Abstract

This article discusses the fulfillment of rights for corporate bondholders declared bankrupt by the Commercial Court. No regulation can provide a comprehensive and integrated benchmark to ensure the protection of the rights of bondholder creditors, making this article important to discuss. This research aims to analyze the status of corporate bondholders declared bankrupt by the Commercial Court as creditors in the liquidation process, evaluate the forms of legal protection applied during the process, and assess the future application of the law in providing certainty of protection for bondholders.  This research used normative legal research with statutory, historical, and futuristic approaches. The discussion results are carried out using an analysis perspective emphasizing deductive conclusions. Although corporate bondholders declared bankrupt by the Commercial Court have rights as creditors in the bankruptcy process, the legal protection is still ineffective. A regulatory gap results in uncertainty when implementing protection for bondholders. Revision of the Bankruptcy Law by including regulations regarding bondholders' creditors will provide certainty for the protection of creditors' rights, which can be derived in the Financial Services Authority (OJK) Regulation by enforcing supervision in the bankruptcy process in order to protect the interests of bondholders and ensure the stability of the economic development.

Abstract

Complex bankruptcy issues are still possible, notwithstanding the rise in trade between businesspeople of different nationalities, particularly in cases of cross-border insolvency or bankruptcy that transcend national borders. The severity of the issues in cross-border insolvency proceedings in Indonesia is increased by the lack of consistency or harmonization of bankruptcy laws (statutory regulations) throughout nations worldwide about proposed bankruptcy rulings. This study employs the Normative Juridical research method, emphasizing literature reviews using relevant Indonesian laws and regulations and several relevant book references. It also takes an analytical descriptive approach. The following research findings were derived from the studies that were conducted: Efforts to create legal products that agree on cross-border bankruptcy laws in order to tackle global economic integration, particularly in the ASEAN region, are greatly aided by the UNCITRAL Model Law on Cross-Border Insolvency with Guide to Enactment. Indonesia may choose to implement the Model Law in light of ASEAN's economic cooperation. Only three articles—Articles 212, 213, and 214—of the Bankruptcy Rules now in force govern international matters. These three paragraphs do not govern the technique and process of execution; they solely deal with the transfer of assets included in bankruptcy overseas and the transfer of all or a portion of debts or receivables to third parties.

Abstract

Abstrak Berdasarkan fakta bahwa tenaga kerja Indonesia merupakan aset nasional yang mendatangkan devisa negara, maka upaya pemerintah untuk melindungi tenaga kerja Indonesia harus semakin meningkat. Seolah-olah para buruh migran telah mendapat penghargaan yang sangat mulia dan mendapat tempat yang terhormat di mata bangsa dan negara. Realitanya, buruh migran masih diposisikan sebagai ’komoditas’ yang diperdagangkan dan sering mengalami perlakuan tidak manusiawi. Permasalahan yang diangkat dalam penelitian ini, apakah yang menjadi hak-hak konstitusional buruh migran Indonesia yang dilindungi?. Jenis penelitian adalah penelitian hukum normatif, yang dikerjakan dengan tujuan menemukan asas atau doktrin yang berlaku untuk menemukan dan menganalisis hak-hak konstitusional dari buruh migran Indonesia. Metode pendekatan yang digunakan adalah pendekatan undang-undang (statute approach), pendekatan konseptual (conceptual approach), pendekatan analisis (analytical approach) dan pendekatan futuristis (futuristic approach). Hasil penelitian menunjukkan bahwa hak-hak konstitusional buruh migran dalam UUD 1945 pasca perubahan antara lain : hak atas kerja dan penghidupan yang layak tiap-tiap warga negara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan, hak memperjuangkan hak, hak atas kepastian hukum dan keadilan, dan hak atas kerja dan penghidupan yang layak, yakni setiap orang berhak untuk bekerja serta mendapat imbalan dan perlakuan yang adil dan layak dalam hubungan kerja. Kata kunci : Perlindungan Hukum, Buruh Migran, Hak Konstitusional Abstract Based on the fact that Indonesian workers are national assets that bring in foreign exchange, the government's efforts to protect Indonesian workers must increase. It is as if the migrant workers have received a very noble award and gained a respected place in the eyes of the nation and state. In reality,workers migrantare still positioned as a 'commodity' that is traded and often experiences inhuman treatment. The issues raised in this study, what are the constitutional rights of Indonesian migrant workers who are protected ?. This type of research is legal research normative, which is carried out with the aim of discovering the principles or doctrines that apply to discovering and analyzing the constitutional rights of Indonesian migrant workers. The approach method used is thestatute approach, conceptual approach, analytical approach and futuristic approach. The results showed that the constitutional rights of migrant workers in the 1945 Constitution after the changes included: the right to work and a decent living every citizen has the right to work and a decent living for humanity, the right to fight for rights, the right to legal certainty and justice , and the right to decent work and livelihood, i.e. everyone has the right to work and to receive fair and appropriate compensation and treatment in an employment relationship.

