Abstract

AbstrakPerkawinan antar warga negara sangat dimungkinkan untuk terjadi, bahkan hal ini telah terjadi di Indonesia sejak zaman kolonial Belanda. Sebuah perkawinan akan membawa beberapa akibat hukum, dari segi status kewarganegaraan, harta kekayaan, anak, hingga pewarisan. Perkawinan beda warga negara (perkawinan campuran) sangat dimungkinkan adanya harta bersama atau harta bawaan, yang akan melibatkan lintas negara.  Setiap negara memiliki ketentuan yang berbeda mengenai Waris, bahkan di Indonesia tiap daerah atau suku budaya memiliki pandangan dan cara pembagian waris yang berbeda beda.  Tulisan ini menitikberatkan terhadap hukum waris yang terdapat unsur asing, dengan menggunakan pisau analisis Normatif deskriptif, yaitu dengan membandingkan antara hukum waris di Indonesia (menurut Kitab Undang-undang Hukum Perdata) dengan hukum waris di Jerman, sehingga diharapkan dapat dijadikan jawaban dan ukuran ketika terjadi suatu permasalahan waris yang mengandung unsur asing. AbstractMarriage between citizens is very possible to occur, even this has happened in Indonesia since the Dutch colonial era. A marriage will bring several legal consequences, in terms of citizenship status, property, children, and inheritance. The marriage of different citizens (mixed marriage) is very possible for the existence of joint property or inherited property, which will involve cross-country. Each country has different provisions regarding inheritance, even in Indonesia, each region or cultural tribe has different views and ways of dividing inheritance.  This paper focuses on inheritance law that contains foreign elements, using a descriptive Normative analysis knife, namely by comparing inheritance law in Indonesia (according to the Civil Code) with inheritance law in Germany, so that it is expected to be used as an answer and measure when there is an inheritance problem that contains foreign elements.

Abstract

The implementation of the execution of mortgage rights as collateral for a credit is still as contained in Article 26 UUHT which states that there is no statutory regulation that regulates it and there are still many obstacles faced in the process which trigger delays in protecting the interests of creditors for said mortgage rights. because the debtor as the one who gave the mortgage questioned or questioned the amount and the debt guaranteed by the mortgage, based on this it was what resulted in delays in the execution of the mortgage and the existence of legal incompetence in the execution. The formulation of the problem in this article is whether the creditor can immediately execute the Mortgage Guarantee Deed in the event of bad credit. The research method used is normative juridical research (Legal Research). The results of the study show that the execution of the mortgage deed cannot be carried out directly by the creditor when bad credit occurs due to the inconsistency of Article 224 HIR with Article 6 UUHT which results in execution having to be based on a court request.

Abstract

This research started from the construction of the new National Capital City of the Nusantara which has not yet been completed and requires a very large budget. In this regard, a financing model is needed that can be used as an alternative financing for the development of the new National Capital City. The aim of this research is to find the characteristics of sharia crowdfunding as an alternative financing in the process of building the new National Capital City. The research method used is a normative juridical research method with a statutory and a conceptual approach. The results of this research show that there are several characteristics of sharia crowdfunding as an alternative financing for the development of the New National Capital, namely: it is only intended for halal projects and products so that it complies with sharia principles and is free from interest rates; there is fairness in the distribution of profit and loss margins using a profit-sharing system; and supervised by the Sharia Supervisory Board.

Abstract

As a general observation we can say that there exists imbalance of power between producers and consumers of genetically engineered food. This paper, using a doctrinal legal approach, examines three issues: 1) the rationality of protecting consumers of genetically engineered food, 2) the rights of consumers of genetically engineered food, and 3) the effectiveness of consumer protection for genetically engineered food.  Arguably, the same situation exists between producers and consumers of genetically engineered food. Disparities and power imbalance relating to knowledge, capital – or simply power – determines the answer to those questions above.

