Abstract

In the constitutional system, there is an institution called impeachment. Manyparties understand that impeachment is the downfall, cessation, or dismissal ofthe President or high-ranking officials from office. In fact, the meaning ofimpeachment itself is an accusation or indictment so that impeachment focusesmore on the process and does not necessarily end with the cessation or removalof the President and other high-ranking state officials from office. Each countrythat has adopted the provisions on impeachment regulates these mattersdifferently, in accordance with the arrangements in the constitution. In Indonesia,there are grounds for impeachment of the President, one of which is misconduct,where there is still no clarity regarding the regulation of misconduct both in the1945 Constitution and other laws. Misconduct as a reason for impeachment ofthe President in Indonesia is still multi-interpreted, making it a rubber articlethat can be "played" by the House of Representatives. Therefore, it is necessaryto have a comparative country to find a clear arrangement regarding the reasonsfor misconduct as a reason for impeachment of the President, in this case, Indiais the comparative country.This research is normative legal research. It is based on library researchthat takes quotations from reading books or supporting books related to theproblem under study. This research uses secondary data sources consisting ofprimary, secondary, and tertiary legal materials. This research also usesqualitative data analysis and produces descriptive data.From the results of the research and discussion conducted, it is necessary tohave certainty regarding the regulation of criteria or standardization ofmisconduct to be used as a reason for impeachment of the President in Indonesia,so that the reason for misconduct cannot be used as a rubber article that can be"played" by the House of Representatives. There is also a need for a moreefficient dismissal mechanism so that it does not take too long.Keywords: President; Impeachment; reprehensible deeds

Abstract

Civil Servants have a very important role in achieving national goals. To achievethese national goals, Civil Servants must have honest and responsible personalities in carryingout their duties. However, there are still employees who violate disciplinary rules so that it caninterfere with performance in their work which is in charge of serving the community. Manyemployees underestimate the regulations regarding the discipline of Civil Servants. In thisstudy, the authors conducted research at Badan Pendapatan Provinsi Riau to see how it wasimplemented, the obstacles encountered, and the efforts that could be made in upholdingdiscipline at the Regional Revenue Agency of Riau Province.This study uses the sociological legal research method, because it directly conductsresearch on the locations or points examined to provide a complete and clear picture of theproblems examined. This research is located in Badan Pendapatan Provinsi Riau with apopulation and sample, namely parties related to the problems studied in this study. Sources ofdata, namely primary data and secondary data, data collection techniques in this study wereobservation, interviews, and literature review. Qualitative data analysis, namely data stated inwriting or verbally and real behavior with deductive conclusions, namely general to specificwithdrawals.Based on the research results, the Regional Revenue Agency for Riau Province usesGovernment Regulation Number 94 of 2021 for discipline enforcement, but in practice it is stillnot appropriate due to obstacles encountered in its implementation such as lack of supervisionfrom authorized officials, weak law enforcement, limited resources people and the fading senseof self-discipline in the Civil Servants themselves. There have been various efforts made indealing with these obstacles such as by carrying out internal coaching regarding discipline,providing advice and directions to employees who violate it, imposing sanctions according tothe violations committed, and there must also be self-awareness from Civil Servants regardingdiscipline.Keywords: Civil Servants, Discipline Violations, Disciplinary Sanctions Enforcement

Abstract

The regulations regarding the authority to settle regional election resultsgiven to the Constitutional Court have experienced several polemics. The problemthat arises is that the authority of the Constitutional Court (MK) to resolvedisputes over regional head election results is now permanent. This wasconfirmed in Decision Number 85/PUU-XX/2022 in which the Court stated thephrase "until the formation of a special judicial body" if a Special Judicial Bodycan be formed, of course by studying the paradigm and system of direct regionalelection dispute resolution that has been handled by the Constitutional Court. ,then perhaps this would be the best solution to "reduce" the burden on theConstitutional Court, whose ideals are focused on handling constitutionalproblems which are the authority and obligation of the Constitutional Court(Article 23 C paragraphs (1) and (2).This type of research can be classified into the type of normative legalresearch. This study used secondary data consisting of primary legal materials,secondary legal materials, tertiary legal materials and data collection techniqueswere carried out using the library study method.From the results of research on the problem, there are two main thingsthat can be concluded. First, resolving disputes over election results (election ofgovernors, regents and mayors) has experienced significant changes in practice.This expansion stems from the Constitutional Court's authority given by law inhanding down decisions, so that there is also an expansion of the applicant's legalposition, the object of the petition, case examination, evidence, as well asdecisions handed down by the Constitutional Court, the legal enforcement ofwhich has not yet been completed or has been completed but is ignored by theorganizers. Second, the ideal format for resolving the General Election ofRegional Heads Based on the Constitutional Court Decision Number 85/PUU-XX/2022 is ideally carried out by the Special Judiciary Agency.Keywords: Constitutional Court, General Election, Special Judicial Body

