Abstract

he integration of artificial intelligence (AI) into various sectors, including banking, has grown increasingly prevalent. AI holds significant potential in the banking system, particularly in financial risk analysis. However, its utilization requires a robust legal framework to ensure ethical and accountable application. This study aims to analyze the direction of Indonesia's legal policy and develop a legal framework model that supports the ethical use of AI for financial risk analysis in the banking sector. The research employs a normative legal research method. Through this method, the study identifies several normative issues that may negatively impact the use of AI for financial risk analysis. These issues range from fundamental legal norms, such as accountability for AI utilization, to more technical concerns, including transparency, cybersecurity, and data privacy. The findings highlight gaps in the current regulatory framework, necessitating an urgent response to accommodate the complexities introduced by AI technologies in financial systems. This research proposes a legal framework development model to provide a normative construction for relevant regulations. The proposed model emphasizes the pivotal role of the Financial Services Authority (OJK) in implementing and monitoring regulations based on the framework. By addressing these regulatory challenges, the model seeks to facilitate the ethical and responsible deployment of AI in financial risk analysis while safeguarding stakeholder interests and ensuring compliance with prevailing legal principles. Pemanfaatan artificial intelligence (AI) dewasa ini semakin terintegrasi ke dalam berbagai sektor, seperti salah satunya sektor perbankan. AI memiliki potensi yang signifikan dalam sistem perbankan, khususnya untuk digunakan dalam analisis risiko finansial. Namun pemanfaatan ini perlu diakomodasi dengan kerangka hukum yang memadai, untuk memastikan pemanfaatan sistem AI yang etis dan bertanggung jawab. Tujuan penelitian ini adalah untuk menganalisis arah politik hukum Indonesia serta mengembangkan model pengembangan hukum yang dapat diterapkan untuk mendukung pemanfaatan AI yang etis untuk tujuan analisis risiko finansial dalam sistem perbankan. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Dengan menggunakan metode penelitian hukum normatif, hasil penelitian ini menemukan beberapa permasalahan normatif yang dapat berdampak negatif terhadap pemanfaatan AI untuk analisis risiko finansial, mulai dari norma hukum yang mendasar seperti pertanggungjawaban mengenai pemanfaatan AI, hingga yang bersifat lebih teknis seperti transparansi, keamanan siber, dan privasi data. Penelitian ini mengusulkan model pengembangan hukum yang dapat dimanfaatkan untuk memberikan gambaran konstruksi normatif bagi beberapa peraturan perundang-undangan relevan, dengan mendukung OJK sebagai bagian sentral dari penerapan dan pengawalan regulasi berdasarkan model tersebut.

Abstract

This research aims to explore and analyze the regulations and implementation of the Free Trade Zone (FTZ) policy in the context of improving the economy in Batam City, Indonesia. This research uses non-doctrinal or empirical research. The applied problem approach involves three main approaches: a statutory approach, a conceptual approach, and a sociological or empirical approach. The data analysis technique used is qualitative analysis with a deductive data presentation pattern. Researchers will explore the regulations related to FTZs in Batam City and analyze the economic implications of these policies. Research findings show that in 2022 after the publication of PP No. 41 of 2021 has had an impact on improving the economy in Batam, including increasing export and import transactions so that Batam City's trade balance recorded a surplus of USD 2,262.24 million. Increase in the number of industrial and investment areas. It is hoped that the analysis of these findings will provide better insight into the contribution of FTZ policies to economic development at the local level

