Abstract

Related to the crime of money laundering committed by political parties, as a legal entity a politicalparty can be held to hold criminal responsibility for what it has done. It can be said that a corporation hascommitted a crime if the criminal offense is carried out by a corporate executive or employee who is stillwithin the scope of his authority, and intra-vires in the sense that it is still in part of the corporation'sintentions and objectives, and acts for corporate purposes. The purpose of this thesis is first to find out howto determine errors in political parties as corporations that commit a crime in the crime of moneylaundering as a result of corruption in Indonesia. Second, to find out the form of criminal liability ofpolitical parties as corporations in criminal acts of money laundering resulting from criminal acts ofcorruption in Indonesia.From the results of the research conducted there are three main things that can be concluded. First,determining the mistakes of the corporation can be done by looking at the intentions or negligence of thepolitical party administrators. This form of error is not individual but is collective and the corporationreceives the benefits of the crime. Therefore, it can be stated that the corporation (political party) is blamed.Second, based on the theory of direct corporate liability and functional actors, corporations can be held tohold criminal liability insofar as it is known to the political party management to commit the crime for andon behalf of the corporation itself (political party). The author's suggestion, First, is expected to the Houseof Representatives and the President to explicitly regulate the criminal responsibility of the corporation bothin the Act on crime of money laundering and corruption. Second, it is hoped that law enforcement officialswill be more courageous in disclosing and taking action against the involvement of political parties in theuse of funds that are sourced or reasonably suspected of money laundering.Keywords: Accountability of Political-Corporations-Corporations-Money Laundering-Corruption Crimes

Abstract

In the midst of tumult of democracy and trade access opening urging the Indonesian government took a bold step by signing international trade agreements both at the bilateral, regional and international levels. As we already know with Indonesia is one of the ten countries included in the ASEAN organization. According to mutual agreement, ASEAN shall establish an ASEAN Community in the late 2015's, which consists of three pillars, one of which is the pillar of the ASEAN Economic Community or. The purpose of the establishment of this AEC is that economic integration in ASEAN member countries in the field of trade liberalization in goods, services, investment, capital and labor flows in the region. To that end, formed the ASEAN Comprehensive Investment Agreement (ACIA) in order to create a more liberal investment regime and open. The purpose of this thesis namely; First, to determine the preparation of the Riau provincial government in bringing foreign investors to improve the competitiveness of SMEs in connection with the ASEAN Economic Community; Second, to determine the measures to be taken by the provincial government in connection with the preparation of the SME entrepreneurs increase the ASEAN Economic Community.From the research, there are three main things that can be inferred. First, the government's readiness Provision of Riau in bringing foreign investors to SMEs in connection with the Economic Community (AEC) in 2015 is to implement policies that have been made by the central government are associated with it. Secondly, In welcoming AEC 2015, there are various efforts made the provincial government to SMEs to face the AEC in order not to lose competitiveness with products from other ASEAN member states, among other things by providing loans (bank and non-bank), a grant of equipment to support the products, provide socialization and training to SMEs Riau Province, as well as lift 175 OCFA (Officers Cooperative Field Assistants) in each sub-district / city.

Abstract

ASEAN open skies is a form of policy to open the airspace between fellow members of ASEAN countries. ASEAN open skies policy is part of the purpose of the establishment of the ASEAN Economic Community in an effort to boost the economy in the ASEAN region to improve competitiveness in the international arena so that the economy can grow evenly, also improve people's lives, and the main thing is to reduce poverty. ASEAN open skies does offer access to a huge market, huge profits, increase tourist attraction, as well as the flight frequency will increase. The purpose of this thesis namely; First, to determine the relationship or link between sovereignty with the implementation of the ASEAN policy of open skies; Second, to determine the strategy or the Indonesian government's efforts in dealing with the implications of the implementation of the ASEAN open skies policy, especially in terms economic, defense and security. From the research, there are two main things that can be inferred. First, Indonesian airspace sovereignty and the implementation of the ASEAN open skies policy are interrelated. The principle of sovereignty over the airspace is absolutely and fully recognized in the Multilateral Agreements of ASEAN Multilateral Agreement on Air Services that support the ASEAN open skies policy; Second, , Indonesian government's efforts in dealing with the implications of economic, defense and security of the implementation of the ASEAN policy of open skies is to make improvements to the infrastructure at the airport either airport capacity, systems, and technologies that support flight, and the most important is the strengthening of policies and regulations, especially in the field of safety, security and defense, consumer protection, and law enforcement investment.

