Abstract

Introduction: Technological developments have an impact on today's business world, which is buying and selling activities carried out through Instagram.Purposes of the Research: The purpose of this study is to examine the perspective of civil law books regarding the phenomenon of buying and selling via Instagram and analyzing the best solution so that buying and selling activities via Instagram do not violate the law.Methods of the Research: The method in this study is normative juridical which uses a library approach. In answering the formulation of the problem, the juridical basis is used, namely the civil law code book and the theoretical basis, namely modern contract law theory.Results of the Research: Based on research results, buying and selling activities via Instagram are very difficult to fulfill the legal requirements of an agreement as stipulated in the civil law code. This has also led to many cases of law violations through Instagram. Therefore, it is necessary to apply the principle of good faith in the buying and selling process on Instagram.

Abstract

The utilization of advanced technologies in the context of digital transformation plays a crucial role in economic progress and growth. However, the use of cutting-edge technologies such as AI and 3D printing must be supported by an adequate legal framework to prevent violations of intellectual property protection principles and avoid harming intellectual property holders. This study aims to explore the issues that may arise from the use of AI and 3D printing technologies. Using a normative legal research method with a comparative approach, this study analyzes the paradox of protection created by these issues, while highlighting the problems found in the legal norms of relevant legal frameworks, such as patent and industrial design regimes. The analysis reveals limitations in the application of the exhaustion doctrine, which could provide balanced protection for the use of these two advanced technologies. Based on these findings, the study offers recommendations for strategic legal development that could be applied by Indonesia and Vietnam, as two ASEAN countries with significant potential in the era of digital transformation.

Abstract

The development of various professions in the field of law basically plays a crucial role in supporting various legal actions such as making agreements. The existence of an agreement is crucial in underlying legal relations because it contains legal objectives that protect the parties. In line with this, this research aims to respond to the existence of the legal drafting consultant profession which has a crucial role in preventing the problem of implementing agreements. The research was conducted using normative jurisprudence method with qualitative descriptive analysis. The approach method used is statue approach and conceptual approach using primary secondary and tertiary legal materials. The results showed that the urgency of legal drafting consultants in making agreements is to help compile agreement files, carry out the legal profession credibly and responsibly, carry out the preparation of agreements independently and objectively, professionally and can protect the interests of clients. Specifically, the role of legal drafting consultants in anticipating problems arising in the agreement is to assist clients in carrying out the pre-contract stage in the form of negotiations, helping to make agreements carefully, accurately and paying careful attention to the clauses and ensuring the implementation of the agreement and anticipating disputes.

Abstract

This study aims to analyze the principles of legal justice embodied in Decision Number 31/Pdt.Sus-Hak Cipta/2020/PN.Niaga.Jkt.Pst., concerning the copyright dispute between the artwork “Urban Light” by Chris Burden and the “Love Light” installation at Rabbit Town. The research employs a normative juridical method, utilizing statutory and case approaches to examine the relevance of Law Number 28 of 2014 on Copyright and its application in the court’s judgment. The data used are secondary, comprising legislation, court decisions, and related legal literature, analyzed descriptively and qualitatively. The findings reveal that the panel of judges has duly considered distributive, commutative, and procedural justice by providing comprehensive protection of the moral and economic rights of the creator. The decision affirms that unauthorized reproduction and adaptation of copyrighted works constitute infringement, ensuring a balanced consideration of the rights of creators and users. Furthermore, this ruling is expected to serve as a significant precedent for copyright protection in Indonesia and to enhance public legal awareness regarding the importance of respecting intellectual property rights.

Abstract

Introduction to the Problem: Unfair competition threatens economic growth and is harder to detect in the digital era. For Indonesia and Thailand, growing digital economies depend on fair online marketplaces, yet these platforms face risks like price manipulation and visibility bias. Addressing these issues is crucial to unlocking their global trade potential. Purpose/Study Objectives: The purpose of this research is to analyze the normative potentials and challenges in enforcing antitrust laws in Indonesian and Thai online marketplaces, particularly in addressing antitrust challenges that are unique to the digital environment. Design/Methodology/Approach: This research utilizes normative legal research method and a comparative legal approach to examine the frameworks for protecting against unfair competition in online marketplaces in Indonesia and Thailand. Findings: Findings of this study highlight that the existing antitrust laws in Indonesia and Thailand are not equipped to address the unique challenges of digital markets, such as algorithm-driven price fixing, product visibility manipulation, and data monopoly. The study proposes a legal framework model focusing on enhancing algorithmic transparency, ensuring search neutrality, establishing robust market monitoring, and integrating data governance with antitrust measures. This model aims to bolster fair competition and consumer protection, positioning both nations to leverage their digital economy potentials effectively. Paper Type: Research Article

Abstract

Perkembangan perekonomian Indonesia yang terdampak penyebaran Corona Virus Diseases 2019 (Covid-19) sejak awal tahun 2020 merupakan salah satu alasan mendesak bagi pemerintah dalam membentuk satu aturan yang dapat mendorong perkembangan iklim investasi. Hal tersebut kemudian direalisasikan dalam aturan yang baru disahkan yaitu Undang-Undang Tentang Cipta Kerja. Yang kemudian memberikan perubahan hukum terkait dengan hukum ketenagakerjaan yang telah ada. Permasalahan yang akan dibahas yakni terkait bentuk-bentuk perubahan hukum ketenagakerjaan dan substansi perubahan yang terkandung dalam Undang-Undang Cipta Kerja. Tujuan penelitian ini yaitu untuk mengkaji bentuk-bentuk perubahan dan substansi perubahan hukum ketenagakerjaan pasca revisi Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dalam Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Dengan menggunakan jenis penelitian normatif, diharapkan penelitian ini dapat memberikan perbandingan hukum ketenagakerjaan terdahulu (sebelum revisi) dengan pasca revisi. Hasil penelitian menunjukan bahwa terdapat cukup banyak bentuk perubahan terkait hukum ketenagakerjaan, dan garis besar perubahan tersebut diuraikan dalam bentuk tabel. Dapat disimpulkan bahwa secara keseluruhan terdapat sekurang-kurangnya 72 poin perubahan Undang-Undang Nomor 13 Tahun 2003 dalam Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja.

