Abstract

Kegiatan  pengabdian  masyarakat  ini  bertujuan  untuk  meningkatkan  literasi  keuangan  di  kalangan mahasiswa Universitas Sjakyahkirti, khususnya dalam hal penanaman modal dan investasi. Pengetahuan mengenai investasi dan pengelolaan keuangan pribadi sangat penting bagi mahasiswa sebagai generasi penerus  bangsa  untuk  merencanakan  masa  depan  yang lebih  baik  secara  finansial.  Namun,  banyak mahasiswa  yang  belum  memiliki  pemahaman yang  memadai  terkait  dengan  hal  ini.  Oleh  karena  itu, program  ini  dilaksanakan  dengan metode  sosialisasi,  penyuluhan,  pelatihan  praktis,  dan  diskusi kelompok untuk memberikan pemahaman dasar mengenai berbagai instrumen investasi, seperti saham, reksa  dana,  dan obligasi.  Hasil  evaluasi  menunjukkan  peningkatan  signifikan  dalam  pemahaman mahasiswa mengenai konsep dasar investasi, serta pentingnya perencanaan keuangan jangka panjang. Program  ini  diharapkan  dapat  membuka  wawasan  mahasiswa  tentang  pentingnya  investasi sejak  dini dan  membekali  mereka  dengan  pengetahuan  yang  cukup  untuk  mengambil keputusan  investasi  yang bijak meskipun dengan dana terbatas.

Abstract

Interfaith marriage is a marriage bond between a man and a woman who have different beliefs and religions. In principle, interfaith marriages are prohibited by every religious teaching. Every religious instruction requires a marriage bond to be carried out in a bond of the same faith (one religion). Based on Article 2 paragraph (1) of Law Number 1 of 1974 concerning Marriage, it is explained that a marriage is considered valid if it is carried out according to their respective religions and beliefs. Legal problems arise due to interfaith marriages, including the validity of marriages that give rise to rights and obligations between husband and wife and children's status due to interfaith marriages on their inheritance rights. Interfaith marriages occur in society but are usually covered up. In the case of interfaith marriages in Ogan Ilir Regency, our Community Service Team, Faculty of Law, Sjakhyakirti University conducted legal counseling to understand the legal consequences of interfaith marriages, especially regarding the validity of marriages, child status, and inheritance.

Abstract

The use of e-cigarettes can endanger health, especially the heart, lungs and other diseases. Therefore, youth understanding of the dangers of e-cigarettes is necessary. The aim of this activity is to raise the understanding of young people about e-cigarettes; to help young people better understand the health hazards of e-sigarettes; and to improve the perception of adolescents who believe that e-cigarettes are a safe way to smoke and are one of the right ways to quit smoking. The method of implementation of this dedication uses a discussion that consists of interactive discussion activities and delivery of material. The results of the pre-test study showed that the majority (40.6%) of teenagers are aware of cigarettes and their common dangers, including that they are aware about e-cigarettes and the dangers. The results of the post-test analysis showed a fairly significant improvement in their understanding after the deliberations carried out through the methods of discussion and video playback. In this case, their knowledge about cigarettes and the dangers of cigarettes, and their knowledge of e-cigarettes and their dangers increased to 82.5% This shows that the approach used during this devotional activity is quite effective. Based on this, it was concluded that all participants stated that they were willing and ready to act as mentors of change to quit e-cigarettes.

Abstract

Pengabdian kepada Masyarakat ini bertujuan untuk memberikan edukasi tentang mekanisme pelaksanaan arbitrase kepada dosen sebagai salah satu penggerak dalam mendidik mahasiswa dan mahasiswa di lingkungan Universitas Sjakhyakirti akan pentingnya penyelesaian sengketa secara musyawarah terutama dengan cara Arbitrase pada Badan Arbitrase Nasional Indonesia (BANI). Untuk membantu peserta memahami dan menghayati, penyuluhan dilakukan melalui diskusi interaktif dan penyampaian materi. Hasil studi pre-test menunjukkan bahwa 38,2% para peserta ada telah mengetahui mekanisme pelaksanaan arbitrase. Hasil analisis post-test menunjukkan peningkatan yang sangat signifikan dalam pemahaman para peserta setelah dilaksanakan diskusi interaktif dan penyampaian materi. Dalam hal ini pengetahuan para peserta terutama penyelesaian sengketa dengan cara arbitrase telah meningkat 82,5%, metode yang digunakan dalam pelaksanaan kegiatan sangat mendukung dan efektif. Berdasarkan hal tersebut didapatkan kesimpulan bahwa semua peserta dapat menerapkan arbitrase ini dalam penyelesaian sengketa untuk dapat mewujudkan rasa persaudaraan dan siap bertindak sebagai penggerak dalam menerapkan musyawarah terutama arbitrase dalam kehidupan sosial masyarakat.

