan langkah dalam penyelesaian sengketa tanah, dilakukan penelitian terhadap kasus, dan yang terakhir adalah gelar akhir sebagai mekanisme terakhir dalam penyelesaian sengketa tanah waris di Badan Pertanahan Nasional (BPN) Kabupaten Gorontalo.

Abstract

This study examines the determination of wives' post-divorce maintenance rights from the perspective of the Gorontalo District Religious Court, focusing on Case No. 539/Pdt.G/2024/PA.Gtlo. It addresses two core issues: the factors influencing judicial decisions on maintenance awards and the effectiveness of enforcement mechanisms. Employing an empirical juridical methodology with content analysis and basic jurimetrics, the research identifies four primary determinants: husband's financial capacity (60% weighting), marital circumstances, wife's nusyuz status, and actual needs aligned with Gorontalo's Living Wage Standard. Judges apply substantive justice principles under Islamic Law Compilation (KHI) Article 149 and Supreme Court Circular No. 5/2021, setting iddah maintenance at 25-40% of husband's income. However, enforcement effectiveness remains low at 30%, hampered by defendants' lack of seizable assets, limited court staff (two clerks for 1,200 annual cases), and informal compromise culture. The study proposes a tripartite Maintenance Enforcement Task Force, integrated SIPP-PA digital asset database, and community legal literacy programs to achieve 70% compliance per RPJMN 2025-2029 targets, shifting family justice from reactive adjudication to proactive enforcement.

Abstract

The reform of the termination of employment (PHK) regulation in Indonesia through Law Number 6 of 2023 concerning Job Creation has had a significant impact on the legalprotection and welfare of workers. This study aims to evaluate changes in layoff regulations, the implications of compensation reductions, and the implementation of Pancasila principles and Human Rights (HAM) in the protection of workers who experience layoffs. The normative-juridical method is used by reviewing legislation, Court decisions, and the latest legal literature. The results show that although the job creation law provides flexibility for employers, the looser provisions in layoffs have the potential to harm workers, especially in the aspects of compensation and legal certainty. The implementation of Pancasila and human rights principles is an important foundation in ensuring the protection of workers so that the right to work, social justice, and humanity are maintained. Social security policies and fair dispute resolution mechanisms are strengthened through the latest Ministry of labor regulations, but the effectiveness of their implementation needs to be constantly monitored. The study recommends comprehensive reforms that promote a balance of interests between workers and employers, as well as strengthening constitutional protections for the sustainable welfare of workers.

Abstract

The practice of repackaging food products is increasingly prevalent in Indonesia, especially in the small-business sector and in the trade of foodstuffs in small packaging without labels. This practice poses serious problems for consumer protection and food safety. Although Law No. 18 of 2012 on food has imposed a strict prohibition on opening food packaging for repackaging, this provision is subject to a normative contradiction under Article 84paragraph (2), which provides exceptions for food that is “commonly repackaged,” without clear definitions or technical limitations. This ambiguity creates a crisis of legal certainty that hinders criminal enforcement under Article 139. This study uses a socio-legal research approach, combining normative juridical analysis with empirical data from interviews with BPOM officials and field observations. The results showed that the vagueness of the norm is the main factor preventing authorities from carrying out repressive measures, thereby hindering the effective operation of criminal law enforcement. This condition has an impact on weak consumer protection, distortion of business competition, disruption of the national food security system, and potential violations of state obligations to protect the right to public Health. This study confirms the need for strict implementation regulations, repackaging technical guidelines, and strengthening BPOM capacity and consumer literacy to ensure the effectiveness of law enforcement and food safety in Indonesia.

Abstract

This study examines the legal challenges of remote working in Indonesia, aiming to inform comprehensive, justice-based employment policies. Employing a normative juridical method with statutory, conceptual, and case-based approaches, including analysis of Indonesian court decisions, the research reveals that remote work faces structural injustice due to regulatory gaps. The Ma power Law (Law No. 13/2003) and Job Creation Law (Law No. 11/2020 jo. Law No. 6/2023) lack specific remote work provisions, while foundational Civil Code (Burgerlijk Wetboek/BW) principles governing employment contracts remain underutilized. This regulatory vacuum generates legal uncertainty that disproportionately affects vulnerable workers. Persistent gaps concern working hours, overtime, occupational health and safety, data protection, monitoring, employment agreements, social security, and cross-border taxation, leaving weak and unilateral corporate policies as the de facto framework. Comparative analysis of Russia, Spain, Turkey, and the Netherlands confirms that comprehensive legislation is both feasible and necessary. Grounded in justice theory, this study argues that regulating of remote work goes beyond administrative technicalities and forms part of the protection of fundamental constitutional rights. Consequently, Indonesia must enact dedicated legislation establishing minimum standards to ensure equitable protection, dignity, equality, and legal certainty for all workers in the digital era..
