Abstract

Penelitian ini mengkaji penerapan plea bargaining dalam sistem peradilan pidana Indonesia, dengan fokus pada peran ganda mekanisme ini dalam meningkatkan efisiensi sekaligus potensi risiko penurunan kepastian hukum. Penumpukan perkara yang terus terjadi di pengadilan Indonesia menuntut solusi inovatif untuk mempercepat proses peradilan tanpa mengabaikan prinsip keadilan. Plea bargaining menawarkan pendekatan pragmatis untuk mempercepat penyelesaian perkara melalui kesepakatan negosiasi antara jaksa dan terdakwa, yang tercermin dalam mekanisme Jalur Khusus pada Rancangan Kitab Undang-Undang Hukum Acara Pidana (RKUHAP). Namun, ketiadaan regulasi yang eksplisit dan komprehensif menimbulkan tantangan berupa potensi penyalahgunaan diskresi oleh jaksa, risiko paksaan terhadap terdakwa rentan, serta inkonsistensi putusan yang mengancam nilai-nilai keadilan dan kepastian hukum. Penelitian ini melakukan analisis normatif, peran diskresi jaksa, dan studi perbandingan dengan yurisdiksi lain. Temuan penelitian menegaskan kebutuhan mendesak akan pengawasan ketat, transparansi prosedural, dan perlindungan hukum guna menyeimbangkan efisiensi dengan perlindungan hak terdakwa dan kepentingan korban. Penelitian ini memberikan kontribusi dalam wacana reformasi peradilan pidana di Indonesia dengan mendorong desain regulasi yang harmonis antara efisiensi prosedural dan keadilan substantif.

Abstract

The investigation system in Indonesian criminal procedure law is still dominated by a single authority approach that places the police as the primary actor. This model is increasingly questioned with the increasing complexity of modern crimes, the development of sectoral investigative institutions, and the emergence of Constitutional Court decisions rejecting the monopoly of investigative authority. This fragmentation of authority without a clear coordination design has the potential to give rise to institutional conflict and human rights violations. This study aims to formulate an ideal concept for implementing multiparty investigations in the Indonesian legal system that aligns with the principles of the rule of law, due process of law, and the protection of human rights. This study uses normative legal methods with statutory, conceptual, case-based, and comparative approaches. Data were obtained through a literature review of primary legal materials in the form of laws and court decisions, as well as secondary legal materials in the form of scientific journals, law books, and comparative studies of investigative systems in South Korea and the Netherlands. The results show that the practice of multiparty investigations in Indonesia has developed sectorally through the authority of the Corruption Eradication Commission (KPK), the National Narcotics Agency (BNN), and the Civil Servant Supervisory Agency (PPNS), but has not been integrated into a comprehensive criminal procedure law framework. Weak coordination, unclear boundaries of authority, and minimal judicial oversight increase the risk of inter-institutional conflict and violations of suspects' rights. Multiparty investigations require an integrated institutional design, a clear division of authority, horizontal coordination mechanisms, and strengthened judicial oversight to create a fair and effective criminal justice system.

Abstract

This study examines the enforcement of election law against money politics in Gorontalo Province under Law Number 7 of 2017 on General Elections. Elections as an expression of popular sovereignty require fairness and integrity, yet in practice continue to be challenged by widespread money politics that undermines democratic values. This research employs a normative legal method with statutory and conceptual approaches, supported by secondary data and case illustrations derived from official reports of the Election Supervisory Body (Bawaslu). The findings indicate that although legal provisions on money politics are clearly regulated, their enforcement remains ineffective, as many cases fail to proceed to the judicial stage. This ineffectiveness is influenced by evidentiary difficulties, weak institutional coordination within the Integrated Law Enforcement Center (Gakkumdu), and a permissive legal culture toward transactional political practices.

Abstract

This study aims to analyze the quality of public services provided by the General Election Commission (KPU) of Gorontalo City. Data were collected through interviews, observations, and documentation, and then analyzed using qualitative analysis methods. The findings reveal that the quality of services offered by KPU Gorontalo City staff is optimal. Facilities and infrastructure, such as parking spaces, waiting rooms, internet connectivity, and other supporting amenities, provide significant comfort for service users and are updated to meet modern needs. Services are delivered promptly according to standard operating procedures (SOP) and are provided free of charge without any additional fees. This favorable condition is reinforced by the office environment, which prominently displays posters or notice boards emphasizing a zero-tolerance policy for illegal levies. However, the quality of services can be further improved by enhancing staff reliability in IT. This could be achieved through training existing staff or recruiting skilled IT personnel. Such improvements would support the technology-driven activities and performance of the KPU Gorontalo City.

Abstract

The conventional criminal justice system, which focuses on punishment, causes a backlog of cases and lengthy proceedings, making restorative justice through penal mediation an alternative for resolving minor criminal offenses (TPR) based on Perkap No. 8 of 2021. This study aims to identify the main factors that hinder the implementation of mediation in MOC cases such as petty theft, minor assault, and defamation at the Gorontalo City Police Station, using a sociological empirical legal approach with primary data from interviews with investigator Brigpol Fier P. Simanjuntak, as well as secondary data from legal documents, analyzed qualitatively through reduction, classification, and interpretation. The results of the study show that the main obstacles include the strict formal requirements of Perkap No. 8 of 2021, disagreement between the parties (victim or perpetrator due to trauma or refusal of responsibility), family intervention that causes emotional or cultural pressure, and financial constraints such as inability to pay restitution and operational costs, with internal factors such as investigator human resources and bureaucracy being more dominant than external factors. Overall, mediation has not been optimal due to ineffectiveness in terms of legal substance, law enforcement, facilities, society, and legal culture. Recommendations include more flexible regulations, mediator training, state financial support, socialization of restorative justice, and integration of local values to improve effectiveness and social justice.

