Abstract

This research discusses consumer protection in cases of credit congestion in Indonesia, with a focus on improving law enforcement as one of the key aspects in ensuring adequate protection for consumers. In this context, effective law enforcement is crucial to protecting consumer rights and maintaining the integrity of the financial system as a whole. This research identifies several strategic steps that can be taken to strengthen law enforcement against financial institutions that violate consumer protection regulations. The results of this research are: First, it is necessary to increase supervision and law enforcement from financial supervisory authorities, such as Bank Indonesia and OJK, through routine audits, surprise inspections, and strengthening authority. Second, cooperation between financial supervisory authorities and law enforcement such as the police and prosecutors is important to increase the effectiveness of law enforcement.

Abstract

This research was motivated by the merger of three Sharia Banks namely Bank Syariah Mandiri (BSM), Bank Negara Indonesia (BNI) Syariah, and Bank Rakyat Indonesia (BRI) Syariah into Bank Syariah Indonesia. The merger had legal consequences for the customers because the merger policy led to integrating customer personal data into one Big Data. This had become customers' concern related to the security and monitoring system. Consequently, legal protections were needed to secure this issue. This study aims to find a form of legal protection for Sharia Bank Customers after the merger of the three Sharia banks. This study implemented normative legal research with the statute approach and the conceptual approach. The results found that the legal protection for Sharia Bank Customers as intended consists of 2 (two) forms. First, External Protection: legal protection made by the authorities in the form of laws and regulations. Second, Internal protection: legal protection made by the Sharia Bank to secure the customers' personal data.

Abstract

Information technology encourages globalization and IPR protection, making brands an important asset to differentiate products or services in business competition. This research aims to analyze the first to file principle in the registration of the Etawaku goat milk brand regarding legal certainty and legal consequences. The first to file principle as regulated in Law Number 20 of 2016 concerning Trademarks provides exclusive rights to the first registrant, without regard to previous use. This created a polemic in the case of a dispute between Imam Subekhi, the initial user of the Etawaku brand since 2012, and Mukit Hendrayatno, the official registrant of the brand in 2021 and 2022. This research uses a juridical-normative method with a statutory and conceptual approach. The research results show that the application of the first to file principle has provided legal certainty to the first registrant, namely Mukit Hedrayatno. As a result of the law, Imam Subekhi lost his rights to the brand even though he had used it previously. To protect its rights, early adopters can file a trademark cancellation lawsuit on the grounds of bad faith. Apart from that, it also has consequences for third parties, namely changes in ownership or brand disputes that can confuse consumers regarding the authenticity of the product and affect loyalty, as well as risk canceling contracts or cooperation with business partners if the trademark cancellation lawsuit is granted. This research emphasizes the importance of trademark registration to avoid future disputes and provides recommendations to DJKI to increase socialization and speed up the brand verification process through the latest technology.

Abstract

Pada prakteknya penagihan dalam proses perdata mebutuhkan waktu yang panjang perlu menggunakan upaya somasi atau gugatan perdata, sehingga perusahaan merasa tidak efisien dengan prosedur ini, untuk memepersingkat waktu dan mendapat keuntungan, perusahaan pinjaman online memilih dengan cara mengancam menggunakan konten asusila dan pornografi untuk menakut nakuti debitur. Cara ini dinilai perusahaan lebih cepat dan efektif memangkas prosedur umumnya yang Panjang, perbuatan ini didasari atas preferensi seseorang dalam memilih perbuatan yang paling menguntungkan serta efektif bagi diriya. Selain itu motivasi untuk mendapat keuntungan yang sebesar besarnya merupakan dorongan yang kuat sehingga korporasi dalam mengoperasikan niaganya secara langsung atau tidak langsung mengarah pada keterlibatan atau melibatkan diri dalam kejahatan. Pada masalah ini perusaahaan pinjaman online ikut serta dalam kejahatan korporasi yang termasuk pada tindak pidana yang dilakuan oleh karyawan korporasi atau korporasi itu sendiri untuk kepentingan korporasi. Pada masalah ini kesalahan yang dilakukan debt collector dapat digantikan oleh korporasi sebab adanya hubungan subordinasi antara pemberi kerja dan pelaku yang melakukan tindak pidana, serta keuntungan yang diperoleh pelaku sebenarnya bukanlah keuntungan pelaku melaikan keuntungan perusahaan sehingga korporasi dapat dimintai pertanggungjawaban pidana karena pelakunya merupakan karyawan korporasi dan bertindak dalam lingkup perkerjaan serta atas nama korporasi.

Abstract

This research reports on a legal study of trade secrets which are part of the Intellectual Property Rights system. Legal protection is given to trade secrets in order for trade secret right holders to be able to create a climate that encourages creation and innovation to advance Indonesian industry in order to compete in the scope of national and international business. A trade secret is information that the law considers to be a property. The classification of information as a trade secret must have economic value, be unknown to the public and kept confidential by the owner. There is a problem, namely the character of trade secrets that cannot be included in the system of property law in Indonesia, because the characteristics of trade secrets do not fulfill the elements of property rights and there is no single norm that regulates the registration of trade secret rights as property rights. Jeremy Bentham and Thomas Hobbes Theory of Legal Protection and Theory of Ownership are chosen as the analytical knife, that a trade secret is a legal right, namely a property right over an intangible movable property that arises due to a registration. The implication of this is that the trade secret law does not provide legal protection and legal certainty for the right holder.

Abstract

Contract default often occurs, as a result the creditor demands compensation from the debtor through the religious court instrument, the murabahah contract as a sharia contract which in fact implements sharia principles has fundamental differences related to compensation. The difference lies in the calculation of compensation only taking into account the original losses suffered and not the loss of future profits. The study focuses on two legal issues, namely the characteristics of compensation and the suitability of the application of compensation cases with the principle of justice in murabahah contract default disputes. This study is a normative legal study with a statutory, conceptual and case approach. The results show that sharia principle compensation has special characteristics, namely the value of compensation is calculated from real losses and does not depend on total future profits. In several cases of this study, the mandated sharia principles often do not become the legal basis for judges in deciding cases of compensation for default so that the principle of justice is not achieved.

Abstract

This research is based on the fact that injustice is experienced by motorcycle drivers working as couriers for online food delivery (OFD) services. Restaurants and OFD drivers hold very weak positions and are exploited by OFD companies through mechanisms such as the rating system, fake orders, and unfair profit sharing. In this study, the author aims to explore the characteristics of al-‘uqūd al-murakkabah (composite contracts) in online food delivery services. Several characteristics of OFD services based on al-‘uqūd al-murakkabah found in this research are as follows: 1) The contract subjects are the consumers and the service providers, 2) The three service providers are united in a syirkah abdān (partnership of labor), 3) The involved contracts include syirkah abdān, sales (bayʿ), agency (wakālah), and lease (ijārah), 4) Profit distribution is conducted through a revenue-sharing system.
