Abstract

Penelitian ini mengkaji perlindungan hukum terhadap data pribadi debitur dalam aktivitas pinjaman online dengan fokus pada regulasi di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kepustakaan. Hasil penelitian menunjukkan bahwa perlindungan data pribadi debitur telah diatur dalam berbagai peraturan, termasuk UU ITE, KUHPerdata, dan peraturan OJK. Namun, implementasinya masih menghadapi tantangan dalam dinamika pinjaman online. Pelanggaran data pribadi dapat dikenai sanksi pidana dan administratif. Penelitian ini bertujuan untuk meningkatkan pemahaman tentang kerangka hukum perlindungan data pribadi, sehingga masyarakat dapat memanfaatkan layanan pinjaman online dengan lebih aman dan terhindar dari penyalahgunaan data pribadi.

Abstract

The legal protection of cultural diversity within the context of Traditional Cultural Expressions (TCEs) is not governed by specific legislation, which can significantly hinder the protection and validity of cultural expressions. Utilizing normative legal research methods, this study aims to conduct a comprehensive analysis of the urgency of establishing a specialized legal regime that recognizes and safeguards TCEs as a unique form of communal intellectual property. The analysis supported with a statutory approach indicates that there is a strong urgency to form this specialized legal regime, highlighting normative conflicts in existing regulations. The analysis also outlines how the formation of this regime can be accomplished by referring to a comprehensive normative framework and considering the unique elements that constitute TCEs. The research findings show that existing regulations have not been able to provide adequate protection for TCEs, especially in the context of the Industrial Revolution 4.0, which demands more comprehensive protection, particularly in the digital realm. Therefore, the establishment of this specialized legal regime becomes a crucial step in addressing new challenges in the era of Industrial Revolution 4.0.

Abstract

Model Pendidikan abad XXI menjadi hal yang sangat penting untuk dijadikan rujukan dalam penyelenggaraan sebuah pembelajaran. Artikel ini menguraikan berbagai indikator ideal dalam pendidikan vokasional bidang musik di Indonesia. Melalui observasi, wawancara, dan studi dokumentasi, diperoleh beberapa indikator ideal pendidikan vokasional bidang musik antara lain 1) Konteks pembelajaran vokasional bidang musik dapat ditinjau dari konteks ekonomi, sosial, pendidikan, sejarah dan internasional yang mampu memberikan daya kreatifitas dan skill yang tinggi dengan didukung sarana prasarana yang mutakhir; 2) Proses input melalui pengembangan instrumen tes berbasis kompetensi yang bertujuan untuk mengukur kompetensi; 3) Proses pembelajaran menggunakan strategi, metode, teknik, gaya dan taktik pembelajaran yang efektif; 4) Output pendidikan vokasional musik meliputi kompetensi utama dan tambahan yang harus dimiliki; 5) Outcome pendidikan vokasional musik terkait dengan kemandirian, kepercayaan publik, dan kreatifitas. Indikator-indikator ini dapat menjadi dasar untuk mengembangkan pendidikan musik yang ideal untuk menghadapi tantangan kehidupan yang sangat dinamis dan kompleks di abad XXI.AbstractIdeal Indicators of XXI Century Vocational Education in Music in IndonesiaThe 21st-century education model is very important to use as a reference in organizing learning. This article describes various ideal indicators in music vocational education in Indonesia. Through observation, interviews and documentation studies, several ideal indicators of vocational education in the field of music were obtained, including 1) The context of vocational learning in the field of music can be viewed from economic, social, educational, historical and international contexts which can support high levels of creativity and skill. state-of-the-art infrastructure; 2) Input process through the development of competency-based test instruments which aim to measure competency; 3) The learning process uses effective learning strategies, methods, techniques and tactics; 4) Music vocational education output includes main and additional competencies that must be possessed; 5) The outcomes of vocational music education are related to independence, public trust and creativity. These indicators can be the basis for developing ideal music education to face the very dynamic and complex challenges of life in the 21st century.Keywords: Indicators; vocational education; Indonesia's 21st century music