Abstract

This study examines the role of the Commercial Court in executing decisions from the Industrial Relations Court (PHI), which often face technical and procedural obstacles despite having permanent legal force. The main barriers to the execution of PHI decisions are the low level of compliance by employers with the decisions and the high costs and lengthy time required for the execution process. The Commercial Court, with its more efficient procedures, can serve as an alternative to address these barriers, especially in cases involving companies facing financial difficulties. This research aims to analyze the legal construction of executing PHI decisions through the Commercial Court and provide recommendations for improving the existing legal system. The research method used is normative legal research with approaches based on legislation, case law, and historical analysis, which leads to the conclusion that the use of the Commercial Court can improve execution efficiency and provide legal certainty. It is recommended that there be stronger synergy between industrial relations law and commercial law, as well as regulatory updates to support the implementation of fairer and more efficient executions.

Abstract

The purposes of this research is to identify and analyzed environmental management regulated according to international and Indonesia law. Also to proposed the optimization land conversion regulations to overcome exploitation. The research method used in this research is the library search method, namely by studying various legal books, a collection of laws and regulations, legal articles, the internet and other written sources. The results of the study show how the regulation of international law for the protection of the environment needs to be considered for its sustainability. From this research, it can be concluded that international law regulation on environmental utilization must have an appropriate spatial planning by taking into account the sustainability of the environment itself.

Abstract

Penundaan Kewajiban Pembayaran Utang (PKPU) seharusnya menjadi alternatif dalam menyelesaikan permasalahan utang antara debitor dan kreditor. Selama periode Penundaan Kewajiban Pembayaran Utang, kreditor separatis harus menangguhkan hak eksekusinya. Penulisan penelitian ini bertujuan mengidentifikasi dan menganalisis tanggung jawab hukum kreditor separatis atas harta debitor dalam PKPU yang dijual tanpa persetujuan dari debitor dan pengurus. Metode penelitian penulisan ini termasuk tipe penelitian normatif dengan pendekatan penelitian perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian ini diketahui penjualan harta debitor dalam PKPU oleh kreditor separatis tanpa persetujuan dari debitor dan pengurus tergolong dalam perbuatan melawan hukum sehingga perbuatan tersebut batal demi hukum dan kreditor separatis harus membayar ganti rugi. Dengan demikian, pengaturan mengenai tanggung jawab serta sanksi bagi kreditor separatis yang beritikad buruk pada masa penangguhan PKPU dipandang perlu untuk dirancangkan lebih lanjut demi terwujudnya rencana perdamaian dan terciptanya keamanan dan kesejahteraan bagi para kreditor dalam PKPU.

