Abstract

Tujuan dari Peneltian ini ialah untuk memastikan bagaimana prosedur pembuktian pidana untuk kasus pelecehan seksual beroperasi di kampus. Menentukan hambatan terhadap proses pembuktian pidana dalam situasi tindak asusila yang umum terjadi di wilayah kampus ialah tujuan lainnya. Peneltian ini memakai teknik Riset hukum empiris yang berasal dari perilaku manusia, termasuk perilaku aktual yang diamati lewat pengamatan langsung dan perilaku verbal yang diperoleh dari wawancara. Temuan studi ini menunjukkan bahwa, meskipun ada undang-undang yang menentang tindak asusila, stigma, kurangnya pengetahuan terkait hukum, dan ketidakberdayaan korban sering kali menyulitkan penegakan hukum ini di area perguruan tinggi. Lebih jauh lagi, banyak kasus tidak dilaporkan karena kekhawatiran akan dampak sosial dan akademisnya. Riset ini merekomendasikan perlunya peningkatan edukasi hukum, penyediaan saluran pelaporan yang aman, serta keterlibatan aktif pihak kampus dalam menciptakan area yang bebas dari tindak asusila

Abstract

Tujuan dari penelitian ini adalah untuk Untuk mengetahui dan menganalisis faktor penyebab Kecelakaan lalu lintas korban Meninggal Dunia Dan Luka Berat di Kabupaten Pohuwato dan upaya penyelesaian yang sesuai Undang-Undang Lalu Lintas dan Angkutan Jalan Nomor 22 Tahun 2009 serta model penyelesaian perkara kecelakaan lalu lintas korban meninggal dunia dan luka berat.  Metode yang digunakan dalam penelitian ini adalah normative. Dalam penelitian ini, digunakan beberapa pendekatan, yaitu pendekatan perundang-undangan (statute approach), pendekatan  kasus, dan pendekatan sosiologi hukum (yuridis sosiologis). Hasil penelitian (1) Upaya penyelesaian Perkara kecelakaan lalu lintas Korban Meninggal Dunia Dan Luka Berat sesuai Undang-Undang Lalu Lintas dan Angkutan Jalan Nomor 22 Tahun 2009 Pasal 235 ayat (1) UU LLAJ yang berbunyi: Jika korban meninggal dunia akibat Kecelakaan Lalu Lintas sebagaimana dimaksud dalam Pasal 229 ayat (1) huruf c. (2) Model penyelesaian perkara kecelakaan lalu lintas korban meninggal dunia dan luka berat perdamaian menjadi alternatif penyelesaian kasus kecelakaan lalu lintas karena adanya kesadaran dari kedua pihak untuk menjalin hubungan baik antara keluarga pelaku maupun korban kecelakaan.

Abstract

The high influence of the internet plays a role in the increase in criminal acts that use children as the main perpetrators. In legal involvement on the part of the child as a suspect, the law must consider the mental aspects of the child. Children who come into contact with the law are often confronted with the Juvenile Justice System (JJS). The judge’s decision following the trial can have negative effects on the child. Restorative Justice through the implementation of Diversion is a step that law enforcement officials can take to prevent children from facing trial situations. This study aims to examine the implementation of Restorative Justice in juvenile cases and analyze its role in shaping character and safeguarding children’s rights amid the challenges of the digital era. This research used normative legal research by examining literature studies from primary and secondary legal materials. The results of this research indicate that the implementation of Restorative Justice in juvenile cases can be carried out in the Pre-Adjudication stage (investigation and inquiry), Adjudication stage (prosecution and trial), and Post-Adjudication stage (execution of sentences). Meanwhile, the implementation of Restorative Justice in building character and protecting children’s rights can be achieved through the integration of restorative justice principles, including education and awareness, rehabilitation approach, active participation of children, involvement of victims, use of alternative sanctions, collaboration with experts, respecting children, and developing social and emotional skills.

