Abstract

Abstrak: Aborsi merupakan isu yang kompleks karena melibatkan dimensi hukum, agama, dan medis, terlebih dalam konteks masyarakat Indonesia yang plural dan mayoritas beragama Islam. Penelitian ini bertujuan untuk menganalisis secara mendalam pandangan agama Islam terhadap aborsi berdasarkan interpretasi sumber-sumber utama ajaran Islam. Selain itu, penelitian ini juga mengkaji bagaimana hukum kesehatan Indonesia meregulasi praktik aborsi melalui peraturan perundang-undangan, termasuk PP Nomor 28 Tahun 2024 dan UU Nomor 1 Tahun 2023 tentang KUHP. Hasil penelitian menunjukkan bahwa pandangan Islam terhadap aborsi memiliki spektrum interpretasi yang beragam, mulai dari pengharaman mutlak hingga pengecualian dalam kondisi tertentu seperti ancaman terhadap nyawa ibu. Di sisi lain, hukum kesehatan Indonesia memberikan batasan dan persyaratan ketat terkait praktik aborsi. Di era keterbukaan informasi, pemahaman yang komprehensif mengenai perspektif agama dan hukum menjadi krusial untuk meningkatkan literasi masyarakat dan mencegah risiko aborsi tidak aman.Abstract: Abortion presents a complex challenge, intertwined with legal, religious, and medical considerations, particularly in Indonesia's diverse, Muslim-majority society. This study seeks to thoroughly examine the Islamic religious perspective on abortion, drawing from interpretations of its core tenets. Furthermore, the research investigates how Indonesian health law governs abortion through regulations like Government Regulation No. 28 of 2024 and Law No. 1 of 2023 on the Criminal Code. Our findings reveal that Islamic views on abortion range widely, from outright prohibition to allowing exceptions in dire circumstances, such as when the mother's life is at risk. Conversely, Indonesian health law outlines stringent restrictions and conditions for abortion procedures. In this age of open information, a holistic grasp of both religious and legal viewpoints is essential to boost public understanding and mitigate the dangers of unsafe abortions.

Abstract

Rekam medis elektronik dimanfaatkan untuk menghimpun, menyimpan, memproses, dan mengakses data rekam medis dengan cepat dan akurat, memanfaatkan kemajuan teknologi. Penelitian ini bertujuan untuk mengevaluasi penerapan Peraturan Menteri Kesehatan Nomor 24 Tahun 2022 mengenai rekam medis terhadap efektivitas pelayanan kesehatan. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan analisis deskriptif, melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa adanya sanksi administratif, seperti teguran tertulis atau rekomendasi pencabutan status akreditasi, akan diberlakukan terhadap fasilitas pelayanan kesehatan yang tidak mematuhi atau melanggar ketentuan mengenai penerapan rekam medis elektronik sesuai dengan batas waktu yang telah ditetapkan dalam Peraturan Menteri Kesehatan Nomor 24 Tahun 2022. Selain itu, keterbatasan sarana dan prasarana, serta ketidakstabilan jaringan dan koneksi juga menjadi masalah yang dapat mengakibatkan gangguan atau kesalahan sistem pada beberapa titik waktu.

Abstract

Regarding the right to protect and respect individual rights as stated in positive law in Indonesia, these rights are part of the human rights of every citizen. So that the state is obliged to guarantee the availability and fulfillment of these rights, in order to avoid the threat of abuse and violations by various parties, including state officials themselves. During the Covid-19 pandemic the question is how can the right to individual health be obtained and the state can guarantee it? This research uses sociological normative juridical research by conducting a survey of 531 respondents in Jakarta in March 2020. The results of the study were analyzed qualitatively so that the state has the authority to guarantee telemedicine services as a form of state responsibility in the new normal era according to Regulation of the Minister of Health of the Republic of Indonesia Number 20 2019 concerning the Implementation of Telemedicine Services between Health Service Facilities.

Abstract

This normative juridical research scrutinizes Indonesia's legal framework surrounding abortion, juxtaposing the criminalization of abortion with the nuanced provisions of Law Number 17 of 2023 concerning health. The study focuses on Article 42, which permits abortion under specific indications such as fetal viability challenges and pregnancies resulting from rape. The primary legal materials are sourced from statutory regulations, with a supplementary examination of secondary legal materials. The research reveals the legal complexities surrounding abortion in Indonesia, shedding light on the delicate balance between criminal sanctions and legal protections. The implications of the findings extend to the broader discourse on reproductive rights and the evolving legal landscape. Abstract

