Abstract

The formation of a new legal product must certainly understand the sciences inmaking statutory regulations. As one of them is to understand the principles in the formationof laws and regulations. The formation of a statutory regulation certainly has reasons andclear objectives in a country, one of which is Law Number 3 of 2022 concerning the StateCapital. However, the process of forming a law was very fast and seemed rushed becauseideally it was in accordance with the standard operational procedures for preparingAcademic Papers and Draft Laws which were prepared within a period of 3 months. Thereis no transparency and openness, as well as the lack of participation from the public in theprocess of forming the law.The objectives to be achieved in this research are the first, namely to find outthat the Formation of Law Number 3 of 2022 concerning IKN is linked to the principle oftransparency according to the formulation of Article 5 of Law Number 13 of 2022 Amendmentto Law Number 12 of 2011 concerning the Formation of Legislation. . Second, so that theideal concept for the formation of Law Number 3 of 2022 concerning IKN is known, which inthe Perspective of Law Number 13 of 2022 Amendments to Law Number 12 of 2011concerning the Formation of Legislation..From the results of the research, can be concluded. First regarding theFormation of Law Number 3 of 2022 concerning IKN, it is associated with the principle oftransparency according to the formulation of Article 5 of Law Number 13 of 2022 Amendmentto Law Number 12 of 2011 concerning the Formation of Legislation. The Second IdealConcept of Establishing Law Number 3 of 2022 Concerning IKN in the Perspective of LawNumber 13 of 2022 Amendment to Law Number 12 of 2011 Concerning the Formation ofLegislation.The authors, in the formation of the IKN Law, is in accordance with thehierarchical provisions for the formation of laws and regulations. The new law must complywith and be guided by the existing law and in the future the ideal concept of making aregulation or legislation must be given the opportunities for the public to participatecomprehensively and holistically. The ideal concept that is right for the future, when there isa bill, the DPR and the Government will immediately provide the draft to the public. Abstract

The 1945 Constitution does not explicitly emphasize the direct filling ofpositions for the process of filling the positions of Regional Heads in the regions,The existence of simultaneous Regional Head Election Preparations is a mandatefrom Law Number 7 of 2017 and Law Number 10 of 2016, has an impact onleadership in area Be it governors, regents or mayors related to the term of office.Replacement of leadership in the regions before the end of the regional head'sterm of office is based on statutory regulations where regional heads who aredemocratically elected can be replaced by Acting (Pj) Regional Heads. ) Districthead. Abstract

The General Election Commission (KPU) juridically has the responsibility oforganizing the democratic party stage commonly known as elections. Thus, the main key inthe successful implementation of elections lies in the hands of the KPU, this is regulated inLaw Number 17 of 2017 concerning General Elections. Voter participation is ofteninterpreted as an indicator of electoral success in various electoral histories in Indonesia.One of the factors of low political participation in the community is due to socializationwhich is only carried out ahead of simultaneous elections. Not only that, the KPU is still notoptimal in providing understanding and awareness for voters to participate in simultaneouselections and socialize about elections.This type of research can be classified into the type of normative legal research. Thisstudy used secondary data consisting of primary legal materials, secondary legal materials,tertiary legal materials and data collection techniques were carried out using the librarystudy method.From the results of the research and discussions carried out, there are severalconclusions obtained, namely: First, the responsibility of the KPU in increasing publicparticipation in simultaneous elections has not run optimally and there are still shortcomingsin carrying out its duties and responsibilities in accordance with applicable regulations.Second, the factors inhibiting the KPU in increasing public participation in simultaneouselections include geographical location, lack of role of political parties, community mindset,problems with the Daftar Pemilih Tetap List (DPT), obstacles when conducting socialization,limited human resources owned by the KPU, and negative public views on elections. Third,the ideal concept of KPU in increasing community participation in the 2024 simultaneousgeneral elections consists of various efforts that can be done including, carrying outsocialization of Goes to Campus and Goes to School, socialization with assisted citizens,forming democratic cadres and embracing community and youth organizations, the use ofsocial media and mass media, dissemination of information through props, socialization ofmobile cars, methods of socialization with electiontainment, democracy ambassadorprograms, and working with educational agencies and work environments to disseminate A5forms. The author's suggestion is that there is a need to strengthen the KPU institution as awhole by creating a new legal rule or a separate KPU regulation regarding the KPU'sresponsibility in increasing community participation, so that later related to the functions andauthorities of the KPU will be stronger, especially in increasing public awareness toparticipate in simultaneous elections, so that later a legal certainty and rules are guaranteedby individuals and the community in political participation.Keywords: KPU, Community Participation, Simultaneous General Elections