Abstract

The use of internet services has become widespread and has become an integral part of daily life for millions of individuals around the world. However, in accessing and using internet services, consumers often face various risks and challenges, such as privacy violations, online fraud, or non-compliance with promises made by service providers. Apart from that, a high security system also increases public confidence in comprehensive data security protection. Legal protection aims to integrate and coordinate various interests in society because in one movement of interests, protection of certain interests. In implementing personal protection in electronic systems, it must be based on the principle of respect for personal data as privacy and every owner of personal data has the right to data in the electronic system. Therefore, legal protection of consumers regarding the use of internet services is becoming increasingly important. This research actualizes the protection of consumer personal data in the context of internet service use. We analyze relevant legal and regulatory developments, both at national and international levels, that play a role in protecting consumer rights and interests in the digital ecosystem.

Abstract

Geographical Indications play a crucial role as an intellectual property regime that protects unique products originating from specific regions, shaped by both human and natural factors. The presence of natural factors makes Geographical Indications a potential tool for strengthening local economies while simultaneously protecting the environment. This study aims to analyze the potential utilization of the Geographical Indications regime in Indonesia to support sustainable development, particularly in relation to environmental protection. Employing a normative legal research method supported by a statutory approach, this study examines the connection between Geographical Indications and environmental protection. The analysis reveals that despite the conceptual link between Geographical Indications and environmental sustainability, there is no normative legal support within the existing regulatory framework governing Geographical Indications. A normative construction model is proposed to facilitate the integration of environmental protection into the Geographical Indications regime, emphasizing aspects of planning, utilization, supervision, maintenance, control, and law enforcement.

Abstract

The rapid growth of TikTok presents new challenges in copyright protection, particularly regarding unauthorized content re-uploads. This study aims to analyze the effectiveness of copyright protection for TikTok creators in Batam City using an empirical juridical approach through interviews and literature studies. The findings indicate that while Law No. 28 of 2014 on Copyright provides a strong legal foundation, its implementation faces challenges such as regulatory gaps, low legal awareness among creators, and weak enforcement on digital platforms. TikTok has copyright protection policies, but its reporting system remains ineffective in addressing violations. The Directorate General of Intellectual Property (DJKI) of the Riau Islands has conducted awareness campaigns; however, these efforts need to be reinforced with clearer regulations and stronger collaboration between the government, digital platforms, and creators. Therefore, increasing legal awareness and strengthening policies are necessary to optimize copyright protection for digital content creators. [Pertumbuhan pesat TikTok menghadirkan tantangan baru dalam perlindungan hak cipta, khususnya terkait dengan pengunggahan ulang konten tanpa izin. Studi ini bertujuan untuk menganalisis efektivitas perlindungan hak cipta bagi para kreator TikTok di Kota Batam dengan menggunakan pendekatan yuridis empiris melalui wawancara dan studi literatur. Temuan menunjukkan bahwa meskipun Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta memberikan dasar hukum yang kuat, implementasinya menghadapi sejumlah tantangan seperti celah regulasi, rendahnya kesadaran hukum di kalangan kreator, dan lemahnya penegakan hukum di platform digital. TikTok memiliki kebijakan perlindungan hak cipta, namun sistem pelaporannya masih belum efektif dalam menangani pelanggaran. Direktorat Jenderal Kekayaan Intelektual (DJKI) Provinsi Kepulauan Riau telah melakukan kampanye penyuluhan, namun upaya tersebut perlu diperkuat dengan regulasi yang lebih jelas serta kolaborasi yang lebih solid antara pemerintah, platform digital, dan para kreator. Oleh karena itu, peningkatan kesadaran hukum dan penguatan kebijakan menjadi hal yang penting untuk mengoptimalkan perlindungan hak cipta bagi para kreator konten digital.]

Abstract

The rapid development of digital technology has significantly transformed various economic sectors, particularly through the emergence of digitized contracts, including electronic contracts and smart contracts. These innovations are especially impactful in the investment sector, providing enhanced speed, security, and efficiency. As the Indonesian economy becomes increasingly integrated with digital technology, the role of electronic and smart contracts becomes crucial, necessitating adaptations in the country’s legal framework. Indonesia's legal system has responded with regulatory reforms, such as amendments to the Electronic Information and Transactions Law, aiming to address the needs of the digital economy. However, the pace of legal adaptation has raised concerns, particularly regarding the timely recognition and support for smart contracts, which are poised to revolutionize investment practices by automating transactions and reducing the reliance on intermediaries. Despite efforts to regulate electronic systems, Indonesia’s legal politics have struggled to keep up with the demands of these technological advancements, leading to gaps in the legal support for digitized contracts. This paper analyzes the intersection of Indonesia’s legal politics and the evolving landscape of investment, focusing on how the legal framework can better accommodate the integration of electronic and smart contracts. The study emphasizes the need for a comprehensive legal structure that fosters the growth of digital investment, providing legal certainty and protecting stakeholders. It ultimately proposes a model to support the future of investments, integrating legal clarity, regulatory adaptation, and industry collaboration to ensure that Indonesia’s legal framework can effectively support the evolving digital economy.