Abstract

Olahraga masa kini tidak lagi sekadar soal gerak fisik, tetapi telah berubah menjadi industri besar yang penuh kepentingan, sehingga sengketa dalam pertandingan pun semakin sering muncul mulai dari protes hasil, masalah teknis, hingga konflik administratif dan pelanggaran etika. Penyelesaian melalui litigasi atau arbitrase memang memberikan kepastian hukum, tetapi sering kali lambat, mahal, dan kurang mencerminkan nilai pendidikan dalam olahraga. Di sinilah musyawarah mufakat menawarkan alternatif yang lebih manusiawi dan dialogis, sejalan dengan nilai Pancasila dan prinsip ADR yang mendorong keputusan cepat, efisien, dan menjaga hubungan baik. Penelitian ini menggunakan pendekatan empiris untuk melihat bagaimana musyawarah bekerja dalam praktik, khususnya pada Porprov Muba 2025 yang dijadikan contoh nyata penerapan penyelesaian sengketa berbasis kearifan lokal. Melalui observasi dan wawancara, ditemukan bahwa dari tiga sengketa yang terjadi, semuanya dapat diselesaikan melalui musyawarah tanpa harus naik ke jalur banding. Hasil ini menunjukkan bahwa musyawarah mufakat tidak hanya mampu meredam konflik dengan cepat, tetapi juga membantu menanamkan nilai fair play melalui dialog yang mendorong empati, kesadaran diri, dan integritas. Temuan tersebut menegaskan bahwa musyawarah mufakat memiliki peran penting dalam membangun ekosistem olahraga yang sehat, harmonis, dan berkarakter, sehingga layak diinstitusionalisasikan sebagai mekanisme penyelesaian sengketa utama dalam kompetisi olahraga di berbagai tingkatan.

Abstract

Objective: This study aims to reconceptualize grant arrangements by BUMDs in CSR programs through a beneficiality principle approach aligned with the Sustainable Development Goals (SDGs), particularly SDG 17 on partnerships for sustainable development. The focus is on formulating recommendations for regulatory concepts that can be applied in the future. This goal is directed to increase legal certainty and the social impact of CSR programs. Theoretical framework: The theoretical framework is based on the concept of regulating BUMD's CSR obligations based on the applicable legal basis while incorporating SDGs principles. The principle of the usefulness approach is used as the basis for the analysis of regulatory reconstruction, including the integration of the perspective of maqasid al-shari'ah and SDG 17. The framework emphasizes a balance between legal certainty, public benefit, sustainability, and collaborative governance. Literature review: The literature review covers social and environmental responsibility regulations and the concept of grants in BUMD CSR, including the need to reconstruct regulations so that they do not overlap with APBD grants, while supporting SDGs-oriented governance. Methods: The method used is normative juridical through the study of legal literature, laws, and regulations to analyze problems and formulate regulatory concepts in line with SDGs values. Results: The results show that there is no clear legal terminology for grants by BUMDs, so that it has the potential to cause inequality with APBD grants and needs to be based on the principle of sustainable utility and SDGs-oriented governance, particularly strengthening partnerships (SDG 17). Implications: This study emphasizes the importance of clear regulations to increase the accountability of BUMD CSR and ensure tangible social benefits for the community while contributing to the achievement of SDGs. Novelty: The novelty lies in the formulation of the CSR concept through BUMD grants based on the principles of usefulness, maqasid al-shari'ah, and SDGs (especially SDG 17), while still paying attention to legal certainty and sustainable development.

Abstract

Krisi legitimasi terhadap pemerintah tumbuh sebagai akibat dari ketidakmampuan pemerintah dalam mengatasi permasalahan ekonomi, politik, dan kesenjangan sosial. Upaya yang dapat dilakukan pemerintah adalah mengkomunikasikan dengan melakukan pelegitimasian sistem-sistem norma, penegakan hukum secara konsisten, tidak diskriminatif, memberantas korupsi, pengangkatan pegawai yang bersih, serta keterbukaan dalam manajemen pemerintahan. Semua itu dapat diakomodasi dengan penggunaan hukum progresif sebagai alat rekayasa sosial dalam meningkatkan harkat martabat bangsa Indonesia di era globalisasi, terutama dalam rangka menciptakan hukum tertulis yang memenuhi standar negara modern dan diakui dunia internasional.