Abstract

This study aims to analyze the implementation of preventive policies by the Gorontalo City Police in handling cases of child abuse by stepmothers, as well as to identify factors that hinder and opportunities for strengthening these policies in the future. The background of this study is based on the increasing number of cases of violence against children in the family environment, particularly by stepmothers, which have serious physical and psychological impacts on the victims. This phenomenon requires a strategic response from law enforcement agencies and all elements of society to create an effective child protection system. The method used is empirical legal research with a sociological-legal approach. Primary data was obtained through in-depth interviews with perpetrators, victims, and investigators from the Women and Children Protection Unit (UPPA) of the Gorontalo City Police Department, while secondary data was collected through literature review and documentation. Analysis was conducted using a descriptive qualitative approach to organize and interpret field data based on applicable legal theories and principles. The research findings indicate that the Gorontalo City Police Department has implemented various preventive strategies, such as legal awareness campaigns and education, restorative approaches, the establishment of reporting centers and hotlines for child abuse, collaboration with non-governmental organizations, and the optimization of the Community Guidance Unit (BINMAS). These efforts have proven to increase public awareness and strengthen the child protection system, although they still face challenges such as limited resources, low public participation, and uneven legal education. This study has yielded positive outcomes, including a community-based child abuse prevention model and multi-sectoral collaboration that can be adopted in other regions. Recommendations for further research include a more in-depth study of power dynamics within stepfamilies, the effectiveness of community interventions, and the optimization of digital technology in reporting and supporting victims of child abuse.

Abstract

Penelitian ini bertujuan untuk mengetahui pemenuhan hak korban tindak pidana perdagangan orang terhadap pemulangan dan reintegrasi sosial. Penelitian ini merupakan penelitian empiris karena menempatkan data primer yang ada di lingkungan masyarakat sebagai data utama, dan dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa Reintegrasi sosial merujuk pada proses mengembalikan individu, khususnya klien, ke dalam lingkungan keluarga inti, keluarga pengganti, atau komunitas yang mampu memberikan rasa aman, perlindungan, serta memenuhi kebutuhan dasar dan emosionalnya. Tahapan dalam proses ini mencakup berbagai aspek penting, seperti penempatan dalam lingkungan yang stabil dan bebas dari ancaman, pemenuhan kebutuhan hidup yang layak, peningkatan kesehatan fisik dan psikologis, serta tersedianya ruang untuk pertumbuhan pribadi dan kemajuan sosial-ekonomi. Selain itu, dukungan emosional dan sosial dari lingkungan sekitar juga menjadi faktor penting dalam mendukung pemulihan. Proses pemulangan korban TPPO berlangsung cepat dimana dalam praktek yang dilaksanakan di Polres Gorontalo Kota, korban setelah selesai pemeriksaan langsung dilakukan pemulangan ke pihak keluarga. Dalam proses pemulangan dan reintegrasi sosial ini, pihak Polres Gorontalo Kota melakukan koordinasi dengan instansi terkait, dan tidak ada upaya memfasilitasi secara lebih. Selain itu, ada tantangan lain yang dihadapi dalam penanganan kasus TPPO di kota Gorontalo dari segi aspek kesadaran para korban akan situasi mereka yang akan diperdagangkan, namun mereka tetap setuju untuk melakukannya dan Dinas Sosial Kota Gorontalo belum memiliki unit Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2A), meskipun amanat Peraturan Daerah Nomor 7 Tahun 2016 dengan tegas mengharuskan keberadaannya.

Abstract

This study aims to examine how criminal acts of assault are resolved through the Restorative Justice approach in areas located far from police stations as centers for reporting and complaints, as well as to analyze the role of the village government as a Restorative Justice House in providing justice for the community in Mohiyolo Village, Asparaga District, Gorontalo Regency. The approach applied uses a descriptive qualitative method, with data collection through interviews, observations, and documentation. The findings show that restorative settlement in the village involves the perpetrator, victim, their families, community leaders, and village officials as mediators. The geographical distance from the police station encourages the community to resolve disputes through village deliberations that prioritize the principles of justice, utility, and social harmony. The effectiveness of this approach is demonstrated by a yearly decline in reported cases. The village government acts as a Restorative Justice House that facilitates peaceful, swift, and efficient case resolution. This study recommends strengthening regulations and the role of village governments to support the sustainability of restorative justice as an alternative to the formal criminal justice system.