Abstract

Model pembelajaran merupakan bagian penting untuk mengembangkan kapabilitas musikal peserta didik. Artikel ini bertujuan untuk mendeskripsikan penerapan model pembelajaran musik orkestra berbasis Student-Centered Learning: Comprehensive Musicianship through Performance (SCL-CMP). Penelitian ini menggunakan metode kualitatif, dengan teknik pengumpulan data melalui observasi, wawancara, dan dokumentasi. Analisis data menggunakan model interaktif Huberman meliputi pengumpulan data, kondensasi data, reduksi data, dan verifikasi/kesimpulan, serta didukung dengan penggunaan software NVivo 12 untuk pengorganisasian data. Hasilnya yang pertama adalah manfaat SCL-CMP dalam pembelajaran orkestra bagi peserta didik meliputi partitur musik orkestra dapat dijelaskan dengan detail, mendorong peserta didik untuk lebih aktif, karakter instrumen musik menjadi lebih mudah dipahami, dan permasalahan teknis dalam memainkan instrumen musik lebih mudah diatasi; kedua, daya tarik SCL-CMP dalam pembelajaran orkestra antara lain peserta didik memiliki waktu lebih banyak untuk berdiskusi, lebih berani berpendapat, dan mendiskusikan partitur musik secara kritis; ketiga , kendala yang dihadapi dalam pembelajaran berbasis SCL-CMP antara lain sikap peserta didik yang malas dan pasif, dan kurangnya kesadaran pendidik terhadap kemajuan peserta didik; dan keempat, optimalisasi SCL-CMP dalam pembelajaran orkestra melalui upaya mengutamakan diskusi dalam pembelajaran, membagi kelompok alat musik menjadi beberapa kelompok, dan mencari solusi dari setiap permasalahan. Permasalahan dalam pembelajaran orkestra dapat dibahas secara mendalam beserta solusinya, sehingga dapat disimpulkan bahwa pembelajaran berbasis model Student-Centered Learning-Comprehensive Musicianship Through Performance sangat cocok diterapkan dalam pembelajaran orkestra.

Abstract

Introduction: Changes in the industrial revolution have increased the risk of copyright infringement of products, which can be detrimental to the creator. Therefore, better protection is needed to address this high risk.Purposes of the Research:  This research aims to analyze law enforcement related to copyright infringement in the era of the Industrial Revolution through case studies of judges' decisions.Methods of the Research: The research method used is the normative legal method by analyzing legislation and Court Decisions Number 505 K/Pdt.Sus-HKI/2021 and Number 1933 K/Pid.Sus/2021 through literature study, by applying descriptive legal interpretation techniques to reach the right conclusion.Results of the Research: The results showed that law enforcement against copyright infringement involves two main approaches, namely preventive and repressive. The preventive approach is carried out through regulations that provide legal certainty, such as the presence of the Copyright Act. Meanwhile, the repressive approach is realized through legal proceedings in court and out of court to take action against violations that occur. This study highlights several cases of copyright infringement in Indonesia and shows the importance of strong law enforcement to protect the rights of creators in the digital age.