Abstract

Penelitian ini membahas kelemahan normatif Pasal 82 Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak yang masih berorientasi pada penghukuman pelaku (retributif) tanpa mengatur pemulihan hak anak korban tindak pidana kekerasan seksual secara komprehensif. Kesenjangan normatif diperparah oleh ketidakharmonisan dengan Undang-Undang Perlindungan Saksi dan Korban serta tumpang tindih regulasi dengan Undang-Undang Tindak Pidana Kekerasan Seksual dan KUHP Nasional, sehingga menciptakan ketidakpastian hukum dan viktimisasi struktural terhadap anak korban. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan de lege ferenda, perundang-undangan, konseptual, dan perbandingan hukum. Hasil penelitian menunjukkan bahwa reformulasi Pasal 82 harus didasarkan pada pergeseran paradigma restoratif yang menempatkan pemulihan korban (victim recovery oriented) sebagai inti ketentuan pidana. Rumusan ideal mencakup enam elemen pemulihan otomatis dan wajib: rehabilitasi psikologis dan medis, restitusi wajib yang dibebankan kepada pelaku atau negara jika pelaku tidak mampu, perlindungan identitas absolut, pendampingan sosial dan hukum berkelanjutan, jaminan keberlanjutan pendidikan, serta pengawasan pelaku pasca-pidana. Selain itu, diperlukan klausul harmonisasi eksplisit dengan Undang-Undang Tindak Pidana Kekerasan Seksual untuk mengakhiri tumpang tindih regulasi. Penelitian ini merekomendasikan agar pembentuk undang-undang segera merevisi Pasal 82 secara komprehensif dan menyediakan anggaran khusus untuk dana kompensasi korban guna mewujudkan keadilan restoratif bagi anak korban kekerasan seksual.

Abstract

The development of digital technology has prompted an increase in Online Gender-Based Violence (OGBV) cases, particularly in the form of sextortion targeting women, which has not been specifically regulated under Indonesian criminal law. This study aims to analyze the criminal liability of sextortion perpetrators under Indonesian criminal law, using normative legal research methods with statutory and conceptual approaches. The findings indicate that the handling of sextortion in Indonesia remains fragmented across multiple regulations, namely the Criminal Code, the Electronic Information and Transactions Law, the Pornography Law, and the Sexual Violence Crimes Law. This regulatory fragmentation creates legal uncertainty, judicial inconsistency, and suboptimal protection for victims. Therefore, a specific sextortion criminal provision with a gender perspective is urgently needed to ensure legal certainty and substantive justice for female victims in the digital era.

Abstract

Introduction to the Problem: The primary issue addressed in this study is the legal uncertainty within the Republic of Indonesia Law Number 20 of 2025 concerning the Criminal Procedure Code (KUHAP 2025) regarding the requirements for case settlement agreements or peace agreements, which mandate the involvement of a 'victim' in restorative justice mechanisms. This requirement becomes irrelevant when applied to victimless crimes, in which the perpetrator is, in essence, also the victim. Purpose/Study Objectives: This article aims to examine and formulate the ideal implementation of a restorative justice approach within KUHAP 2025 from the perspective of ius constituendum, particularly in overcoming regulatory deadlocks in victimless crimes. Design/Methodology/Approach: The study employs a normative legal research method, utilizing statutory, historical, and conceptual approaches. It relies on primary and secondary legal materials collected through library research and analyzed through legal interpretation and construction. Findings: This article finds that the rigid tripartite relationship (defendant–victim–investigator/inquirer/public prosecutor/judge) embedded in KUHAP 2025 hinders the application of restorative justice in victimless or non-predatory crimes. Accordingly, amendment of KUHAP 2025 is necessary by incorporating an explicit definition of victimless crimes and adjusting procedural mechanisms. Such adjustments may include substituting the role of the victim with community leaders or relevant stakeholders to facilitate the restoration of public interest, accompanied by strengthening the concept of judicial pardon, as evidenced by a formal letter of pardon serving as a substitute for a peace agreement in victimless cases. Abstract

This study aims to analyze the legal status and mechanism for imposing corporate criminal liability in cases of unauthorized commercial use of music copyright under the 2023 Indonesian Penal Code (KUHP), and to examine how this general criminal law provision relates to the Copyright Law (UUHC) as a specific regulatory regime. The problem addressed is a persistent liability gap in copyright enforcement, where criminal sanctions have tended to target field-level workers while corporations, as the main economic beneficiaries (crimes for corporation), largely escape legal reach. This juridical-normative research uses a statute approach and a conceptual approach, analyzing primary and secondary legal materials through qualitative analysis with deductive-inductive reasoning. The results show that Articles 45 to 49 of the 2023 Penal Code expand the legal subject of "Any Person" to include corporate entities and open the possibility of imposing criminal liability separately or jointly on a corporation and its functional management, provided the unauthorized use of music is shown to fall within business operations, generate unlawful commercial benefit, or arise from corporate policy or omission. However, these general provisions still need to be read together with the licensing and royalty mechanisms under the Copyright Law to draw a clearer line between civil and criminal liability. This study contributes a preliminary normative framework of functional criteria for shifting liability from individual field workers to the corporation, while noting that further doctrinal and empirical inquiry is still needed to fully operationalize this model in law enforcement practice.