Abstract

Introduction: The company often uses the spread of the Covid 19 virus in Indonesia in carrying out the Termination of Employment (PHK). Force Majeure is regulated by Article 164 of Law No. 13 of 2003 on Manpower but does not regulate epidemics or diseases as force majeure. Hardship itself is not regulated, and this doctrine is not yet known in Indonesia, as evidenced by the lack of contracts implementing the hardship clause.Purposes of the Research: The purpose of this study is to provide legal protection for employees who have experienced termination of employment due to the Covid-19 pandemic based on the principle of hardship.Methods of the Research: The research method used is normative juridical or doctrinal law research. It is research that uses the approach of legislation in the governance and legal values that live in society.Results of the Research: The results of this study include two things, namely the principle of force majeure or hardship in termination of employment, Companies that terminate employment should renegotiate by delaying work or known as the hardship principle. Using the force majeure principle causes workers to be unable to carry out their obligations, namely doing work. Based on the freedom of contract, the hardship principle principle clause can continue to carry out the agreement for workers affected by Covid-19. While the second is the legal consequences of the Covid-19 pandemic on work agreements, basically, in resolving the legal consequences caused by the Covid-19 pandemic, honesty from the parties is needed. This principle is known as good faith. It greatly determines the condition of the Covid-19 pandemic in the termination of employment by the company so that the parties can renegotiate their work agreement.

Abstract

In the context of trade, rivalry or business competition is an inevitable phenomenon in a country's economic ecosystem. Competition law is an important tool in a market economy, because through this tool the government seeks to protect fair competition between economic actors in the market. The Business Competition Supervisory Commission (KPPU) was established based on Law Number 5 of 1999. This research uses normative legal research methods. Normative legal research method is library research conducted by examining library documents or secondary data. By applying the deductive method, which is a way of thinking that draws conclusions based on general matters that have been proven correct, and these conclusions are applied to special matters. The issuance of Law Number 11 of 2020 concerning Job Creation, changes in provisions related to the points of change in articles 44, 45, 46, 47, 48 and the abolition of Article 49. These changes also create legal uncertainty regarding ongoing adjustments, especially regarding the provisions of administrative sanctions and changes to the main criminal sanctions. The Business Competition Supervisory Commission (KPPU) in investigating reports of unfair business competition relies on indirect evidence. The reason is that the Business Competition Supervisory Commission (KPPU) does not have the authority to conduct investigations, searches, and seizures in investigating business competition cases. This causes the decision to not be able to reflect and realise legal certainty. For this reason, it is necessary to have a judicial body that specifically handles business competition issues to enforce the law and ensure legal certainty of business competition.

Abstract

The principle of freedom of contract allows standardised contracts to be used. However, businesses usually use standard contracts that include exoneration or exclusion clauses because they are in a different position. This can be detrimental to consumers if these clauses limit their obligations and responsibilities. The practice of using standard agreements often occurs when the situation is unstable. Manufacturers change the standard rules. The agreement usually favours the business actors. Although the Consumer Protection Law is already in force in Indonesia, business agreements still use exoneration clauses. However, the existence of such exoneration clauses is still debated in the field of law, according to academic research from legal experts. This study uses a normative legal research approach. Research in the field of normative law focuses on the collection and analysis of current law, legal foundations and ideas, analysis of specific cases, the structure of the legal system, the degree of parallels, comparisons between laws, and the historical development of law. The purpose of this research is to study and provide legal results of the application of exoneration clauses in the binding agreement for the sale and purchase of houses and to resolve default disputes that arise because of housing sale and purchase agreements containing exoneration clauses. The presence of this standard model agreement is still a legal issue, especially in civil law in the field of agreements. Conversely, this new draft agreement may violate consumer rights and even violate the legal rules governing consumer protection. The result is that this research is considered interesting and important to conduct.

Abstract

The integration of digital technology into electoral processes marks a significant transformation in modern democracies, including Indonesia. Electronic-based elections have been implemented to improve the efficiency, transparency, and accessibility of the electoral process. However, this shift has also introduced a range of challenges, such as cybercrime, data leaks, misinformation, and legal ambiguities. The 2024 Presidential Election presents a critical opportunity to evaluate the effectiveness of criminal law enforcement in safeguarding the integrity of electronic elections. This research aims to assess how Indonesia’s legal system ensures compliance and accountability in the context of electronic voting. Utilizing a normative juridical approach, the study draws on primary legal materials specifically Law Number 7 of 2017 concerning General Elections and analyzes legal theories, principles, and doctrines relevant to electoral and criminal law. The findings reveal a regulatory gap in the current legal framework, where specific provisions addressing electronic electoral crimes are lacking. Consequently, enforcement efforts rely heavily on general laws such as the Electronic Information and Transactions Law, which are insufficient for addressing the complexity of digital election violations. The study emphasizes the urgent need to revise the Election Law to include detailed criminal provisions related to electronic election offenses, including classifications of violations, enforcement mechanisms, and accountability measures. In addition, the research highlights the positive impact of digital monitoring tools like Siwaslu and Gowaslu, implemented by Bawaslu, in enhancing election. Strengthening these legal and institutional aspects is essential to ensure that the 2024 Presidential Election upholds democratic principles in an increasingly digital landscape.

