Abstract

Problematika rangkap jabatan sipil yang dilakukan oleh anggota TNI dan POLRI telah menimbulkan banyak pro dan kontra. Beragam alasan dikemukakan seperti hak TNI dan POLRI untuk turut serta mengambil peran untuk turut serta menetukan masa depan bangsa Indonesia, menumpuknya perwira TNI dan POLRI non job, hingga kebijakan langsung pemerintah yang meminta anggota TNI dan POLRI aktif yang memiliki kompetensi untuk menduduki jabatan sipil. Adapun rumusan masalah dalam penelitian ini pertama bagaimana pengaturan rangkap jabatan dalam peraturan perundang-undangan? Kedua bagaimana implikasi hukum dari rangkap jabatan TNI dan POLRI di Indonesia? Ketiga bagaimana konsep ideal larangan rangkap jabatan di Indonesia? Penelitian ini dilakukan untuk mengetahui Pengaturan rangkap jabatan dalam peraturan perundang-undangan, Implikasi hukum dari rangkap jabatan TNI dan POLRI di Indonesia dan Konsep ideal larangan rangkap jabatan di Indonesia. Jenis penelitian ini tergolong sebagai penelitian hukum normatif Dalam penelitian hukum normatif, sumber datanya adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Pengumpulan data penelitian hukum normatif menggunakan teknik pengumpulan data secara studi kepustakaan. Data yang diperoleh melalui studi kepustakaan akan dianalisis secara kualitatif. Dalam menarik kesimpulan penulis menggunakan metode berfikir deduktif yaitu cara berfikir yang menarik kesimpulan dari suatu pernyataan atau dalil yang bersifat umum menjadi suatu pernyataan yang bersifat khusus. Berdasarkan hasil penelitian dapat dipahami bahwa peraturan perundangundangan melarang adanya rangkap jabatan TNI dan POLRI sebagai komisaris di BUMN yang mana didasarkan pada kekhawatiran adanya benturan kepentingan yang melekat pada TNI dan POLRI, implikasi yang ditimbulkan dari diangkatnya TNI dan POLRI sebagai Komisaris di BUMN, sesuai dengan peraturan perundang-undangan yang dilanggar, pihak terkait harus diberhentikan atau mengundurkan diri dari jabatannya serta konsep ideal rangkap jabatan di Indonesia harus diatur dalam konstitusi sehingga praktik rangkap jabatan tidak terlaksana, oleh karena itu, nilai-nilai etika harus dijadikan aturan yang mengikat secara konstitusional, agar praktik rangkap jabatan tidak terjadi lagi dalam penyelenggaraan negara

Abstract

This study aims to understand the perspective of Constitutional Court Decision No.65/PUU-XXI/2023 regarding the legality of using educational institutions ascampaign venues. The background of this research is the evolving political andregulatory context involving educational institutions in Indonesia. Prior to thisdecision, strict regulations prohibited the use of educational facilities for politicalcampaigns to preserve the neutrality and integrity of educational institutions asplaces for learning and intellectual development, free from political influence.This research is a normative legal study with a focus on the principle of legaljustice. It uses secondary data sources, including primary, secondary, and tertiarylegal materials. Data collection was performed through literature review, and dataanalysis employed a qualitative method.The findings reveal that the Constitutional Court's decision to permit the use ofeducational institutions for campaigns is based on balancing political expressionfreedom with educational neutrality. The Court concluded that as long aseducational institutions maintain their integrity and are not disrupted by campaignactivities, using these facilities for political purposes does not violate constitutionalprinciples. The implications include potential changes in the dynamics ofeducational institutions, which will need to establish procedures to ensure thatcampaign activities do not affect the learning process. Regulatory adjustments maybe necessary to define limits and mechanisms for campaign implementation ineducational settings.Keywords: Constitutional Court Decision, Educational Institutions, PoliticalCampaigns, Campaign Venues

