Abstract

Tujuan artikel ini merupakan buat menyebutkan bagaimana aturan perbankan menaruh proteksi aturan bagi nasabah bank dan kewajiban bank bagi nasabah yang bermasalah waktu berbelanja online. Hukum Perbankan adalah semua yang berkaitan dengan perbankan, yang mempengaruhi sifat dan keberadaan lembaga keuangan dan semua aspek aturan tertulis dan tidak tertulis yang mengaturnya, yang mengatur kegiatan bisnis mereka, cara mereka menjalankan bisnis, dan mencakup prosesnya. Dasar hukum pengaturan ini adalah Undang-Undang Perbankan No. 10 Tahun 1998. Isi Undang-undang No. 10 Tahun 1998 menyebutkan bahwa asas hukum perbankan adalah bahwa sistem perbankan di Indonesia harus diselenggarakan atas dasar demokrasi ekonomi kehati-hatian. Proses perdagangan online dicirikan oleh kurangnya kontak tatap muka antara bisnis dan konsumen, karena media yang digunakan adalah Internet. Ketentuan ini sangat bermanfaat bagi konsumen karena memudahkan dalam menyelesaikan transaksi tanpa perlu bertatap muka yang membutuhkan perlindungan hukum.

Abstract

This study discusses the construction of residential houses in accordance with sharia principles, both in the art and science of designing and constructing buildings and residential houses, which is then called architectural fiqh. Residential construction in addition to paying attention to architecture must also pay attention to aspects of Islamic law. Attention of classical and contemporary scholars very few specifically talk about architecture from the point of view of jurisprudence. So far, studies on architecture have mostly studied Islamic architecture, but no one has studied architecture in a fiqh approach. So, through the fiqh approach, a new study was initiated, namely architectural fiqh. This research is a literature study with a focus on fiqh studies in building sharia residential houses using a conceptual approach and an architectural fiqh approach which is analyzed through qualitative content analysis. The findings of this study indicate that the construction of residential houses so far only pays attention to architectural aspects, so there is a need for a fiqh and architectural approach (architectural fiqh), namely building houses according to sharia signs such as aspects of worship, muamalah, neighborly etiquette and ‘urf or adat. That occurs in society. Through the architectural fiqh approach, it directs to build and maintain sharia residential homes in accordance with sharia maqashid, namely maintaining religion, soul, mind, lineage, and property.

Abstract

Aiming to legalize the practice of polygamy through the Raqan regulation, which is then outlined in the family Qanun, it needs to have restrictions on practicing polygamy, such as the concept of justice and sanctions for abuse committed by a husband. The purpose is to protect women as human beings whose rights must be protected along with the obligations and be executed. Then, the research aimed to analyze the construction of Islamic law reform in the family sector, especially in protecting the position of women and children in the context of the structure of the legal order and the occurrence of polygamy without the permission of the Mahkamah Syar’iyah in Nanggroe Aceh Darussalam. The research was qualitative using non-doctrinal juridical or sociological methods to reform the legal order of polygamy in Raqan using studies of legal order theory, al-hudud (legal boundaries), and al-maslahah, using a historical approach and a legal philosophy approach. The findings showed that the idea of ​​a legal order for polygamy in the family law community in Nanggroe Aceh Darussalam is the implementation of the idea of ​​legal governance between compliance with Sharia and state law perfectly through Raqan renewal. Legal reform is an illustration and parameter in implementing polygamy to realize benefits for individuals and society. And, protect the position of women and children who have not been accommodated in marriage law, so that they can live a harmonious life.

Abstract

This research aims to investigate and interpret the pesantren's local wisdom, which contains a set of value systems. It is used as social capital in building the organizational culture of Islamic education. Therefore, this study employed a qualitative approach. The data collection techniques were interviews and observation to gain an in-depth understanding. This study found that there was some construction of pesantren local wisdom values: a) the local wisdom of the pesantren is a representation of universal values originating from the al-Qur'an and al-Hadith, the habitualization of these values is used as the basis for various management of pesantren education, b) internalization of the values of local wisdom is believed to be able to generate positive energy in the form of encouragement the formation of ethical behavior for each individual in the organization, such as honesty, commitment, discipline, independence, and responsibility, c) internalization of the local wisdom values of Islamic boarding schools is believed to be able to increase performance productivity. Thus, it can be used as the basis for Islamic education and corporate organization, towards an organization oriented towards religious and moral values and creating an influential organizational culture.

Abstract

The study investigated the development of sharia tourism to encourage the growth of potential tourist destination improve the regional economy as a sharia tourism destination, as well as legal policies in fostering sharia tourism in West Nusa Tenggara. The study employed qualitative research approach using concept of sharia tourism, the legal approach, and the sharia economic contextual approach. The findings revealed that: (1) from the road map view,Sharia tourism carried out by West Nusa Tenggara Provincial government was a continuation of sharia tourism by establishing 99 sharia tourism villages having local wisdom. In addition, developing sharia tourism was done by performing itself as a sharia tourist destination that did not ignore other tourism. It was also an avenur for a particular tourism choice in West Nusa Tenggara. The sharia tourism was considered successful in attracting foreign tourist destination, especially tourists from Muslim countries and some attractive Investment. The development of sharia tourism also tend to increase positively toward economic growth at West Nusa Tenggara. This can be seen from the data released by West Nusa Tenggara Tourism Department and Bank Indonesia, which showed economic growth of this region without mining sector in 2016 has reached 5.72% increase, in 2017 up to 7.10%, and in 2018, despite the earthquake, it continued to increase to 7.23% /year. (2) from the view of legal policies, West Nusa Tenggara already has strong legal legitimacy, so it can guarantee legal certainty in developing Sharia tourism destination. So hat, Sharia tourism destination in West Nusa Tenggara have clear policy directions in their ideas. It was strongly supported by policies, and implemented gradually.