Abstract

Pengaturan tentang kewajiban penunjukan penasehat hukum bagi terdakwa yangdiancam pidana diatas 5 tahun sebagaimana yang diatur dalam Pasal 56 KUHAP. Namun,dalam praktiknya dipersidangan masih banyak ditemukan terdakwa yang diancam pidanadiatas 5 tahun yang tidak didampingi penasehat hukum, dapat dikatakan bahwa kewajibanpenunjukan tersebut diabaikan atau dikesampingkan oleh aparat penegak hukum.Tujuan penulisan skripsi ini, yakni; Pertama, untuk mengetahui pengaturan idealtentang kewajiban penegak hukum untuk menunjuk penasehat hukum bagi terdakwa yangdiancam pidana diatas 5 tahun, Kedua,untuk mengetahui upaya hukum yang dapat ditempuh terpidana terhadap putusan hakim yangtelah berkekuatan hukum tetap yang dalam proses persidangan tidak didampingi penasehathukum.Jenis penelitian ini dapat digolongkan dalam jenis penelitian hukum normatif.Penelitian ini bersifat deskriptif, yang menggambarkan secara jelas dan terperinci mengenaikewajiban aparat penegak hukum dalam menunjuk penasehat hukum bagi terdakwa. Sumberdata yang digunakan adalah data sekunder yang bahan hukum primer, bahan hukumsekunder, tehnik pengumpulan data dalam penelitian ini dengan metode kajian kepustakaansetelah data terkumpul kemudian dianalisis dan ditarik kesimpulan.Dari hasil penelitian dan pembahasan dapat disimpulkan bahwa yang Pertama,pengaturan ideal tentang kewajiban penunjukan penasehat hukum bagi terdakwa yangdiancam pidana diatas 5 tahun sangat diperlukan,karena Pasal 56 KUHAP masihmengandung banyak kelemahan sehingga tidak menciptakan kepastian hukum bagi terdakwadan terkesan mati suri, oleh sebab itu diperlukan pengaturan yang lebih jelas dan terperincimengenai akibat hukum bagi aparat penegak hukum yang mengesampingkan kewajibanpenunjukan tersebut, Kedua, upaya hukum yang dapat ditempuh terpidana terhadap putusanyang telah berkekuatan hukum tetap adalah upaya hukum luar biasa yakni upaya hukumPeninjauan Kembali (PK), ini merupakan bentuk perlindungan hukum represif bagi terdakwayang tidak didampingi penasehat hukum dipersidangan.Kata Kunci : Pengaturan Ideal - Kewajiban- Penunjukan Penasehat Hukum Terdakwa

Abstract

Spatial structures and patterns that are not well implemented in Pekanbaru City in accordance withLaw No. 26 of 2007 concerning Spatial Planning, of course will lead to many problems in spatial planningthat occur in Pekanbaru City. Problems caused by the lack of spatial planning in Pekanbaru City such as;floods, traffic jams, air pollution, land use that is not in accordance with its designation and many otherproblems related to spatial planning that have an impact on the level of welfare of the people of PekanbaruCity. In order to realize good autonomy and spatial planning, the need for the Regional DevelopmentPlanning Agency (BAPPEDA) in carrying out its authority from the formulation of regional planningpolicies, preparation of plans that contain the vision, mission, goals, strategies, policies, programs andcoordinate the development activities of each Regional Work Unit (SKPD).The type of research that the author uses is juridical sociological research approach that emphasizesthe legal aspects related to the subject matter to be discussed, related to the reality that occurs in the field.In this case the authors conducted research on the Pekanbaru City Regional Development Planning Agencyand the Pekanbaru City Public Works and Spatial Planning Office regarding the problems of spatialplanning in Pekanbaru City.From the results of this study it can be concluded that there are three main problems. First, theauthority of BAPPEDA Pekanbaru City in realizing good spatial planning is regulated in PERMENDAGRINo. 86 of 2017 concerning Procedures for Planning, Controlling and Evaluating Regional Development,Procedures for Evaluating Long-Term Regional Development and RPMJD, and Procedures for ChangingRPJPD, RPJMD and RKPD, and PERWAKO Pekanbaru City No. 116 of 2016 concerning the Position,Organizational Structure, Duties and Functions and Work Procedures of BAPPEDA Pekanbaru City,BAPPEDA Authority After the issuance of PP No. 18 in 2016. The two factors that hamper BAPPEDAPekanbaru City are the Pekanbaru City Spatial Plan that does not yet exist, the inconsistency between theprogram and the implementation of the Pekanbaru City administration in the RPJDD, RPJMD and RKPDdocuments, the political interests of several parties, the rationalization of the budget and the building Thereare already three attempts that can be done by BAPPEDA in realizing good spatial planning in the city ofPekanbaru, which are spatial planning, spatial use, spatial use control, PERMENDAGRI No. 116 of 2017concerning the Regional Spatial Planning Coordinating Team, approaching regional development planningwell, following the rules of the formulation of regional development planning policies and regional policiesto issue regulations on Pekanbaru City's spatial planning.Keywords: Authority, BAPPEDA, Spatial Planning.