Abstract

This research aims to describe the implementation of health services at thePanipahan Health Center, Pasir Limau Kapas District, Rokan Hilir Regency andto determine the implementation of Good Governance at the Panipahan HealthCenter, Pasir Limau Kapas District, Rokan Hilir Regency. This research isempirical or sociological legal research. The research location is in thePanipahan District, Pasir Limau Kapas District, Rokan Hilir Regency, namely thePanipahan Community Health Center. Based on research conducted, the resultsshow that health services at the Panipahan Community Health Center are carriedout based on Regional Government and Central Government Regulations andPolicies. The implementation of health services at the Community Health Centerconsists of services from the Individual Health Unit and the Community HealthUnit. The programs at the Community Health Center are KIA, Nutrition, HealthPromotion, Environmental Health and other programs. The flow of healthservices and service standards at the Panipahan Community Health Center havebeen adjusted to the services provided to the community to improve the level ofpublic health. Supporting factors in the implementation of health services at thePanipahan Community Health Center consist of organization, policy andmanagement. Meanwhile, the inhibiting factors are the implementation of healthservices at the Panipahan Community Health Center, namely human resources,infrastructure and funds/budget. The efforts made by the Rokan downstreamdistrict health service to improve services at the Panipahan Community HealthCenter are recruiting human resources and competency training for existinghuman resources, prioritizing development of facilities and infrastructure as wellas appropriate budget allocation.Keywords: Panipahan Community Health Center, Public Services, HealthServices.

Abstract

This article explains the importance of structuring the relationship between local government and local business entities from the perspective of state administrative law in Batam City, Riau Archipelago. This study used a qualitative research method, in which several relevant sources obtained were analyzed using descriptive analysis to be able to explain and answer the research questions as a whole. The findings of this study indicate that the dynamics of the dualism of authority that occurs between the Batam City Government and the Batam Concession Agency have violated several principles of good governance, namely those relating to the principle of legal certainty, the principle of not mixing authority, and the principle of implementing the public interest. In the process, to overcome the dualism of authority that occurs, it is necessary to integrate the Free Trade Areas (FTA) of Batam, Bintan, and Karimun with the Free Port Concession Agency (FPCA) by placing the authority of the FPCA under the control of the Governor of the Riau Archipelago Province. Therefore, to adopt a better possibility of the findings of this study, it is very important to immediately amend Government Regulation Number 46 of 2007 concerning the Free Trade Zone and Free Harbor of Batam as amended several times, most recently by Government Regulation Number 62 of 2019 concerning the Second Amendment on Government Regulation Number 46 of 2007 concerning Free Trade Zones and Free Ports.

Abstract

In Indonesia, the Constitutional Court has the power to decide the dispute over the result of the national election, including that of the regional head election. In practice, the Constitutional Court exercises power with the so-called pseudo-judicial review for the result of the regional election dispute. This study aims to analyse the rationale of the Constitutional Court to implement a pseudo-judicial review over the regional head election result, given the judicial activism that also is limited to checks and balances. It also links the theoretical basis for rule-breaking and judicial activism by the Constitutional Court, the transition of the Constitutional Court's power in deciding regional election disputes from temporary to permanent, as well as further analysis of why the Constitutional Court needs to file a lawsuit for review. This study used legal research that examined legal principles and regulations with a theoretical approach analysed qualitatively. The results of this study indicate that pseudo-judicial review affirms the legal breakthrough beyond ordinary decisions as this was made on the ground of the public interest. While the Constitutional Court is essential in maintaining and overseeing democracy in Indonesia, the rationale of the Constitutional Court under the public interest is justified as it is constitutionally correct that has led to judicial activism. A pseudo-judicial review is for substantial justice and can influence time efficiency.Keywords: Constitutional Court, Judicial Review, Local Election Disputes.

Abstract

Women are a group or group that is vulnerable to violence that occurs in society. To overcome various issues of violence that occur against women, special attention is needed from all groups, both community groups and government circles, consisting of the central government and regional governments. This certainly has an impact on the existence of women's groups in the social order amidst demands for achieving Sustainable Development Goals (SDG's). If we refer to the concept of "mainstreaming" itself, it can be interpreted as a process that is carried out to bring aspects that were previously considered unimportant or marginal into the decision-making and management of main institutional activities and work programs. This series of strategies was prepared based on insight, critical awareness and data obtained from gender analysis. Therefore, this study is considered important to look at gender representation in Siak Hijau policies.