Abstract

The implementation of the zoning system in the admission of new studentsraises various problems. The zoning system is regulated by the Ministry ofEducation and Culture of the Republic of Indonesia in the Regulation of theMinister of Education and Culture of the Republic of Indonesia Number 1 of 2021concerning Admission of New Learners in Kindergartens, Elementary Schools,Junior High Schools, Senior High Schools, and Vocational High Schools, while inArticle 51 paragraph (1) of Law Number 20 of 2003 concerning the NationalEducation System it is stated that schools are given autonomy to manage theirschools. This autonomous right to schools is in the form of School-BasedManagement principles to organize and manage their own education.This thesis uses research with a type of normative research, namelylibrary research. In this research, the data sources used are secondary datasources with primary legal materials of the Minister of Education RegulationNumber 1 of 2021 with Law Number 20 of 2003. The collection technique usesdocumentation / literature study, namely analyzing and examining these primarylegal materials.Minister of Education and Culture Regulation Number 1 of 2021 and LawNumber 20 of 2003 are considered to be out of sync. The incompatibility andinconsistency of these regulations have caused various social and moral problemsthat affect various elements, especially prospective students and theirparents/guardians. The zoning system policy implemented in the New LearnerAdmission results in some people who want to impose their will because they havecertain perceptions, resulting in actions that are against the law, morals, social,and religion. The purpose of the zoning system is very good to advance educationin Indonesia, but many aspects have not been fulfilled by the Government inimplementing this zoning system. Such as unequal access to education inIndonesia, inequality of facilities and infrastructure in various schools, to theuneven quality of teachers in each region.Keywords: Zoning System and New Student Admission

Abstract

The establishment of the Social Security Agency on Health is a part of NationalHealth Insurance which is a government policy in the health sector that aims to ensure theprovision of adequate health care facilities for the entire community asparticipants/patients. In Pekanbaru, one of the advanced referral health facilities that hascollaborated with Social Security Agency on Health Pekanbaru is Prima HospitalPekanbaru since 2017. The results of research related to health services organized at PrimaHospital Pekanbaru, there are problems found in the field, especially for Social SecurityAgency on Health participants/patients. The purpose of the research is to find out how theimplementation; inhibiting factors; and efforts made in improving health services for SocialSecurity Agency on Health participants/patients at Prima Hospital Pekanbaru. The authoruses sociological research methods in analyzing the implementation of health services forSocial Security Agency on Health participants/patients at Prima Hospital Pekanbaru.The implementation of health services for BPJS Health participants/patients atPrima Hospital Pekanbaru City is quite good, but on the other hand it has not been able toreach the level of participant/patient satisfaction. The inhibiting factors are influenced bymiscommunication and the public's lack of understanding of BPJS Health procedures andarrangements at Prima Hospital Pekanbaru City as well as the imbalance in the number ofBPJS Health participants/patients with the number of health workers. Abstract

The position of Pancasila in the Indonesian legal system is as the source of all sources of state law. The Pancasila Ideology Development Agency (BPIP) is an agency that was built as a form of re-actualization of Pancasila in the process of internalizing values ​​in every component of society and state administrators. The main tasks and functions of BPIP are actually included in the main tasks and functions of other state institutions. This overlapping of duties and functions causes pros and cons in society. Pros and cons of establishing BPIP, whose duties and functions should have been carried out by the MPR. As a result of the overlapping of BPIP's main tasks and functions with other state institutions, it certainly puts a burden on the state budget, which can lead to wastage of the state budget. The type of legal research is normative legal research. The data used is secondary data. Meanwhile, if you look at the nature of this research, it is descriptive. The results of this research are the legal politics of establishing the Pancasila Ideology Development Agency based on the legal basis of Presidential Regulation Number 7 of 2018 concerning the Pancasila Ideology Development Agency. The urgency of establishing BPIP still needs to be questioned and the effectiveness of BPIP is still doubtful. The correlation between the duties of the Pancasila Ideology Development Agency which overlaps with the duties of the Indonesian MPR is that the duties and functions of the BPIP have become the duties of a high state institution, namely the People's Consultative Assembly (MPR), which also has the same duties, namely promoting Pancasila, the 1945 Constitution and its implementation. There is an overlap in duties and functions, effectiveness and efficiency, between the BPIP and the MPR which means that the position of the BPIP in the Indonesian constitutional system is still unclear. The ideal concept of fostering the Pancasila ideology in Indonesia is through the high state institution of the People's Consultative Assembly (MPR) which has launched and socialized the Four Pillars of National and State Life. Abstract