Abstract

   Prostitution is a social phenomenon where women sell themselves doing sexual acts as a livelihood. In this definition clearly stated the existence of self-selling as a "profession" or daily livelihood, by way of sexual relations. In this case the moral damage is seen when the community practices the ownership of a place of prostitution as a place for commercial sex workers or familiarly known as CSWs. The purpose of this study aims to determine law enforcement against owners of prostitution sites, to determine the impact of prostitution premises on the community and, to determine the inhibiting factors of law enforcement against owners of prostitution in Siatas Barita District, Tarutung City.In this study the authors use the method of sociological research that is research conducted directly at the location or object of research that wants to see the correlation between law and society, in this study the researchers directly conducted research.From the results of the research that the author did can be concluded, the first law enforcement against the owners of prostitution in the District Siatas Barita Tarutung City is limited to administrative sanctions. it does not make the place of prostitution stop operating until now. Law enforcement against owners of prostitution in the District of Siatas Barita Tarutung City is not based on the Criminal Code. While the Criminal Code has regulated the issue of prostitution as in Article 296 of the Criminal Code and 506 of the Criminal Code. secondly With the presence of prostitution has an impact on the insecurity of the people who live near the place of prostitution caused by many crimes. The three obstacles in carrying out law enforcement against the owners of prostitution places are, among others, the lack of public legal awareness which has implications for their disobedience to the law, due to the spread of information that raids or policing will be held more rapidly so that participation becomes an obstacle.The author's advice, first To the North Tapanuli District Police to carry out law enforcement in accordance with the Criminal Code. Abstract

Drug abuse is a drug that is misused (misused) every time someone with arbitrary use of drugs (suchas when a drug is prescribed for someone else). Pills are abused (absed) when a person continues toconsume the drug, resulting in physical and psychological dependence on the drug. PCC pills (Paracetamol,Caffeine, and Carisoprodol) are drugs that can be used to relieve pain and heart pain medications, so thesedrugs should not be taken carelessly under the supervision,of doctors and pharmacists.Perpetrators of misuse of the PCC pill must be able to take responsibility for their actions. Thisstudy raises the issue of what is the urgency of formulation policies for users as well as the ideal legal policyfor PCC users (Paracetamol, Caffeine, and Carisoprodol)The research method used is normative research with a statutory approach, fact approach and legalconcept analysis approach. The results of this study indicate that pcc pills that have been designated asclass 1 narcotics according to the Minister of Health Regulation are immediately included in Law Number35 of 2009 concerning Narcotics. Perpetrators of misuse of pcc pills are responsible for their actions byundergoing rehabilitation sanctions.Keywords: Accountability, PCC, Legal Arrangements.

Abstract

Indonesia is a legal state that is obliged to give awards and guarantee protection against human rights issues. Various human rights violations since the old order still have not got legal certainty, gross human rights violations also almost always involve the state apparatus, either actively or passively. The victims experienced various acts of violence: physical, mental, until the loss of life. Whereas, the most responsible party to protect and maintain the fulfillment of human rights every individual or citizen is the state through the state apparatus / tool.To prosecute gross human rights violations established by the Human Rights Court within the General Courts. To implement it, Law Number 26 Year 2000 on Human Rights Court was established. Article 4 states that the Human Rights Court has the duty and authority to examine and decide cases of gross human rights violations.The difficulty of working through the formal legal process to deal with past human rights crimes, as mentioned above, is a strong impetus for the need for alternative settlement mechanisms, commonly known as the "Truth and Reconciliation Commission (TRC)". The task of the Truth Commission is to seek, find, and present facts about a past event with all its consequences; Consider and place the justice of victims and perpetrators as a working principle; Should not be unfair and unjust to the perpetrators; And finally all findings must be stated in a fair, fair, honest and transparent manner; And not manipulative.According to the author, the Truth and Reconciliation Commission is still very appropriate to be implemented. Abstract

The crime of smuggling illegal cosmetics continues to increase, behavior that circulates illegal cosmetics goods that have been entrenched and institutionalized. The most vulnerable factors to illegal cosmetics smuggling are the supervisors who are less comparative in supervising each spot that is highlighted by smugglers and the lack of supervision by the BPOM in examining every cosmetics that are taught. The target of the perpetrators is to circulate aimed at the shop in order to get profit. Consumers must be wiser in choosing cosmetic products by paying attention to the Registration number of BPOM. The smuggling of illegal cosmetics has caused concern to the public, the perpetrators of the police spotlight only claim to get the illegal cosmetics from other people and they are entrusted. The case that came to the court was certainly a serious problem, a case that occurred in 2016 in the Pekanbaru District Court on behalf of Adi Putra Alias Awi. The judge sentenced him with light sentences with a large amount of evidence and the absence of fines. With regard to light sentences, it will certainly be difficult to make the illegal cosmetics smugglers deterrent, given the lack of supervision of illegal cosmetics smuggling that is increasingly widespread will cause harm to the Indonesian state. The purpose of writing this thesis, namely: first to find out the judge's consideration in the illegal cosmetics smuggling case in the legal cosmetic circulation of the judge's decision number 1132 / Pid.Sus / 2016 / PN.Pbr in Pekanbaru District Court, secondly, to find out the ideal idea related to the sentence given judge to the defendant related to the absence of fines in the decision. This type of research is normative juridical research or can also be called doctrinal law research. Data collection techniques in this study with the study of literature. From the results of the research problem there are two main things that were concluded, first, the growth of judges in case number 1132 / Pid.Sus / 2016 / PN.Pbr in Pekanbaru District Court, second, related to the imposition of sanctions in cases of illegal cosmetics distribution in case number 1132 / Pid .Sus / 2016 / PN.Pbr in Pekanbaru District Court. Abstract