Abstract

The rapid growth of influencer marketing has revolutionized the way brands connect with their target audiences. However, this novel marketing strategy has also brought forth new legal challenges, particularly in consumer trust and intellectual property rights (IPRs). This study aims to bridge the gap in the current understanding of the interplay between consumer trust and IPR risks in the context of influencer marketing. Through a normative legal research method with a statutory approach, this study seeks to comprehensively examine the wider implications of influencer marketing. The research aims to contribute to developing a more robust legal framework that can effectively address the unique challenges posed by influencer marketing while fostering consumer trust and protecting intellectual property rights. The findings reveal inadequacies in the existing Indonesian legal frameworks, particularly the Consumer Protection Law, Copyright Law, and Trademark and GI Law, in addressing the unique challenges of influencer marketing. The study proposes targeted amendments to these laws, including mandatory disclosure requirements, clear guidelines on fair use and trademark usage, and stronger enforcement mechanisms to mitigate consumer trust and IPR risks. Pertumbuhan pesat pemasaran melalui influencer telah merevolusi cara mengenalkan merek berhubungan dengan audiens target mereka. Namun, strategi pemasaran baru ini juga memunculkan tantangan hukum baru, terutama di bidang kepercayaan konsumen dan hak kekayaan intelektual (HKI). Penelitian ini bertujuan untuk menjembatani kesenjangan dalam pemahaman saat ini mengenai keterkaitan antara kepercayaan konsumen dan risiko HKI dalam konteks pemasaran influencer. Melalui metode penelitian hukum normatif dengan pendekatan perundang-undangan, penelitian ini berupaya memberikan pemeriksaan menyeluruh terhadap implikasi luas pemasaran influencer. Penelitian ini bertujuan untuk berkontribusi pada pengembangan kerangka hukum yang lebih kuat yang dapat secara efektif menangani tantangan unik yang ditimbulkan oleh pemasaran influencer sambil mendorong kepercayaan konsumen dan melindungi hak kekayaan intelektual. Temuan mengungkapkan ketidakcukupan dalam kerangka hukum Indonesia yang ada, terutama Undang-Undang Perlindungan Konsumen, Undang-Undang Hak Cipta, dan Undang-Undang Merek dan Indikasi Geografis, dalam menangani tantangan unik pemasaran influencer. Penelitian ini mengusulkan amandemen khusus terhadap undang-undang ini, termasuk persyaratan pengungkapan wajib, pedoman yang jelas tentang penggunaan wajar dan penggunaan merek dagang, serta mekanisme penegakan yang lebih kuat, untuk mengurangi risiko kepercayaan konsumen dan HKI.

Abstract

Blasphemy laws, while deemed important by some in protecting religious beliefs and practices, can have implication of conflicts with human rights. Utilizing comparative legal research method, this research aims to analyze how blasphemy laws in Indonesia and Thailand affect freedom of expression and religion. Findings of this study highlight the interplay between blasphemy laws, freedom of expression, and freedom of religion. This study also highlights the existing legal norms within relevant positive laws in Indonesia, Thailand, and Vietnam, that have implication of conflicts with freedom of expression and freedom of religion. Indonesia presents the most complex conflict between these human rights, while Thailand, despite offering greater freedom of expression, normatively falls short in religious freedom due to its preferential treatment of Buddhism and its clergy. Vietnam has the least implication of conflicts, as it only governs the prohibition against profaning a religion, which is significantly different than what constitutes as blasphemy, and allowing little to no room for multi interpretation.

Abstract

The provisions of Article 433 of the Civil Code contain phrases that violate the rights of people with disabilities, especially for people with non-permanent mental disabilities. Through this provision, people with permanent mental disabilities are prevented from carrying out legal actions. This research aims to analyze the skills of people with disabilities in carrying out legal actions and analyze the provisions of Article 433 of the Civil Code with the Constitution. The research method used is normative juridical. In formulating the answer to the problem, a juridical basis and a theoretical basis are used. The research results show that the provisions of Article 433 have discriminated against people with non-permanent mental disabilities and it has been declared through the Constitutional Court Decision that Article 433 is conditionally unconstitutional. The challenge is that the district court as an institution that has the authority to form pardons must be truly careful and careful in making decisions/decisions on requests for pardons. Therefore, it is necessary to evaluate the implementation of these institutions on an ongoing basis to ensure that people with disabilities receive protection for their rights as people with disabilities.

Abstract

Introduction: Indonesia and Malaysia are countries with fairly good economic levels in the ASEAN. Economic growth in the business world also has an influence on contract law because the phenomenon that occurs is the use of standard agreement models in the business world to make business processes more effective and efficient.Purposes of the Research: The aim of this research is to analyze the differences in contract law in Indonesia and Malaysia, also describe the phenomenon of standard agreement practices that occur in Indonesia and Malaysia, and analyze the validity of standard agreements that apply in Indonesia and Malaysia.Methods of the Research: The research method used is normative juridical. The type of study used is through literature study. The type of data used is secondary data consisting of primary legal materials, namely the Civil Code, the Malaysian Contracts Act 1950, the 1957 Sale of Goods Deed.Results Main Findings of the Research: The research results show that Indonesia and Malaysia are countries that have implemented standard agreement. These two countries also have a legal basis that allows standard agreements to come into force on the condition that there must be clauses that emphasize the rights and obligations of the parties to achieve justice.
