Abstract

This research is related to the authority of the local government in extending the Right to Cultivate the Limited Liability Company for the Nusantara V Plantation of Air Molek in Indragiri Hulu Regency. The local government also has the authority in the process. In the field it was found that the extension of the Cultivation Right that was carried out was not in accordance with the provisions of the legislation and there was a conflict in the community regarding the Land Cultivation Right of the Nusantara V Limited Liability Company. , the authority of the local government in extending the Rights to Cultivate Limited Liability Company Perkebunan Nusantara V Kebun Air Molek in the district of Indaragiri Hulu, second, the inhibiting factor in the extension of the Right to Cultivate the Limited Liability Company Perkebunan Nusantara V, the third, the procedure that should be applied in the extension of the Right to Cultivate the Right to Cultivate Limited Liability Company Perkebunan Nusantara V, Air Molek plantation in Indragiri Hulu district. This research is a sociological legal research, because the source of the data comes from field research using interview methods and literature review that relates to the problems studied, assisted by primary, secondary, and tertiary data. This study uses qualitative data analysis, described descriptively and summarized by the deductive method. From the results of the study, it was concluded that, firstly, the authority of the local government in extending the Land Use Rights for Limited Liability Company Perkebunan Nusantara V Kebun Air Molek in Indaragiri Hulu Regency is as a member of the land inspection committee B, determining prospective planters who are recipients of facilitation activities for the construction of new plantations by plantation companies, and giving a statement that the land is not in dispute, secondly, the inhibiting factor in the extension of the Limited Liability Company Perkebunan Nusantara V Kebun Air Molek is caused by the rejection by the community around the Cultivation Right and the incompatibility of the land use rights with the RTRW, third, the procedures that should be applied in the extension Right to Cultivate is to follow the applicable laws and regulations which regulate the procedure for extending the term of the Cultivation Right, the procedure for renewing the Cultivation Right, and provisions regarding the obligations of the holder of the Cultivation Right.Keywords: Authority, Local Government, Right to Cultivate

Contamination of path be important trauble to indonesian, because has contamination sea of indonesia until exclusive economic zone. Base philosophical based in article 192 United Nations Convention on the Law of The Sea (UNCLOS) 1982, that every country should keep of the sea, and that mean is article give pressed that ecosystem of sea is a part should to keep and long lasting for every countries. Research purpose is first about dispute resolution in international law that use as method to dispute settlement cases contamination of the sea timor; and second state responsibility of explode examination into sea timor.As for result is first, dispute resolution that taken during this among parties involved into dispute that is, Indonesia and PTTEP Australasia is diplomacy. Second, form of responsibility among australia, and indonesia is in the case of tort claim and compensation.

Abstract

Medicine as a very important component for supporting health treatment for society. Distribute of medicine in society must have license, for production of medicine in of the country and import medicine, that gived by Badan POM (The National Agency of Drug and Food Control). Article 106 clause (1) law Number 36 of 2009 on Health, the preparation of pharmaceutical and health equipments can only be released after obtaining the marketing authorization. So, preparation of pharmaceutical can distribution in Indonesia if has been valuated throught mechanism medicine registration for get license. Illegal import medicine distribution will endanger its consumers’ health and safety because there is no safety, efficacy and quality guarantee of Badan POM.In reality, there are many illegal import medicine distribution cases the pharmacy in Pekanbaru. For example in Apotek Cempaka, Balai Besar POM Pekanbaru (Provincial office of Drug and Food Control in Pekanbaru) to found 58 items illegal import medicine, there are tebonin forte, lescol xl, camazol, navamin and so many import medicine that not yet have license. This show that law enforcement for illegal import medicine distribution in Pekanbaru conducted by Balai Besar POM Pekanbaru is not optimal.Keyword: Law enforcement, import medicine distribution lisence.