Abstract

This article analyzes Mediation in Supreme Court Regulation (PERMA) Number 1of 2016 as an effort by the Religious Court to resolve inheritance disputes from the perspective of legal purpose theory. The theory of legal purpose is used to see the content of legal certainty, justice, and benefit in PERMA Number 1 of 2016 which is the legal basis for Mediation of inheritance disputes. This research is a yuridical normative research of the library research type. The results of this study indicate that Mediation regulated by PERMA Number 1 of 2016 contains legal objectives in the form of certainty, justice, and legal benefits, so that Mediation must be implemented by the court as the first way to resolve inheritance disputes. Keywords: Mediation; PERMA Number 1 of 2016, Inheritance Dispute, Legal Objective Theory

Abstract

Introduction: The background of this research is that there are still many food products that have not been halal certified, even though the government through the Halal Product Guarantee Agency (BPJPH) has provided convenience in registering halal products online with free assistance. Especially in this metaverse era, where technology has developed rapidly so that the use of digital technology should be able to encourage development through the halal industry.Purposes of the Research: The purpose of this study, firstly, is to know and understand the meaning of halal in both Islamic law and the Civil Code. Second, understanding the halal industry in the metaverse era in terms of the theory of utilitarianism and Maqashid Sharia.Methods of the Research: This study uses a normative juridical method with a legal-statutory approach and a conceptual approach.Results of the Research: The results of this study are: First, that halal in Islamic Law and the Civil Code have different contexts, but have a similar meaning, namely referring to something that is permitted and not prohibited by law. Second, the halal industry based on utilitarianism has utility value both for business actors who register their food products, as well as for the general public as consumers. Furthermore, based on Maqashid Sharia, halal food is included in the category of protecting the soul (nafs) and protecting the mind (aql).

Abstract

Over time, globalization has brought significant advancements in technology, especially in e-commerce. In the past, transactions were carried out offline, but with the advent of e-commerce, transactions can now be done online. One such e-commerce application is Shopee, which originated in Singapore and has expanded to countries such as Indonesia. Shopee has introduced a new feature called protection fees. Protection costs are the costs associated with protecting the buyer in the event of damage, subject to certain terms and conditions. However, the cost of protection has become a concern for consumers because they do not receive the compensation to which they are entitled. The research method used in this study is normative legal research. The results of the study show that legal protection for consumers related to damage claims that are subject to protection fees on the Shopee application can be categorized into two forms: internal legal protection based on agreements and external legal protection based on the Consumer Protection Law and the Insurance Law. Dispute resolution for consumers based on Article 45 of the Consumer Protection Law can be pursued through two methods: non-litigation and litigation. The non-litigation method involves resolving external disputes through the Consumer Dispute Resolution Institution (BPSK) using mediation. If an agreement is not reached, litigation can proceed through legal channels, with consumers filing lawsuits based on breach of contract.

Abstract

The right of self-defence is adopted in positive law. Self-defence in forced conditions due to aggression that threatens life, body, or property becomes the basis for exemption from punishment. This study uses the doctrinal type of legal research to justify the right of self-defence from the perspective of Locke's philosophy and Islamic law by collecting, analysing, and interpreting primary and secondary sources of law. In Locke's philosophy, the right to self-defence derives from the executive power of natural law that an individual has in a state of nature to be the judge and executor of natural law against all acts of violation of natural law that threaten their life, freedom, and property. In a political Society formed by mutual consensus to replace the natural state, individuals agree to relinquish the executive power of natural law to a civil government. In a political Society, the civil government is the judge and executor of the law for any dispute between individuals. However, the transfer of Natural Law executive power to the civil government is not absolute because, in certain circumstances that cause the civil government to be unable to protect life, freedom, and property, individuals can reuse their natural law executive power to safeguard themselves. The right of self-defence in a political society becomes a secondary means of self-protection only in circumstances where the civil government cannot protect individuals from threats to life, liberty, and property. Under Islamic law, defending one's own or others' life, honour, and property is the right of every Muslim without relying on a civilian government. Self-defence is carried out in proportion to acts of aggression. Based on Locke's philosophy and Islamic law, adopting the right of self-defence in positive law must have its limits defined to prevent its arbitrary use in an anarchic society