Abstract

Perselisihan antara masyarakat hukum adat dan masyarakat umum, negara, maupun pihak swasta banyak terjadi di Indonesia. Penelitian ini bertujuan untuk menganalisis penyelesaian sengketa kepemilikan tanah ulayat dalam sistem hukum pertanahan Indonesia dan menjelaskan mengenai kepastian hukum kepemilikan tanah ulayat mayarakat hukum Adat Muara Sakal. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Hasil penelitian menunjukkan bahwa pengakuan terhadap hak ulayat masyarakat hukum adat di Indonesia masih lemah, yang terlihat dari sering terjadinya perselisihan terkait tanah ulayat. Perselisihan semacam ini mencerminkan kurangnya kepastian hukum dalam penyelesaian sengketa tanah adat. Perselisihan ini dapat diselesaikan jika peraturan tentang masyarakat hukum adat yang mengatur syarat-syarat pengakuan masyarakat adat dan hak tradisionalnya diterbitkan oleh pemerintah.

Abstract

In Law Number 48 of 2009 concerning Judicial Power, it is stated that justice must be based on simplicity, speed and low costs. However, in reality the process of trying in court in Indonesia is very inversely proportional, considering the large number of cases that have to be resolved at a very high cost, very long queues and the buildup of cases in Indonesian courts which is increasing. This research will understand the concept of plea bargaining which will be added to the criminal justice system in Indonesia. This type of research can be classified as normative juridical research, because this research is carried out by examining secondary data and approaches to law. This normative research examines the applicable regulations and links them with legal politics in the formation of rules to achieve the ideal concept in implementation of Plea Bargainig. The results of this research examine and analyze the rules relating to plea bargaining in the United States and several other countries to obtain the urgency and ideal concept for implementing plea bargaining in Indonesia. The fundamental element for the author to research is Law Number 48 of 2009 Article 2 paragraph (4) concerning judicial power considering that this law contains the principles of justice which is carried out quickly, simply and at low cost. So this is very much in conflict with the reality that exists in the court process in Indonesia.

Abstract

Mahkamah Kontitusi melalui Putusan MK Nomor 42/PUU-XIX/2021 memutuskan Pasal 39 Ayat (2) Undang-Undang Nomor 6 Tahun 2014 tentang Desa bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia 1945 dan tidak mempunyai kekuatan hukum mengikat secara bersyarat sepanjang tidak dimaknai, “Kepala desa yang sudah menjabat 1 (satu) periode, baik berdasarkan Undang-Undang Republik Indonesia Nomor 6 Tahun 2014 tentang Desa maupun berdasarkan undang-undang sebelumnya masih diberi kesempatan untuk menjabat 2 (dua) periode. Begitu pula, bagi kepala desa yang sudah menjabat 2 (dua) periode, baik berdasarkan Undang-Undang Republik Indonesia Nomor 6 Tahun 2014 tentang Desa maupun berdasarkan undang-undang sebelumnya masih diberi kesempatan untuk menjabat 1 (satu) periode”. Kedua putusan tersebut cukup memberi andil terhadap penataan Pilkades di Indonesia, utamanya calon kepala desa yang tidak wajib lagi berdomisili di desa setempat. Jenis penelitian yang digunakan dalam penelitian ini merupakan penelitian hukum normatif. Penelitian hukum normatif pada hakikatnya mengkaji hukum yang dikonsepkan sebagai norma atau kaidah yang berlaku dalam masyarakat, dan menjadi acuan perilaku setiap orang. Menurut Soerjono soekanto dan Sri Mamudji mendefinisikan penelitian normatif, adalah penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder belaka. Penelitian ini mengkaji pokok permasalahan sesuai dengan ruang lingkup dan identifikasi masalah melalui pendekatan Undang-Undang (Statute approach) dilakukan dengan menelaah peraturan perundang-undangan dan regulasi yang bersangkut paut dengan isu hukum yang diteliti. Dalam penelitian normatif ini penulis melakukan penelitian terhadap asas-asas hukum, dengan cara mengadakan identifikasi terlebih dahulu terhadap kaidah-kaidah hukum yang telah dirumuskan di dalam perundang-undangan tertentu. Problematika Masa Jabatan Kades Dalam Peraturan Perundang-Undangan mengalami dinamika. Puncaknya Jabatan Kades menjadi semakin panjang dalam UU Desa, yaitu enam tahun dan dapat dipilih kembali untuk dua kali masa jabatan, dan masa jabatan yang panjang ini diperkuat oleh Putusan MK No.42/PUUXIX/2021, yang menjadikan masa jabatan tiga periode bagi Kades menjadi konstitusional. Kelemahan Masa Jabatan Kades Tiga Periode menimbulkan ketidakadilan bagi Cakades non incumbent, mengingat Cakades incumbent dapat menggunakan fasilitas umum dan dana dari APBDes untuk berkampanye, dan rentan terjadi ketidaknetralan birokrasi dalam pilkades.Ideal Pengaturan Masa Jabatan Kepala Desa Dalam Sistem Ketatanegaraan Pengaturan Masa Jabatan Kepala Desa Dalam Sistem Ketatanegaraan Republik Indonesia adalah dengan menjadikan Masa Jabatan Kades Satu Periode perubahan ini dibutuhkan agar Kades lebih fokus bekerja dan tidak terganggu oleh jadwal kampanye serta keinginan untuk terpilih kembali.