Abstract

Penelitian ini dilaksanakan yang bertujuan untuk memahami mekanisme perlindungan hukum terhadap pemilik polis asuransi serta bagaimana akibat hukum terhadap pelanggaran dalam perjanjian asuransi. Dengan menggunakann metode penelitian yuridis normatif dapat dijelaskan bahwa pemilik polis asuransi merupakan pihak yang melakukan perjanjian dengan perusahaan asuransi supaya mendapatkan perlindungan hukum dalam berbagai peraturan perundang-undangan sebagaimana telah tercantum dalam Undang Undang No. 21 Tahun 2011 tentang Otoritas Jasa Keuangan, Undang-Undang No. 40 Tahun 2014 tentang Perasuransian, dan Peraturan Otoritas Jasa Keuangan No. 1/POJK.07/2013 tentang Perlindungan Konsumen Sektor Jasa Keuangan. Dikarenakan pada umumnya pemilik polis asuransi bersifat individual yang kebanyakan kondisi ekonominya lemah berhadapan dengan perusahaan asuransi. Oleh sebab itu, peraturan perundang-undangan lebih menitikberatkan terhadap perlindungan hukum kepada pemilik polis asuransi dari kemungkinan terjadinya pelanggaran hukum oleh perusahaan asuransi. Pelanggaran dalam perjanjian asuransi dapat mengakibatkan timbulnya tuntutan hukum yang dapat terselesaikan dengan jalur pengadilan atau melalui alternatif lain yaitu melalui tahap arbitrase dan penyelesaian sengketa tesebut dalam klaim asuransi merupakan perjanjian melanggar wanprestasi dengan segala konsekuensi akan hukumnya.

Abstract

The rapid advancement of technology has transformed various aspects of life, particularly in the economic sector, with the emergence of Financial Technology (Fintech) lending providing access to funding for individuals without access to conventional financial services. However, the rise of illegal fintech lending platforms has created significant legal and social issues, including lack of transparency, misuse of personal data, and unethical collection practices. This community engagement initiative, conducted in Pulau Mubut Laut, Kelurahan Karas, Kecamatan Galang, Kota Batam, aimed to enhance public awareness regarding fintech legality, risks associated with illegal platforms, and available legal protections. Through legal education and consultations over two months, the program revealed participants’ limited understanding of digital finance, often leading to risky financial decisions. The initiative successfully improved participants' awareness of fintech risks and regulations, fostering wiser decision-making. Recommendations include intensifying fintech education in remote areas and strengthening legal frameworks to combat illegal fintech operations. Abstrak: Kemajuan teknologi yang pesat telah mengubah berbagai aspek kehidupan, terutama di sektor ekonomi, dengan hadirnya Financial Technology (Fintech) lending yang menyediakan akses pendanaan bagi individu yang tidak memiliki akses ke layanan keuangan konvensional. Namun, munculnya platform fintech lending ilegal telah menimbulkan masalah hukum dan sosial yang signifikan, termasuk kurangnya transparansi, penyalahgunaan data pribadi, dan praktik penagihan yang tidak etis. Pengabdian kepada masyarakat, yang dilakukan di Pulau Mubut Laut, Kelurahan Karas, Kecamatan Galang, Kota Batam, bertujuan untuk meningkatkan kesadaran masyarakat tentang legalitas fintech, risiko yang terkait dengan platform ilegal, serta perlindungan hukum yang tersedia. Melalui penyuluhan hukum dan konsultasi selama dua bulan, program ini mengungkapkan rendahnya pemahaman peserta terhadap keuangan digital, yang sering kali menyebabkan keputusan keuangan yang berisiko. Program ini berhasil meningkatkan kesadaran peserta tentang risiko dan regulasi fintech, sehingga mendorong pengambilan keputusan yang lebih bijak. Rekomendasi mencakup intensifikasi edukasi fintech di daerah terpencil dan penguatan kerangka hukum untuk memberantas operasi fintech ilegal.

Abstract

The development of the business world in Indonesia in the current modern era creates a new legal phenomenon that needs attention. This legal phenomenon is the existence of crimes that are hidden within the corporation. Therefore, Indonesia implements beneficial owner transparency for all corporations.  The purpose of this study is to analyze the application of beneficial owners in Indonesia. The method used in this research is normative juridical using the Theory of Law as a tool of social engineering by Roscoe Pound.Based on the results of the study, it was found that the implementation of BO transparency in Indonesian corporations had not gone well. Only 8.3% percent of companies in Indonesia report BO, even though Indonesia has regulated the obligation to report BO in Presidential Decree No. 13 of 2018. This shows that the laws made have not been able to manipulate and or change people's behavior.

Abstract

Notary is a protocol for public officials who have a fairly large responsibility, namely to keep the notary properly because the notary is a document belonging to the state. However, in practice, notaries in the Riau Islands region face various obstacles in keeping the notary protocol. The purpose of this study is to analyze the notary's accountability to the protocol he has made. Based on the results of the study that there are obstacles for notaries in storing notary protocols, namely the lack of facilities in the form of adequate and adequate storage places. Then, there are no regulations governing the storage of notary protocols, the regulations used are regarding the notary code of ethics and the Law on Notary Positions. based on the Legal Responsibility Theory by Hans Kelsen, a notary who violates the law should receive sanctions as stipulated in the Ethics and Laws concerning the Position of a Notary. Therefore, the recommendation in this study is the need for special regulations regarding the storage of notary protocols.