Abstract

This research is related to the Juridical Review of the vote of no confidence in the chairman of the Pekanbaru City House of Representatives by its members which was reviewed based on the laws and regulations in Indonesia. The vote of no confidence is one of the efforts used to overthrow the government in parliamentary countries. While Indonesia is a country whose form of government is presidential, it needs to be studied stimulantly. First, how is the mechanism for replacing the chairman of the Pekanbaru City People's Representative Council based on laws and regulations, Second, the implications of a motion of no confidence in the chairman of the Pekanbaru People's Representative Council based on laws and regulations. This research is a sociological legal research, because it is based on field research, namely by collecting data from observations, interviews and literature reviews that are related to the problems studied, assisted by primary, secondary and tertiary data. This study uses quantitative analysis, produces descriptive data and  From the results of this study, it was concluded that,, the First mechanism for replacing the chairman of the Pekanbaru City House of Representatives based on laws and regulations does not regulate through a vote of no confidence. Reimbursement can only be made through the DPRD honorary body after the honorary body has investigated, verified and clarified the complaint. Abstract

The enactment of the Criminal Code in the case of the press, then the criminal liability also applies. Responsible parties must also be determined on the basis of a criminal responsibility system under the Penal Code. In this case relates to criminal liability for criminal defamation through Koran. The purpose of writing this thesis, namely: first, criminal liability to the press who committed criminal defamation through the newspaper, Second, who is responsible related to criminal liability to the press who committed criminal defamation through the newspaper.The type of research used in this study is a normative legal research. Normative legal research is a literary legal research. In this study, data sources used, primary data, secondary data and tertiary data, data collection techniques in this study with literature study.From the results of this study indicates that the concept of Defamation in news in the newspaper occurred after the cooperation of parties who served in news mempubikasikan. The legal subject who can be held criminally liable for defamation in the news in newspapers are journalists, editors, chief editors and printers. Suggestion of the author, Firstly, the Press Law needs to be revised in order to contain the explicitly defamation of defamation so as not to be multiple interpretation; Secondly, in determining the subject of criminal responsibility law should be applied the principle of mistake and the principle of participation so that the offender of defamation can be given sanction in accordance with applicable laws and regulations, Third, the press company must have standard procedures related to the technical publication of the news so that the mechanism of accountability can be clearly identified.Keywords: Accountability-Crime-Press-Crime-Pollution-Name-Good

Abstract

This research was conducted in Kasang Limau Sundai Village, Kuantan Hilir Seberang District, Kuantan Singingi Regency. This type of research is a sociological study of a study in the form of empirical studies to find theories about the process and about the workings of law in society. Nature of this research is descriptive research is to provide thorough data about peoples, circumstances or other symptoms. The results showed that the implementation of the Village Consultative Body authority in the organization of government in the Kasang Limau Sundai Village, Kuantan Hilir Seberang District, Kuantan Singingi Regency according to Regulation No. 1 of 2009 have not been able to bring the regulations the new village, because the members of the BPD has not been submitted draft regulations and material to the village government. Constraints faced by BPD Kasang Limau Sundai in doing authority to draft village regulations are educational background factors BPD is still low, the lack of understanding of the procedures and the BPD Perdes formation mechanism, and the lack of cooperation with the village government. Attempts to do BPD Kasang Limau Sundai to overcome obstacles in the implementation of the authority is to follow the training and seminars related to the procedures for the formation mechanism of the village or the regulations relating to the empowerment of rural communities. Moreover, it also can be a way members of the BPD over again deepen the knowledge of the law by reading books related to the formation technique of legislation, as well as by increasing cooperation with government village that BPD can equally with the village government in the deliberations and discussions held, and took the decision to make a village regulations in order to achieve progress in the future well-being of rural communities.Keywords: Implementation, Authority, Village Consultative Body (BPD)

The Constitution of the Republic Indonesia 1945 and law of No. 8 of 2011 about Constitutional court haven’t constitutional complaint as constitutional court’s authority.that’s because be important to think again will add constitutional court’s authority to complete about constitutional complaint that violation of constitutional right that there is no path of its legal settlement can be handled by the constitutional court. The kind of research can be classified normative law research. Abstract