Abstract

This research discusses the strength of the Constitutional Court's decision regarding judicial review in Indonesia. The Constitutional Court is an institution of judicial power tasked with exercising the authority of judicial review born from the 3rd Amendment to the 1945 Constitution. In this study, the philosophical and normative foundations that form the basis for the strength of the Constitutional Court's decision to conduct judicial review will be discussed. The method used is normative juridical, using secondary materials such as laws, decisions of the Constitutional Court, and related legal literature. This study's results confirm that the Constitutional Court's decision to conduct a judicial review has a powerful dimension of power. This power can be viewed from several angles, both philosophical and normative. In the philosophical aspect, the strength of the Constitutional Court's decision lies in the principles of popular sovereignty and constitutional supremacy. While in the normative aspect, the strength of the Constitutional Court's decision is based on the provisions of laws and regulations governing the authority and procedures of the Constitutional Court in conducting judicial reviews.

Abstract

The village is an important part of the Indonesian constitution. When viewed from thenature of the Indonesian state which contains the ideals of the state regarding the justification of theIndonesian state, regarding the formation of the Indonesian state, as well as regarding the objectivesof the Indonesian state, basically all of these are the same as the essence, justification of existence,formation and purpose of the village. Attamimi said that all of this was of course in a much largerscope and in a more modern context in accordance with the era and period when the Republic ofIndonesia was proclaimed. Soepomo even said that the ideals of the country are basically containedin the village community association which consists of its leaders and the people. Soepomo alsoemphasized that the state model known as the Village Republic is the original model of Indonesiangovernment, this is because the basic ideals of forming a Republic of Indonesia government are thesame as the ideals of forming a Village Republic, which is adapted to the real social structure ofIndonesian society. In fact, the form of village government existed long before there wascolonialism by the Dutch East Indies government, as emphasized by Van Vollenhoven.The research method used in this thesis is normative research using a statutory approach.The main data in this study is secondary data, namely legal literature which consists of severalquotations from various related literature sources. The other supporting research data used byresearchers are primary legal materials, secondary legal materials and tertiary legal materials.From the discussion and research conducted by the researcher, there are several conclusionsthat can be obtained. First, basically, the position status of village regulations in the hierarchy oflaws and regulations in Indonesia is Wettelijk Regeling, which is a type of law. This confirms thatvillage regulations are legal products in the form of laws which basically must be regulated andconfirmed in the hierarchy of laws and regulations in Indonesia. Second, that it is necessary toinclude village regulations in the hierarchy of laws and regulations in Indonesia to emphasize theposition and legal certainty of village regulations.Keywords : Legal Politics - Village Regulations - Laws

Abstract

Talking about criminal law often makes people imagine everything that is evil, dirtyand full of deception. When people talk about criminal law, what comes to mind is theeradication of crime by the police, prosecutors and judges. The criminal justice system isdiscussed in the criminal justice procedural law regulated in Law Number 8 of 1981. However,in legal practice the suspect's right to take legal action in the pretrial process may not begranted by the legal authorities on the grounds that the main case has been transferred to court. And the unprofessionalism of law enforcers makes it difficult for pretrial hearings to realizepretrial as an effort to defend the rights of a suspect. The impact of the weaknesses in theexisting rules in the pretrial court case process has resulted in futile law enforcement by legalsubjects in defending their rights. So that new regulations are needed that can guarantee thatthe pretrial hearing process can run so that suspects get legal certainty.This research uses the type of normative juridical research, namely research that isfocused on examining the application of the rules or norms in law to legal principles. The datacollection technique used in this study was a literature study. The approach used in this studywas to use a normative approach, namely library law research.The results of the research conducted by the author are first, making rules regardingthe pretrial case delegation process can be said to be important, this is because in pretrialhearings there are many violations committed by law enforcers such as delaying attendance ofpretrial hearings, then rushing cases principal to court with the aim of aborting the ongoingpretrial. Second, in the process of determining suspects carried out by law enforcement, therewere many violations that were not in accordance with the criminal procedure law and alsomany violations of the code of ethics of the law enforcers themselves.Keywords; Pretrial-Criminal Procedural Law