Abstract

This study aims to analyze marriage regulations with child protection, namely Law Number 16 of 2019 on Marriage and Law Number 35 of 2014 on Child Protection. These two regulations will be analyzed to protect children who marry underage. The study method used is normative juridical. As a novelty, the study tries to compare marriage arrangements with child protection arrangements. The purpose and perspective of underage marriage between the two regulations are different. The research results show that marriage law has a different spirit than child protection law. This is shown in the marriage law, which states that children are still allowed to marry for urgent reasons by applying for a dispensation to the court. However, child protection law explicitly does not allow this. Therefore, there is a need for more detailed regulation regarding the category of "urgent reasons" regulated in the marriage law.

Abstract

Indonesia already has regulations in place to regulate digital fraud matter, but these regulations have not been able to accommodate current needs. The novelty in this research is that this research discusses current issues where fraud is carried out using sophisticated technology, namely through cyberspace, even fraud can also be carried out for the reason of a good cause, namely making a donation. The purpose of this study is first, to analyze the laws governing online donation fraud. Second, to identify cases or phenomena regarding fraud that occur online and resolve these cases. then through this research can produce a recommendation or legal solution will be found in overcoming the online fraud case. The method in this study is normative juridical which uses a statutory approach consisting of laws, namely Law Number 9 of 1961 concerning Collection of Money or Goods, Government Regulation Number 29 of 1980 concerning Implementation of Contribution Collection. Then the data collection technique is through literature studies and studies through fraud cases that have occurred. Based on the results of the research, it was found that online donation fraud cases are currently being tried using the criminal law code and the law on information and electronic transactions. However, the two regulations have different elements of fraud and sanctions. Even though Indonesia has a regulation that specifically regulates the collection of donations, however, these two regulations do not regulate the forms of donations that can be made online.

Abstract

Introduction to The Problem: Marriage is everyone's right. However, the phenomenon that occurs is the practice of underage marriage, this also occurs in the indigenous community of the Orang Laut tribe in Lingga Regency.Purpose/Objective Study: The aim of this research is to analyze the regulation of national law and customary law in dealing with underage marriage in the Orang Laut tribal community and to find a concept of legal harmonization that can resolve the practice of underage marriage.Design/Methodology/Approach: The research method used is empirical juridical. The type of data sourced from primary data is through observation and interviews as well as primary data. The basic theories used are the Theory of Legal Work and the Theory of Development Law.Findings: The results of the research state that there is a regulatory inconsistency between marriage law and child protection law. The marriage law allows for underage marriages by applying for dispensation, while Article 26 of the child protection law strictly stipulates that parents are obliged to prevent child marriages from occurring. And there is a culture of "reciprocation" which is the basis for the Sea People tribe to perpetuate the practice of underage marriage. In fact, marriages are only carried out through traditional ceremonies and according to their respective religions without applying for dispensation to the court. This means that the marriage carried out is only valid according to custom and religion and is not legally valid. Therefore, it is necessary to harmonize the law with an institutional approach in overcoming the phenomenon of underage marriage in the indigenous people of the Orang Laut tribe, Lingga Regency.Paper Type: Research Article

Abstract

The proliferation of digital technology has challenged the traditional understanding of identity and subsequently brings forth its own unique legal implications. Identity theft as a crime that has existed even before this development has also brought its own unique legal implications, particularly in the realm of criminal law. Using normative legal research method, this research aims to establish the boundaries around digital identity theft, to distinguish it from the traditional identity theft, to provide a more relevant and robust understanding of its criminality within the digital age. Results of this study highlight the gaps in Indonesia's current legal framework, emphasizing the need for a revised approach that distinctly addresses the complexities of digital identity theft. The research proposes a model of normative development aimed at refining legal definitions and enhancing enforcement mechanisms to better combat this modern crime. This model seeks to provide a more relevant and robust legal framework, ensuring that the legal system is responsive and adaptive to the challenges posed by digital advancements.