In general election contestation, the election of the method of converting votes into seats often gets less attention in election arrangements. In fact, the difference in the type of vote conversion method used will also affect the difference in the number of seats that can be obtained by a political party in parliament. In the history of elections in Indonesia, there are at least two types of vote conversion methods that have been used, namely the Hare Quota method and the Divisor Sainte-Lague method. The purpose of writing this thesis: first, to find out whether the method of converting votes into seats in the 2019 Legislative General Election system in Indonesia is in accordance with the principles of General Elections based on Law Number 7 of 2017. Second, to find out how the Legal Politics of Use the Sainte Lague method in Law Number 7 of 2017 concerning General Elections.This research is a normative juridical research, research conducted based on legal materials and legislation. The approach taken includes a library approach, namely by studying books and laws and regulations. The types of data used are primary data types, secondary data sources, namely data sources derived from books and other regulations. The theory used in this research is the theory of legal politics and the theory of the general election system.From the results of the study there are two main things that can be concluded. First, the method of converting votes into seats in the 2019 Legislative General Election system in Indonesia can be said to be inconsistent with the principles of the General Election Law Number 7 of 2017. There are several points that cause this to be inconsistent, including: (1) the method This is not considered effective when implemented. (2) this method creates the potential for the formation of new parties that take advantage of the situation. (3) by using this method of converting votes into seats, it will create a sense of injustice for a handful of political parties in navigating the election contestation. Abstract

Constitutional Court as one of the institutions in judicial power holders, get special attention because the laws were issued. Product legal form that is both positive legislature decision considered to have displacement of the authority Constitutional Court from a negative into a positive legislature. The legal conditions cause various polemics and phenomena in the system of constitutional law in Indonesia, that related validity constitution and implementation of the positive legislature’s decisions. Purpose of this study was to determine the constitutionality of positive legislature decisions in Indonesia and implementation of the decision by the government in Indonesia’s legal system. This research is a normative study, which the authors tried to collect and analyze data on the writing of literature. The source of data is divided into primary, secondary and tertiary data. Constitutionality of the positive legislture’s decisions by Constitutional Court when viewed under Article 24C of the 1945 Constitution is not contradictory. Because the Indonesian constitution does not provide authority to limit the Constitutional Court issued a legal product. In addition, the legal reasoning in the Constitutional Court issued a positive legislatur’s decision needs to be considered in valid decision of the Constitutional Court. Where most of the legal considerations given in the Court issued a positive legislature’s decision is to achieve justice for the substantive constitutional rights holders. Whereas, for the implementation of positive legislature’s decision if not immediately followed by legislator, is valid since it was decided in court. Given the Indonesian legal system that is more influenced by positivism, needs to be made to understand the written regulations related to the authority of the Constitutional Court to issue a ruling in particular legal product that is positive legislature. In addition, for the effectiveness of the delivery of law in Indonesia should also be made binding rules for the legislator in order to more quickly respond to any product preformance law issued by the Constitutonal Court therefore do not trigger a legal vacuum in Indonesia’s legal system .Keywords: positive Legislature, constitutionality, legal consequences.

Abstract

According to Article 24C of the Constitution of 1945, especially the decisionof the Court judgment in the judicial review of Law is final and binding. But howif the rule of law is also unconstitutional by the Constitutional Court decisionrevived in the laws changed but still set the same thing by the legislator as Article12 letter g and Article 51 paragraph (1) letter g of Law Number 8 of 2012.Interestingly, when issuance Court decision number 42/PUU-XIII/2015 testarticle 7 letter g of Law Number 8 of 2015 which sounds identical to the norm ofarticle unconstitutional it, and startling in the verdict of the Constitutional Courtstates grant the petition for partially unconstitutional conditional as the ruling ofthe Constitutional Court ruling Number 4/PUU-VII/2009. Then how about thenorm clause that contained in Law Number 8 of 2012, is constitutional orunconstitutional, ever tested to the Court but the Court rejected it by its DecisionNumber 79/PUU-X/2012.The results of this study is that Article 12 letter g and Article 51 paragraph(1) letter g of Law Number 8 of 2012 is unconstitutional and the legalimplications after the Constitutional Court Decision Number 4/PUU-VII/2009,the Constitutional Court Decision Number 79/PUU-X/2012, and theConstitutional Court Decision Number 42/PUU-XIII/2015 is a legal ambiguitypolitical rights of former prisoners, the loss of mutatis mutandis ConstitutionalCourt ruling, does not contain provisions by ne bis in idem, and invalidates theerga omnes nature of the Constitutional Court.
