Abstract

Objective: This article aims to analyze the concept of gender consciousness from an Islamic perspective and its relevance in contemporary society. This study focuses on the principles of justice, spiritual equality, and complementary gender roles. The ultimate goal is to formulate a moderate, contextual, and applicable framework for Islamic gender consciousness. Theoretical framework: This research uses the framework of Islamic justice and spiritual equality. The analysis is supported by maqashid al shariah and the thought of contemporary scholars. This framework emphasizes the balance of gender rights and responsibilities. Literature review: Previous studies have shown diverse views on Islam and gender. Gender inequality is often associated with patriarchal culture and interpretations. However, contextual synthesis studies are still limited. Methods: This study uses a qualitative approach based on literature studies. Data are obtained from the Quran, Hadith, and the latest academic literature. The analysis is carried out through content and thematic analysis. Results: The results of the study show that Islamic gender awareness is based on proportional justice, not absolute equality. Gender inequality in social practice is more influenced by cultural factors and ahistorical interpretations. Moderate Islamic gender awareness has proven to be relevant for maintaining social balance and harmony in society. Implications: These findings have implications for strengthening education and gender-fair policies. Islamic gender awareness can prevent discrimination and extremism. This approach supports social harmony. Novelty: The novelty of this research lies in the synthesis of Islamic values and modern gender issues. This article offers a moderate Islamic gender awareness concept. This approach is both applicable and contextual.

Abstract

Background. Customary law ('urf) plays a crucial role in shaping Islamic legal thought, particularly in traditional regions where local traditions intersect with Sharia principles. Historically, Islamic jurists have recognized the relevance of customary law in legal deliberations, particularly when it does not conflict with the fundamental texts of the Qur'an and Sunnah. Purpose. This study aims to analyze the integration of customary law within the Islamic legal framework, emphasizing its role in the formulation of legal decisions across time periods and schools of jurisprudence. Methods. This study uses a qualitative research design with a case study approach to explore the role of Islamic social movements in shaping Indonesian democracy, particularly in the areas of activism, welfare, and education. Results. The findings indicate that customary law not only serves as a complementary legal source but also contributes significantly to the contextualization and adaptability of Islamic legal norms across various communities. Furthermore, jurists from the Maliki, Hanafi, and Shafi'i schools have demonstrated varying degrees of acceptance of 'urf, reflecting a dynamic and pluralistic legal tradition. Conclusion. In conclusion, the incorporation of customary law into Islamic jurisprudence underscores the flexibility and responsiveness of Islamic legal theory to local realities.

Abstract

Background. The development of Islamic law in Indonesia reflects ongoing efforts to reconcile normative fiqh with social realities within a plural legal system. The concept of social fiqh has emerged as a dynamic approach that emphasizes public interest, contextual reasoning, and responsiveness to societal change, particularly in the domains of criminal and civil law. Purpose. This study aims to analyze comparatively how social fiqh informs the formulation and implementation of Islamic criminal law and civil law regulations in Indonesia, and to assess its contribution to legal reform. Method. The research employs a qualitative comparative legal approach, combining normative analysis of statutes, court decisions, and fiqh literature with contextual analysis of socio-legal dynamics. Data are analyzed through doctrinal interpretation and comparative frameworks. Results. The findings indicate that, regardless of proficiency level, L1, FLCA, or FLE level, learners prefer more explicit OCF techniques, such as metalinguistics feedback and explicit correction. However, Korean undergraduates scored lower in the majority of OCF strategies (i.e., ignoring, elicitation, recast, explanation, and public feedback) compared to the other participants. Conclusion. The findings indicate that social fiqh plays a more explicit and flexible role in civil law regulations, facilitating adaptation to social needs, legal pluralism, and state law. In contrast, its influence on criminal law remains limited and cautious, constrained by positivist legal principles, human rights considerations, and political sensitivity.

Abstract

Religious moderation is a fundamental principle in Islam that emphasizes balance (tawazun), justice (i'tidal), tolerance (tasamuh), and the middle path (tawassuth) in religious life. This article aims to analyze the concept of religious moderation from the perspective of Islamic law and examine its implications for Islamic education. This study employed a qualitative approach using a library research method by reviewing primary and secondary sources, including the Qur’an, Hadith, classical and contemporary Islamic legal literature, academic journals, and official documents related to religious moderation. Data were analyzed using content analysis to identify key concepts, principles, and educational implications of religious moderation. The findings reveal that religious moderation is an integral part of Islamic law, reflected in the objectives of Sharia (maqashid al-shari'ah), the principles of justice, tolerance, consultation, equality, and legal flexibility. In the context of Islamic education, religious moderation can be implemented through curriculum development, inclusive learning approaches, and the creation of a tolerant and dialogical educational environment. However, religious moderation has clear normative boundaries and does not imply compromising core Islamic beliefs, including the principles of tawhid, Sharia, and Islamic morality. Therefore, religious moderation serves as a strategic framework for strengthening social harmony, preventing religious extremism, and fostering an inclusive and peaceful Islamic civilization.