Abstract

Penelitian ini mengeksplorasi perlindungan hukum bagi penerbit cek dalam menghadapi risiko kesalahan pembayaran oleh bank kepada pembawa cek yang tidak berhak. Mengingat meningkatnya risiko kejahatan dalam transaksi bisnis, cek sebagai alat pembayaran memiliki peran yang signifikan, tetapi juga rentan terhadap penyalahgunaan, terutama pada cek atas tunjuk yang dapat dicairkan oleh siapa saja yang membawanya. Dengan menggunakan metode yuridis normatif berbasis kajian pustaka, penelitian ini menganalisis regulasi terkait, termasuk Kitab Undang-Undang Hukum Dagang (KUHD) dan peraturan Otoritas Jasa Keuangan (OJK) tentang perlindungan konsumen. Hasil penelitian menunjukkan bahwa cek atas tunjuk memerlukan perlindungan hukum yang lebih kuat karena sifatnya yang mudah dipindahtangankan. Rekomendasi yang diusulkan adalah agar bank meningkatkan kewaspadaan dalam proses pencairan cek dan agar otoritas terkait menetapkan peraturan yang lebih spesifik. Kesimpulannya, terdapat urgensi untuk memperbarui regulasi guna meningkatkan keamanan cek atas tunjuk sebagai instrumen pembayaran yang sah dan aman dalam transaksi bisnis.

Abstract

The protection of personal data has become increasingly critical in the digital era, particularly in e-commerce transactions involving the use of Artificial Intelligence (AI). A significant legal gap persists because, although Indonesia has enacted Law No. 27 of 2022 on Personal Data Protection, there are still no implementing regulations specifically addressing the use of AI in personal data collection and processing. Consequently, legal protection for consumers remains inadequate and vulnerable to misuse by digital businesses and cybercriminals. This study aims to analyze the effectiveness of legal protection for consumers’ personal data in Indonesia and to assess the urgency of regulating AI use in e-commerce activities. The research employs a normative legal method, utilizing legislative and conceptual approaches. The findings reveal that AI can enhance the detection and prevention of personal data breaches more effectively. However, without implementing regulations and an independent supervisory authority, AI may also pose significant privacy risks. Moreover, the lack of clear legal standards governing the accountability of electronic system operators for data security further weakens personal data protection. This study recommends formulating detailed implementing regulations governing AI use in personal data management and establishing an independent supervisory body with the authority to monitor, evaluate, and enforce compliance with personal data protection laws. Perlindungan data pribadi menjadi semakin krusial di era digital, terutama dalam transaksi e-commerce yang melibatkan penggunaan Kecerdasan Buatan (Artificial Intelligence, AI). Terdapat kesenjangan hukum yang signifikan karena, meskipun Indonesia telah memberlakukan Undang-Undang No. 27 Tahun 2022 tentang Perlindungan Data Pribadi, belum terdapat peraturan pelaksana yang secara spesifik mengatur penggunaan AI dalam pengumpulan dan pemrosesan data pribadi. Akibatnya, perlindungan hukum bagi konsumen masih belum optimal dan rentan terhadap penyalahgunaan oleh pelaku bisnis digital maupun kejahatan siber. Penelitian ini bertujuan untuk menganalisis efektivitas perlindungan hukum terhadap data pribadi konsumen di Indonesia serta menilai urgensi pengaturan penggunaan AI dalam aktivitas e-commerce. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa AI dapat meningkatkan efektivitas deteksi dan pencegahan kebocoran data pribadi. Namun, tanpa adanya peraturan pelaksana dan lembaga pengawas independen, AI juga berpotensi menimbulkan risiko serius terhadap privasi. Selain itu, ketiadaan standar hukum yang jelas terkait tanggung jawab penyelenggara sistem elektronik atas keamanan data semakin melemahkan perlindungan data pribadi. Penelitian ini merekomendasikan penyusunan peraturan pelaksana yang komprehensif mengenai penggunaan AI dalam pengelolaan data pribadi serta pembentukan lembaga pengawas independen yang berwenang untuk memantau, mengevaluasi, dan menegakkan kepatuhan terhadap peraturan perlindungan data pribadi.Keywords: Artificial Intelligence; E-commerce; Legal Protection; Personal Data