Komisi Kejaksaan Republik Indonesia dibentuk berdasarkan Pasal 38 Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan dan diatur lebih lanjut dalam Peraturan Presiden Nomor 18 Tahun 2011 untuk meningkatkan kualitas kinerja Kejaksaan. Namun dalam pelaksanaannya, lembaga ini menghadapi berbagai kendala akibat keterbatasan kewenangan yang menyebabkan pengawasan belum optimal. Penelitian ini bertujuan untuk menganalisis perbandingan kewenangan Komisi Kejaksaan RI dengan United States Department of Justice Office of the Inspector General serta merumuskan konsep ideal kewenangan Komisi Kejaksaan dalam perspektif ketatanegaraan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perbandingan hukum, menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Pengumpulan data dilakukan melalui studi kepustakaan dengan mengkaji berbagai literatur, peraturan perundang-undangan, karya ilmiah, dan sumber-sumber lain yang berkaitan dengan objek penelitian. Analisis data dilakukan secara kualitatif dengan metode berpikir deduktif. Hasil penelitian menunjukkan bahwa United States Department of Justice Office of the Inspector General memiliki kewenangan yang lebih luas dalam melakukan pengawasan, seperti kewenangan investigasi mandiri dan kewajiban pelaporan berkala ke Kongres. Sementara Komisi Kejaksaan RI memiliki kewenangan terbatas dan bersifat pasif yang hanya dapat bertindak berdasarkan laporan masyarakat. Berdasarkan hasil perbandingan tersebut, diperlukan penguatan kedudukan Komisi Kejaksaan melalui revisi Undang-Undang Kejaksaan dengan menambahkan bab khusus yang mengatur secara komprehensif tentang kedudukan, tugas, fungsi, dan kewenangan Komisi Kejaksaan. Revisi ini harus mencakup perluasan kewenangan investigasi mandiri, dan mekanisme pelaporan berkala kepada DPR untuk meningkatkan efektivitas pengawasan terhadap lembaga Kejaksaan.

Abstract

ABSTRAKKonflik muncul berasal dari kondisi kemajemukan struktur masyarakat dan konflik merupakan fenomena yang sering terjadi sepanjang kehidupan manusia dalam masyarakat. Salah satu fenomena atau permasalahan yang terjadi saat ini adalah konflik tanah ulayat antara masyarakat hukum adat Kenegerian Kopah dengan PT. Duta Palma Nusantara. Konflik ini telah terjadi bertahun-tahun yang lalu akan tetapi sampai saat sekarang belum dapat terselesaikan dengan baik di antara kedua belah pihak. Penyebab terjadinya konflik antara lain: tumpang tindih hak di atas hak ulayat dan HGU, Konflik batas penguasaan lahan, Pembangunan Parit Gajah, Corporate Social Responsibility tidak dilaksanakan; Pembangunan kebun masyarakat yang tidak dilaksanakan; terjadinya tindakan kekerasan terhadap masyarakat hukum adat kenegerian kopah. Oleh sebab itu pemerintah harus memberikan solusi dalam penyelesaian konflik tanah ulayat dengan cara pemerintah memaksa perusahaan menyerahkan 20 % lahan HGU untuk dikelola oleh masyarakat hukum adat kalau tidak ditaati maka pemerintah membatalkan HGU perusahaan; atau Pemerintah dapat mempertimbangkan lebih lanjut untuk tidak memberikan perpanjangan HGU perusahaan yang memiliki konflik berkepanjangan dengan masyarakat hukum adat terkait dengan tanah ulayat.Kata kunci: tanah ulayat; faktor penyebab konflik; masyarakat hukum adat. ABSTRACTConflict arises from the condition of the plurality of the structure of society and conflict is a phenomenon that often occurs throughout human life in society. One of the phenomena or problems that occur today is the ulayat land conflict between the customary law community of Kenegerian Kopah and PT. Duta Palma Nusantara. This conflict occurred many years ago but until now has not been able to be resolved properly between the two parties. The cause of conflict between others: overlap on the rights of the ulayat and HGU, Conflicted land rule boundaries, Building elephant trench, Corporate social responsibility not carried out, Development of unexerted community gardens, The occurrence of violence against the customary law kenegerian kopah. Therefore the government must provide solutions to conflict resolution ulayat land with the way the government forces companies to hand over 20 % of HGU land to be managed by the customary law community if not heeded the government cancel HGU company or government may consider further not to provide extra HGU that has prolonged conflict with the customary law community relating to the ulayat.Keywords: ulayat land; factors causing conflict; customary law community.