Abstract

This study aims to analyze the concept of pesantren education from ethical, legal, and psychological perspectives by placing the thinking of KH. Hasyim Asy'ari is the main basis of the analysis. This research uses a qualitative approach based on literature studies with hermeneutic-critical analysis. The results of the study show that in the thinking of KH. Hasyim Asy'ari, pesantren education is built on the integration of adab, fiqh, and kiai-santri relations as the foundation for the formation of student character. This study found that adab is placed as the main requirement in the process of seeking knowledge, so that students are required to prioritize respect for teachers, sincerity, discipline, and self-control before achieving intellectual competence. In the normative dimension, fiqh is not only understood as a formal rule of worship, but also as an instrument for fostering social behavior and ethics in the daily life of students. Meanwhile, the kiai-santri relationship functions as an affective pedagogical model that emphasizes example, emotional closeness, and habituation of values through direct interaction in pesantren life. These findings show that pesantren education from the perspective of KH. Hasyim Asy'ari is oriented towards the integration of intellectual, spiritual, and moral development. This article emphasizes that this paradigm has high relevance in responding to the crisis of dehumanization of modern education. The novelty of this research lies in the effort of an integrative conceptual reconstruction, which synthesizes the dimensions of ethics, law, and psychology in one coherent epistemic framework, different from previous studies that tended to be partial, both sociological, historical, and pedagogical. These findings show that the paradigm is relevant in responding to the crisis of dehumanization of modern education as well as contributing to the development of a more integrative epistemology of Islamic education.

Abstract

This study examines the concept of humanism in Islam and its contemporary problematics within the context of community development. Employing a qualitative library research approach, the study analyzes classical and contemporary scholarly works published between 2021 and 2025, with particular attention to discussions on Islamic humanism in academic journals. The findings indicate that Islamic humanism is firmly grounded in theological and philosophical principles that emphasize human dignity (karāmah al-insāniyyah), moral responsibility, social justice, and collective accountability. Unlike secular humanism, which is largely anthropocentric, Islamic humanism is characterized by a theo-anthropocentric orientation that integrates divine values with human welfare. The study further reveals that Islamic humanism has strong relevance for community development, especially in education, social transformation, and the empowerment of marginalized groups. Nevertheless, several challenges hinder its implementation, including the gap between normative Islamic ideals and social realities, reductive interpretations that confine humanism to individual morality, and rigid textual approaches that overlook contextual and humanitarian dimensions of Islam. The novelty of this research lies in positioning Islamic humanism not merely as an ethical discourse but as an integrative normative-structural framework for community development. By emphasizing its applied and transformative dimensions, this study contributes to expanding Islamic humanism from a conceptual discourse to a practical paradigm. The study recommends strengthening contextual interpretations of Islamic teachings, integrating humanistic values into Islamic education, and employing Islamic humanism as a foundation for community empowerment and policy development to promote a just, inclusive, and sustainable society. Keywords: Islamic Humanism, Human Dignity, Community Development, Islamic Education, Social Justice

Abstract

The Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) is one of the most significant instruments in the development of Islamic law in Indonesia, particularly in the areas of marriage, inheritance, and waqf. Although it has served as the primary legal guideline for Religious Courts since its promulgation through Presidential Instruction No. 1 of 1991, the KHI continues to generate debates regarding its formal legitimacy, substantive provisions, and relevance to contemporary social developments. This study aims to critically examine the strengths, weaknesses, and reform directions of the KHI within the framework of Indonesia’s national legal system. The research employs a library research method with a descriptive-analytical approach. Data sources consist of primary legal materials, including the KHI and related regulations, as well as secondary materials such as books, journal articles, and previous scholarly studies. Data were analyzed through a normative assessment of the KHI’s legal position, functions, implementation, and challenges in Islamic family law practice. The findings indicate that the principal strength of the KHI lies in its ability to promote legal uniformity, simplify diverse fiqh opinions into operational legal provisions, and strengthen legal certainty within Religious Courts. However, the KHI also faces formal and substantive limitations, including its relatively weak legal status and its insufficient responsiveness to issues of gender justice, child protection, legal pluralism, and contemporary family dynamics. Therefore, KHI reform should be conducted through a participatory and maqāṣid al-syarī‘ah-based approach that emphasizes substantive justice and social responsiveness

Abstract

The dichotomy between religious and secular sciences has long been a challenge within the Islamic education system, particularly in madrasahs. Consequently, teaching practices often become fragmented and disconnected from the spiritual dimension of Islam. This article aims to conceptually examine the importance of an integralistic approach in Islamic Studies as an epistemological foundation for integrating science and Islam in madrasah education. The study employs a library research method using content analysis of classical and contemporary Islamic scholars such as Amin Abdullah, Fazlur Rahman, Ismail Raji al-Faruqi, and Zakiyuddin Baidhawy. The findings indicate that the integralistic approach facilitates an epistemological dialogue between revelation, reason, and empirical reality, allowing madrasah learning to integrate the values of tawhid with modern scientific knowledge. Hence, the integration of science and Islam is not merely a curricular synthesis but a paradigm shifts that positions knowledge as an act of devotion to God. The study recommends developing a curriculum model based on integrative-interconnective approaches and strengthening teachers’ competencies to foster holistic and transformative learning.

Abstract

Differences of opinion are an inherent part of Islamic intellectual tradition and become a social reality in the religious life of Indonesian Muslims. However, the emergence of digital media, shifting patterns of authority, and the increasing politicization of religious symbols often exacerbate tensions within communities. This article examines how disagreements can be managed ethically through the framework of religious moderation. Using a qualitative library research method, the study reviews classical Islamic discourses on ikhtilaf, national policy documents on religious moderation, and contemporary socio-religious dynamics in Indonesia. The findings show that conflicts rarely arise from the substance of theological or jurisprudential differences, but rather from communication patterns, emotional responses, and weak religious literacy. The principles of moderation such as balance, tolerance, anti-violence, and respect for local traditions provide a constructive approach for interacting across divergent viewpoints. The study concludes that courteous disagreement is not only an ethical imperative but also a civic necessity for sustaining social harmony in a pluralistic nation. Keywords: Disagreement, Religious Moderation, Islamic Ethics, Tolerance