This study aims to analyze and compare the institutional structure and basic principles of the Criminal Justice System (CJS) in Indonesia and South Korea. This study examines how the adaptation of Civil Law principles shapes the unique dynamics of the criminal justice process in both countries. Indonesia and South Korea are both rooted in the Civil Law tradition that upholds the principles of legality and codification. This study uses a normative legal method with a comparative approach through a literature review to analyze relevant legislation and literature. The results of the study show significant differences in implementation: Indonesia maintains an integrated criminal justice system model with a sectoral separation of the functions of investigators (the police) and prosecutors (the attorney general's office). In contrast, South Korea shows a more dynamic evolution through the centralization of the authority of prosecutors as leaders of investigations and the application of the limited principle of opportunity (Opportunitätsprinzip). This adaptation, including the participatory jury system as a foreign element, aims to improve efficiency, public accountability, and substantive justice-particularly in victim protection. In conclusion, South Korea’s strategy offers valuable insights for Indonesia to strengthen inter-agency integration, improve victim rights protection, and examine the potential flexibility in the principle of legality for the sake of a more equitable and effective CJS/SPP.

Abstract

Law Number 17 of 2023 on Health transformed the Indonesian Medical Discipline Honorary Council (MKDKI) into the Professional Discipline Council (MDP). This development gave rise to three research questions: what is the relationship between professional discipline and law in Indonesia, how do disciplinary sanctions relate to legal sanctions, and how can MDP recommendations assist criminal and civil court proceedings? This research employed a normative legal research method using conceptual and statutory approaches. Law Number 17 of 2023 on Health is the primary legal material, which was analyzed normatively and qualitatively. This research found that professional discipline norms, which ideally should complement and support legal norms, still overlap with them. Article 306 uses the term “disciplinary sanction”, which may be interpreted as a legal measure, given that the term “sanction” carries legal implications. Further analysis is required, as the current study was limited to the aspect of legal diction. Article 308 introduces a new provision requiring MDP recommendations to be requested by investigators in criminal cases and by defendants in civil cases. However, the role of such recommendations in civil proceedings remains unclear, as it involves the principle of liability and potentially raises concerns of judicial subordination to the MDP. In summary, while efforts have been made to establish a connection between professional discipline enforcement and legal processes, further in-depth study is necessary.AbstrakUndang-Undang Nomor 17 Tahun 2023 tentang Kesehatan mengubah bentuk Majelis Kehormatan Disiplin Kedokteran Indonesia (MKDKI) menjadi Majelis Disiplin Profesi (MDP). Kehadiran undang-undang ini mengantarkan kepada tiga rumusan masalah berupa bagaimana hubungan antara disiplin profesi dengan hukum di Indonesia, bagaimana posisi sanksi disiplin terhadap sanksi hukum, dan bagaimana kemampuan rekomendasi MDP dalam membantu proses peradilan pidana dan perdata. Penelitian ini menggunakan metode hukum normatif dengan pendekatan konseptual dan perundang-undangan. Bahan hukum primer ialah Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, yang selanjutnya dianalisis secara kualitatif normatif. Penelitian ini menemukan bahwa norma disiplin profesi, yang secara ideal seharusnya memberikan makna dan dukungan terhadap norma hukum, masih tumpang tindih terhadap norma hukum. Pasal 306 masih menggunakan frasa “sanksi disiplin” yang berpotensi diinterpretasikan sebagai salah satu upaya hukum karena kata “sanksi” mengandung makna hukum. Analisis tersebut perlu diteliti lebih lanjut karena terbatas pada aspek kebahasaan. Pasal 308 membawa kebaruan berupa rekomendasi MDP yang harus dimintakan penyidik dalam konteks pidana dan tergugat dalam konteks perdata. Posisi rekomendasi secara perdata masih belum terang karena membawa asas tanggung gugat dan berpotensi menimbulkan subordinasi pengadilan terhadap MDP. Dengan demikian, terdapat usaha dalam menjelaskan hubungan antara penegakan disiplin profesi tenaga medis dengan hukum yang masih membutuhkan pendalaman.

Abstract

Perkembangan teknologi informasi telah mendorong transformasi signifikan dalam sistem pelayanan kesehatan melalui layanan konsultasi kesehatan online. Layanan ini memberikan kemudahan akses bagi masyarakat, namun sekaligus menimbulkan tantangan hukum baru, khususnya terkait perlindungan atas keamanan dan kerahasiaan data medis pasien. Data medis merupakan data pribadi yang sangat sensitif karena berkaitan langsung dengan kondisi kesehatan, identitas, serta martabat seseorang, sehingga memerlukan perlindungan hukum yang ketat. Penelitian ini bertujuan untuk menganalisis pengaturan dan pelaksanaan perlindungan hukum terhadap hak atas keamanan dan kerahasiaan data medis pasien dalam layanan konsultasi kesehatan online di Indonesia, mengidentifikasi permasalahan hukum yang dihadapi dalam penerapannya, serta mengkaji upaya hukum dan kebijakan yang telah dan perlu dilakukan untuk menjamin perlindungan tersebut secara efektif dan berkelanjutan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual, melalui analisis bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa perlindungan data medis pasien secara normatif telah diatur dalam Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi, Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, serta Undang-Undang Informasi dan Transaksi Elektronik. Namun demikian, pengaturan tersebut masih bersifat parsial dan belum sepenuhnya harmonis, sehingga menimbulkan celah hukum, terutama terkait standar teknis keamanan, pembagian tanggung jawab para pihak, pengelolaan rekam medis elektronik, dan mekanisme pengawasan. Oleh karena itu, diperlukan penguatan regulasi yang lebih spesifik, peningkatan koordinasi antarinstansi, serta penguatan kapasitas sumber daya manusia agar perlindungan hukum terhadap data medis pasien dalam layanan konsultasi kesehatan online dapat terwujud secara optimal tanpa menghambat inovasi pelayanan kesehatan digital.

