Abstract

Supervision of judges in Indonesia is a crucial element to maintain the integrity, independence, and professionalism of the judicial system. This study anayzes the effectiveness of the judicial oversight mechanism through an internal approach by the Supreme Court, external by the Judicial Commission, and the role of the community through a code of ethics. With a qualitative descriptive-analytical approach, this study uses secondary data from legal documents, such as the 1945 Constitution, Law Number 48 of 2009, and the Joint Regulation of the MA-KY 2012, as well as interviews with judges and academics. The results of the study indicate that the MA's internal supervision is constrained by a large workload, while the KY's supervision is limited due to the Constitutional Court Decision Number 005/PUU-IV/2006, which excludes MK judges and supreme court justices, triggering the risk of judicial corruption and a crisis of public trust. Public supervision through a code of ethics is effective but requires further education. The main challenges include overlapping authority between the MA and KY and the lack of supervisory integrity. This study recommends better coordination, strengthening the authority of the KY, and increasing the role of the community to ensure justice and judicial independence.

Abstract

This study aims to analyze the legal aspects of aggravated theft in the context of social justice, focusing on Case Number 47/Pid.B/2022/PN Lbo. It examines the application of criminal sanctions against the perpetrator and considers the judge's perspective in delivering the verdict. The research addresses two main questions: first, how are criminal sanctions applied in this case, and second, how do the judge's considerations reflect the values of social justice. Employing a descriptive analytical method, this study explores the legal dimensions of aggravated theft within the specified case. The findings underscore the importance of a social justice-based approach in law enforcement, which emphasizes not only punishment but also rehabilitation and crime prevention, in order to create a more equitable and effective justice system.

Abstract

This research aims to analyze the criminal responsibility of children in the crime of inducing a child to engage in sexual intercourse, using the case study of Decision Number 1/Pid.Sus.Anak/2025/PN Bjm. The research focus includes the application of criminal liability principles to children, the legal factors influencing children's criminal liability, special legal treatment and protection, as well as efforts to reform laws and policies on children's criminal law enforcement to make it more effective in the future. The research method uses a juridical-normative approach, with analysis of court decision documents, relevant legislation, and legal literature. The research results indicate that the application of the principles of criminal responsibility for children prioritizes guidance and rehabilitation, not solely retributive punishment. Legal factors such as the age of criminal responsibility, the ability to be held accountable, the element of fault, and the causal relationship are the main considerations in determining a child's accountability. Additionally, diversion mechanisms, legal protection, and psychological support are important instruments for ensuring children's rights are protected. This research also highlights the need for legal and policy updates, including improving diversion mechanisms, integrating restorative justice principles, using information technology for monitoring rehabilitation programs, and adopting best practices from other countries that are effective in reducing child recidivism. In conclusion, the application of the principles of juvenile criminal responsibility in Indonesia has already integrated theories of criminal responsibility, rehabilitation, and restorative justice, but legal and policy reforms are still needed to improve effectiveness, fairness, and protection for both child offenders and victims.

Abstract

Currently, the legal system in Indonesia is experiencing development. This development emphasizes the orientation of criminal case resolution which was initially based on the retributive paradigm that provides retribution for crimes committed by the perpetrator towards a new approach model, namely "Restorative Justice". In order to adapt to existing developments and achieve legal and national goals, the Prosecutor has issued a legal product regarding restorative justice in handling criminal cases at the prosecution stage (the authority of the Prosecutor as Dominus Litis). This study aims to determine and analyze (1) a philosophical legal review of the concept of restorative justice in the Indonesian criminal justice system, (2) the relationship between the principle of dominus litis of the prosecutor and restorative justice efforts in the criminal justice process, and (3) the problem of the function of dominus litis of the prosecutor in applying the concept of restorative justice in the criminal justice process. The approach method used in this study is sociological juridical. The specifications of this study are descriptive analytical. The data sources used are primary data and secondary data. Primary data is data obtained directly from the field or from the first source and has not been processed by other parties. While secondary data is obtained from library research consisting of primary legal materials, secondary legal materials and tertiary legal materials. The results of the research and discussion can be concluded: (1) Restorative justice philosophically has a foundation contained in the fourth and fifth principles of Pancasila, which have the essence of meaning towards the values of deliberation and justice. Pancasila as the ideology and outlook on life of the Indonesian nation is used as a guide for all activities in life in every field. (2) This new justice model is then formulated in the form of technical instructions that can be used as a reference in handling cases with a restorative justice approach. On July 21, 2020, the Indonesian Attorney General issued Regulation of the Attorney General of the Republic of Indonesia Number: 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. Restorative justice is one of the efforts that can be made by the Prosecutor's Office in functionalizing the principle of Dominus Litis. (3) The regulation regarding the principle of dominus litis through restorative justice in the Criminal Procedure Code (KUHAP) in Indonesia is still unclear. Restorative justice is a legal approach that emphasizes reconciliation between perpetrators, victims, and the community, and has not been regulated in detail in the current Criminal Procedure Code.