Abstract

Budaya Belom Bahadat adalah norma yang diikuti oleh masyarakat Dayak di Palangka Raya. Ini adalah aturan perilaku yang mengharuskan anggota masyarakat untuk mengikuti sistem yang ada. Penelitian ini mencoba memahami bagaimana masyarakat Dayak beraksi, dengan menggunakan teori Max Weber dan Talcott Parson. Penelitian ini tidak hanya menggunakan kajian literatur, tetapi juga menggunakan kolaborasi dari hasil wawancara dan survey literature review. Beberapa kategori tindakan masyarakat Dayak menampilkan bahwa tindakan rasionalitas nilai yang mendominasi dalam tindakan masyarakat Dayak, walaupun tindakan rasionalitas instrumental, tindakan afektiva dan tindakan tradisional juga ada dalam masyarakat ini. Tindakan-tindakan ini, maka diketahui pula bahwa masyarakat mengikuti sistem sosial yang berlaku di tengah masyarakat. Dengan kata lain, anggota masyarakat-pun wajib mengikuti sistem yang berlaku di masyarakat tersebut. Hasilnya menunjukkan bahwa masyarakat Dayak cenderung bertindak secara rasional sesuai dengan nilai-nilai budaya mereka. Mereka mengikuti sistem sosial yang ada untuk menciptakan keseimbangan dalam kehidupan bersama manusia dan alam.

Abstract

The main objective of this legal research is to compare the legal construction and the use of “rahn tasjily” mechanism in the Sharia bank financing between Indonesia and Malaysia through law, concept, and history approaches. The data were analyzed qualitatively by systematic interpretation and historical interpretation. The results are: 1) Both countries do not have a strong regulation in Sharia guarantees, thus the law construction is implemented by harmonization and integration between Sharia principles and conventional regulations (civil). The differences are in the concept, the division of rahn, and the law substance in the Sharia banking complement regulation. 2) The mechanism is also different, where in Indonesia the guarantee should be bound by an authentic certificate (notary) and registered in the authority institutions in order that Sharia bank (murtahin) obtains a strong law protection beside an insurance. While in Malaysia, the use of collateral is only included in the financing contract without an authentic certificate; the registration is not compulsory and the ownership proof of guarantee (marhun bih) as well as the object is in rahin permanently (except a land); and the collateral strength for Sharia bank is an insurance.

Abstract

Animal conservation aims to preserve and breed animals to achieve the benefits of a sustainable natural ecosystemincluding community and family. One of the efforts made by the government to provide information and knowledge to the public in an attempt to minimize wildlife hunting is through the legal protection of animals, as stated in Law Number 5 of 1990 concerning the Conservation of Biological Resources and Their Ecosystems, and Government Regulation Number 13 of 1994 concerning the Hunting of Game Animals. The research method used is juridical-normative with a legislative and socio-legal approach. Then, it is linked to the policy of animal conservation, which is examined from the Maqasid Shariah perspective. The research results provided recommendations to the government in creating legislation or decision policies oriented to animals that are not yet rare. These recommendations include educating the public about rare and non-rare animal species, setting educational targets, supporting conservation efforts, and establishing animal breeding programs. Furthermore, from the perspective of Maqasid Sharia, the conservation of these animals falls under the category of daruriyah, which means that the preservation and protection of wildlife are essential for the sustainability and keeping of the Hifz al-Mal element (natural ecosystem wealth).

Abstract

This study examines and proposes several roles that Central Kalimantan Indonesian Ulama Council [Henceforth (MUI)] can play in encouraging Muslim participation in regional elections [Henceforth (Pilkada or Pemilukada)] through the perspective of fatwa on prohibition of abstention [Henceforth (golput)]. As a religious institution, MUI holds a strategic role in guiding Muslims on political issues, particularly regarding Pemilukada. In a democratic system, participation is crucial for electing leaders who can ensure people’s welfare and fulfill their responsibilities. The fatwa on the prohibition of golput, issued by MUI, serves as a normative foundation for Muslims to exercise their voting rights in Pilkada. This study utilized normative juridical by reviewing various secondary sources and literature relevant to the topic. The findings reveal that Central Kalimantan MUI can promote political awareness among Muslims in the region, with MUI actively participating in public outreach and campaigns about the importance of political participation. Furthermore, collaboration with local institutions such as the Indonesian Da’wah Institution, religious counselors, and media platforms is key in promoting Muslim voter participation through the fatwa on the prohibition of golput. This study also found that the fatwa has been highly effective in raising awareness among Muslims about the significance of their political involvement in regional elections.