Abstract

Kekuasaan yudikatif adalah kekuasaan independen yang melaksanakan fungsi peradilan. Mahkamah Konstitusi adalah lembaga yang melaksanakan kekuasaan yudikatif berdasarkan Pasal 24C Undang-Undang Dasar 1945. Selain itu, Komisi Yudisial adalah bagian dari kekuasaan yudikatif tetapi tidak melaksanakan fungsi peradilan. Komisi Yudisial berfungsi menyeimbangkan kekuasaan kehakiman dengan wewenang menjaga dan menegakkan martabat serta perilaku hakim. Penelitian yang digunakan adalah penelitian hukum normatif, yang mengkonseptualisasikan hukum sebagai apa yang tertulis dalam peraturan perundang-undangan (law in book). Penelitian ini berkaitan dengan Putusan Mahkamah Konstitusi Nomor 56/PUU-XX/2022 yang menguji materiil Pasal 27A ayat (2) Huruf B Undang-Undang Nomor 7 Tahun 2020 tentang Mahkamah Konstitusi. Putusan Mahkamah Konstitusi Nomor 56/PUU-XX/2022 menyatakan bahwa satu anggota Komisi Yudisial sebagai unsur Dewan Kehormatan Mahkamah Konstitusi bertentangan dengan Konstitusi dan dihapuskan. Pembentukan Komisi Yudisial bertujuan mengatasi praktik mafia peradilan dan memulihkan kepercayaan publik terhadap peradilan. Komisi Yudisial diamanatkan oleh Pasal 24B ayat (2) untuk melindungi dan menegakkan kehormatan hakim, sedangkan Mahkamah Konstitusi berpendapat bahwa hakim yang dimaksud berbeda dari hakim Mahkamah Konstitusi dalam kedudukannya. Konstitusi tidak membedakan hakim berdasarkan posisi atau fungsi. Pengecualian Komisi Yudisial ini dikhawatirkan membuka peluang praktik mafia peradilan. Putusan ini juga membuat Mahkamah menjadi lembaga yudikatif super body tanpa pengawasan eksternal yang akan menegakkan etika hakim konstitusi.

Abstract

Indonesia is a constitutional state which is not only based on power, but onexisting rules or laws. The government runs on the basis of the constitution and isnot absolutism (unlimited power) in accordance with the Provisions contained inArticle 1 paragraph 3 of the 1945 Constitution of the Republic of Indonesia whichstates that Indonesia is a state of law.The presidential system is a system of government that is centered on theposition of the president as head of government as well as head of state. In thissystem, the executive branch, which is represented by the president, is notresponsible to the legislature, which, if exemplified in the Indonesian governmentsystem, is represented by the DPR. The position of the executive body is strongerin dealing with the legislature. A presidential system can be said to be arepresentative government of the people, with a system of strict separation ofpowers. The separation between the executive and legislative powers means thatthis executive power is held by an agency or organ which, in carrying out itsduties, is not responsible for the people's representative body.This concurrent position in the Ombudsman's assessment will causeseveral losses. Starting from the existence of conflicts of interest, issues ofcompetence and capability of officials who are concurrently not in accordancewith the position of commissioner, and the emergence of double income. In theview of the State Civil Apparatus Commission (KASN), the phenomenon ofmultiple positions apart from causing a conflict of interest, is also the root offraud. Concurrent positions of SOE commissioners by public officials areopportunities for corruption.Multiple Positions is an action carried out by a person in two or morepositions in the same or different environments. Abstract

Legal Politics which is the direction of a legal policy made officially by the stateregarding laws that will be enforced or will not be enforced to achieve state goals within acertain period as well as a formal-procedural mechanism that determines whether or not thislaw-making procedure is legal can be related to legal development which cannot be separatedfrom the social reality that lives in a country. The dissolution of political parties is regulated inarticles 68 to 73 of Law no. 24 of 2003 concerning the Constitutional Court. As in other cases,in an application for the dissolution of a political party, there are three (3) possible decisionsthat will be handed down by the constitutional court, namely the application is declaredinadmissible, the application is granted and the application is decided within 60 days. If theconstitutional court is of the opinion that the petition does not meet the requirements. So thatresulted in weaknesses in the constitutional court, related to the existence of Legal Standingholders for proposing the dissolution of political parties which were only proposed by thegovernment. Until now, the Constitutional Court has never decided to disband a political partybecause it has never been brought to court.The purpose of this study is to find out an idea that there is a weakness in theConstitutional Court in the dissolution of political parties in Indonesia. This type of researchis normative in which the writer tries to collect and analyze bibliographical data as a writingsource which is divided into primary, secondary and tertiary data.The results of this study are that the dissolution of political parties is due to partyactivities that are contrary to Pancasila, and the 1945 Constitution of the Republic ofIndonesia. So that there is a weakness in the Constitutional Court in dissolving politicalparties, which no longer fulfills the requirements determined by laws and regulations anddoes not carry out its obligations and does not carry out its functions in accordance withapplicable laws and regulations, in laws and regulations, legal politics has a very importantrole as a necessary reason in the formation of a statutory regulation and becomes aformulation in articles.