Abstract

The anatomical pattern of fictitious mode crimes can be used by banks, some elements of fictitious mode only, or all elements of fictitious mode are used, so that this fictitious mode can be faced by banks because it comes from outside or from within. But banks can also use it themselves from outside and from within, when the bank uses fictitious mode from outside and from within, then the funds that are actually distributed will appear and the funds that are distributed are only records or documents or transactions, but the funds do not exist or are empty, imaginary, so that they become fictitious, then fictitious funds or credit funds become fictitious credit. This research aims to find out and analyze (1) the legal nature of criminal policy in the banking sector, (2) patterns of criminal responsibility for the disbursement of fictitious credit funds by banks, (3) legal problems of criminal responsibility in cases of disbursement of fictitious credit funds by banks. The approach method used in this study is normative juridical. The specifications of this study are descriptive analytical. The data source used is secondary data. Secondary data is data obtained from library research consisting of primary legal materials, secondary legal materials and tertiary legal materials. The results of the study and discussion can be concluded: (1) Law No. 10 of 1998 concerning Banking, specifies thirteen types of banking crimes (Articles 46 to 50), of which thirteen crimes can be classified into four types of crimes, namely: crimes related to licensing; crimes related to bank secrecy; crimes related to supervision and guidance; crimes related to banking business. (2) Implicated by the provisions of laws and regulations governing fictitious credit, the suspect can be subject to criminal responsibility under Article 49 of Law No. 10 of 1998 concerning Amendments to Law No. 7 of 1992 concerning Banking. Paragraph 1 states that: Members of the Board of Commissioners, Directors or bank employees who intentionally make or cause false records to be made in the books or in the reporting process, or in documents or reports on business activities, transaction reports or accounts of a bank. (3) Conceptually, the cumulative-alternative formulation system has been regulated in Law Number 1 of 2023 concerning the Criminal Code, whereby if the fine is not paid, the property is confiscated and auctioned to pay the fine or taken from the convict's income and if there is none (not enough), a substitute prison sentence/imprisonment is imposed for a period not exceeding the maximum prison sentence/imprisonment threatened.

Abstract

Hospitals in Indonesia, as mandated by the 1945 Constitution and health law policies, are required to provide equitable healthcare services to all citizens, including economically disadvantaged groups. However, frequent cases of hospital rejections against poor patients due to inability to pay reveal a gap between constitutional guarantees and practice. Such acts constitute misbruik van omstandigheden (abuse of circumstances), where hospitals exploit patients' positions vulnerable in therapeutic agreements and informed consent. The objectives of this research are threefold: first, to analyze the practice of misbruik van omstandigheden in medical contracts between hospitals and poor patients; second, to assess the form of legal responsibility of hospitals in cases of denial or neglect, and third, to formulate recommendations to strengthen the protection of poor patients' rights through regulatory reforms and effective sanctions. This study employs a doctrinal research method with a normative legal approach, supported by empirical case studies. Primary sources include the 1945 Constitution, Law Number 36/2009, Law Number 17/2023, and the Civil Code, complemented by Islamic legal principles (maqashid al-Shariah). The findings show that hospital rejections violate civil law, constitutional mandates, and ethical obligations.