Abstract

Perjanjian perkawinan dapat diartikan sebagai persiapan memasuki bahtera rumah tangga. Perjanjian perkawinan adalah perjanjian yang dibuat sebelum perkawinan dilangsungkan. Namun saat ini, ada suami istri yang membuat perjanjian pernikahan di tengah-tengah pernikahan. Perjanjian perkawinan biasanya menjanjikan tentang harta benda dalam perkawinan. Perjanjian perkawinan juga mempengaruhi pihak ketiga yang mempunyai kepentingan. Rumusan masalah: 1) Apakah perjanjian perkawinan mengenai harta warisan yang dibuat oleh suami istri mempunyai kekuatan hukum yang sah dan mengikat kepada pihak ketiga, 2) Apakah notaris berwenang untuk mengesahkan perjanjian harta warisan yang disepakati oleh seseorang yang masih terikat? melalui pernikahan, dan 3) Bagaimana pengaturan selanjutnya? Terhadap kontrak warisan yang dibuat oleh suami istri. Tujuan penelitian ini adalah untuk mengetahui dan memahami keabsahan dan kekuatan hukum mengikat bagi pihak ketiga dalam suatu perjanjian perkawinan mengenai harta warisan yang dilakukan oleh suami istri, untuk mengetahui dan memahami kewenangan notaris dalam pengesahan suatu perjanjian harta warisan yang disepakati oleh seseorang yang masih terikat perkawinan, dan untuk memikirkan pengaturan-pengaturan yang akan datang bagi perjanjian pewarisan yang dibuat oleh suami istri. Jenis penelitian yang digunakan adalah yuridis normatif, pendekatan masalah yang digunakan adalah pendekatan undangundang, pendekatan konseptual, pendekatan kasus, dan pendekatan komparatif. Berdasarkan hasil kajian terhadap bahan hukum yang ada, dapat disimpulkan bahwa: Pertama, perjanjian perkawinan mengenai harta bawaan yang dilakukan oleh suami istri mempunyai kekuatan hukum dan mengikat bagi pihak ketiga jika dicatat atau dicatat dalam daftar umum di Kepaniteraan Pengadilan Negeri di wilayah hukum. pernikahan itu terjadi. Kedua, Notaris berwenang untuk mengesahkan perjanjian pewarisan yang diperjanjikan oleh orang yang masih terikat perkawinan, sebagaimana tertuang dalam Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015., dan Ketiga, pengaturan masa depan dari perjanjian pewarisan yang dilakukan oleh suami istri, memerlukan adanya kepastian hukum dalam membuat perkawinan terkait harta warisan yang dilakukan di tengah-tengah perkawinan.

Latar belakang penelitian ini adalah penggunaan term dan, atau, dan/atau, kecuali, dan selain dalam undang-undang secara tidak tepat yang kemudian menimbulkan problematik pemaknaan dan implementasi dalam praktik. Berdasarkan latar belakang tersebut dirumuskan isu hukum: Apa makna dan problematik penggunaan kata dan, atau, dan/atau, kecuali, dan selain dalam undang-undang? Menggunakan tipe penelitian hukum doktrinal, hasil penelitian ini: (1) term dan memiliki empat makna: (a) dan sebagai konjungsi, (b) dan berarti inklusif, (c) dan berarti atau, atau (d) dan berarti gabungan atau beberapa; (2) term atau adalah konjungsi yang memiliki dua makna: (a) atau berarti ekslusif dan inklusif dengan penggunaan secara umum adalah inkulisif kecuali konsep yang dihubungkan saling eksklusif, atau (b) atau berarti dan; (3) term dan/atau berarti konjungtif untuk menggabungkan sekaligus disjungtif untuk memisahkan; dan (4) term kecuali berarti ekslusif dan disintegratif sedangkan term selain sifatnya inklusif dan komplementer.