Abstract

Judicial power is an independent and independent power that carriesout a judicial function in the field of justice. The Constitutional Court is a stateinstitution that carries out the functions of judicial power which is grantedconstitutional authority in Article 24 letter C of the 1945 Constitution of theRepublic of Indonesia. In addition, the Judicial Commision is part of the judicialpower but does not carry out a judicial function. Judicial Commision is only aninstitution that balances the power of the judiciary which has the authority by theConstitution to maintain and uphold the nobility and behavior of judges.The type of research used by the author is normative legal research orwhat is known as "legal research". Which means that this legal research, law isoften conceptualized as what is written in statutory regulations (law in book) orlaw. Regarding the Constitutional Court Decision Number 56/PUU-XX/2022which conducted a material review of Article 27 A paragraph (2) Letter B LawNumber 7 of 2020 Concerning the Constitutional Court.The Constitutional Court Decision Number 56/PUU-XX/2022 states that1 (one) member of the Judicial Commission as one of the elements in theHonorary Council of the Constitutional Court is contrary to the Constitution anddeleted. Meanwhile, the background or urgency for the establishment of theJudicial Commision was to overcome judicial mafia practices that hadmushroomed at that time in Indonesian courts, as well as to restore publicconfidence in the judiciary. Judicial Commision is mandated by Article 24Bparagraph (2) to protect and uphold the honor of judges, while the ConstitutionalCourt is of the opinion that the judges in question are different fromConstitutional Court judges in their positions. in the Constitution itself there is nodistinction between judges according to their position or function. It is feared thatthe Judicial Commision's exception will further open up opportunities for judicialmafia practices. Abstract

The aim of this research is to find out the mechanism of communityparticipation in the formation of regional regulations in Indragiri Hulu Regency. Andto find out the arrangement of regulations related to community participation in theformation of regional regulations in Indragiri Hulu Regency. The data sourcesneeded to obtain information were the Legal Section of the Regional Secretariat ofIndragiri Hulu Regency, the Public Relations Section of the Indragiri Hulu RegencyDPRD, the Head of the Special Committee and members in the Raperda Discussion inIndragiri Hulu Regency and community representatives in making regionalregulations of Indragiri Hulu Regency. The data collection tools for this research arefield research studies or interviews and document studies (library). The research datawere analyzed using qualitative data analysis.The type used in this research is descriptive analysis. Research usingdescriptive analysis is research that merely describes the state of objects or eventswithout an intention to draw general conclusions. Legal research can be carried outusing 2 (two) approaches, which consist of normative legal research (normativejuridical) and sociological legal research (empirical juridical). So it can beconcluded for this research that leads to an empirical juridical research approach.From the research results it is known that public participation is viewed fromthe applicable laws and regulations, namely Article 136 paragraph 4, Article 139paragraph 1 Number 23 of 2014 concerning Regional Government, Article 53 of theLaw of the Republic of Indonesia Number 13 of 2022 concerning the SecondAmendment to Law Number 12 of 2011 concerning the Establishment of Legislation.Forms of community participation can be done verbally and/or in writing. Abstract

Political reforms in 1998 which was followed by afree and democratic elections in 1999, has a fairly fun-damental change relationship patterns that charac-terized the President and the Parliament many politi-cal parties that play a role in the constitutional struc-ture. Because it came back the idea of simplificationis a political party. efforts to simplify the number ofpolitical parties is a must in order to support an effec-tive presidential system of government, while the ef-fort to do that is by simplifying the number of politicalparties naturally through the electoral threshold,tighten the terms of the establishment of political par-ties dismaping it is also the reality that there is cur-rently a clear need for regulation of the coalition sys-tem.