Abstract

This article aims to analyze the legal responsibility for violence committed by police officers, with a focus on cases of wrongful arrest and violence in Gorontalo. This study was motivated by the increasing number of cases of violence by law enforcement officials, which not only violate human rights and the principles of the rule of law but also undermine public trust in the police institution. The method used is normative legal research, with a legislative and conceptual approach. The analysis was conducted on primary legal materials such as laws, government regulations, and implementing regulations, as well as secondary legal materials such as literature, journals, and legal expert opinions. The results of the study indicate that violence by police officers, particularly in cases of wrongful arrest, constitutes a serious violation of the right to freedom and fair treatment before the law. The legal responsibilities that can be imposed include criminal, civil, administrative, and disciplinary liability. Criminal sanctions are imposed if there is evidence of intent or gross negligence, while civil sanctions provide victims with the opportunity to seek compensation. Administrative and disciplinary sanctions, such as reprimands or dismissal, are also important to maintain the integrity of the police institution. Informal resolution through restorative justice mechanisms should not eliminate legal accountability and the victim's right to redress. This study emphasizes the importance of strengthening complaint mechanisms, external oversight, and legal and institutional reforms to ensure the protection of victims' rights and the accountability of police officers in practice.

Abstract

This article aims to determine the problems of implementing article 44 paragraph (3) of the law on the elimination of domestic violence in criminal acts of domestic violence which result in the victim's death. This research uses normative legal research methods. If you look at the severity of criminal cases, what often happens are cases of domestic violence in which the victim dies. The crime of domestic violence actually has a special law that regulates criminal acts within the household locus, namely Law number 23 of 2004 concerning the elimination of domestic violence. However, sometimes there are still similar cases which are decided by applying Article 338 of the Criminal Code (KUHP).

Abstract

This article is a study of the legal politics of regulating self-defense actions in Indonesia as well as describing the practice of law enforcement against acts of self-defense. This article will be analyzed normatively using a statutory approach and case approach. The results of the analysis show that tha act of self-defense regulated in the Criminal Code as the basis of criminal law in Indonesia shows the principles of the rule of law, as well as being a form of protection for citizens in defending their lives, especially in situations of threats and crimes.Factually, there are actions from law enforcement not continuing the law enforcement process of self-defense actions as felt by Irfan and Rofiqi in Tangerang and by Amaq Shinta in lombok. However, there are still differences in the settlement and handling of cases rleated to acts of self-defense as experienced by ZL in Malang. This Actually shows that there is injustice because there is process that influences criminal policy so that it has an impact on not fulfilling a sense of justice for every citizen as one of the guarantees in a legal state like Indonesia.

Abstract

This article aims to determine and analyze the application of the law to drug abusers and addicts based on Law Number 5 of 2009 on Narcotics and Law Number 1 of 2023 on the Criminal Code. Furthermore, to know, analyze, and construct drug crime arrangements that ensure legal protection for drug abusers and addicts. This article is normative research with a statutory approach, a case approach, a historical approach, and a conceptual approach. The results show that first, the application of the law against drug abusers and addicts has many problems, especially in the implementation of the law on narcotics. This problem has implications for regulatory bias in some articles, such as in Articles 4 and 54, which cause differences in subjects who are obliged to undergo medical rehabilitation and social rehabilitation. Furthermore, there is a tendency to use Article 111 or Article 112 charged with Article 127 (if an alternative charge) or without Article 127 (if a single charge) against drug abusers and drug users. This trend illustrates that the approach used is criminal, even if it is towards drug users, not drug dealers. Furthermore, the regulation of drug crimes in the New Criminal Code basically does not eliminate these problems because the provisions maintained through the New Criminal Code are only copies of repealed articles and no longer apply to the law on narcotics. Second, criminal regulation that ensures legal protection for drug abusers and addicts can be realized by revising the law on narcotics, which focuses on subject consistency in Article 54, Article 55, and Article 103, changing the elements of Article 127 paragraph (3) and abolishing the Explanation to Article 54.