Abstract

Introduction: This study examines the application of causation theories in medical malpractice cases, focusing on the complex intersection between medical uncertainty and legal certainty. Within the inherently multi-causal nature of clinical practice, establishing a definitive causal link between a physician's omission and a patient's death remains a significant judicial challenge in Indonesia.Purposes of the Research: This research aims to evaluate the consistency of judicial reasoning in applying causation theories through an in-depth analysis of the District Court of Denpasar Decision No. 126/Pid.Sus/2011/PN.Dps. Furthermore, it seeks to identify whether the court's approach aligns with modern normative attribution standards in criminal law.Methods of the Research: Employing a normative legal research method with statute, case, and conceptual approaches, the study compares conditio sine qua non, adequate causation, and objective imputation.Findings of the Research: Findings reveal a “methodological shift” in judicial reasoning, moving from rigid factual analysis towards elements of adequate causation and objective imputation. However, a critical flaw identified is the court's failure to distinguish between “inherent medical risks” and “negligent risks”. The novelty lies in exposing the inconsistent application of these theories, leading to legal unpredictability. The study concludes that Indonesian courts require a more robust normative framework, particularly the integration of objective imputation, to ensure criminal liability in medical malpractice is assessed based on professional standards, not just fatal outcomes.

Abstract

Introduction: This paper analyzes the strategic role of legal structure in addressing crime as a social phenomenon that threatens public order and legal stability. Legal structure comprises legal norms and law enforcement institutions, including the police, prosecutors, courts, and correctional facilities, which collectively support crime prevention, law enforcement, and offender rehabilitation.Purposes of the Research: The research aims to examine the functions of legal structure in preventing, suppressing, and rehabilitating criminal conduct, as well as to identify institutional and societal challenges affecting the effectiveness of crime control.Methods of the Research: This study applies a normative juridical approach, using statutory and conceptual analysis to assess criminal law policies and the performance of the criminal justice system in crime prevention and control.Findings of the Research: The findings reveal that legal structure operates through three key stages: legislative formulation grounded in legality, proportionality, and humanism; judicial application requiring institutional coordination within the criminal justice system; and administrative execution focused on offender rehabilitation and reintegration. The study identifies internal obstacles such as corruption, limited institutional capacity, regulatory complexity, and bureaucratic inefficiency, alongside external challenges including low public legal awareness, unequal access to justice, and rapid technological change. The research proposes reforms to strengthen institutional integrity, enhance legal capacity and infrastructure, harmonize regulations, expand legal education and free legal aid, and promote restorative justice involving community participation. The originality of this study lies in its integrated, stage-based analysis of legal structure and its emphasis on institutional synergy and public engagement as essential elements for sustainable crime prevention and substantive justice.

Abstract

Introduction: Embezzlement in office constitutes a form of crime arising from the abuse of trust within employment relationships, particularly in the automotive workshop sector, which is characterized by intensive asset management and high-frequency daily transactions. Modern car workshops operate through complex interactions involving cash handling, spare parts circulation, and technical service authority, creating structural vulnerabilities to occupational crime.Purposes of the Research: This article aims to analyze the practice of embezzlement in office within specialized car air conditioning and suspension workshops, with particular emphasis on the legal construction of employment relationships, the scope of employee authority, and the lawful possession of property that is subsequently abused.Methods of the Research: The research employs a statutory and conceptual approach, focusing primarily on the provisions of Article 488 of the New Indonesian Criminal Code. Doctrinal analysis is used to examine the elements of the offense, especially in relation to authority, trust, and asset control within the framework of employment.Findings of the Research: The analysis demonstrates that the operational characteristics of automotive workshops—such as cash management, spare parts administration, administrative record-keeping, and delegated technical service authority—generate heightened susceptibility to embezzlement aggravated by position. The article asserts that the elements of an “employment relationship” and “trust” constitute decisive factors in establishing embezzlement in office, thereby distinguishing it from ordinary embezzlement. This research underscores the necessity of a comprehensive understanding of employment relations and mechanisms of asset possession to ensure the accurate and proportional application of criminal law.
